No trailer houses shall be parked in any street or wit}tin building setback lines. No trailer, basement, tent, shack, garage, barn or other outbuilding erected on a tract shall be at any time used as a residence, temporarily or permanently, nor shall any residence of a temporary character be permitted. No building of any kind shall be erected or maintained on a building site prior to the erection of the dwelling house thereon, except that a garage or other small building of permanent construction may be erected for the purpose of storing tools attd other articles prior to the erection of a permanent dwelling. (g) PROSECUTION OF CONSTRUCTION R~RK: The construction of the dwelling and associated structures shall be prosecuted diligently and continuously from time of conunencement thereof until such dwelling and associated structures are fully completed and painted. All structures shall be completed as to external appearance, including finished painting, within eight months from the date of conmencemettt of construction, unless prevented by causes beyond the control of the owner or builder and only for such tune as that cause continues. (h) OIL AND DIINING OPERATIONS: No oil drilling, oil development operations, oil refining, quarrying or mining operations of any kind shall be permitted upon or in any lot, nor shall oil wells, tanks, tunnels, mineral excavations or shafts be permitted upon or in any lot. No derrick or other structure designed for use in boring for oil or natural gas shall be erected, maintained or permitted upon any lot. (i) EXCAVATION, DEFACING OR LA;ti'DSG4PE, DITCHES: No excavation for stone, sand, gravel, earth or minerals shall be made upon a building site unless such excavation is necessary in cotmection with the erection of an improved structure thereon. No irrigation drain or waste water shall be permitted to flow in open ditches to or on any lot in said subdivision and may be transmitted only as follows: (1) Ditches, if any, are to be carried at sufficient depth underground so as not to interfere with the use of such ground. (2) Ditches, if any, are to be carried in sealed underground conduit. (3) Ditches, if any, are to bo located only within easement or street right-of-way lines as shot~n on the plat of said subdivision. (4) The cost of constructing such ditches, if any, shall be paid by the parties installing same. The ot~ners of said subdivision arc tinder no obligation to deliver water or furnish rights-of-way to any of the lots in this subdivision. No trash, garbage, ashes, or other refuse may be thrown, dwnped or otherwise disposed of upon the_real property. No building materials shall be placed upon the building site until the Grantee or builder is ready and able to ewrmtence construction, and then such materials shall be placed within the property line of the building site upon which 'the structure is to be erected. 17te undersigned shall have the right to enter upon any vacant building site for the purpose of burning or renwving weeds, brush, grotath or refuse. (1) FENCES - HEDGES: No fence, hedge or boundary wall situated anytahcre upon an}' building site shall have a height greater titan that allotaed by the local controlling ordinance, but in no event shall it be greater than six (6) feet in height above the finished graded surface of the ground upon which such fence, hedge, or wall is situated. No fence, wall, hedge, or shrub planting which obstructs sight lines at elevation between four (4) and eight (8) feet above the roadways shall be placed or permitted to remain on any corner lot wit}tin the triangular area formed by the street property lines and a line connecting them at points twenty (20) feet from the intersection of the street property lines eetended. The saute sight-line limitations shall apply on any lot within ten (10) feet £rom the intersection of a street property line within the edge of a drivetaay or alley pavement. No tree shall be permitted to remain within such distances or such intersections unless the foliage line is maintained at sufficient height to prevent obstruction of such sight-lines. (m) NOXIOUS USE OP PROPERTY - SPITE FENC)S: No portion of the real property nor of a building site nor any structure thereon shall be used for the conduct of any trade, business or professional activities. Noxious or undesirable acts, or undesirable use of any portion of the real property is prohibited and shall not be, permitted or maintained. The determination of the undersigned owner that any activity or use is undesirable or noxious shall be conclusive upon all parties. The construction or maintenance of a spite fence or spite tree shall be prohibited upon any building site. The determination by the undersigned owner that any wall, fence, hedge, or tree falls within the latter category shall be conclusive upon all parties. (n) GENERAL APPEARANCE AA~D 1TATN~SS OF PROPERTY: No recreational vehicles nor other vehicles larger titan a three-quarter ton pickup shall be parked on any lot in Meridian Manor No. 4 Subdivision nearer the street than the front line of the duelling, or in the street right-of-taay. For the purposes of these Protec- tive Restrictions and Covenants, recreational vehicles shall include, but not be limited to: boats, campers, snowmobiles, motorcycles and race cars. All main- tenance wrork pcrfonned on the above vehicles or personal automobiles shall be done inside the garage with the doors closed. No vehicle shall be parked on the street for a period of time exceeding twenty-four hours at a time. All Grantees in Meridian D}anor .'40. 4 Subdivision shall maintain their property in a neat and orderly fashion. Landsr_aping must be planted within three months from the time the dtaelling is occupied and must be maintained and irrigated. All Grantees shall maint:ai.n the dtaelling in good repair and appear- ance and shall. not tllota the buildinr;s, fences, landscaping or any other part of the property to have a shoddy appearance. III That no buildxxxg shall be erected, placed, or altered on any lot until the construction plans and specifications and a plan showing the location of the structure have been approved by the Architectural Control Commmittee, hereinafter designated, as to quality or worlanarxship and materials, harmony of external design faith existing structures, and as to location witlx respect to topography and finish grade elevation. No fence or wall shall be erected, placed or altered on any lot nearer to any street thaix the minimum building setback line unless similarly approved, as provided in Paragraph N hereof. As to all improvements, construction, and alterations upon building sites, the Architectural Control Committee shall have the right to refuse to approve any design, plan, floor area or color for such improvements, construction or alterations which is not suitable or desirable in the opinion of a majority of said Committee, for any reason, aesthetic or otherwise, and in so passing upon such design the Committee shall have the right to take under consideration the suitability of the proposed building or other structures, and the material of which it is to be built and to the exterior color scheme, to the site upon which is it proposed to be erected, the han~ny thereof with the surrotmdings and the effect of the building or other structure or alterations therein as planned on the outlook of the adjacent or neighboring property, and the effect or impairment that said structures w711 have on the view on surrounding building sites, and any and all factors which in the opinion of a majority of tlxe Committee shall affect the desirability on suitability of such proposed structure, improvement or alteration. Actual construction shall comply with the plans and specifications as approved and shall not commence prior to the receipt of the written approval or expiration of the time period provided herein for the granting of such approval, by the Architectural Control Cotmtuttee. N The Arc}itectural Control Committee is composed of W. Burton Smith, 9530 Halstead Drive, Edward L. Bews, 5206 Sorrento Circle; and Arthur C. Davis, 7203 Sar. Fernando Drive, all of Boise, Idaho. A majority of the Committee may designate a representative to act for it. In the event of the death or resig- nation o£ any member of the connnittee, the remaining members shall }xave full authority to designate a successor. Neither the members of the committee, nor its designated representative shall be entitled to any compensation for services performed pursuant to this convenant. At any time, the then record ox~zxers of a majority of the lots as shown on the plat of the subdivision shall leave the power through a duly recorded written instrtmtent to change the membership of or to withdraw from the connnittee or restore to it any of its powers and duties. No member of this committee duly appointed or elected shall incur liability by reason of any act or omission in exercising the duties herein established for such committee. Mav 14, 1979 Orton inquired if Boesiger had written into the covenants that the easement along fJine Mile does not prohibit recreational use. Boesiger stated he had. Hinrich stated that ACRD has strongly advised bike paths in regard to this concept. The Motion was made by Mitchell and seconded by Orton that Sunnybrook Farms Preliminary Plat be recommended for approval to the City Council, with the condition that covenants be the same; sewer and water standard. Motion Carried: All yea Agenda 6 Bews'.& Smith Industrial Park Preliminary Plat - Located on East Pine Wayne Forrey was present representing Smith &Bews Industrial Park Preliminary Plat. Forrey stated that they had met with ACHD and resolved the problem of access upon Locust Grove. There will be only three accesses onto East Pine, four on Locust Grove. The 10 inch water line and sewer will be extended from east 5th. Forrey stated that they forsee small businesses. There would be a choice of small or large lots. Sharp stated that there should be landscaping and buffering in between accesses. The Motion was made by Mitchell and seconded by Hinrich that Smith & Bews Industrial Park preliminary Plat be approved with Design Review and sewer and water to meet standards. Motion Carried: All yea Agenda 7 Meridian Manor #4 Preliminary Plat Wayne Forrey representing Devco, Inc. Meridian Manor #4 Preliminary Plat. Action was held until input of Comprehensive Plan. Forrey stated that density excluding office area facing Meridian Road is 3.8. Mail boxes will be located at the curb cuts. Central water and central sewer will be provided for; all street names will be for approval of APA and the City; fire hydrants will be provided according to City Ordinances; an additional crossing of Five Mile Creek will be discussed with Fire Department and an agreement be reached. Forrey stated that the planned park area of the old sewer plant was considered being used by BSU as a test station, which would change the proposed use next to 8th St. If the sewer plant is used fora Votech establishment, they would want a redesign to make extra deep lots. There was discussion on street and access of sewer plant area. Problem of bike path on Federal property was discussed. Public right-of-way was discussed. ACRD has asked Devco to do a redesign because of no public right-of-way on 8th St. Sharp stated they needed the street matter resolved before coming back to Planning and Zoning. Marsden referred to previous discussion of 8th St. and explained design of use around old sewer plant. Access has been provided to adjoining landowner and will have to build a ditch which would be piped. Marsden stated they have provided two culdesacs. Lots have been designed for more outdoor use. Density is 4.29, smallest lot is 55X105. A special lot variance is requested to accomodate new design area. The Plotion was made by Williams and seconded by Y,ingsford that the Meridian P1anor #,4 Rezone from "A" to "C" on the eastern portion be denied. Agenda '~~ 4 Meridian Manor #4 Preliminary Plat Forrey stated that before the Planning and Zoning would make a decision, they directed this proposal to the City Council for direction on development of W. 8th St. extention, then back to Planning and Zoning. There was discussion. Williams did non support duplexes because of the flow of traffic. He favored a redesign of 8th St. and concentration on single family dwellings. Forrey again asked for input on 8th St. extension. Kingsford stated that there should be a full street. Bodine agreed. Gary Smith, Engineer, stated that there is a street from Pleadow View that dead ends at the Sewer Treatment site at 8th St., and it could at some time be continued through. He felt this street should be continued through to Ustick, but not as a "straight shot" to Meridian or Linder Roads. Welker stated that there is too lone of a block area on Block 12 for Police and Fire protection. Forrey stated that these block lengths had been granted a variance in 1975. The Motion was made by Kingsford and seconded by Bodine to not accept Pteridian Planor #4 Preliminary Plat until 8th St. is a through street and no duplexes. Two aluminum buildings owned by two different people with a bearing wall. It would be a great cost to both if they had to move the buildings 5' for set back required. Hopkins stated he would have to tear down his building because of the great cost to move. Vern stated he needs a Variance on the set back because all buildings need to be 5` from property line. Five Mile Creek is one of these identified lineal open space corridors. The developers of the two proposed subdivisions now being planned along Five Mile Creek; Meadow View N2 and Meridian Manor ~4, should each provide a 10 foot asphalt Bicycle Path (See Bicycle/Pedestrian Design Manual for Ada County) along the Creek. The presence of an existing city sewer easement along Five Mile Creek should make this easier to accomplish. Besides providing the Bike Path, connections should be made between the interior streets and the Five Mile Creek corridor to enhance access by foot and bike. For Meridian Manor -- Waterford Drive and Creekview; for Meadow View #2 - Chateau Avenue east of NW 10th Street. Eventually all of Five Mile Creek in the Meridian area could be developed as a plant and wildlife preserve and as a Bicycle/Pedestrian corridor. The location of the Bike Path within the right-of-way of Five Mile Creek should be worked out between the developers and the City of Meridian, and consideration should be given to the establishment of a separate, non- paved foot path in the future (possibly on the side opposite the Bike Path). This "Human-Power" corridor would provide an excellant connection between the two residential areas and the Cherry Plaza Shopping Center... allowing residents to bike or walk, Instead of using motorized transportation. Final Bike/Pedestrian design plans must be reviewed by myself prior to Ada County Highway District approval of the plats.
