Chief Porter: I have checked this out and can find no reason why the licenses should not be transferred; The Motion was made by Tolsma and seconded by Giesler to approve the transfer of the beer & wine license from Arthur Moore dba The Farmers Club to Shirley Rae Hardy dba The Main Event: Motion Carried: All Yea; Department Reports: Mayor Ringsford: As the Council is aware we are in the process of apply- ing for Grant Funds to help defray the cost of the secondary clarifier at the Sewer Department, which the City Engineer -is preparing. It has come to my attention that we need a resolution or a motion authorizing the fiiing of the'applibation and authorizing the person identified as the official: representative to act on the applicants behalf. The Motion was made-~by--Myers and seconded= by Giesler to apply for Grant Funds for the Secondary Clarifier including all understandings and assurances contained therei<n, and directing and authorizing the City Engineer as the-official-representative of the City of Meridian to act in connection with the--application-.and to provide such addi~tion~l information as may be needed. Motion Carried: All Yea: Brewer: In regards to the Seconds on First, I think-we-have some loose ends to clean up there, Sue Stover was kind enough to come down and meet with the Council tonite, a few days after Tam Woodwards article=and our legal :~ notice she invited me over-and we discussed her position. She had been served and talked to the Mayor who seemed under the conditions willing to give her so;ne time. and.. work with her I but we felt.-because==she-had-been legally served her the same impression _ self should-#~ake some action: on this'. Motion Carried: All Yea: Brewer: We have had neighbors to the South of me that have had continued problems with the Phillips 66 Service Station. I am going to just mention their names, Brent Alger, Dennis Nielsen and then also the people in the Ambrose Building to the West of the Phillips 66, they have all made for- mal complaints. I think I will let those people elude to what the compl- aints are. Brent Algers, 120 East State, I live across the Street, North of the Phillips 66 Station, since the present party 'that is operating the Stat- ion has been there we have had problems with vehicles parked in front of our house either unlicensed or a fictitious•display, I am certain of it, because any time you find a license plate hung on a pickup with a nylon stocking and the licnese plate setting on the bun-per the plate in all probablility does not belong to that vehicle. As of late_ there are three different semi's that have been parking either in front of our house or in front of the renters house and across the street, one semi quite often parks out on First Street in front of the station and makes it very difficult and dangerous for traffic leaving State Street onto East First, it blocks the vision from the South . Not my point of view but the neighbor across the street says they have parked in the alley so they can not use the alley, that alley is supposed to be a one-way alley and they have had cars parked in front of their house as well. Dennis Nieslen, 1012 East First, _I have had patients complain to me, about two weeks ago they had a Jeep with a camper parked right at the corner of East State and East First and it was blocking the view of people coming out onto East First from my business. It was right at the corner they were parked in a yellow zone plus partially in my driveway. It stayed there about ten days and I finally went over and complained to them and it was finally moved. After that one left they parked another one in the same place and I called the police and it was towed away. Today I drove by there and counted nineteen cars parked around their business,I imagines a couple of them are their employees but one of them was parked on the sidewalk in front, two other vehicles were parked between the sidewalk and the road, I feel it really looks like a junk yard and I think in the middle of town that should be clean- ed up. Brewer: We can just add to that the Ambrose people are supportive of these comments and even though they did not come they wanted their feelings to be noted. This has been an ongoing problem ever since he moved in and I know the Police Chief has had to visit them on more than one occasion. Mayor Kingsford: City Attorney, do you think anything from your office might be benificial, do you have any recommendations? City Attorney: I will look into the violations they have and see about civil action proceedings, not leaving out criminal violations as well. ~~~ .. Acting Mayor Brewer: Have you any problem with this transfer, Chief Porter? Chief Porter: We have ran a check on this and can find no reason why the transfer should not be granted. The Motion was made by Tolsma and seconded by Myers to transfer the Beer License from Great Western Pizza to Ventures Northwest, Inc. owners of the Chicago Connection. Motion Carried: All Yea: Item #10: Wine License for Ventures Northwest, Inc.: Acting Mayor Brewer: Ventures Northwest, Inc would also like a wine license for their Chicago Connection Pizza at the prior Great Western location. The Motion was made by Myers and seconded by Tolsma to grant a wine license to Ventures Northwest, Inc. upon the payment of the necessary fee. Motion Carried: All Yea: Department Reports: City Attorney: I sent the letter-to Nlr. Johnson regarding his property at 1103 East First Street and received: an anwser from Mr. Johnson which has been distributed to the Mayor & Members o~ the Council. Acting Mayor.. Brewer:. We have received a request from the-APA asking that we increase -our funding from $600,00 to $1,OOO.OU for-the next fiscal year. I would like to have the City Engineer'give-~his thoughts on this as he serves on this Board with me. City Engineer: This -item was brought up by Mayor Haley of Eagle at one of the recent meeting and her feeling were that the APA was doing a good job for the smaller cities and she volunteered to increase Eagle membership from the $600.00 to the $1,000.00. Mayor Davis from Garden City has also said that Garden City would increase their membership. I feel quite comfortable with APA and their leadership both at the Board level and at the Staff level. I think there is a lot of good people involved in APA now and they know what needs to be done and they are proceeding in that direction. First. Attached is a copy of the City Council's minutes of their August 4 , 1987 meeting which in brief summarizes their feelings. Because of this and because of the City Attorney's demand letter of August 10, 1987 (copy .attached) I have no other reasonable alternative other than to ask you to cease and desist from using the premises as a commercial enterprise. The property is quite cluttered and unsightly and the signs are a violation of city ordinances. If you are willing to catch up the rent and continue to keep it current I have no problem with you continuing on as a residential renter. The use of the property you own at 1103 East First Street has once again come before the City Council. As you know, the property is zoned residential and is being used in a commercial fashion. There was at one time a conditional use that pertained to that property but that expired with the change of use and occupancy. The use of the property in the commercial fashion is a violation of the zoning laws of the City of Meridian, as of course, you are well aware. It is further a violation of the zoning ordinance, sign code, to use the signs that are being used by the commercial venture occupying the premises.- I have informally discussed this matter with you on a prior occassion, and, as I recollect, you informed me that you would correct the situation and you might possible apply for a zone change and might even convert the residence to your own offices. Since you have failed to correct the violations DEMAND IS HEREBY MADE UPON YOU AND YOUR TENANT TO CEASE THE VIOLATIONS REFERENCED HEREIN. If you and your tenant fail to heed this demand and notice within ten (10) days from the date of this letter, the City has instructed me that the City. will institute legal proceedings against you to enjoin such vilations. Brewer:-Once again I would Like to discuss the property at 1103 East First, belonging to Mr. Jim Johnson one of our Planning & Zoning Members, some time ago at one of our meeting the Council asked our City Attorney to write a letter to Mr. Johnson. In visiting with our City Attorney he said he had not done this, I think our City Attorney feel in a awkward position, I think Mr. Johnson is r~Tl'1;=~ in putting our Attorney in this position, I know at least a year ago Mr. Johnson agreed at that time to probably take steps for a rezone on that property and he continues to ignore our requests. They are continuing to run a day to day yard sale at this property and actually it is a continuation of the business on the inside of .the build- ing. They have illegal signs leaning up against the trees & the State Highway signs. They have rope and electrical wire strung between trees about neck high which is very dangerous if someone is out in the dark. I want to see something done about this property.-I think that sitting- in this position or on the P &Z Commission we need to set an example not take an advantage of the situation. Myers; What are the steps to eliminate all the stuff outside there? Mayor Ringsford: Chief, if you would, I think we have some handle on those areas in the right-a-way, lets site them on that. Qbunse0,or would you clarify your position on this, you do not feel: comfortable~in writing the letter? City Attorney: I received direction from the Council, I talked to you and advised I would not write him a letter but would talk to him personally, I did talk to him and he advised he would take care of the situation, he would get the people to clean it up and in the near.future he had plans to rezone the property and possibly use this property for his own office. It is a little uncomfortable because he is -on~ -the -Commission=. ~ - The was discussion on what should be-done on this issue, Councilman Myers suggested he talked to him and report back at the next Council Meeting. Mayor Kingsford: I certainly agree with Councilman Brewer, lets pursue this diligently, Councilman Myers you talk to him and Counselor I think the letter needs to be written, if you are not comfortable in writing the letter we need to get someone else to do it. Johnson was present for a conditional use as an antique shoppe which was formally "The Window Box," Johnson stated that there would be adequate parking. ,Two (2) spaces on E. 1st, four (~) on Carlton and a lot that he intends to clear for resident and employee parking. Brewer stated that he felt t!nere would be no problem with the antique shoppe at ,this location and complimented their business. The mayor called for public comment. There was none. Hearing. Closed. Pipkin abstains from Hearing. Annabelle Youmans was present,requestina the Conditional Use for a Day Care School. Annabelle stated that she now has the pre-school and day care combinatipn license at this time, located at the Christ Lutheran Church in the educational annex. She explained her dedication to pre-school teaching and education before kindergarten. Youmans stated that the pre-school children should be divided from the day school children and needs a separate place for the pre-school teaching which would benefit both groups. This would be-the nine month pre-school session and turn to day school approximately the first of June. Youmans stressed the advantage to the children and the smooth running of the pre-school and day care. Youmans stated she~w®uld be licensed for 15 children. There was discussion concerning the E. First-Street traffic. Youmans explained the plans she has made to control any traffic problems. The back door would be used, no activity in the front, fenced, the drive along the side of the property all the way to the back to a turn around facing the front, two resting places with clear view of the driveway, never any backing, Delivery and pick up times are staggered.
