Ada County Highway District: The Ada County Highway District Commissioner s approved and certified the final plat of Meridian Park Subdivision #1 whi h c consisted of 88 lots. Subsequent to the certification, the Commissioners signed an agreement with the Developer to withhold improvements and sale of lots in the easterly portionof th e sub. (29 lots). The ACRD recommends the Developer be required to complete Subdivision #1 i !' pr or to final platting #2. Tf the City Council decides to approve the plat, then the followin re i g qu rements apply: 1. Dedicate 40' of right-of-way from centerline to Linder. 2. Improve Linder, make deposit to the Public Road Trust Fund. 3. Lot access restriction.to Linder. 4. All dedicated streets to ACHD standards. 6. Leading - 331 E. 3rd, Lots 1, 2 and 3, Block 3, Bown Addition. ` Mrs. Leading presented a diagram of three 30 X 90 lots, 1, 2 and 3 and a request ~~° to`spli lot 2, resulting in two lots, 42 X 90 and 48 X 90. She stated that the.garag.e is not on a foundation and will be moved, There will be no building ~~~: wi~hc~ut a permit. There was discussion concerning the platting. - The Mayor suggested that the Leidings get a metes and bounds legal description, 1: quick claim and deed recorded. :Agenda 2 Theodore Kellogg- 305 W. Broadway Westview Tract Addition, Block 6. "~< Mr. Kellogg presented a drawing and petition of approval from neighbors for his request to split lot. t ', Property lines and setbacks comply with Code, net size of lot would be 55 X 83, however, Kellogg stated that a 14 foot setback off of W. 3rd St. keeping in x' form of the block. He stated he would like to build a one-bedroom duplex. Schoen stated there would have to be a 20 foot setback. Mayor Glaisyer stated that this would have to be taken under advisement and a variance obtained before construction. - Kellogg explained that this street (W. 3rd) dead ends at railroad. k. , Kingsford stated this would also require the legal description filed~by metes and bounds, quick claim and deed. Osier referred to the discussion of Meridian Park #2 covenants and -the minimum housing size. Osier stated the first covenants presented were tentatively approved and the second covenants had the minimum housing size ~' am~ended,to standard FHA and VA for Final Plat approval request. { . Osier suggested that the City might impose some type of a one time fee upon a ' development of a lot or when they are sold so us to share on the tax base, i. ;. Mayor Glaisyer stated that the City of Meridian has taken the minimum housing size under advisement pending completion of interim type ordinances. Februarv 11, 1 Meridian Park #2 Final Plat.- E, of Linder Rd., North of Meadowview Sub. Roy Johnson was present, representing and explained that Meridian Park #1 Final Plat was filed in 1979 and displayed a map with the layout of #1 and #2. Changes included angles have been straightened, intersection in Barclay Court conforms with Ada County Highway District, fire hydrants, streets are 50 foot, 5 foot easement on each side, dedication of 40 foot right-of-way. The Motion was made by Mitchell and seconded by Tewksbury that Meridian Park #2 Final Plat be approved as long as development plans are followed and have approval of City departments. The front of the house is on the remainder of their property. The Leidings wish to sell the house and 48 font depth to their daughter. There was discussion concerning setback requirement. Tf lot is split, a variance would be needed-for the present house for back property line. The Motion was made by Hinrichs that the Commission recommend to City Council that Mr. & Mrs. Leiding be allowed to split Lot 2, Block 3 of Bown Addition, the lot with the house to be 48X88, the other lot (3) to be 42X88, with a six foot set back on west side of house. Motion died for lack of second. The Motion was made by Mitchell and seconded by Tewksbury that the Leiding request for split lot #2, Block 3 of Bown Addition be tabled unti) March 10 ,1980. Parker introduced David Jensen who read the request for commercial and put up a new steel or block building .approximately 30X50. (Letter on file with these minutes) There was discussion concerning lot size. The lots are approximately 105 deep. A11 owners within 300 feet had been notified by certified mail. Chairman Sharp asked for public comment. There was none. Parking area was discussed: Access to be from Ada St. and parking paved. The Motion was made by Tewksbury and seconded by Hinrichs that the Commission recommend to City Council approval of Parker Rezone of Lots 16 and 17, Block 2, Dowers First Addition from "A" Residential to "C" Commercial, with Ada St. entrance.. Motion Carried; All yea. Gentry Annexation Rezone - Meridian Plaza.- E. Fairview. James Gipson, architech, presented the ,project and described the request to additional commercial zoning from "A" to tie into existing commercial. This is not final design, they will modify this based on input and comply with greenbelt idea by leaving Five Mile Creek open (originally shown as ti1~d) GQR and Nampa-Meridian Irrigation go along with either ti1e or open. Gipson stated that an interesting development had occured by way of adjoining property owner who wishes to develop also. JOHNSON: May I make a cO1m~tE~rit, Mr. Mayor? The Covenants for Meridian Park Subdivision No. 2 are identical to Meridian Park No. 1 except Section 3A. We deleted the minimum square foot area. Is that what we`re tabling to discuss the specific: minimum R~~s~uare foot requiren Or what are we? MR. GLAISYER: When was Meridian Park No. 1 approved? MR. OSIER: It's been a year -- MR. JOHNSON: Approximately a year ago, I think a little bit less than a year. MR. OSIER: And it was approved with the old City requirement in there is 1,350 square feet. No sign of any kind shall be displayed to the public view on any lot except that the name of a resident of a dwelling upon a lot may be displayed on a sign of not more than one square foot in area. The Grantor reserves the right to display signs upon lots advertising the_ property for .sale~or rent, and signs used by builders to advertise the ~ropert during the construction and sales period. Section 12. Fences. No fence, hedge or boundary wall situated upon a lot shall have a h ie ght greater than six feet above the graded sufface of the ground around which such fence, hedge or wall is situated. The constructic or maintenance of spite fences or spite trees or shrubs shall be profiibited upon all lots in this subdivison. All wooden fences shall be constructed in a substantial manner, and shall be painted at attractive color and be maintained in good regain so as ta~be inoffensive to any other property owners in said subdivision. ~No barbed wire fences shall be constructed within this subdivi- sion. Fences greater in height than three feet shall not be placed nearer to a front .street line than a dwelling unless the plans for said fence have been approved by the Architectural Control Committee as provided in Section 2,b Section-13. Oil and Mining Operations. No oil drilling, oil development' operataons_, oil refining, quarrying or mining operations of any kind shall be permitted-upon or in any lot, nor shall oil wells, tanks, tunnels, mineral excavation or shafts. be permitted upon or in any lot. No derrick or other structure designed for use in boring for oil or natural gas shall be erected, maintained or permitted upon any lot. Section 14. .Water. The Grantors will deliver domestic water to the point where the water .meter .is located at the property line. Each lot-owner shall connect to this water system at this point and use this water for their domestic use. Grantors are under no obligation to deliver irrigation water to any lot in this subdivision. However, each .lot owner may avail himself of the irrigation water for those lots that are within the existing irrigation districts,: subject to the payment of any and all dues and assessments for the use of said irrigation water. Additional irrigation laterals may only be constructed in the easement area that is provided along each lot line. No individual sewage disposal shall be ~,. ,,:,~.. permitted. Ail bathroom, sink and toilet facilities shall be located inside ~1~ the dwelling house and are required to be connected by underground pipe to the wet line sewer system in the said subdivision. No machinery, appliances or unsightly material shal be stored upon a lot until a Grantee is ready and able to commence the constru tion with respect to which such building material shall be used, and then such building material shall. be placed within the property lines of the lot upon which the structure is to be erected. Section 17. Driveways. Any driveway constructed on any of said lots sha be of 4,000 psi 4° thic~r-entrained concrete and shall be connected to the curb at the edge o~ the street in a manner that it will not disturb the drainage pattern created by the street and curb section. Sidewa~lks* To preserve the aesthetic quality and living style intended by the Grantar, standard five foot concrete sidewalks shall be constructed by the Grantor adjacent to the back of the curt for the full width of .each lot prior to the time the dwelling is occupied. Damage to Improvements. It shall be the responsibility of the mil er of any residence in this subdivision to leave streets, curbs, sidewalks, fences and tiled irrigation lines, if any, and utility facilities free of damage and. in good and sound condition at the conclusion of the con- struction period.
