Idaho Avenue Meridian, Idaho 83642 Dear Mayor and Council, May 25, 1990 0 i' It has come to my attention that the time period I was granted on November 1988 to store a mobile home E.A. Rosselli's property for a period of 1 year while repairs were being made, has since expired. on My intention was to repair the mobile home so that it could be resold at a later date, however, I was befallen with some unforseen financial and personal circumstances that made it impossible for me to carry out my plans in the allotted amount of time. My neighbors have contacted you that the unit is over their "right-of=way" by two feet, thus causing them a problem pertaining to the building of a fence around their business. I have contacted them in writing and have enclosed a copy of the letter with this request. I have permission from my landlord, E.A. Rosselli, to store the unit on his back property for whatever length of time I lease the home from him at 700 W. Franklin Rd., or until such time as I am able to repair or remove it. It is being maintained on the outside and it has fire insurance on it. We have also kept the taxes current and are maintaining the property around it so that it is not a fire hazard or an "eye -sore." At the present time it is being utilized as a storage unit. If it agreeable with you and I can reposition it to the satisfaction of my neighbors, I would like to request an extension of time from you to allow the mobile home to remain in storage on Mr. Rosselli's property for the time that I lease the home from him or until such time as I am financially able to repair or resell it. I do not believe that it would be, or is now, harming anything by just sitting there as a storage unit for the time being. Thank you for your considerate cooperation in this matter. Rosselli's property, we spoke about the "possibility" of wanting to put up a fence around your business. I was led to believe that at the time you finalized a decision you would be in contact with me, personally, so that arrangements could be made to reposition or move the moble home so that it could remain in storage, but so that it would no longer be in your way. If it is satisfactory with you, I would like to be informed in writing as to where your property lines are (or are believed to be) so that I might accomodate your wishes and take the liberty of repositioning the unit to the satisfaction of both parties. DEPARTMENTAL REPORTS Agenda 13 Williams reported on public meetings that are coming up. Glaisyer stated that the City and County should confer over matters of concern to both units in the near future to resolve the impact area questions. The Clerk reported he had contacted Chairman Bermeosolo with the request. He was referred to Kris Korte, who will be contacting the City to work on the problems in the Impact Area. Williams referenced the recent number of rezone requests. He clarified the City's position. He reported on the last Commissioners Meeting and the need for City representation at the hearings, OTHER BUSINESS Agendas The property on Franklin of Roselli and others was discussed. 14 I Williams stated that those at the recent hearing told untruths concerning City Policy. Problems like this continually crop up. Williams outlined the Commissioners position on the businesses South of Meridian, as out of Meridian's influence. Meridian City Hall October 15 Meeting called to order by Mayor Joseph Glaisyer at 7:33 P.M. Councilmen present: Richard Williams; Marvin Bodine; Grant Kingsford; Bill Brewer. Agenda 1 B&B Business Park Annexation Hearing located at 650 W. Franklin. Brent Barrus was present, representing Annexation request. Barrus displayed vicinity map, pointing out small parcel to the west owned by Stanley's that did not come in with proposal, which would leave an enclave. He asked for a variance of the Ordinance for this reason. Barrus stated the property annexed would relieve fire, police protection and the proposed businesses would create tax base. They will clean up area; be a asset to the community; build a building 150 X 150 which would include another business besides Meridian Glass and Screen. Brewer stated that he felt this should be zoned Light Industrial and that they obtain Conditional Use Permits for 150 foot frontage. Barrus stated he did not object to those conditions. Williams stated he also felt that the whole Annexation should be zoned Light Industrial and come in with each plan for the front 150 feet. Barrus questioned jeopardizing the monument retail business that is there now and what would happen to the trailer home on Strikwerda property. Mayor Glaisyer stated there would be Grandfather rights. If there is a change of title, the trailer home would not be allowed. Kingsford stated that there should be review of plans for 150 feet front through Conditional Use. Barrus stated that the home there, would probably be converted to a business office, with black top on the area that is covered with weeds and grass now. Black top would go back to where the old barn is now, which will be the new Meridian Glass building site. Water and sewer hookup was discussed. Sewer stub appears to be on the end of the Boise Cascade property next to Strikwerda. The water is on Franklin now. Ward stated that the sewer line would have to be extended through the property. Welker stated he did not like the enclave (Stanley) and felt the paper work should be done to annex. Ada County Trading Co. Conditional Use Hearing - Car Sales Lot - located at 225 E. Fairview. Jim Potter was present, representing Harry Hazen, owner and Ed Brooks, Proprieter. Potter stated that they had resolved all requirements of the Ada County Highway District except for the access onto 2 1/2 St. The plans have been approved by Ada County Highway District. There were no objections. The Motion was made by Williams and seconded by Bodine that the Ada County Trading Co. Buds Broiler transfer of Beer, Wine and Liquor License. Attorney, Tony Clark was present, representing Merinco, Inc's request to transfer licenses from Bud Reimer. Clark explained by law, they are required to transfer the license to the name of lessee. He stated that unfortunately the lessee turned out not to be a good manager. The request now was for a re -transfer. The State and County had approved the re -transfer. He introduced the new manager, Ray Harris. He felt the operation would be a good one for the City. The Mayor asked for comments from the Council. Brewer commented it was new to him and needed time. Bodine stated that he does not want any problems and not in favor at this time, backing Chief Sherwin's report. Chief Sherwin reported upon the research of applicants of transfer of licenses. It was his recommendation, based on his research, that the license not be re- transfered. There was much discussion concerning this type of establishment. Parks stated that the establishment was purchased by Merinco, Inc. - Robert Keller, in 1977 for $225,000.00; there had been no violation of Liquor Laws while they operated Bud's Broiler; the Council had approved these same people; that Bud's Broiler should not be compared with the Alpine Bar in Garden City and the Hide -away Bar; that it would be extremely unfair to reject the license transfer back to the previous owners. Mayor Glaisyer stated that the City's concern is the management and does not want the strain on the Police Department required of this type of establishment. Brewer again based his opinion on the City's Chief of Police recommendation. Bodine was not in favor. Barbara Keller addressed the Mayor and Council explaining reputation and management of the Alpine and Hide -away Bars. She attempted to explain circumstances leading to Chief Sherwin's report. There was discussion on the actual footage of the la -d for the easement. Kingsford suggested that they wait on a motion until the actual: measurements had been taken. There was discussion as to who would pay for the added engineering services. Mayor Glaisyer asked for public comment. Dave Reeves stated that thirty days after plat approval., the City or County must see that the property is developed as recorded. Attorney Wayne Crookstor stated that it hadn't been initially plat approved. Orton recommended that this be done under contract since this is a major item of work for the engineering firm. ienda Brent Barrus - Request septic tank for variance. Brent Barrus representing the proposed Meridian Glass and Screen, B & B Business /// Park was present, requesting a variance from the city ordinance to allow a septic tank Barrus stated that the location is west of Boise Cascade. The only sewer available is higher than the gravity flow and requires a lift pump. Their previous request for a lift pump was denied. He stated he was unable to obtain right of way north of line where it hooks onto Huico. That property owner does not desire to cooperate. The only way to proceed with their building, is to put in a septic tank until such time they can hook up. Boise Cascade refused a crossing because of numerous underground services, and is not a large line, the flow would be questionable, 1,000 yards with only 1 foot drop. Boise Cascade does not want their services disrupted. Barrus stated there are plans that show a trunk line down through their (Boise Cascade) property to directly north of his property, but there is no such line. Kingsford stated that this plan should be investigated and the responsible party comply. Smith stated these are private lines. There was disc1;ssion concerning the property that refuses sewer line for public use. Crookston stated that the city may have the power to condemn for public use for getting the sewer lines through. This would have to be researched. Brewer reviewed the plans of Barrus' Meridian Glass. Barrus stated that the sewer requirement would be equivalent to one fourth of a household. Water is not used in their manufacturing. Mayor Glaisyer stated that as much as he discourages a septic tank variance, he felt since Barrus has been a city businessman for over five years and a good citizen, that the variance should be granted with stipulation that in the future if and when property condemned, the sewer line would be put in place. Barrus asked that he be required to hook on to city services when they become within 300 feet. He did not want to be in a position to have to purchase the right of way if the Standley property was condemned. Engineer Smith explained that "When the B & B Annexation came to the city, there were three (3) alternatives to get sewer to Barrus. 1. to Boise Cascade, 2. across the street to Franklin Square, 3. north to Huico Phase III sewer. Phase III was stopped short because of the inability of obtaining an easement across the property that is standing in the way. Boise Cascade alternate has been exhausted and isn't acceptable. The crossing of Franklin Rd. to Franklin. Square would require a pressure line, Barrus is lower, and Franklin Square right now is on a septic tank and a drain field and pressuring back up Franklin Rd. to a drain field. The city owns and maintains the lift station. In the future,Tower Plaza will extend that line along Ten Mile Creek at which point Franklin Square would discharge into it and eliminate Franklin Square left station. The crossing of Franklin Rd. is the only alternate outside the septic tank interim, although, the requirement of any lift station or sewage injector should be located on Barrus' property for his maintenance, based on maintenance problem, of the city's existing lift stations." s Meridian City Hall .3. July 21, 1980 In summary, Smith stated,"It is not a good engineered application to go across Franklin Rd. with a pressure line into a manhole. It would be an extreme expense for Barrus while waiting for a line to become available, even if the property of the uncooperative owner is condemned. Williams stated in discussion of motion, that he was concerned of setting a dangerous nrece�lent and there not being a time stipulation. Orton agreed with 'Williams. There was discussion concerning Barrus being in business several years and the fact this property was annexed with the intention of the building of Meridian Glass and Screen business. Mayor Slaisyer instructed Barrus not to proceed until contacting the City Clerk or himself about the bonding. Agenda 3 Jim Potter - Old Towne Potter was present, representing residents of the area designated as Old Towne, properties west of Locust Grove,south of Fairview, north of Pine,and generally east of Five Mile Creek. Mayor Glaisyer stated, "T'he Council has already reviewed this 'Proposal, and speaking for the Council, correct me if I'm wrong, we are not objectable to your concept. I personally feel we cannot endorse this tonight until our ordinances are complete. Until we know what we are dealing with, I say this should be out on the table." Potter stated, "We are asking for - not an approval of the subdivision plan, per se, but the approval to include the land use plan as developed for this future development as a part of the ordinances so that when the ordinances and zoning map become effective, they will be a part of it." Kingsford stated, "I agree with Joe and I agree with Annette Hinrichs that this needs .to be renamed (Planning and Zoning) they have the ordinances now and are working on it. The Planning and Zoning is considering things you (Potter) are proposing now and it is my understanding that if they approve it through the public hearings, I have no objections to it. If it gets through both public hearings, I have no on,jections whatsoever. It would in fact be a part of that ordinance and I see no reason for your being here tonight." Potter stated, "The reason we are here tonight, on the part of the owners, they have received tentative propsals from several major development corporations and these development corporations are interested in the project and they would like putting price figures together and do their marketing studies and so forth. This is why we pursue this approach, to ask for recognizing this as part of those ordinances that would be adopted, so that these development corporations would have some positive assurance that the city would consider or recognize this type of development in that area." Williams stated, "Number one, the Comprehensive Plan is general in nature, we see by the map on display of policy diagram. lumber two, this would not be included in the ordinances as the city has no jurisdiction on that land, it is riot a part of the city limits of Meridian, Idaho." Potter stated, "A portion of it is." Williams stated, "Until request for annexation comes in, it is a mood point to talk about this. We have stated previously that the concept generalities as proposed awhile back was a good beginning. The Mayor's concern was to require minimum square footage and/or a dollar price on the quality if a ower house, to keep up a balanced community housing upgrade. There was discussion concerning the size houses and quality, subsidized 0usinn. Harmon asked that the City allow them (Meridian Place #1) to build the sized house that can sell, not being restricted to the 1350 sq. ft. each unit, and they will put the quality in the building of the house. This matter is to be placed on the March 3rd agenda. Agenda 10 B & B Business Park .Sewer System - W. Franl<14 Harold Briscoe was present to request permission to connect to sewer line a Franklin Square across Franklin Rd. from the Meridian Glass proposal., Mayor Glaisyer explained the policy of coming to City Water and Sewer and going South requires a pressure lif` - it is not a gravity flow. Briscoe stated the exnense would be too great to connect from as far as Huico, 2000 feet sway. Engineer Smith explained Phase IIi intent to serve this land, but it is unknown at this time how much of the line is owned by ?& se Cascade, which would be a closer connection. The land to the south and west can be sewered by the extension coming up Ten vile. To cross Franklin Rd. and dump into a manhole would he a last resort. It was the feeling of the Mayor and Council that 5 k B Business Park make the effort to obtain an easement from adiacent property owner. Agenda ll Department Reoerts: Building Inspector Schoen, reported that the property owners in No*_eboom Annexation, Woodland, Inc. and Matlocks had been informed that their business operation is noncomplying w ":h "A" Residential. There has been no attempt on their part to comply with City Ordinance. These properties were "A" Residential in the County before Annexation to the City in December 1978. Schorr stated that quality homes should contain: two (2) car garages, two (2) baths, solar siding or brick, shake rooO, fireplac and a heat pum-. Chief Sherwin reported that a crime analysis shnws that the largest percent of cri,re in cities stem from the low priced housing. Attorney Crookston described the procedure of City Ordinances. He suggested that the Vayor and Council should direct the Attorney to draw up an Ordinance after a favorable hearing. At the next regular meeting the Ordinance would be presented for the Council's consideration. Crookston was directed to obtain a recorder for meeti, . to record and transcribe meetings. The Attorney also suggested that there be a public notice for a Preliminary Plat to legally notify adjacent property owners, or perhaps a letter of notification. Crookston brought up the AiC Attorney's meeting at McCall March 12, 19P9. Registration fee is $10.00 for two days. The d-ecision will be made at a later date. January 21, 1980 The Motion was made by Williams to allow a service line to the Church of God property across the Bodine property with an easement between Bodine Oil and the Church of God be.given to the City with the restriction that the use of this sewer line is personal to the Church. Stucker questioned if the Bodine property would be able to hook on the same service line in the future. The Engineer stated this could be a maintenance problem. The building is 7100 square feet. The Mayor asked for public comment. Martin Igo spoke in support on behalf of Winston Moore, developer adjacent to proposal. The Motion was made by Orton and seconded by Williams to approve Scout Annexation "C" Commercial, subject to compliance of water and sewer requirements, design review, landscaping, construction of acceleration and deceleration lanes, fire and police approval, and subject to the proposed zoning ordinance. Agenda 4 Meridian Glass Design Review-- 560 West Franklin Brent Barrus, owner, and James Gipson, architect, were present>representing Design Review. Gipson displayed drawing and stated that the existing house is structurally in good ! shape, the out buildings to be removed, the house to be remodeled into an office, the trees will remain, the new Meridian Glass building in the back to be used for light manufacturing and storage. The parking and drive will be by two curb cuts. There is a loading zone and a fire turn -around area, trash enclosure and fencing. Landscaping will be preserved and added to. The fire turn- around was reviewed with Fire Chief Welker. Barrus stated that there would be black too for access to the fire hydrant at the south end. Gipson stated that this pavement would sacrifice landscaping. Orton remarked that a steel grating could be used for fire equipment access across the lawn and a visual remedy for landscaping. Gipson stated that the curb cuts are existing now. Water and sewer lines were discussed, Barrus stated that his Engineer is working on this and will go the best route. Williams requested that a landscape plan be placed on file. Barrus stated building should be started within the next six months. Brewer requested that a sprinkler system be installed. Agenda Rainey -Kuhl Annexation Hearing "C" - Located Overland & Hwy 69 5 Howard Foley, Attorney, representing Annexation requested,displayed, and explained graphics stating that this proposal will benefit the City as it lies at the entryway to the City. The present Time -For -Two building would he razed and a supper club put in its place. The impound quarters are to be moved across the road from Mar -Mon development on West Overland (Ro-Ho). Foley explained the impound yard and general repair facilities, - not dismantling. The purpose to hold vehicles requested by the City or the State for the period of time it takes for insurance bids. This lot will not be a permanent storage. Foley stated the Ro-Ho proposal will serve a need as well as an improvement and he felt this would be compatible with other buildings that presently exist, in particular Mtn. View Equipment and their servicing area. Steve Teed, Architect, described the drawing. Parking has been provided to comply with Ada County Highway District, State Highway concerning the approach, landscaping, 4500 sq. ft. restaurant, 25% bar and 75% restaurant area. Supper Club design, entirely new brick building. Williams stated that he does not agree with going to the south of the Interstate for annexing. He questioned the 55 foot center line right-of-way on Hwy 69, known as the official State requirement. Also, if there would be assurance this would be built. In answer, Foley stated, certainly the Council has means to see that they follow the policy and general outline of their proposal. He had talked to Mr. Sessions, Director of the State Highways, regarding the 30 feet on each side in order to expand to a four lane highway, resulting in 120 feet. They are prepared to answer to all requirements and give right-of-way. The Impound Area was displayed, approximately 1/4 of a mile from Kuna-Meridian Rd. south side of W. Overland. The lot is designed in back of the Rainey home, a repair complex, a holding area, impound lot, 7 acres, but not all 7 acres included in annexing. Orton stated that the general opinion of Planning & Zoning and still in his opinion, is that this proposal does romply with the Comprehensive Plan, Commercial on the corner and Industrial in the other area. In the case of the restaurant and the impound area, the City would achieve an improvement over the existing situation. Kingsford asked about the holding period. Mrs. Kuhl stated 30 to 60 days for insurance companys. With the new State reguUtion, they. -will be holding at least 60 days again. Brewer stated he agreed to the obvious improvement of the area and that in communicating with Mar -Mon, found they were definitely encouraging the annexation and the project. He stated that Mar -Mon was going to do their best to incorporate the stream into their project and asked that Rainey -Kuhl do this also. Teed stated there would be no problem of putting some borderline planters on the easterly side. Kelly Parker was present to discuss potential rezone from Residential to Commercial property located at 12 E. Ada, behind the Surge Business. Parker stated that he thought this was a double lot size and planned a small retail store and warehouse. There was discussion. Parker will notify the City Clerk,if he desires to apply for a rezone. 2 Meridian Plaza - Gentry Annexation James Gipson, Architect was present to discuss the plan for the plaza located on E. Fairview. Gipson introduced the owners, Kirk and Eric Anderson. Gipson explained the proposal and displayed a layout map. Five Mile Creek runs through this property,. Their plan was to tile and landscape. The front part to be Commercial, the back part as 12 units per acre, residential, to make the transition from Commercial to high and medium density buffing. Total 36 units to approximately 3 acres. This may be built in phases, pedestrian plaza, built in fountain, with the parking around the Outside. The frontage is 330, depth 660. Gipson stated that they would be most anxious to develop their share of Gruber St. The Tromburg property has -not been developed next to this proposal. There was discussion pertaining to a green belt along Five Mile Creek. Their plans would have to be modified to allow bicycle paths and green belt. Gipson willcontact the City Clerk for a formal application. genda 3 B&B Business Park - W. Franklin - Design Review James Gipson represented Brent Barrus in 'proposal of remodeling original house into an office and erecting a new Meridian Glass Co. building. Half of the building is warehouse, the other half manufacturing, (put together windows.) There would be a portion for rental, however. Gipson displayed a map and stated that there is a loading zone area,enclosed trash collection area, gate and fence for security and traffic control. Boise Cascade is at the rear and east. The access and turn around area for a fire truck was questioned. This will be confirmed with Fire Department. Landscaping was discussed. The present lawn and several bushesand trees will be maintained as much as possible. The Ada County Highway District has notified the Architect that since E. 1st is an arterial for the State of Idaho, there was an additional 10' of right-of-way purchased and there is actually a 40' right-of-way which goes approximately 3 1/2 feet behind the proposed sidewalk on that street. Rudeen was present to request the front yard set back be reduced from 20' to 10'. The reason being that the State owns the 10' for poles, lights, etc. The property line has moved 10' west. Notion Carried: All Yea: Item #5: Susan Quarnstran: Request to park trailer home behind Rossell" s on Franklin Road while repairs are being made to trailer: Mayor Kingsford: Ms. Quarstran would you care forward and address the Council: Quarstran: we rented the house from Rosselli's with the condition that it would be alright to park, I was living in a ten wide trailer by 55, and it was really not live- able, we were told on good faith by Rosselli that it would be alright to park it while it is being repaired, it is not going to be used as a residence just redone so it can be moved back into a park or resold. Mayor Kingsford: For the Councils information, she asked the City Clerk about this and it was thought this should be approved by the Council Giesler: How long period time are we looking at? Quarstran: We anticipate no longer than one year. if it does go over that we could care and ask for a extension. Giesler: Do you have any problems with any of the neighbors or anything like that? Quarstrom: I have a small problem with Teresa SidmorQ who awns some property back there, she has advised the City Clerk that it is two feet on her property, it does hang over two feet into the easement , as soon as we can clear out some weeds we will reposition it . Giesler: There won't be any utilities or anything like that hooked up to it? Motion Carried: all Yea: Depaztnent Reports: City Attorney: Council has directed me to pursue enforcement efforts regarding violations of the Day Care OrdinancQ, the City Clerk has sent letters and he has turned a couple of poeple over to me to send letters, I have sent letters, I did receive a response from Mary Wilson, she indicated in the response that they were in the process of trying to move her, what she terms as a pre-school to another location, in her letter she indicated they were dealing on some property, she did not indicate where the property was, she requested a 120 day grace pericgl,I told her that I would present that to the Council, I believe Mr. Wilson is here and I would like him to make some kind of presentation to the Council, what their intention are , where the property is. I also sent a letter indicating that a pre-school under our Ordinances is a private school and whether it is a day care or not it would still require a Conditional Use Permit in order to be operated in any zone within the City. Wilson: We requested 120 days because we were not aware of the need for a Conditional Use Penut, the Ply we are thinking about is located at 1608 Meridian Street, it is aranerci.ally zoned Property, we thought this would take us out of the residential setting, place us where the Council would look upon more favorably. We feel that the school provides a real service to the canmunity and we would like this opportunity to have time to apply for this. City Attorney: How long do you think it is going to be before you are able to move to this location, assuming the Conditional Use Peaait is granted. Wilson: The property will take a little renovation which I will need to do, that is why we requested that amount of time before we even knew we needed the Conditional Use Permit. It looks like we will have approval for financing within a week or less. Morrow: A question here, what happens if the whole thing falls through? Wilson: If it falls through, I guess we will have to call it quits.
