The Motion was made by Williams and seconded by Kingsford that all sealed bids opened and read be taken under advisement. Motion Carried: .Williams, yea; Kingsford, yea; Orton, yea; brewer, yea Senior Citizens Land Agreement Annie Jones, Chairman of the Meridian Senior Citizens Board of Directors: "Mr. Mayor, City Councilmen, the agreement that the City Attorney drew up has been accepted by we of the Board and Mr. Elwin Grout,-the man we have to look forward to for building money has also agreed to this contract. This one, this time, I don't believe any changes were made." Mayor: "Thank you, Annie" Brewer: "As Annie stated, the City Attorney and their Board have arrived at this acceptable agreement through proper negotiations. b!e do have a legal description, the three acres in the southwest corner of the new City park, prepared by our City Engineer. I think all the proper steps have been taken." Mayor: "Any questions from the Council?" Orton: "I would like to bring up that this ground is covered under the Parks' Department restriction for recreational use. The next step is to ask them to remove that restriction on that three acres in lieu of some other site." Mayor: "Any other comments from the Council?" Williams: "Just happy to see this happen" February 2, 198 The Motion was made by Brewer and seconded by Williams that the Council approve the land lease agreement between the City of Meridian and P~leridian Senior Citizens. Brewer: "I would like to make it clear, in behalf of the Senior Citizens, that the acquisition of this land does now put the Senior Citizens in a better light in the respect to being able to obtain government grants. They are in the planning stage of an annual fund raising event that will be carried off and in the hopes that this will bring about a private donation cause that may be a snowballing effect. The official signing of the document we would like to have take place tomorrow and have the news media take some pictures of the Mayor and the Senior Citizens." Loren Ross - Hearing on Rocky Mountain Meat Sewer Charge Loren Ross: "Mr. Mayor, City Council men, you probably know in reviewing some of your notes, I don't feel in my position that being charged for sewer equipment on the building that we lease to Rocky Mountain Meat. Due to legal advise that we have had there doesn't seem to be any strong wording that this is a valid charge - it is more in relation to new hookup opposed to existing hookup, and this would be our position at this point." Mayor: "Mr. Ross, what was your original occupany in the building?" Ross: "Furniture business" Mayor: "What is the use now?" Ross: "Meat business" "Retail, I should say" Williams: "With this the use has changed substantially, both water consumation and the waste that is required to be treated by the plant and I think it would be our interpretation of the ordinance that the building should be assessed at its highest and best use, of which it could be at, In this case there were substantial changes made idian City Hal l .3. T think the Board of Appraisers backed up the feelings of Bruce (Public Work's) and Earl (Wastewater) that this was an equitable rate." Ross: "Does my monthly fee have anything to do with this?" "I pay for my volume, doesn't that mean anything?" Williams: "'You pay for the volume, that is the monthly charge. But also, to treat that type of waste we have to enforce certain expenses, the monthly expenses are for the operation and maintenance not for the capital expenditures that we as the City have incurred," Ross; "That applies to all businesses as opposed to just new structure?" Williams: "`That applies to virtually any business that has substantial change in the use of the building ~- then we have the ability to come back in and assess that at the highest use." Ross: "Is there any place in the ordinance that would state that once I pay this fee that I will not be billed again upon another occupant'? If there is, I can't find it" Williams: "If the use changes substantial" Ross; "Right now we are talking about three (3) Hookups - suppose I go back to a one (1)?" Or I go back to a two (2)?" • Williams: "'You have paid for the highest use of the building as used" Ross: 'Your position is that I' am duty bound to pay this, is that correct?" Williams: "This is our interpretation and I think this is what the Board of Equalization has said" Mayor: "The Board recommended that you pay it and it is now for the Council's action, if the Council want`s to overrule they can do so." `"Is that right Counselor?" Crookston; "That`s correct" Qrton; "Is the fee that you are objecting to, the sewer hookup fee - the $1200?" Ross: "I't's been reduced to'$800.00 - giving me credit for the $400.00 that I paid at one time." "Yes, that is my objection" Mayor; "'Any other questions from the Council?" Williams: "dust one regarding reduction of fees as opposed as to what our bonds say we can do." Crookston: "That would 6e different" "T think I have reviewed these ordinances to quite a degree and they are fairly clear in that the City Council appoints the Board of Appraisers ~ the Board of Appraisers has basically two responsibilities, set the initial charges ~ whether they be on a monthly basis, whether they are industrial cost control recovery, inspection fees, permanent fees, etc. Then they are to review those, and the equivalency rates every year by the 20th of August. They are also to stand as a board of review to hear complaints and set rates that do not fall within aiexact schedule that is set out in the ordinances, you may haves a business that doesn't fall within the enumerated schedule and they have the responsibility to set those fees. They also have the responsibility under the industrial cost recovery portion of the ordinance to review each of those industries or users that falls in that classification. -The Board is supposed to take a look at the charges, or raise, on a annual basis, which I think they have done. The Board of Appraisers are to adjust, or charge or make certain that charges are closely as possible equal to all similar type users. I would assume the closest equivalent to Rocky Mountain Meat sq, footage would be Meridian Meat and Sausage - so their rates should be similar. The ordinance is designed to take into consideration changes of uses." Kingsford: "So you are saying that the Board of Appraisers have the responsibility to review, for example Cherry Plaza, changes that go in there?" Crookston: "'Right, besides the annual review's Ross: "Why were we rot advised of these fees until six months after we negotiated the lease?" "I•s that a normal routine of business to not let a businessman know what these fees are at the time he is trying to negotiate his costs?" Mayor: "To answer your question, Loren, I hope it is not a procedure and it seems to me that this was pushed through so that you could get your tenants in there to get them started," Orton: "The lease was signed way ahead of when a conditional use and a building permit were required and that is when our mechanism goes into action. The ordinance does pretty much stand on its own, its highly technical and sometimes hard to understand and interpret, but sq, footage requirements for sewer and water hookups are explained in this ordinance. But our mechanism does not swing into action until we get a building application - I donut consider this our fault. I did think our primary conversation did mention hookup fees." Mayor: "The application date was 5.23.80-and the meter date installed was 6.4.80" "So there was eleven days between application and installation" Ross: "I was not advised of my hookup fee until November" "I think there is some erroneous things when people work with it every day - if I had been advised that there was a sewer ordinance at that time it`s not hard to read. I don`t work with sewer and water every day - those that do should have some answers available." Mayor: '"You have a good point" ~ • 1 i Meridian City Hall .~. Agenda 4 Meadow View No. 2 - Ken Montee Montee; "The purpose as to why I am here this evening is to request approval of the square footage basis on our lots in Pieadow View and get a clarification on part of the ordinance. The ordinance states that these units be designated per lot and we would like to know if there is any consideration given tv switching one lot to another once that designation is named," P~layor: "How are we going to administer that?" "Are you going to brim in a plat every time you do this?" Montee: "I don`t know how we can do it - weve got about five builders that have actually signed earnest money. and some of them are "subject to" clarification of i this ordinance, the question has come up that if they get a build ,job for a certain sized house,and they only have so many lots and a buyer would like to have another lot, what could we do? The ordinance states so many lots are a certain percentage of square footage and we thought possibly we could come in and the building department could change lots "to such and such" - the building department could monitor that. Kingsford: "Wouldn't this end up being in your restrictive covenants -which lot and block to be which size?" Montee: "At this time we have not redrafted the restrictive covenants because we do not know how they are going to be drafted." '}Originally we were just aping to draft them 10% of the lots would be 1,000 square feet, 20% 1,100 - then we have to designate each lot building restrictions." Mayor: "T think what you are talking about for example, you have one lot with 1,000 square foot, the builder comes in and wants to change that - now if he's going to upgrade that square footage higher, my interpretation is that he can go ahead and do that." "But you can`t go down." a Williams: My biggest conern, people would 6e buying specific lots knowing what would be next to them, and if someone had a 1300 sq. foot lot and had bought those lots under that. premise - if that premise changed in the middle,I would be concerned about that Mayor: "The other thing too is that you have to have a public hearing on that." "lf you want to upgrade, fine." Montee: "Then the square footage for so many lots could not be monitored just by ance that many lots, or when building permits are issued couldn't you say "no more 1,000 sq. footage lots?" Mayor: "Tf you have a public hearing and people want to look at your plat - if you amend the plat every time you want to make a change there is no sense having public input on it." "When you bring in ,your plat, like you are bringing in now, you have to have one public hearing - and that is put on record for the building aermit." ~~~"VJhen yoU Game in far permits the building inspector can check off the lots."~ There was much discussion concerning a buyer that has a plan not fitting proposed lot and switching, the function of a public hearing and how the subdivision relates to the surrounding property. The mayor instructed the chief to carry out notices. •~ He proposed Agenda Class II Wastewater Operator from 7 Williams presented certificates. to Keith Boyd, the chairman of the Wastewater Certification program. To Dan Grogg, Class I Wastewater Operator, from the director of Association of Idaho Cities. Williams commended the men on their accomplishment. ', Agenda 8 City Clerk reported that Ralph and Loren Ross had requested variance from hooking onto water line for commercial use of main house, located at 321 E. Fairview. This is located in Chapin Annexation to the rear and east of the Rocky Mountain Meat (originally Ross ~"urniture.) Fire Chief Welker stated that any .time-this house falls out of the realm of a dwelling, it must be brought up to fire and safety codes for business use. As this house is within 300 feet of service, it was the feeling of the Council that the hook on to city service must be complied with and brought up to codes. Orton stated that he has an unusual request from Mr. Bolen, Cherry Lane Village, to use city fire hydrant to fill up his swimming pool. Bolen is willing to pay for time and water. Welker stated this has been turned down before.in another request such as this. Attorney Crookston reported that the electrical inspector~'' had requested a letter directed to the pool builders for Mr. Bolen because of ~n electrical code violation. The Council's decision was that this request be denied. SPECIAL PROVISIONS • PERMIT 3-80-40 Prior to starting construction all required labor, materials and equipment shall be on the site. The Idaho Division of Highways shall be notified at least 24 hours in advance of working within their Right of Way. During the construction of the sewer line and the manhole on the State Right of Way, warning signs in accordance with the current Manual on Uniform Traffic Control Devices shall be in place at all times. The Idaho Division of Highways reserves the right to require additional signing if necessary for the protection of the traveling public. All warning signs shall be in compliance with the current Manual on Uniform Traffic Control Devices. Advance warning signs (Road Construction Ahead - End Construction) shall be in place at all times during construction. Additional warning signs (Men Working - Flagperson Ahead) shall be in place only when applicable and shall be removed when the sign message does not apply. Signing for the trenching of US 30 shall be as shown on Page 6B-9, Figure 6-7 of the Manual on Uniform Traffic Control Devices which is attached. A minimum of two certified flagpersons shall be on duty at times necessary to control traffic for the safety of the motorist and workmen. The flagpersons shall be properly trained and equipped with flagging paddle and flagpersons' jacket so they are readily visible. If at all possible, the City of Meridian should coordinate with the contractor and do this trenching at the same time as the new highway project. If this is not possible, the City of Meridian shall make every effort to have the work accomplished before the highway project. A minimum of one lane of traffic for each direction of travel shall be left open at all times. The replacement asphalt shall be hot plant mix and shall be installed within 24 hours after the trenching. No trenches shall be left open in the roadway at night. The base course shall consist of 12 inches of 3/4 inch crushed roadmix gravel compacted in 4 inch layers. Compaction shall be Class A as specified in the State Division of Highways Standard Specifications for Highway Construction, 1976 Edition. The asphalt shall be installed in two courses with 0.20 foot in each course, fora total thickness of 0.40 foot or match adjacent asphalt, whichever is greater. A tack coat of oil shall be used on the abutting edges of asphalt, SS1 emulsion or equivalent. All construction signs, barricades, and/or barrels used in hours of darkness shall be High Intensity (Class B) Reflective Sheeting. The Idaho Division of Highways shall be notified at least.24 hours in advance of working within their Right of Way. During the construction of the sewer line and the manhole on the State Right of Way, warning signs in accordance with the current Manual on Uniform Traffic Control Devices shall be in place at all times. The Idaho Division of Highways reserves the right to require additional signing if necessary for the protection of the traveling public. All warning signs shall be in compliance with the current Manual on Uniform Traffic Control Devices. Advance warning signs (Road Construction Ahead - End Construction) shall be in place at all times during construction. Additional warning signs (Men Working - Flagperson Ahead) shall be in place only when applicable and shall be removed when the sign message does not apply. Signing for the trenching of US 30 shall be as shown on Page 6B-9, Figure 6-7 of the Manual on Uniform. Traffic Control Devices which is attached. A minimum of two certified flagpersons shall be on duty at times necessary to control traffic for the safety of the motorist and workmen. The flagpersons shall be properly trained and equipped with flagging paddle and flagpersons' jacket so they are readily visible. If at all possible, the City of Meridian should coordinate with the contractor and do this trenching at the same time as the new highway project. If this is not possible, the City of Meridian shall make every effort to have the work accomplished before the highway project. A':minimum of one lane of traffic for each direction of travel shall be left open at all times. The replacement asphalt shall be hot plant mix and shall be installed within 24 hours after the trenching. No trenches shall be left open in the roadway at night. The base course shall consist of 12 inches of 3/4 inch crushed roadmix gravel compacted in 4 inch layers. Compaction sha11 be Class A as specified in the State Division of Highways Standard Specifications for Highway Construction, 1976 Edition. The asphalt shall be installed in two courses with 0.20 foot in each course, fora total thickness of 0.40 foot or match adjacent asphalt, whichever is greater. A tack coat of oil shall be used on the abutting edges of asphalt, SS1 emulsion or equivalent. All construction signs, barricades, and/or barrels used in hours of darkness shall be High Intensity (Class B) Reflective Sheeting. The manhole shall be installed so that the top and/or lid will be flush with the surrounding asphalt in order for the State to plow snow over the topcof the manhole without causing any damage to the plows. Agenda Home Federal Savings R Loan Variance-located East First and Franklin 1 Robert Rudeen and Wade Sterns. were present to request a 10 foot variance set back from 20 foot on East First. The state of Idaho had purchased an additional 10 foot right-of -way some time ago but had not been projected on the-site plan.. There were no other changes except perhaps -the loss of a parking space, leaving 14 parking spaces.... ,The building is 2600 square feet. Rudeen had talked with the Ada County Highway District which handled permits concerning curb cuts, site: lines, etc. Access for handicap parking was discussed. The larger stall was selected although it is further from the rear entrance to the bank building. Landscapincl in front to remain with berms and shrubs. The Motion was made by Kingsford and seconded by Brewer that Home Federal Savings b Loan, on East First and Franklin be granted a10 foot variance set back on East First Street., Motion Carried: Williams, yea, Kingsford, yea, Brewer, ,yea, Orton, yea. Agenda Church of God-Sewer Service-located at Gruber Street and 3rd. Lee Stucker was present to request running a service line across to Bodine's property. ~~ In the past the church has not been able to hook on the old sewer line. The-new line would involve tearing up 3rd street and would not be as economical, because it would only service the Church's property. Gary .Smith Engineer, demonstrated drawing the feasibility, explaining that City Policy that extension of City facilities is to, through, and past the property- in question. To extend the line up 3rd street or up 2 1/2 street to the property and by it, would Serve no useful purpose. Smith could see no problem .with the Bodine service line extension, but addressed the Council to consider the possibility of the property changing hands. If the property were to go Commercial the service line may not be sufficient fora piece of property this size, approximately 3 acres. Smith stated if in the future this property was to go Commercial, the City would want to put a line in 3rd street with a manhole. Stucker stated that the septic tank there now is not adequate and has created problems. Bodine stated he had no problems with allowing the service line-across his property. The.Motion was made by Williams that the service line extension: should_cross~~Bodiil~'s°'- property to the Church of God, and should the property change hands, the sewer lines be reviewed. Attorney Wayne Crookston, stated that some kind of recording be made to run with this property to put any new owner on notice that sewer line cannot be available for just any type of hookup, applies to the Church only. The Plotion died for lack of second.. 4. ~ • Meridian City Hall 2 . January 21, 1980 The Motion was made by Williams to allow a service line to the Church of Cad property across the Bodine property with an easement between Bodine Oil and the Church of God be given to the City with the restriction that the use of this sewer line is personal to the Church. Stucker questioned if the Bodine property would be able to hook on the same service line. in the future. The Engineer stated this could be a maintenance problem. Orton suggested that Bodine. install a 4 inch line at the same time. The Motion. was seconded by Kingsford. Motion Carried: Williams, yea, Kingsford, yea, Brewer yea, Orton, yea. Agenda Scout Annexation "C"- Located on East Overland, adjacent to LDS Deseret Industries. 3 Rex Black, Council Executive, was present to request that the one acre be annexed for the purpose of Ore-Ida Council. Administration. The building is 7100 square feet. The Mayor asked for public comment. Martin Igo spoke in support on behalf of Winston Moore, developer adjacent to proposal. The Motion was made by Orton and seconded by Williams to approve Scout Annexation "C" Commercial, subject to compliance of water and sewer requirements, design review, landscaping, construction of acceleration and deceleration lanes, fire and police approval, and subject to the proposed zoning ordinance. Agenda 4 Meridian Glass Design Review-- 560 West Franklin Brent Barrus, owner, and James Gipson, architect, were present, representing Design Review. Gipson displayed drawing and stated that the existing house is structurally in good shape, the out buildings to be removed, the house to be remodeled into an office, the trees will remain, the new Meridian Glass building in the back to be used for light :manufacturing and storage. The parking and drive will be by two curb cuts. There is a loading zone and afire turn-around area, trash enclosure and fencing. a.andscaping will be preserved and added to. The fire turn- around was reviewed with l=ire Chief Welker. Barrus stated that there would be black top for access to the fire hydrant at the south end. Gipson stated that this pavement would sacrifice landscaping. Orton. remarked that a steel grating could be used for fire equipment access across the lawn and a visual remedy for landscaping. Gipson stated that the curb cuts are existing now. Water and sewer lines were discussed, Barrus stated that his Engineer is working on this and will go the best route. Williams requested that a landscape plan be placed on file. Barrus stated building should be started within the next six months. Brewer requested that a sprinkler system be installed.
