Meridian City Hall May 1, 1978 The Meridian City Council meeting was called to order at 7:45 P.M. by the Mayor, Don M. Storey. Councilmen present: Williams, Richard; Marvin Bodine;Grant Kingsford;Joseph Glaisyer Agenda 1 The Minutes of previous meeting were approved as read. Agenda The first item of business under old business was Franklin Square Subdivision. 2 Jim Stubblefield was present representing Franklin Square. Richard Williams stated that there was a reconsideration on the hook-up charge when Franklin Square comes upon City sewer. Stubblefield stated that there are three alternatives and he didn't see a problem, going down Franklin, going down Ten Mile or connecting to gravity flow. The planned interim system will carry the development until such time as one of the alternatives are available. If the lift station is in effect for more than one year the City can defray any cost on connections by recovering equipment out of the lift station. Mr. Williams'concern was who is going to pay for the ultimate hook-up and put the line in. Jim Stubblefield stated that at some point;in time, other developments will bring a line to Franklin Square so there is not a problem. Mr. Stubblefield stated "if we can work out something with the people adjacent to us we would be more than happy to contribute the cost of the force main to their installation of the line or something like that, which would be mutually agreeable, but at this point in time I cannot may -that that will happen but if it can --that will eliminato-the problem totally - if it doesn't we still have connected to the City sewer by virture of a Forced main to the Phase II connection where it intersects Franklin Road." Mayor Storey stated that what concerned the Council is that we have a resolution that all developers must come to City line. Jim Stubblefield stated that"we did address that, we would go to the line with the force main like Franklin Square." "We would prefer not to do that, but if it comes on tap and is ready to go, we will do it." "We were trying to give you alternatives so you could tell us what to do - I don't think the third alternative will come up." "If you would want to give back the equipment I would be happy to make the crossing." Mr. Williams stated that the City is not in business to make money, we just want to get the connection. Mayor Storey then read the portion of the previous minutes pertaining to Franklin Square Mr. Stubblefield stated that they had asked that the City increase the fees for the temporary system development if the third alternative was used but the other two alternatives do not require anything by the City. Mayor Storey and Councilman Williams agreed that the first two alternatives would be better. The Council reaffirmed the acceptance of the Franklin Square interim sewer measure. Patrick Joy asked for a -.point of clarification, "then Mr. Stubblefield is going to connect to the City sewer at his own expense?" Mr. Stubblefield stated that this was already the case. Agenda The next item of business was the Conditional Use Permit at 14 E. Carlton 3 The Mayor read the Conditional Use Comment sheet (evidence filed with these minutes) The Mayor pointed out the increasing number of Conditional Use Permits in residential areas and that they are a means of circumventing an ordinance or policy. It was zoned residential and if the City infiltrates these areas wb are not going along with Planning and Zoning. It is the Councils decision but they are going to have to stop the Conditional Use Permits somewhere. Th. M..f*n, v .j l.-.-..». An Meridian City Hall .2. May 19 1978 Mr. Ed Jones of 538 W. Washington was present representing himself. He stated the primary use of this Conditional Use Permit is his own private office. The importance of this is not later profit - he has an office in Boise and all of his staff is from Meridian. Mr. Jones stated that this was his dream to have an office conveniently located to him and that it was important to him personally. The Mayor restated points of concern on Conditional Use Permits. Mr. Jones stated that he has submitted plans, he has provided for parking, torn down a potential fire trap and is improving the area. The person most affected stated to Mr. Jones that he was pleased with the proposed use considering other possibilities. The building will be brought up to code. Richard Williams inquired about the basement use and design. There is a kitchen and two rest rooms. As a gesture, the Senior Citizens are looking for a place to use and this may fit into their plans, at least on a temporary basis. Perhaps something could be worked out with them. Mr. Williams also stated that he is for the Conditional Use if its limited to a service type organization and not a retail outlet. These types of businesses should be encouraged around City Hall and down Meridian Street because they are fixing up some of the older homes. Light service and limited office space would benefit the City, from the Church down to the railroad crossing corridor. Grant Kingsford agreed with Richard Williams. Marvin Bodine stated that he didn't see anything wrong with the proposed use and there would be less traffic than when the Church was in there. The Motion was made by Richard Williams and seconded by Marvin Bodine that the Conditional Use Permit for 14 E. Carlton be approved with the condition that this building not be used for any retail sales and that Mr. Ed Jones consider contacting the Senior Citizens for the possible basement use of this building. Motion passed: Williams, yea; Bodine, yea; Kingsford, yea; Glaisyer, yea. Agenda 4 The next item of business was the consideration of the Final Preliminary Plat of Settlers Village. Norman Fuller was present representing Settlers Village. Mayor Storey stated that Planning and Zoning had approved Settlers Village but they were making conditions on whether they were in condominiums or changing the plans around. The feeling is that any time the plans are changed they must go back to Planning and Zoning. Planning and Zoning cannot state what they want, they only advise the Council. Mr. Fuller stated that there is a lack of Bommunications. He did not ask for Condominium approval, he only asked that at such time as the City had an Ordinance was there any objection to selling them as condominium units rather than rental units. The Mayor stated that this was presupposing and no onecould say what would happen in five years. Mr. Fuller replied that all he is asking for now is approval of the Final Preliminary Plat,if things change he will resubmit a new plan to Planning and Zoning. Mr. Glaisyer and Mr. Williams inquired as to what they were approving. Mr. Fuller explained the approval was needed originally for Four-plexes on Four-Plex lots. This was discussed. Also discussed was an alleged mix-up on submission of the Final Preliminary to the Council. Joseph Glaisyer inquired as to the reasons for platting the commercial block by block. Richard Williams stated that he thought the Plat came in as residential. The matter of residential - commercial was discussed. Carl Ellsworth of J -U -B Engineers commented that he and Sumner Johnson discussed this project before the meeting. Mr. Fuller had always stated at meetings that the zone was Commercial -Residential. He further stated that there are technical mattes that can be resolved fairly easy. "If you were to approve it, Norman Fuller needs a variance on Block One (1) for length and Block Two (2) and Five (5)." "Sumner wanted to make you aware that he realized the fact that you want Block Ten (10) designated as a park and they have been nothing but headaches for the cities that have them". Erland presented sketch and proposed 3-Plex located fronting E. Carlton Ave. next to the Window Box. 90X72 It, 12 foot City easement. ,Erland stated there are older people interested in the small tri -plea, close to doctors, Post Office, and stores in the downtown area, inexpensive to heat, unit is 520 sq, ft.; one bedroom, kitchen; dining, living room, bath; sliding glass door onto 10x20 patio - per unit. The concept is low maintenance for older people. Erland stated that the rear setback is shy 5 feet. The Building Inspector had indicated the usual setback is 15'and this would be 10'. This 5 foot variance 1 would allow him to meet City Code parking facilities and yard area. Erland stated it would be advantagous to the City as he would have to run a new 4" water line down Carlton, between $1,200.00 to $1,800.00 at his cost. The water pressure on Carlton is very poor now and there would be about four other homes that would have access to that new water main. There would be separate meters and sewer lines. The sewer line would cost about $2,000.00. The sidewalks on that street do not exist, but Erland stated he is willing to put in the sidewalk on his property. Density was discussed. The proposed zoning map indicates this area as high density. There was consideration of the Window Box and the proposed tri-plex becoming one parcel, all area owned by Erland. The ratio for density would be more favorable. Guidelines of the Comprehensive Plan were considered. The Motion was made by Mitchell and seconded by Pipkin that the proposed tri-plex of Bob Erland be approved, contingent on the Window Box property, E. 1st and E. Carlton to be included as one (1) parcel; 4 units total, sidewalks, water and sewer line compliance; and a five (5) foot variance. Motion Carried: All yea. Erland stated that net property would be decided as one parcel. The City's portion would be blacktop, then sidewalk and blacktop for parking. Agenda 2 Cherry Lane Village West Preliminary Plat - located in the Lampe Annexation. Marilyn Olmstead was present, representing J -U -B Engineers for Leavitt-NuPacific. Preliminary Plat was presented for reconsideration. Olmstead displayed map and stated there had been no changes - same number of lots, same density and proposed school site. She reviewed the reason for the Commission tabling the proposal as being the need for a timetable for the second nine holes of the Cherry Lane Golf Course. Olmstead stated that there is no way they can put a number of years on how long it is going to take to sell the required number of lots around the golf, course to put a specific year on coming back in with the second nine holes. Olmstead stated as soon as they design the first phase of 600 lots around the second nine holes, they will put in the second nine holes of the golf course. She stated that before this piece of property can be picked up by the Leavitt- NuPacificg Company, there has to be a Tentative Plat approved.\Tentative Plat approval does not mean they will be coming with the Final Plat next. They will be doing the Tentative Plats as. the options are necessary to be picked up:, Meridian Planning and Zoning .2. April 10, 1978 Mr. Mitchell was concerned about another Plat having to be formed to accomplish this. The Motion was made by Jim Kling and seconded by Burl Pipkin that the Planning and Zoning Commission accept the Settlers Village for the concept of zero lot line Condominiums provided that prior to the time the Preliminary Plat is submitted the City of Meridian has in effect an ordinance providing for the condominium concept and that the preliminary plat conform to this ordinance. Idaho in the Meridian Original Townsite for office space for an attorney. Mr. Glaisyer stated that parking will be provided on a lot to the East which is now a vacant lot. This will be prepared in the near future by black topping. The Motion was made by Annette Hinrichs and seconded by Jim Kling that the Conditional Use Permit be granted to Joseph Glaisyer at the premises of 35 E. Idaho for use as an Attorney Office, contingent to acceptance by the Nampa -Meridian Irrigation District and the paving of the parking lot. Motion passed: All, yea. Mr. Edmon Jones was present to discuss the request for Conditional Use for the premises of 14 E. Carlton in the Nourses 3rd Addition. He presented a parking proposal for the use of the land. The Motion was made by Don Sharp and seconded by Lee Mitchell that the Commission recommend to the City Council that the Conditional Use Permit be granted to the premises of 14 E. Carlton located in the Nourses 3rd Addition for the purpose of permitting office use. Motion passed: All yea. Impact Area matter was discussed. It had been agreed by the Commission to take action on this as a result of the Impact Area Hearing held before the Commission on March 27, 1978 at the American Legion Hall. All present at this hearing offered favorable comment for the acceptance of this impact area. There has been no negative response concerning this area. It was noted that the City needs to have the response from the Planning and Zoning Commission. Mr. Sharp stated that this area should not necessarily be annexed to the City or attempt to provide services in the South East area but it definitely has a strong influence on our immediate arsaof Meridian, and that Meridian needs to have a strong voice in how that area is developed and planned. The Motion was made by Don Sharp and seconded by Burl Pipkin that the Commission recommend to the City Council that the Impact Area as defined in Ordinance #319 as described County line on the West, Highway 20-26 on the North, Cloverdale on the East as far South as the Freeway -Overland area, then including 5 Mile, 8 Mile and 10 Mile Creek drainage but extending no farther East than Cole Road or the New York Canal whichever comes first, then returning West to the County Line in the general vicinity of the Rawson canal be approved.
