Agenda 2 A letter from Meridian Manor #3 was read by Mayor Storey, regarding Final Plat. (Letter on file with these minutes) Richard Williams stated that he understood that the Limited Office and Retail had not been approved by Planning and 'toning; 1/2 street proposal at Sewer Treatment Plant; who has decided the City vacate this Plant? Mike Preston, J-U-B Engineers representing Meridian Manor #3, stated that the Planning and Zoning were reluctant to approve that area of concern before adoption of their Comprehensive Plan, however the area under consideration is Meridian Manor #2 that was approved by the Planning and Zoning Committee, all they did was takeout some lots. Smith and Bues wanted to put some larger homes in with larger lots. Mr. Preston stated that all they were asking for this meeting is approval of the Tentative Plat that underlies Meridian Manor #2, to be known in the future as Meridian Manor #3 Subdivision, TPeis has gone through Planning and Zoning Committee and this is the only portion that they have approved. They are asking approval for that which is platted as Meridian Manor #2 and iY the City approves they will submit Meridian Manor #3 and with its approval they will vacate #2, this.. is tenative approval. There was discussion on the area around the Sewer Plant and on through streets. Mr. Preston explained that there are a couple of variances that they would-request per letter from Larry Sale. These are some excessive block lengths, Blocks limited to land in #2 Plat (blocks 2 and-4) vary in length from 1,050 to 1,300 feet. Roger Welker, Fire Chief, stated that he has not seen the amended plan. Agenda Opening of the Phase III Sewer Line bid. 3 The City Engineer, Carl Ellsworth of J-U-B Engineers,'made the following announcements before opening bids: Corrections: Page 21 typographical error that states; sod repair and replace 500 linear feet of a unit price. 1454 linear feet is a mistake, they will use the 500 linear feet as the extension. Page 23 typographical error; deductable alternate 1, b deduct 285 linear feet of 18" diameter type E sewer pipe. Should be Type F sewer:--pipe_.__:__, included in bid type #20. Page 30, typographical error; deductable alternate 7,b deduct 049 linear feet of 12" type F sewer pipe. Should read 948 linear feet for the deductable alternate. Agenda 6 Meridian Manor No. 3, Vacation of Meridian Manor No. 2 (Preliminary Plat) The Motion was made by Joseph Glaisyer and seconded by Marvin Bodine to tracate Meridian Manor No. 2 and accept Meridian Manor No. 3• Motion passed: Bodine, yea; Kingsford, yea; Glaisyer, yea `. Agenda 7 Fire Department report by Chief Roger Welker: Chief Welker stated that emergency 911 program should be in by the end of the year and that we have an interim agreement with Boise Fire in resolution form. The cost is $50.00 per month for Boise to dispatch and $78.00 for two line per, month. This cost will be City and Rural. Boise will be answering the phone and dispatching with Arden's as aback up. The Motion was made by Grant Kingsford and seconded by Marvin Bodine to approve Resolution #237• Motion passed: Bodine, yea; Kingsford, yea; Glaisyer, yea Agenda 8 Public Work's Superintendent, Bruce Stuart, had nothing to report. Agenda 9 Building Inspector, Vernon Schoen, had nothing to report. Agenda 10 Agenda 11 Chief Welker statedthat he had a application for a Bews Industrial Development that would leave enclaves in the City. Mayor Storey stated that he would discuss it with Wayne Crookston. Councilman Joesph Glaisyer presented a policy statement. The Motion was made by Joseph Glaisyer and seconded by Marvin Bodine that when Preliminary Plats are submitted that they should include restrictive covenants at the same time. Agenda 12 Pat Joy informed the Council that the application for an Industrial Site ,,~~ Selection was successful. Agenda 13 Condominium Ordinance: Councilman Glaisyer stated that he would like to see more in the Ordinance. The matter was tabled. City Clerk, Herald Cox, informed the Council on what the Boise Policy was. The matter was discussed Councilman Glaisyer requested that it be tabled. Ci er 4 78 Agenda Thomas Annex - LDS Conditional Use (Cont'd) 4 Weaver stated that there was a problem. The money has been appropriated for 1978 for this property once the year goes by then they will need reapproval. It was discussed. Williams stated this should not be considered as a negative response. Hosac asked for clarification on an Ordinance. He read from the Ordinance book on procedures on Conditional Use Permits and questioned if the Zoning Commission could grant Conditional Use Permits. It was discussed. Agenda 5 Meridian Manor #2 Vacation j Larry Sale was present representing the request. He stated that they are asking the Council to vacate Meridian Manor #2 and toy approve Meridian Manor #8. The main difference in the two is lot size. Utilities are under construction - the sewers are in the roads. Sale explained the changes - they need two variances on Block 2; overlength Block 4 and 7. Williams stated one thing they should consider is no determination has been made to remove the. plant. He felt strongly that the plant would be turned over to B.S.U. as a training facility. He stated that he is making them aware of this point. Nothing is final but consideration is being given to that use. !.~, _s~t,aeets were outlined. Glaisyer inquired if protective covenants were submitted. Sale stated that on #2 they were recorded but they need ammended and did not have them at this time. Sale stated that the request was to vacate Meridian Manor #2 and second approval of the Final Plat on Meridian Manor #3 subject to modification of covenants and approval of variances on Blocks 2 and 4 for length. Crookston stated that they should be considered separately and explained the results. The P1otion was made by Grant Kingsford and seconded by Richard Williams to vacate Meridian Manor #2. Bodine stated that he hated to see 8th Street being a half street. ._ 8th Street was discussed. Sale stated that they needed to work closely with the City in the future to see what sort of access the City needs at the Treatment Plant and perhaps bring 8th into the property. The request on Meridian Manor #3 for approval with variances on Black 2 and 4 was presented. Glaisyer requested that the Final Plat approval be held up because of the procedure of requiring protective covenants. Sale stated that they have taken away a lot of investment by vacating the first plat and inquired if they had assurance that they will receive approval on the #3 Plat. Glaisyer stated that he like #3 better than #2 but it is a matter of procedure. Storey instructed Sale to get the covenants submitted and it will be scheduled for the December 18, 1978 Council meeting. Rackham explained that ~+ there was a trailer there, it was not their intention to place it there. Zt was placed before they knew there was restrictions. Rackham inquired what the objections were to mobile homes and explained their proposal. ;'~~ The Mayor outlined the need to control mobile home placement. 'i Rackham explained the nature of their emergency business and the crime problem. The situation in the City was discussed. Rackham summarized their request.. Kingsford inquired specifics on the crime problem. Bodine stated that he is against trailer homes coming into the City. Every merchant would like a trailer house, but no one is entitled to it. Glaisyer stated he was against the request. The Motion was made by Marvin Bodine and seconded by Joseph Glaisyer that the Conditional Use Permit for Roto Rooter, Housetrailer, request be denied. Agenda 7 Vac aT.ion of Meridian Manor #2 ,,/ Joy read the Public Notice of Public Hearing. ~ Larry Sale was present representing the request and volunteered to answer any questions. ~ / f! i Williams stated that he also receioed a letter. There has been some rumors going around on what the request entailed. The Mayor polled the Public on how many were present on the request. There were several. Sale explained the process of vacation and the history of the development. The developers felt the market changed to higher priced homes needing larger lots, because the plat was recorded it needed to be vacated. A request was made by the developer that asked the city to reduce the lots from 101 to 92 lots. The developer has submitted restrictive covenants that are the same as for Meridian Manor #1 except it calls for a larger minimum dwelling size. Williams inquired how many duplex lots in #2 were eliminated and how many duplex lots will be in Meridian Manor #3. Sale stated that there are 18 lots out of 92 that can be used for either single family or two-family dwellings. Lester Travis, a homeowner, inquired where the duplexes would be located. Sale outlined where the lots were located. Kingsford inquired how many duplexes were approved in #2. Sale was not sure. Sale read the square footage from the covenants. Travis inquired why they wanted to put duplex housing in.. Sale outlined the Comprehensive Plan as it applies to this development. Travis inquired why the duplexes were not distributed through out the Subdivision instead of on the fringe area. Bi11 Carroll stated that he was in about three weeks ago and had been assured there would not be any duplexes in there. Joy disputed his contention. The location of the duplexes was discussed. Carole Gab rielson stated when the developer chooses not to put duplexes in the middle of a new subdivision that. says they feel duplexes will pull the value of adjacent homes down. She inquired what that would do to their property values. K.~Babcock observed as a neighbor to these people they supported her request. She concluded that she would be less threatening to them than something that happens a lot morecommonly, the duplexes. D. Babcock inquired on number~of duplexes. Richard Potter stated everyone at this meeting would like to see single family in the development. Eric Gabrielson inquired why the developers were not there to answer questions. Sale stated that they coulc research Plat #2 and determine where the duplex lets were located. Sharon North inquiredif there was a price range of the structures. Sale read squarefootage of structure from the covenants and cost not less than $35,000 excluding the lot cost. He stated that the lot value should be $11,000 to $14,000. ,. C. Gabrielson stated that she would not be opposed to duplexes if the covenants guaranteed t:he property next to others would be kept up. She stated there are a lot of loop holes in their covenants. She was concerned wfth their property v~1ue. Covenants and their enforcement was outlined by the Mayor and Sale C. Gabrielson observed that if the Council approves the Plat they have no input into tyre decision. Glaisyer stated that the Architectural Control Committee has to be named by the • developer. 99~ of the tine it will be 'the developer on the committee. The only time these people could be named to the committee is before the covenants wire recorded. It was discussed. ~ Williams stated that in defense of the developer they have done a good job in Meridian Manor #1 on developing. What a homeowner does with hisproperty cannot be controlled completely through the covenants. The problems of rentals keeping property up was rediscussed. Kingsford stated the advantages of separating duplexes throughout the develops^r.t. Bedelco Developers were discussed. 'y~ E. Gabrielson stated that until the new Subdivision covenants cover the areas of concern to those presen±, the Subdivision should not be approved. Sale responded that the responsibility for enforcing the covenants restswith the people in tFe .,_ Subdivision. C. Gabrielson responded by outlining the problems of enforcing the covenants. Sale stated that they could sue, cost was outlined. The matter was discussed. Travis stated thatthe problem would be eliminated if they did not alloca any duplexes in the development. Kingsford suggested tabling the request until Sale could explain the #2 Develonnr.:nt in terms of the duplex lots. Bodine stated he felt the same way as Lester Travis. ~~.Glaisyer thought it should be tabled and let the neighborhood people get together 'with Sale and developers and see what they can come up with. Williams agreed or was in favor of accepting Meridian Manor #3 as all single dwellings. The indications are DVY and Warren Construction crib accept the Change Order. .Coleman recomtt:ended approval of Change Order #3. Crookston inquired if EPA in Seattle had been notified. Agenda The minutes of the previous meeting were approved as read. 1 Agenda Franklin Square 2 Jim Stubblefield was present and requested permission fora conditional use permit to place a formica shop in their warehouse complex at the North- 40 feet of building one. He presented a plat for Council review on the proposal. He had discussed the proposal with two of the Council members. They own the property on all sides. It is a clean business which involves laminating formica in the building. There will be no trash accumulated inside or outside and no noxious vapors or anything of that nature. It will use little water or sewer. Egress and ingress will be through Franklin Road only. Stubblefield stated that they are going to landscape all they own along Franklin Road. Ttte Motion was made by Joseph Glaisyer and seconded by Grant Kingsford to allow the Formica shop under a conditional use permit in Franklin Square. He stated that they are requesting vacation of Meridian Manor #2 and approval of Meridian Manor #3. He outlined a meeting he held with residents of Meridian Manor #1 and recommended to Smith/Bews they eliminate duplexes under consideration on lots located .next to single family residence" in #1, and the Subdivision across 8th Street. Smith/Bews agreed to eliminate almost 20% of the duplexes. Sale refferenced a map showing where duplex lots can be located. He argued for the duplex lots backing up to the 1~lobile Home Park. They may not build duplexes on all the proposed lots. All duplexes will be built by Smith/Bews, no lots will be sold for construction of a duplex dwelling. Rental property upkeep was outlined. Williams called for comment from the public. Eric Gabrielson was present representing the property owners on the question of Vacation of Meridian Manor #2 and acceptance of #3. In a prepared statement he stated; "On Friday night, January 26, 1979, twenty-fo~~r residents of Meridian Manor #I and Cherry Manor met to discuss Vacation of Meridian ,,,,,.,,,,,,,..~,.t4anor #2 and approval of Meridian Manor #3. All those people attendointshwere agreed ~! received a certified letter concerning this matter. The following p upon: Proposal: We will agree to Meridian Manor #2 providing the duplexes or multi- family dwellings are excluded. These dwellings have been proposed for Lots 9 & 10. Or: We will agree to Vacation of Meridian Manor #2 and approve Meridian Manor #3, provided that there are no duplexes or P1ulti-Family Units." The consensus of our group is that these should be single family dwellings instead of duplexes or mutli-family units. 4) Although you have decreased the number of lots in Meridian Manor #3. The total number of dwelling units has increased: Meridian h1anor #2: 100 lots designated on the plat as single family dwellings. Meridian Manor #3: 92 lots - 18 duplex lots and 24 single family lots which provided for 110 dwelling units (Footnote: this shows an increase of 10 dwelling units by the vacation of #2 and approval of #3) (Note: lots 9 and 10 are the only lots designated on the plat as duplex lots. The other lots designated as duplex lots were handwritten in)." "Questions concerning presentation of plats: 1) On the plats for Meridian Manor #2, lots 9 and 10 were not sepcified as duplex or multi-family lots. The only mention of the fact that these could possibly be duplex lots was in the covenants." "On the application for Subidivision approval for Meridian Manor #2, which was signed by Burt Smith, it is stated that the Subdivision would consist only of single-family dwellings." 2) The revised Tentative Plat, dated January, 1978, was presented to the Planning and Zoning Committee. This plat was to replace the plat for Meridian Manor #2. The only lots specified as duplex or multi-family were two lots at the East End of Cranmer Drive and the last lot on the Southeast corner of Willowbrook and lots 9 & 10 on N.W. 8th. No mention was made of any duplexes or multi-family units on Longford or Crestmont or any additional Duplexes or mutli-family units on Cranmer. 3) The only exit presently planned for Meridian Manor.#3 is Crestmont Drive. Since Crestmont is only 50' wide, the impact of extra traffic from tli~ new Subdivision would create a definite hazzard to existing dwellings on this street. It would also create more traffic problems on Cherry Lane'.' "Even though there are plans in the future for extending at least one exit in Meridian Manor #2 on through to Meridian Street, there was some concern voiced that people would be in the habit of using Crestmont and would not utilize the new street." "4) Upon reading the minutes from April 3, 1978 to the .present, no mention was made of any additional duplex lots or multi-family lots except for January 15, 1979. At this .time, concerned residents of Meridian Manor' #1 and Cherry Manor specifically inquired about additional duplex or multi-family lots." "5) We are also concerned. about the reasoning for developing Bedelco's property in such a piecemeal fashion. i.e. The property along N.W. 8th and the property North of Meridian Manor #2." "Concerns about Covenants: 1) We feel that there should be some additional covenant which would concern the maintenance of property within the Subdivision. i.e., setting a time limit, within which a lawn would have to be planted and maintained." "Ending Points: 1) We feel that when a Plat is presented for approval, it should be specifically designated what is to be built on each lot. 2) We would like the City Council to be aware of the fact that we are concerned about the growth of our Subdivision We also realize that the developers are also concerned with keeping high standards on any expansion proposal. Therefore, we would like to work closely with them in developing a plan that would be satisfactory to all concerned." Sale congratulated the citizens on the presentation and research. He also stated that no duplexes will be placed adjacent to single family homes. They show multiplex along Peridian Road. Williams stated that they are speaking to the Plat for #2 as it currently stands. Sale stated that #2 was plated as a low middle cost housing area, the intent now is to increase the value of all the dwellings constructed in it. Sale agreed on the points for the covenants and would like input if there are suggestions. Glaisyer inquired how much other property was owned by the developers. Sale outlined the area. Glaisyer inquired what the developer's intentions were in the undeveloped areas. Sale stated that the same general lot size as in #3.Along the East side large lots have been presented for possible commercial/office area. Gabrielson stated that he felt these points of opposition were still valid and they should specify what is going on each lot. Duplexes lined up in a row is poor planning in comparison to the development already existing. He stated that he felt the piecemeal approach could develop into more duplexes than houses. Cherry Lane was discussed and future proposals for fouraane traffic flow was discussed. E. Gabrielson stated that they are trying to get some points settled so they can determine future growth and development. As a resident of the area it is of concern to him and effects the health of their Subidivsion and the City in the future. Gene Kindred from Meridian Manor #1 inquired about access to the North. He wanted to know what access was planned and how police and fire protection would be effected because of emergencies without an entrance from the backside, N.W. 8th. Williams requested comment from Fire Chief Welker on access for fire emergencies. Welker stated that he was unfamiliar with the development but stated that if the one road was blocked there would be no access. Sale stated there is a secondary access to the property through the old sewer treatment plant site. Williams stated at the present time there is an open ditch cutting the property paralle l to N.W. 8th Street. The area around the treatment plant was discussed. Welker stated that his trucks need an all weather street to support the vehicles. Kingsford stated that the issue at hand is whether to vacate or not vacate. Kindred inquired if the vacant lots along 8th Street were to be Platted. a Carole Gabrielson stated that she had the last plat presented to the Planning and Zoning Commission and N. W. 8th is platted, also the area above #2. This Plat designated all the lots on N. W. 8th as 18 more duplex lots. She pointed out that 36 duplexes is too many far that neighborhood. Kingsford inquired when the Plat was produced. It was January 1978. He stated that his plat of #2 shows N.bJ. 8th as unplatted. Williams stated that Planning and Zoning had eliminated some duplex lots. Sale stated that his understanding was that Planning and Zoning and the Council approved the Preliminary Plat as revised with the exception that lots along Meridian Road be held from judgement until the completion of the Comprehensive Plan. They submitted the old and new Preliminary, the old Plat of #2 and the new Plat of #3 all in one package. Glaisyer stated that the citizen group has had some goad input and stated his position is to withhold judgement or vote it down. If the two groups feel they. .can work something out then it can be tabled, otherwise he supported the citizens group. '" ' `Sale stated that there is not any way the developers can satisfy the demands of the residents.. They have been in the process for a long time on numerous occasions. Developers are ready to move forward in the spring, interest, rates are high. He requested they be approved, the Council set a compromise but decide tyre issue tonight. Gabrielson requested clarification on what was allowable on lots 9 and 10, duplex or single family. Williams stated that he felt either/or was approved. They did not change the use, here you have a remodeling - a permit should have been obtained and the money that has been expended for remodeling could have been avoided. Storey felt the Council had bent on the Race Track. Bews and Bert Smith were present representing the request. 1~~ Sale stated that they had worked out an agreement with hams owners in the development, • Smith and Bews will reduce the number of •lots available for duplex dwellings. The lots available for duplex dwellings are lots 10 - 13- 15- 24 - 25 - 25- 27- 2B - 29 and 30 of Block four (4). The Homeowners requested the covenants be changed to include ~ stronger language on timing of completion of improvements to Property, specifically finish work on painting and trim, along with landscaping and lawn improvements. They found that their covenants meet will all FHA requirements. They put soma language together for the Homeowners consideration, They stressed the parking of recreational. ., vehicles and general appearance and neatness of the property and landscaping completion timetable. The third compromise that was reached was that the developers would start processing Phase IV at the time they have completed 50% of the houses in this project to aid access to the east. Erik Gabrielson outlined the agreement to include access to the east was primarily to get traffic access and fire and insurance standards. -They agree the covenant criteria has been met.
