What will the detail be for the temporary plug inside the sanitary sewer manhole, for the 8-inch diameter sewer line extending westward, that will divert flow to the North? Using the driveways of the triplex and the fourplex, across the street, with adequate signing, as an emergency turn-a-round would be acceptable with the City since it apparently meets Fire Chief Welker's requirements. The City, however, does not feel it appropriate to waive the original requirement of constructing the curb and gutter on the North side of West Idaho Avenue. The City's apprehension is that if this section of curb and gutter is not constructed at this time, either by Custom Builders or by the Ada County Highway District, it may never get built as the City is not in the business of street construction. For-this reason, the requirement of the City will continue to be for construction of this section of curb and gutter. Please request Custom Builders to submit a letter to the City of Meridian stating that they agree to furnish and install restrictive signing on both sides of the fourplex and triplex driveways for "No Parking - Emergency Vehicle Turnaround" and their time schedule to install the signs. Also include that they agree to install curb and gutter on both North and South sides of West Idaho at the location of .the existing temporary turna- round. Mayor Glaisyer has stated that if this letter can be supplied by Custom Builders, it will not be necessary for them to return to City Council t~ waive the temporary turn-a-round requirement. GLAISYER Mayor February 8, 1980 Honorable Mayor and City Council City of Meridian 728 Meridian Street Meridian, Idaho 83642 Dear Mayor and Council: Custom Builders Research of the files for the Herby Subdivision development, which is adjacent to the East boundary of and across West Idaho Street from the Custom Builders development, reveals the following information. No respon- sibility was placed on the Herby Subdivision developer, or anyone else at that time, to construct the curb and gutter in the area occupied by the temporary turn-a-round. The development plans, for the Herby Subdivision, show the section of curb and gutter in question simply as "future curb and gutter". As shown on the development plans, only the North one-half of West Idaho Avenue, adjacent to the South side of Lots 2 and 3, Block 1, was con- structed. This occurred because the property owner on the South side of West Idaho, adjacent to Lot 1 Block 2, would not cooperate in dedicating the South one-half of right-of-way to facilitate full width construction of the roadway. Attached for your review and reference with this letter is a blue line print showing the development plan for Herby Subdivision. The City of Meridian has had a policy in the past that required all property developers to extend services, i.e., streets, water, sanitary sewer, etc., to and through the affected properties so that they could be further extended by adjacent property development. It is my recommendation that the City of Meridian continue this policy and, in so doing, require that Custom Builders construct the two pieces of curb and gutter in question to complete the street along with other utilities as development continues. This survey drawing is for the dividing of a parcel of land of approximately .44 acres westerly of and immediately adjacent to Herby Subdivision. In accordance with the previous approval by the Meridian City Council, this parcel will be divided into two (2) parcels each of which will have a three (3) unit apartment constructed on it and a small parcel which will be deeded to the Ada County Highway District as an extension of West Idaho Avenue. Establish a temporary 40' radius turn-a-round at the west end of West Idaho Street. This temporary turn-a-round shall be part on the right- of-way and part on the two tri-plex lots to the south of West Idaho Street. The turn-a-round parcel outside the right-of-way shall revert to the respective property owners when West Idaho Street is extended to the West. 3. Road Trust Fund that portion of improvements within the temporary turn-a-round. 4. IDAHO 83704 PHONE: 384-8938 1. Provide and install street improvements in accordance to the latest edition of the Ada County Highway District Detail Specifications and Standard Drawings. Street improvements to install include the following: a) Provide full improvement to the south 1/2 of West Idaho fronting the proposed subdivision to include curb, gutters, 5' wide sidewalk and match paving. b) Provide improvement fronting Lot 1, Block 2, Herby Subdivision, to include curb, gutter and matching pavement. 2. J B ENGINES , South Nampa, Idaho 83651 Telephone: 467-5252-888-2321 July 5, 1979 Honorable Mayor and City Council City of Meridian 728 Meridian Street Meridian, Idaho 83642 Mayor and Council: Custom Builders - Herby Subdivision Relative to the discussion at the regularly held City Council meeting last evening, July 2, 1979, concerning a plat re- quirement for the two triplex lots proposed adjacent to the existing Herby Subdivision. It is our opinion that it is not necessary to plat these two lots and that they can be sold under metes and bounds descriptions. Idaho State Code Paragraph 50-1301 defines a subdivision as "A tract of land divided into five (5) or more lots..........." It will be necessary however, to file in the office of the County Recorder, under "surveys" a final survey drawing showing the two lots and ties to existing subdivision boundaries. It shall also be necessary to dedi- cate a minimum depth of the north end of this parcel to continue the required 60 foot wide road right of way for West Idaho Avenue. This right of way must be shown on the survey map and noted as such and designated for use by the public. Since a plat will not be filed it will be necessary to formally transfer ownership of the road right of way area to the Ada County Highway District (ACRD) by deed. Condition 1(b) of ACHD letter dated June 12, 1979, will eliminate the. south side of the existing temporary turn-a-round (Lot 1 -.Block 2). We feel it would be appropriate to also eliminate the north side of this turn-a-round (Lot 4 - Block 1) and connect the curb and gutter pieces on this side of West Idaho for continuous storm water flow. Since the temporary turn-a-round is being removed it is our recommendation that this developer provide a turn-a-round on the front portion of his property. The ownership of the property beneath the turn-a-round would revert to the appropriate lot owner once West Idaho Avenue is extended onto the West. The turn-a-round is particularly necessary for emergency vehicles and generally necessary for travelling public and must have the dimensional requirements of a 40 foot radius to curb face as required by ordinance. Commissioner Fairbanks seconded. Motion carried unanimously. Herby Subdivision - John Joines said a two lot addition to the Herby Subdivision an West Idaho Street has come in. He presented the proposed requirements and the Commission felt his requirements were in order. Southwestern Subdivision - Mike Tanner asked that the Commission allow them to consider subject sub ivis~on p at dormant. Commissioner Fairbanks asked that they vacate the plat, and that they can do this if they don't sell any lots. Further discussion followed concerning the access onto Amity Road, the Commission feeling that there will be objection to the accesses at a later date. Mr. Tanner explained that he is proposing that an agreement be made that would not allow them to sell any lots and would then release the surety. They would have to reinstate the surety before any lots could be sold. Staff to see if an agreement can be worked out to accomodate the problem of the developer, and to bring it back to the Commission for approval.
