Bill- outlined below is the Development Agreemeirt Language with Hawkins Company
redlines and comments for three development agreement items. ~Ve are comfortable with
the other 16 items.
14. The applicant is re uestin~ access to Meridian Road at tliree locations; two ri~ht-
in/right-out access points and one right-in/right-out, left-in access as shown on the
concept plan. Except for one ri t-in/right-out access point at the quarter mile as
recommended by the Planning, and Zoning Commission, any additional access
points are subject to continued discussions between the Citv of Meridian and the

access points shall be terminated prior to issuance of the first occupancy permit in
this development.
Hawkins Companies Comment:
Access to the site from Meridian Road is critical to the successful operation of the
center, and critical to the success of retailers within the development. The proposed
access drives will be designed to a higher safety standard than those typically
existing on Eagle Road We believe the design of the drives, the precedent set by
similar variance requests, and the applicant's willingness to surrender 4 of its 7
deeded access points will ultimately merit approval of these access points shown.
18. The applicant shall construct half of the collectorlbackage road from Amity Road or
Hams Street to the center west/east drive aisle prior to the issuance of first
certificate of occupancy for the respective phase if a plat has not been recorded.
Hawkins Companies Comment:
A phasing plan was not a requirement by the Planning and Zoning Commission.
Furthermore, this obligation was not discussed and /or approved at the Planning and
Zoning hearing. It was clear that each respective half of the backage road would be
constructed prior to the Certificate of Occupancy for said phase. Market conditions
and the economic environment will dictate timing of each phase and control the
eventual build-out of the entire backage road.

19. The applicant shall coordinate with the Northwest Pipeline Company "NPC"
re ag_rding construction and development within the NPC has line easement
("Easement'°Znursuant to the terms of the Easement and the governing federal
regulations.

Hawkins Companies Comment:
Federal regulation and terms of the easement agreement already govern the roles
and responsibilities of each party. We do not believe that the additional burden
upon the applicant is necessary and will create a situation where the NPC has final
and ultimate control in determining how the site maybe developed. Following the
commission meeting, we met again with NPC and each party has gained a better
understanding for the development for the site and potemial obligations. In fact, no
upgrades may be required as there are testing, variance and wavier opportunities for
NPC through the federal regulations. We will continue to work with and coordinate
development activity with NPC.
