AOA COUNTY, IDAHO.
The t4otion was made by Kingsford and seconded by Brewer that Ordinance H346,
be passed with suspension of the rules and provisions of 50-9002 requiring that
Ordinances be read on three different days.

Resolution of the Coooperative Aa reement for construction of Street Light
Intersection of U.S. Highway and Cherry Lane.
It was the feeling that this aggreement should be studied pertaining the
Section 4, that the City agrees maintaining any new or relocating any
existing sanitary or any facilities.
The hiot ion was made by Kingsford and seconded by 6odine that the Resolution
of the Cooperative Agreement with the Idaho Transportation be tabled, contingent
upon the sanitary and water lines be moved, repaired and paid for through the
project costs.
Motion Carried: Bodine, yea; Kingsford, yea; Brewer, yea.
Chief Sherwin presented a proposal parking Ordinance to be studied by Police
Commissioner Bodine and the City Attorney's review.
Vern Schoen reported 221 permits so far this yea.
,. City Engineer Gary Smith submitted a bill from J-U-B Engineers Inc. for
General Engineering from 3-19-79 to 5-25-79, 16 subdivsions and/or consultation
in the amount of 54,700.64.
The Motion was made by Bodine and seconded by Brewer that Engineering bill
from J-U-B in the amount of 54,700.64 be paid.
Motion Carried: Bodine, yea; Kingsford, yea; Brewer, yea.
Smith recommended payment of Pay Estimate #1B, OVY Construction for the period
of 5.25.79 to 6.20.79, 97`.i completion.
The (lotion was made by Kingsford and seconded by Bodine that Pay Estimate @18, DVY
Construction, Waste4la ter Treatment Facility, in the amount of 320,936.86 be paid.

Smith recommended payment of Pay Estimate X12, Galey Construction Co., for period of
5.27.79 to 6.29.79, two (2) items involved; sewer trench repair and pavement
patching in the ano unt of S1 Fi,799.40.
The Motion was made by Oodine and seconded by Kingsford that Pay Estimate N12,
Galey Construction Co., be paid in the amount of 516,799.40.

8 Proposed Sewer Ordinance
Ellsworth stated that he would like to consolidate all the comments he received from
Crookston and Joy. Cononents need to be incorporated.
Storey had no comments
Ellsworth clarified the last paragraph Page 19. Essentially it says anyone that has
sewer available can be charged a monthly user fee. This could cover a vacant home.
The issue is the City is reserving capacity for every Subdivision and all platted land.
If they do not develop we still have to reserve space at the plant.
Williams stated to clarify this issue specify that all platted property to which
public sewer is available. By platting they are reserving space for the Plat.
Ellsworth stated that it should clarify Platted or developed. The issue was discussed

Ellsworth stated that the difference in those Subdivisions is that they supply access
T- to adjacent properties. Lynnwood Circle as an entity by itself is in violation of

The Council discussed the matter.
Ma tzinger clarified their position.
Williams asked Ellsworth what alternatives existed. He stated to accept the Lontept
Plan, request a Preliminary Plat in compliance with the Ordinance on Lynnwood Circle -
provide a Preliminary Plat for the whole area or deny it. His impression of the
previous Council decision was that they wanted a Concept Plan to get Lynnwood Circle
tentatively approved.
Kingsford withdrew his Motion.
Ma tzinger stated that as he read the Ordinances that apply to Platting in Meridian
he felt they were in compliance except for access to adjacent properties, and provided
a development plan in lieu of that access, which they had done. Now they are asking
approval of the Lynnwood Circle Preliminary Plat.
Ma tzinger explained their Concept Plan and inquired how the Council wanted the
development approached on the Multi-family area.
Williams stated that as a Preliminary Plat.
Matz inger inquired if they had approval of the general Concept.
Storey stated there was no apposition to it.
Ma tzinger inquired if they had approval of Lyhnwood Circle.
The procedured step in the process was discussed. ~

they had final approval previously.

Agenda Primrose Subdivision - Request for Vacation of dedicated parcel (not in City)

Tom Lynville was present representing the request. Also present was Frank Marcum,
petitioner. Lynville stated that he is appearing for two reasons: He has been
involved from the beginning and second, it does involve Idaho Lode 50-1306A which
gives the City the power to grant the petition far vacation of this parcel. He
explained why they were appearing before the Council. Mr. Marcum developed and lives
in the Subdivision. This parcel is over one acre and was required by the County
before the Plat could be approved for sewage removal since the Linder Road Development
and City Sewer trunk line. This is no longer required. He wants the ground vacated.
Williams inquired about the reference to the sewer line.

Ellsworth stated that a variance needs to be granted for block length to comply with
the Ordinances. Riso, he was unaware that the Council had approved the Preliminary Plat.
The Ordinance for block length was explained.
Storey inquired if the Preliminary Plat had been before the Council.
Glenn replied it had not, the Ff nal was ready before the Engineering changes were
completed.
Storey stated that it would have to come in the right way.
Ellsworth explained because it has come in piecemeal, the City does not have a full
development plan and it is hard to determine what has been approved.

Commision recommend to the Lity Council the annexation of Davis, as "C" commercial,

Southern right of way, the remainer being "A" residential, and "A" residential
far the Stewart Property, the right of way provided for Gruber Street. adjatent s
to the Morgan property, and built through the Stewart property, extra paving for
acceleration, deacceleration lanes on Fairview, and that the Planning S Zoning
Commission and the City Council have design review of all construction.

2 Five Mile Creek Annezation
Gene Wright was present representing the request of annexation and tentative plat.
Wright stated that there is 10 acres on East Pine Street. He stated that they
have a planned 56 units total, 24 single family, and the remainder being townhouses.
There will be four townhouses per group. Wright stated that thearea. fs immediately
adjacent to 5 Mile Creek, the developers are going to provide a green belt along
5 Mile Creek, and 5 Mile Creek will be fenced for safety.
Jim Tamarelli, one of the developers of the property explained same of the plans
for the development.
Burl Pipkin questioned access to the green belt area.
Wright stated that there will be access from Pine Street, andthat theywould put
gates in to assure access into the green belt area.

this request for annexation considered in conjunction with the similar
request by the owners of the property known as 870 W. Franklin Rd. Since
these properties are contiguous, together their annexation would eliminate
an enclave within the boundaries of the Meridian City limits.
