Smith, Ken Kulach, Patsy Leach, Steve Gratton, Joe Osier, Lee Stucker. Minutes of the previous meeting were approved as corrected to read - Page 2, paragraph 1, last sentence of Motion concerning Meadow View #2 Final Plat "that they come back to Council with any street scape plans on any reduced square footage under. 1350 feet on 0' lot line and deeded Lot 1 by metes and bounds to the City." Agenda 1 Mr. and Mrs. Leiding - 331 E. 3rd, Lots 1, 2 and 3, Block 3, Bown Addition. Mrs. Leiding presented'a diagram of three 30 X 90 lots, 1, 2 and 3 and a request to split lot 2, resulting in two lots, 42 X 90 and 48 X 90. She stated that the garage is not on a foundation and will be moved. There will be no building without a permit. The Motion was made by Williams and seconded by Brewer that the lot split of Lot 2, Block 3, Bown Addition be approved. Motion Carried: Williams, yea, Kingsford, yea, Brewer, yea, Orton, yea. There was discussion concerning the platting. The Mayor suggested that the Leidings get a metes and bounds legal description, quick claim and deed recorded. Agenda 2 Theodore Kellogg - 305 W. Broadway Westview Tract Addition, Block 6. Mr. Kellogg presented a drawing and petition of approval from neighbors for his request to split lot. Property lines and setbacks comply with Code, net size of lot would be 55 X 83, however, Kellogg stated that a 14 foot setback off of W. 3rd St. keeping in form of the block. He stated he would like to build a one -bedroom duplex. Schoen stated there would have to be a 20 foot setback. Mayor Glaisyer stated that this would have to be taken under advisement and a variance obtained before construction. Kellogg explained that this street (W. 3rd) dead ends at railroad. Kingsford stated this would also require the legal description filed by metes and bounds, quick claim and deed. The Motion was made by Williams and seconded by Kingsford that Mr. Kellogg's lot split, Block 6, Westview Tract Addition be approved, providing all Code requirements be followed as recommended by Planning and Zoning. Orton Meridian Planning and.Zonin Agenda 2 7 Agenda 3 Agenda 4 i ission .2. February 11 1980 Meridian Park #2 Final Plat - E. of Linder Rd., North of Meadowview Sub. Roy Johnson was present, representing and explained that Meridian Park #1 Final Plat was filed in 1979 and displayed a map with the layout of #1 and #2. Changes included angles have been straightened, intersection in Barclay Court conforms with Ada County Highway District, fire hydrants, streets are 50 foot, 5 foot easement on each side, dedication of 40 foot right-of-way. The Motion was made by Mitchell and seconded by Tewksbury that Meridian Park #2 Final Plat be approved as long as development plans are followed and have approval of City departments. Motion Carried: All yea. Leiding - Lots 1, 2 and 3, E. 3rd and Ada St. Mr. Leiding presented a diagram and requested the approval to split Lot 2, making two good sized lots instead of three (3) 30X88 lots. The front of the house is on the remainder of their property. The Leidings wish to sell the house and 48 foot depth to their daughter. There was discussion concerning setback requirement. If lot is split, a variance would be needed for the present house for back property line. The Motion was made by Hinrichs that the Commission recommend to City Council that Mr. & Mrs. Leiding be allowed to split Lot 2, Block 3 of Bown Addition, the lot with the house to be 48X88, the other lot (3) to be 42X88, with a six foot set back on west side of house. Motion died for lack of second. The Motion was made by Mitchell and seconded by Tewksbury that the Leiding request for split lot #2, Block 3 of Bown Addition be tabled until March 10, 1980. Parker introduced David Jensen who read the request for commercial and put up a new steel or block building approximately 30X50. (Letter on file with these minutes) There was discussion concerning lot size. The lots are approximately 105 deep. All owners within 300 feet had been notified by certified mail. Chairman Sharp asked for public comment. There was none. Parking area was discussed: Access to be from Ada St. and parking paved. Neither Mr. Christensen nor his agent are present. They received notification in the mail the 30th of March that the meeting would be held today including the date and the time and they are not present so we will proceed with the hearing at this time. Specifically, the violations of the regulations are that there was sewage or septic tank pumping, which was confirmed by tests run by the State Laboratory, on top of the,ground at the property which is used for their offices in the City of Meridian on Franklin Road. This is a direct violation of regulations governing the cleaning of septic tanks, Section I-15003.03 discussing disposal methods and, in that the site is not an approved site for dumping of sePo septic tank wastes lamming, also it is a violation of the sewage regulations becauSe there was fecal matter on top of ground, Section 3.1 of the District's sewage disposal regulations. In addition to that, it was a violation of the Meridian City Regulations, Section 8-907, talking about offensive matter ..."It shall be unlawful for any person, firm or corporation, to place upon any property or to allow to remain upon;!any property within his or its control, any matter which is offensive to the senses or injurious to the health, and as we are the official Health Agency or officers for the City of Meridian, we are charged with enforcing those regulations too. Because it was confirmed that it was sewage by the visual observation of Marty Jones and{also at this time Randy Roberts and Earl Ward from the City of Meridian, have come into the meeting) Still Mr. Christensen or his agent have;)4- arrived. Also in presence today is Marty Jones, myself, Tom Turco and Doug Patchin, all from the Central District Health Department. Because there were violations of the septic tank Pumpers regulations and, violations of ..... stop for a minute... There is a correction to the minutes of the meeting. The analysis was not run by the State Laboratory, it was run by Century Laboratories, which is an approved laboratory in the State of Idaho so the information is still valid. Specifically what we are here today to do is to solve the problem of the sewage being on top of the ground, irregardless of the fact that there has been earth cover put on top of it. In the past we have had, in 1978, there is a letter in our file which indicates that Roto Rooter did the same thing out on S. Linder Road - they were contacted by George Varin and requested to cease and desist and they were also told to get in touch with our office to make arrange- ments if they wanted to continue to do this to get approval of this piece of ground. In about 1974, Mr. Christensen, did in fact, make application for waste disposal on a piece of ground that he had southeast of Boise, so he was aware of the fact that he needed to make application for disposal sites. It is our feeling that fourteen (14) days from receipt of the minutes of this hearing that the area will have been cleaned up - in terms of cleaning up, what we are talking about is the material must be loaded into a truck or some other means and hauled to the landfill and properly backfilled. If at that time, it has not been corrected, we will seek other measures for correction. In the future, if this happens again, the District Health Department will immediately start proceedings to suspend or revoke the septic tank pumper's license for R & R Sanitation known as Roto-Rooter here in Boise. Does anyone have anything they would like to add to the minutes of the informal hearing? Earl-- Mr. Ward: The only comments that I might have regarding-the cleanup - we do have some question on their dumping rates and locations that they have had within the county. We would like to have some sort of documentation of where everything has gone- if you could supply us-=with something like that. Tom Turco: O.K. Basically because it appears that the amount that is being dumped at the approved disposal sites•lias-:dropped off Mr. Ward: There appears to be some discrepancies between the various cities in the area - the dumping rates - Tom Turco; O.K., we would like to have that information too fourteen 14 days after receipt of the minutes of this hearing. Marty: I think we have covered everything - just make a note that on file are the records of everything that we have done in regards to the case since the day it was started. The complaint that was received from the City of Meridian, I believe that was March 7th when we started this, the fact that photos were taken by the City of Meridian and they should also be entered Tom Turco: Yes, we would need to have copies of those photos put into the file. Kingsford inquired how many children would be involved at any one time. Mrs. Babcock explained that the average was between 4.3 and 4.6. Dale Babcock stated what his counseling entailed. Karen Babcock pointed out the strong neighbor support and the use by the neighbors of the service. She explained the history and stated that it was a neighborhood service. She clarified that the kitchen will not be used for a cooking area " rather they stress child rearing and sewing. Williams inquired about signs.
