On September 19 ,1973, I met with your City Engineer, Mr. Sumner Johnson, to discuss this matter. Mr. Johnson's thoughts are to take the traffic from Owen Frost's property across his South property line into Mr. Larson's property and onto a street .running East and West, from Linder Road to the 1/16th line or an extension of N.W. 12th'Street from Meadow View Subdivision. A temporary cul-de-sac could be made at Owen Frost's South property line until Mr. Larson's property was developed. Because of this proposed street arrangement, we request that the access requirement from Owen Frost's property through Block l of Meadow View Subdivision, as required in the minutes of the Plat approval, be deleted. Engineers. Said letter being a very shocking piece of news. To begin with please consider the following fac'ts which we feel certain that you and the City Council are unaware of, that number "one, our company negotiated with Mr. Owen Frost, a licsensed Real Estate Broker, for over two years on the negotiation and purchase of the land then owned by Mr. Owen Froet, which is today known as Meadow View Subdivision number 1. Through these years of negotiation and purchase and including after Mr. Owen Frost revieved his full cash amount which was agreed upon for the sale and purchase has Mr, Owen Frost or our company ever mentioned any lot be given back to Mr. Owen Frost at any price or even free. In fact Mr. Owen Frost called our office herg in Boise, Idaho and asked special consideration towards the purchase of several lots which border on Mr. Owen Frost's remaining property. Mr. Owen Frost specifically <aaked us to sell him one of the 1pts at the rear of the property bordering to his property, and he Owen Frost further asked us to sell him one or.,mo�1113". bordering to his property and fronting on Linder'-Rdad°' and"f'urth`er s aced that he, Owen Frost, wanted to purchase these lots to protect his view and keep his feeling of openness. Our Co, told Owen Frost, which we have every intention of keeping our word, that we would give Mr. Frost first choice to the lots that Mr. Frost specifically asked to buy, but Mr. Frost would have to pay the same price as anyone else.would have to pay. This conversation took place on or about the middle of May 1974. A couple of days letter i, Stan McDonald, went to Mr. Owen Frost's office in Meridian, Idaho, and Mr. Frost and Q further discussed the property owned by my company, which my jampany bought and paid for in cash to Mr. Owen Frost. These costs are presented as requested by the City Council at their special meeting held on September 18, 1973, at the City Hall. Attached for orientation is a set of blue line print drawings showing the location of the oversized water main. The item costs have been established from local suppliers for the valves and tees and from bid documents from local contractors for the piping. The developer would appreciate this item being presented to the City Council at their October meeting. The Idaho statutes governing Plats always refer to or require platting be,done by the owners; for example: Idaho Code 50-1309, requires the owners or owner of the land providing for streets and alleys make a certificate describing correctly the land for such intended use, and to have certificates acknowledged, and also provides this certification shall be endorsed on the plat. The surveyor or engineer is to certify to the correctness of said plat. Idaho Code 63-301 states, " . . and on each subdivision shall be entered the name of the resent owner, " and goes on to state the duties of assessor to update his plat books with changes of ownership. .Idaho Code 50-1301,.subsection 1,_:defines, "Owner: the proprietor of the land (having legal title). These provisions should be construed as requiring the present owner (having lega? title) to plat a subdivision and not someone purchasing land from the owner under contract; as a contract purchaser ordinarily does not have legal title transferred to him until he has paid the contract price and received a deed, unless the owner -seller joins in the platting. Cox City Clerk Meridian City Hall 728 Meridian Street Meridian, Idaho 83642 Dear Herald: Boise, Idaho 83706 October 2, 1974 Re: Amended Plat - Meadow View Subdivision Telephone: (208) 344-7938 Before the final plat of Meadow View was recorded N.A.N., Inc. entered into a partnership agreement with another firm to help finance development of the subdivision. This partnership agreement also involved ownership of the subdivision and therefore reference to the partnership should have been made in the "Certificate of Owners" on the back of the plat. The plat was recorded by N.A.N., Inc. without the Certificate of Owners being changed and at a time later the error was found by the Ada County Assessor's Office. Since the plat had been recorded it was im- possible to retrieve it to make the necessary changes and the assessors office would not accept an affidavit stating the change. In lieu of draft- ing a new plat it was the opinion of the legal department of Ada County that N.A.N., Inc. could prepare a new plat back only on a transparent media. Since the plat front did not change, with the exception of adding the word "Amended" to the plat title, N.A.N., Inc. was able to use the transparency that existed for the front. It was required to precede any reference to the subdivision name with the word "Amended." Since the approval section by the City Council on the plat back was changed by the word "Amended' it is necessary to bring the plat back to the Planning and Zoning Commission and subsequently the City Council for approval of the change. N.A.N., Inc. respectfully requests that this item be placed on the aggenda for the Planning and Zoning Commissions regular meeting to be held on October 21,,1974. N.A.N., Inc. would appreciate this item being heard after the Owen Frost lot access issue. Please advise myself or N.A.N., Inc. if this item can be placed on that aggenda.
