The present zone classification of the above described lots is RESIDENCE "A" ZONE and any use other than residential must be approved by the City of Meridian Planning and Zoning Commission and the City Council, 75° approval of all property owners within 300 feet and public hearings before both bodies. TM Mayor announced the canvass of votes would beat the City Ha11, Wednesday, November 7, 1979 at 5:30 P.M. and invited citizens to attend. KBBK Conditional Use Hearing Burt-H. Oliphant, owner, was present, representing request for a radio station at 1114 Meridian St. Nillaims recommended approval if there were no .exterior transmitting towers. Oliphant stated that the exterior antenna was small dish type dome which would not interfere with anyone's television or radio. The frequency that they broadcast on is 960 msg., so far above anybody's frequency that there would be no interference. Oliphant stated in behalf of KBBK, he would like to extend an invitation to their open house and appreciated being welcomed to the community. Martin Igo represented both requests and asked that the Council consider presents- lion of both, as the reason for the .LDS application was because of the Winston Moore application. Minutes of the previous meeting approved as read. Agenda 1 KBBK Radio Station Nearing for Conditional lJse - located at 1114 Meridian St. Dave Williams and Burt N. Oliphant, owner, were present, representing Conditional Use request. 4illiams explained that the office complex is being used by Ed Jones who has a Conditional Use Permit. The parking lot is paved and adequate for 16 spaces; the staff will be approximately 13 employees, but parking at any one time would be needed for 5 to 8 vehicles; very little traffic in and out; no huge antennas, approximately 12 feet high; no noise; 35 signatures of neighbors with no objections. Hinrichs asked for comments for hearing. Kitchell asked if there would be a sign. _ _ Oliphant described the KBBK letter light - approximately 2 feet each. No _ __ flashing lights. The Plotion was made by Mitchell and seconded by Tewksbury that KBBK Radio Station, located at 1114 Meridian St be granted a Conditional Use Permit. Motion Carried: All yea. (Agenda 2 Cherry Lane Village !west Preliminary Plat - located in Lampe Annexation. Marilyn Olmstead, J-U-B Engineers Inc., was representing Leavitt-Nu Pacific Co. Olmstead stated that this Tentative Plat fits in with Cherry Lane Village Master Plan - 77.4 acres, density of 3.4 lots per acre; 268 lots and does not have a possible school site, Block 8. The lots are roughly designed if there is not a school site picked up by the School District. If the School District picks this site up, they will resubmit a revised tentative at that time. Olmstead stated they will have a wet line sewer. There is a 18" trunk line that will eventually tie in sewer extension on Ustick. A lift station will be pumping back over to Cherry Lane for this first phase. A thorough design of location of lift station has not been done yet, but approximately Block 11. Orton stated that he could see a conflict with what was presented earlier on Cherry Lane Village development. There was a promise to develop lots and the last nine holes for golf course in a timely manner. Orton questioned ~ if there is a schedule developed to come through with the second nine holes. Olmstead stated that the schedule of the existing nine holes has always been that when we begin the 200 lots around the second nine hole, or first phase 200 lots, the second nine will be constructed. Olmstead stated that Leavitt will stand by his oblication to put in the second nine as soon as the first lots are ready to go in around the second nine. The main reason they are coming today with the Lampe Property Tentative Plat is because the schedule on the way this property has to be picked up, the optioh has _ to be exercised this December. The Leavitt-Nu Pacific Company does not pick up options, except in rare occasions, if the Tentative Plat has not been approved. Orton stated that he felt Leavitt could push the second nine back with ,just this kind of monopoly. Hosac read his response to Sumner dated 4-18-79, talking about Springhave 4Jay which has now been changed to S/E 3rd Way, which is 60-foot, right-of-way. "Springhave 4Jay in the Meridian Greens Project is designed as a collectur street and is, .a 60-foot right-of-way. This street will become the major North/South collector street for this area. As a result, there is no n~~d for the street in Country Terrace Subdivision (which is only a 50-foot right-of-way and currently terminates in a cul-de-sac) to be extended southward. The double frontage situation referred to vaould only occur if Country Terrace Dr. were to be extended southward, which as mentioned above, is neither necessary or desirable. To elirninate the potential for Country Terrace Dr. to be extended southward thus creating double frontage, we are in the process of preparing an application to vacate the pori;ion or right-of-way in Country Terrace South of the existing cul-de-sac which is not now needed as a future road. In addition, Calderwood Dr.. in heridian Greens is designed as a future connection to the West to the Kuna/Meridian High;ay and this street will provide access to the undeveloped portion of Country Terrace. which lies below the rim of the existing Country Terrace Subdivision." Country Terrace map was brought out and studied. There was more discussion on connecting street to Country Terrace. Roust stated that the problem of the old station will be solved and that he is not the owner. Ron Byron is the owner and the station is in the process of being torn down. Williams read from the correspondence of repea£ed warnings to Roust to .clean this property up. He stated that this was not responsible development. This is a fire trap and a nuisance. Johns, architech and Hank Houst was present representing the Shopping-Mall, 1603 E. 1st-St. The parking lot in the proximity of 1616 Meridian St., required a Conditional Use Permit. Houst stated that the old station on the corner of Meridian St. and Franklin had been sold to Ron and Sherill Byron, and that they were responsible for tearing the building down. Houst stated that the building will be completely sprinkler system for fire protection. The access would be a "straight shot" clear through from one street (E. 1st St.) to the other (Meridian St.) There would not be landscaping because their frontage is so narrow. Sharp inquired if Houst there could be some sort of curbing to prevent cars from backing out onto street. Houst answered yes. Chairman Sharp reminded the Commission and public the purpose of this hearing was fora Conditional Use Permit for the parking lot. Messick stated there would be some minor changes after reviewing the comment recap. He stated the dimension of buildings would be approximately 20 to 24 feet in width, depending on whether they are one or two bedrooms. Some would be single story; some would be two story with garage driving underneath. There would be a break in roof line as well as frgnt yd rd appearance. Some natural landscaping would be along five Mile Creek. These units are designed for retirement people.
