June 2, 1980 Orton stated that the city can allow the hookups outside the limits, but there is a d®uble fee> He reminded Stucker that the sewer billing is through the use of water. There was discussion concerning fees. All fees would be double. The charge for installation of meter would not be double. Service connection can be for the existing house only, single family. The Motion was made by Orton and seconded by l~Jilliams that the existing Arnold home, 2025 W. Pine, be allowed one hookup to city water and sewer, based on double rates. Motion Carried: Williams,. yea, Kingsford, yea, Brewer, yea, Orton, yea. I Agenda 6 Church ,of God - Sewer Connection 2 1/2 St. Lee Stucker explained that when the. sewer line was put in 2 1/2 St. years ago, the church was too low to connect. He stated it would have saved the church five to eight thousand dollars now, besides a lot of .problems. Stucker felt they (church) had met the hookup ree now requested through user fees some years past, and should not be required to pay to hook on now. The Mayor suggested that the date of the paid user fee be investigated. Orton suggested that the Board of Equalization analyze the church hookup fee if there was not sufficient data. Agenda 7 The Mayor read Ordinance.#371 entitled: APd ORDINANCE APfiENDING TITLE 7, CHAPTER 5, ENTITLED SE~JEk USE OF THE REVISED AND COMPILED ORDINANCES OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO BY CHANGING SECTION 7-533 SUCH THAT THE SUMMER MONTHS SEWER USE IS BASED ON THE FIVE MONTH AVERAGE WINTER UJATER USE. a The Motion was made by Williams and seconded by Kingsford that the rules and provisions of 50-9002 and all rules and provisions requiring that ordinances be read on three different days, be dispensed with and that Ordinance Number 371, as read, be passed and approved. The frequency that they '• broadcast on is 950 mag., so far above anybody's frequency that there would be ,: no interference. ~' ~~_ .~. There were no other .comments. The Motion was made by Williams and seconded by Bodine that KBBK Conditional Use fora radio station. at 1114 Meridian St, be granted. Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Brewer, yea. The Mayor welcomed KBBK to the community. Oliphant stated in behalf of KBBK, he would like to extend an invitation tQ their open house and appreciated being welcomed to the community. Benda 2 Martin Igo represented both requests and asked that the Council consider presenta- tion of both, as the reason for the LDS application was because of the Winston Moore application. The Mayor and Council did not object. •Igo stated that Varselle Weaver was pti^ES~nt, representing the LDS Ghurch-and their objective was approval of a Gon~f~.ic~n~al Use for 10 acres of land. Bast of the Meridian-Kuna Road on Overland. I~i~isy.cn Me,ore has asked that the present 10 acre parcel be moved to the east t~~ alls~w a combination of 21 acres and a planned commercial development in that 1t~~r..~~tir.?n. The Church agreed to do this -subject to their being. able to have the i`~~nJitic~r~al Use for a tle1fare Service Complex which was granted by the Ci~~y ;lr,~~~tn~Knp• 1978. In their behalf, Winston Moore has submitted the application, al,i. ir~t~! ~~•equired petitions,. and supplied maps. Igo displayed a map of the con:biry~~:d pr~c~posals. Moore has purchased the 6 acres which lies up against the prol;iiS~U urn ramp of Interstate, .The Church, of approved, will move their project over t®-the east, on the easterly boundary of the City. He explained the map was arc~iit~ctural conception. Kingsford commented that the only objection xrom the area residents seemed to be regarding the traffic screenirrg. Me questioned access onto Meridian~Kuna highway. Igo stated that access has not been deleted from this particular`drawing, but the understanding from the State Highway was that if the on ramp becomes a reality, the State will have control access of the first 300 feet. The control access .would not.a1low any ingress and egress. TI'ien the State would have limited control over another 150 feet.. In that 150 foot limited control area the State would F allow one access onto Meridian-Kung Rd, that would have to be negotiated with the State. If the on ramp dies not go through, they would have to take another look at providing an access. Williams asked if the LDS Conditional Use request was the same or. if there 6a~- been. changes. ;' i an Ci Hall 2. Weaver stated the only difference is that the Stake Center (Church Building} will not be located there as originally planned so the service complex will be up closer to the road. The nine items as listed and on file are proposed only. Kingsford questioned the use of back property. Weaver stated this 4 acres would be in grass. Williams stated that there should be a design review and ingress -egress.. taken into account far the Cope-Erwin property if and when annexed. This. parcel lies between--the Roho and Winston Moore property on ~ver1and. .979 Igo stated that Vance Cope, as well as the Roho owner, has seen and discussed the concept plan of Winston Moore. Cope has retired and has no intention of a move. They have no control of the property, but have an understanding. The Mayor questioned if there would be any problem with a curb cut if the Cope property is developed in .the future. Moore stated he would certainly take that into consideration on the i'ina1 design. He intended quality commercial development and realizes this. piece of land (Cope's) presents a problem of .access. Moore stated that they have every intention of cooperating to whatever extent to achieve the goal of a decent intersection, if a curb cut makes sense, it will be there, Williams stated that the State is requesting a 55 foot right-of-way centerline, so there would be 110 foot right~of-way on MeridianrKuna Highway, Engineer Smith questioned sanitary sewer and domestic water service extension. Igo stated they have been in attendance to the meetings with Mar-Mon, proposing bringing the sewer in the TO mile route. At this point they do not know what the;- Engineering or the cyst will be. Smith stated that the City does not want to get locked into development in that area and being served-with only one crossing, a dead head line could create problems. Moore stated his only response would be that they will do whatever is appropriate. He stated that Cooknell (Mar-Mond is considering bringing the extension west of his development and Meridian Greens slightly east of theirs, one or both of those will happen. Williams pointed out the low area and stated the City has not been. accepting a pressurized lift station. Cecil Th®mas stated the Moore and LDS. property drains into Ten Mile. The field drains naturally from the SE corner into Ten Mile, which is 7 feet lower than Nine Mile. Everything east of Meridian-Kung Rd. drains into Ten Mile. Mayor Glaisyer referred to the letter directed to the Council from Paul Buskey in behalf of residents within 300 feet of development. Moore had no problem with the residents request and most would be incorporated in the design review. Duskey letter on file with these minutes. The Mayor called far Hearing comments. There were none. The Motion was made by Williams and seconded by Kingsford to grant the EpS Conditional Use, subject to sewer and water before occupancy, widening of Overland Road for acceleration and deceleration, lands-caging plan and design ~, review. Motion Carried: Williams, yea; Bodine, yea, Kingsford, yea;~rewer, yea. The Mayor called for .public hearing- comments on the Winston Moore Rezone* There +~ere none. ` The Motion was. made by Kingsford and seconded by Bodine that the Winston Moore Subdivision Rezone tv General Commercial, subject to compliance of water and sewer requirements; design .review; landscapir~a; construction of acceleration ar~d deceleration lanes; subject to Fire and Police approval; and sub~eci to the , proposed zoning prdinance. 0 ;, F ~: i f ~' Meridian Planning and Zoning .2. __ October 9, 1979 Olmstead--stated that this proposal now was for economic reasons. It is not even necessary that it be final platted next. Orton pointed out how important it is to ask Mr. Leavitt and Company to produce a schedule for developing the rest of that area in an orderly manner before he comes to the outlying areas. They have changed the concept by bringing this list annexation in first. Orton stated if Mr. Leavitt would commit to a schedule of three years, as far as he was concerned, this issue would be solved. Olmstead stated they have not changed the Concept Plan of Cherry Lane Village. Orton stated the Change is in the timing, they have added~so much new land, Leavitt could push the nine hole back. He felt Leavitt was making the City a second rate municipal golf course. We want a first rate golf course and to culture clientele, it can't be done with nine holes. Olmstead stated Leavitt has promised a first class. golf course, ,but the developer should not be rushed into the second nine holes and would be better to let the economic climate develop to get the additional nine holes. Orton maintained the economic climate can be controlled for a long time out there to low frontend cost projects unless the City put some incen ive in this. The City should have a date committment. Mitchell stated Leavitt's options are not the Planning and Zoning's problem. He felt the Tentative Plat was coming in for the wrong reason. Mitchell was not in favor with the pumping station. The Motion was made by Orton and seconded by Tewksbury to table Cherry Lane Village West Preliminary Plat until the scheduling and phasing for the second nine holes of the golf course and, the lots around that are defined and confirmed commitment from Leavitt-Nu Pacific Company. Motion Carried: Orton, yea; Tewksbury, yea; Mitchell, n_._~!r. Marilyn Olmstead requested to be put on the October 15, 1979 City Council agenda. Agenda 3 Marty Igo was present to represent both the LDS Church Conditional Use and the Winston Moore Rezone located in Thomas Annexation, East Overland. Igo stated that the Winston Moore Rezone involved 22 acres north of Overland Rd, and east of Kuna-Meridian Rd. The request was to rezone to General ~ Commercial District to allow retail and service commercial such as motel., office, theatre, restaurant and ..certain limitations. Igo distributed signed petitions for the LDS Church Conditional Use and Winston Moore's Rezone by homeowners in favor. Upon displaying a map, Igo pointed out the original 10 acre site for the LDS Welfare Service Complex. This was approved by Council, December 18, 1978. The purpose of this request is to ask the City to grant a similar use on a different parcel of land located approximately 208 feet east of the land parcel now owned by the church. All of the property is within the City Limits. This move would allow Winston Moore to request about.~22 acres., now Agriculture zone, be rezoned to General Commercial to allow retail and service commercial. Igo stated the plan before them is conceptional as Mr. Moore now has a tenant, the buildings are architectural concept. Moving the LDS complex to the east allows Moore to do a Planned Commercial Development. The development would be compatible. to the Church's development. He stated Moore proposed different kinds of businesses that would lend well to the shopping centers of Naha's and Mar-Mon. The access or exits onto Kuna-Meridian Rd. are. not planned at this time. Igo pointed out that Moore has limited his request for rezone and specific uses would be brought in for approval. He had tried to design according to the new Ordinance. ,~~ , ~~ • • Meridian Plannin and Zonin .3. October 9 1979 Hinrichs commented that the new zoning ordinance. will have several Commercial categories. In each of those Commercial areas, planned unit developments, whether residential or Commercial, are listed under Conditional Use. That means they must come in for public hearing review and approval. The Chairman asked for public comment on the Winston Moore Rezone. Laura Conner asked if property was in City. The answer was yes, annexed in October, 1977. Connor asked about sewer and water. Hinrichs stated they may not develop until developer comes to City Sewer and Water. Paul Buskey, a homeowner across from the Winston Moore and LDS property, presented a prepared statement in favor of both developments, but with reservations listed for consideration: 1. A deceleration lane in front of the LDS property (Note: this was agreed to by the church at last November's City Council meeting). 2. A greenbelt of grass, trees, shrubs, and hedges about 50 feet in width on the LDS property (Note: future bldg. expansion on-the blueprint goes south toward Overland Rd.). 3. Entrances/exits to/from the LDS property on Overland Rd. should be at the extreme East and West ends of the property as currently shown on the blueprint. PdOTE: All of the above currently appear or are planned on the blueprint. -Our concern is greenbelt width and unmarked exits or entrances on Overland Rd. 4. A speed limit of 30 m.p.h. on Overland Rd. in front of the developments and our residences. (Mr. Frank Capshaw of the Highway District Traffic Office at my request last year performed a traffic flow study and concluded that we need a lower speed limit and more enforcement of it. A copy was sent to the Sheriff's Department. Nothing has been done.). 5.
