'nsufficient size to accommodate the full ' e of i der round i , '~ Un g P P ~`'' load of the next user. This causes the water to back water up and flood the Leighton and Adams properties. Elimination of original ditch that serviced the Leighton, Adams, Crabtree and Kerr properties and carried water to the 1 outside of the Kerr property, northeast corner wier current y of Dunten Place. This has meant that the Leighton, Adams, Crabtree and Kerr properties have no access to irrigation water or drainage of surplus irrigation water. f ~ 1:: ~~~i ~:ti,, :~ ~' ; ~.4 It would be fitting to mention that several codes of the have been Idaho law, concerning irrigation water and its ditches, violated. Idaho law protects the free access of water to 2-1208). Also, the liability for triple damages irrigation users(4 to those denied water by such actions as described above (42-902). We wish to work with all involved on the solution to the problems. It is our hope that we can solve it as neighbors helping one another. The Leisure Lane Irrigation Water Users Association requests the following actions by the developer of Dunten Place to remedy the irrigation problems. Move the present water collection wier to the northwest corner of Kerr's lot. Cap and cover old wier for safety. The ditch on Kerr's lot to be open south from wier to rail fence at edge of back yard. Across the Kerr back yard buried pipe, of sufficient size. Continuing south with an open ditch inside the western fence line south across Crabtree, Adams, and Leighton properties. The Leisure Lane Irrigation Water Users Association is open to other reasonable suggestions for solving this important matter. I am not exa.etly-sure that the legal description of this property is e~a,ct and am making an investigation to determine this and will advise you at a later date. From the application, it is apparent that the lots will be 80i by 100E or 5000 sq. ft.; that the subdividers desire to hook on to your public sewer system; that they are not clear as to how to solve their water problem or what can be done in the matter of pavement, curbs and gutters. Mr. 1~oundy appears to b e rather anx3.ous to get this show on the road and is apprehensive over the cost of providing water faci]3ties to this site, I ~,m unaware as to any other neighbors who might be interested in joining in to share the coat or what other arrangements might be made to reimburse ham or the nwnber of paying customers that may be added to the system. ~t any rate, it would be appreciated if you would review the problem and give this of f ie a the benefit of your recommendations.
