HomeMy WebLinkAboutMeridian Industrial Park Project FileAeridian Planning & Zoning 2 September 1.0,1979 Agenda 2 Ada County Trading Company - S/E Corner of Fairview Avenue and 2 1/2 Street Jim Potter, Edward Brooks proprietor and Harry Hazen, owner, were present representing requested for Conditional Use for a car sales lot. Design plan was presented. Potter outlined compatable use, curb cut and access. The Highway Department has not called for sidewalks. Potter explained the Highway Departments plan for curb cuts. The Commission requested that they negotiate with the Highway Department to eliminate the access near the corner of Fairview and 2 1/2 Street, leaving the access onto Fairview at the East end and on 2 1/2 Street. The Motion was made by Mitchell and seconded by Tewksbury that Ada County Trading Company Conditional Use Permit for a Car Sales Lot be allowed with the condition that the West Fairview access be eliminated and that there be Design Review for City Council. Motion Carried: All yea .1genda B & B Business Park Annexation - West Franklin 3 Brent Barrus and Harold Briscoe were present representing request. Barrus displayed map and explained the first 150 feet off of Franklin would be Commercial the rest, extending to the Railroad, Industrial Sewer available off of Boise Cascade property, water available off of Franklin. Sharp pointed out that the small piece of Stanley property would create an enclave and the City's policy is to not create such an enclave. Barrus stated that the property owner, Keith Stanley, was contacted and his opinion was that when the City wants them in, they will be taken in. Barrus felt that Stanley had no objection to "be taken in". Barrus stated that they need their annexation request approved so that they could better develop and convenience to the City of fire and police protection. There was discussion concerning enclaves. The Motion was made by Orton and seconded by Hinrichs that the B & B Business Park Annexation be approved based on the condition that the Stanley property (created enclave) be produced also for annexation by written committment. Motion Carried: All yea agenda 4 Paul Keene Conditional Use - located at 1123 E. 1st St. Paul Keene was present, requesting a Conditional Use Permit for an Art shop. Keene presented signatures of consent of neighbors, and stated there will not be many patrons at anyone time, some parking off of alley, his living quarters in the back and compatible location. Sign will be unlighted and approximately three feet of driftwood design. The Motion was made by Orton and seconded by Tewksbury that they approve Paul Keene Conditional Use for an Art shop, located at 1123 E. 1st St. Motion Carried: All yea. \genda 5 Meridian Business and Industrial Park Preliminary Plat - located 516 E. Franklin. Al Marsden representing and Wins,t;pn Moore, Industrial Park owner, were present. Marsden displayed Preliminary Plat combination development which includes a Warehouse development, Industrial development, and a Business Park with a bank and restaurant corner. The project is 46 acres, small business in front, large buildings in back, not retail and semi warehouse functions. East Bower access was discussed. Lot 12 shows an easement. Marsden stated that this easement parking area could serve as access for fire protection from E. Bower. f Meridian Planning and Zoning 3 September 10, 1979 Marsden reviewed Recommended Conditions of Approval (on file with these minutes.) Access on Franklin was discussed.' Marsden stated they have complied with Ada County Highway District requirements of an access every 300 feet. Distance of frontage is 2000 feet long. He stated that they want to specify the uses so they are very clear for record, referring to the Recommended Conditions of Approval. lie again stated that the Fire Department's request would be complied with by allowing Lot 12 connection to Bower St. Anticipated first phase project to be' next Spring. Winston Moore stated that they would appreciate to be able to proceed this Fall if weather permits. They have created a high quality Business Industrial Park. They intend to sell parcels with reasonable, but strict covenants; outside storage will be screened, not visible from Franklin. The Motion was made by Orton and seconded by Tewksbury that Meridian Business and Industrial Park Preliminary Plat be approved contingent upon the agreement that they comply with the new ordinances, review of variances of lot lines, access on Franklin be limited, the access paved easement be put through to E. Bower St. for Fire protection, and their Recommended Conditions of Approval be part of the submittal. Motion Carried: All yea. Agenda 6 Mike Anderson and Steve Moore were Present, representing First Church of Christ, seeking advisory. Property in question is located at the Northeast corner of Pine and Locust Grove. Their intention was to build a church, access being from both Locust Grove and Pine. Since purchasing the land, the impact has changed. It was their feeling that this would be better suited for Industrial. Their question was to what use they could solicit this property for resale. It was pointed out by Orton that the Comprehensive Plan does commence that area to Industrial development. ".genda 7 John Ewing - 6-Plex Proposal Idaho and 2nd St. Design map was presented. Ewing felt that design fit lot, trees would be maintained, parking off alley, retired homeowners, and condominium type. Density was discussed. It was the feeling of the Commission that a four-plex would be acceptable to meet building codes and density requirements. It was Ewing's desire to submit his proposal October 9, 1979. Keith Stanley entered the meeting to discuss the Annexation of his property next to B & B Business Park. Stanley stated that he was not in favor of Annexation. The Commission discussed the advantages of Fire and Police protection and the problem it presents in approving B & B Business Park. It was pointed out that creating an enclave was against City Ordinances. Pipkin stated that hook-up fees would be required upon Annexation. Sharp suggested that this problem be worked out between the property owners. igenda 8 Flannary, Oliver and Mrs. Lytle, owners of homes located on the Northeast corner of Cherry Lane and Linder. Flannary stated that the three homes are zoned Residential and this location has become very undesirable because of extreme traffic and noise. He stated that their concern was input for Commercial rezone. It was pointed out by the Commission that the Comprehensive Plan calls for Commercial development on one of the four corners of an intersection. There is already one of those corners zoned Commercial. Limited Office would be the only alternative, when the new Ordinances are adopted. Meridian City Hall .2. July 7, 1980 Mayor Glaisyer called for comments from the public. There were none. The Motion was made by Orton and seconded by Brewer that the Conditional Use for Century 21 Real Estate office be allowed with the provision that all city codes and ordinances are followed and that they agree to fulfill ACHD's request. Motion Carried: Williams, yea, Kingsford, yea, Brewer, yea, Orton, yea. Agenda 3 Bills were; read. The Motion was made by Williams and seconded by Kingsford that the bills be approved. Motion Carried: Williams, yea, Kingsford, yea, Brewer, yea, Orton, yea. Agenda 4 Engineering: Gary Smith reported that Dennis Burton of CH2M Hill had contacted him in regard to Meridian Industrial Park, Winston Moore, the developer, had purchased additional land adjoining the south and desires to develop with the first parcel. Meridian Industrial Park has preliminary plat approval. Smith stated that the street can now be extended on through to Bower, and will probably be required to improve half of Bower St. Smith pr rit�ed the question as to whether Moore has to come back to Planning and Zoning with a new preliminary plat. Attorney Crookston stated that since the boundary is changing, this is the same as starting all over or platting another section. Smith stated that the Final Plat has to be the image of the preliminary, with very minute changes, if any. There was discussion about the water line extension. It was the feeling of the council that Meridian Industrial Park should start over with a new preliminary plat to include the additional parcel, (old sale yard parcel). Smith stated that they (Moore) anticipated starting development this fall. Engineer Smith stated that an amendment had to be made to the crossing of Creason Lateral with the pressure line with the Boise River Outfall line from the Treatment Plant. The Mayor inquired if the public would like the amendment read. There was'no comment. The Motion was made by Williams and seconded by Orton that the mayor be authorized to sign the amended agreement with Nampa -Meridian Irrigation District for the pressure line crossing of Creason lateral. Motion Carried: Williams, yea, Kingsford, yea, Brewer, yea, Orton, yea. Agenda 5 Department reports: Wastewater superintendent, Earl Ward presented two (2) bills that are due and payable. VWR Scientific, Inc. $53.02 and Banner Machine Works Fire Chief Welker reported that on August 1, 1980 the fire department is going to have a Salmon Feed, funds to be used for burn -out victims. He encouraged sale of tickets, $5.00 adults, $3.00 children. Glaisyer and Williams expressed their support at this time as they will be out of town. r - Meridian City Hall September 17, 1979 Meeting called to order by Mayor Joseph Glaisyer at 7:34 P.M. Bob Chapin; Gene Wright. The minutes of the previous meeting were approved as read. Agenda 1 Bill Brewer reported that the sealed bids for a backhoe and pressure sewer cleaner were opened at City Hall on September 13, 1979 at 2:00 P.M. and 2:30 P.M. The Motion was made by Williams and seconded by Kingsford that the backhoe bid from Idaho Tractor, Inc. in the amount of $24,123.00 be accepted. Motion Carried: Brewer, nay; Bodine, yea; Kingsford, yea; Williams, yea. The Motion was made by Kingsford and seconded by Brewer that the bid from Flexible Pipe Company for a pressure sewer cleaner in the amount of $14,388.00, FOB included, be accepted. Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Brewer, yea. Agenda --I 2 Meridian Business Industrial Park Preliminary Plat - located 516 E. Franklin. ' Al Marsden representing and Winston Moore, owner were present. Marsden displayed Preliminary Plat combination development which includes a Warehouse development, Industrial development and a Business Park with a bank and restaurant corner. The project is 46 acres, small business in front, large buildings in back, not retail and semi warehouse functions. Marsden stated their intent is to develop a good design that the City of Meridian can be proud of. Landscaping along Franklin and along the canal area was displayed as creating a good image from Franklin Rd. Marsden stated the first phase will begin this fall, hopefully. The intent of the project is to be developed over several years. They do not know how the lot layout will be at this time,as the warehouse development requires flexibility in sizes. Marsden presented the Mayor and Council Recommended Conditions of Approval (on file with these minutes). He stated that they desire to submit a Final Plat without lots deleted, if Preliminary is approved tonight. They intend to come back in the future, exactly identifying the lot lines where needed. The County has approved this type of flexibility. This is described in Item 3, Development Plan, Recommended Conditions of Approval. Marsden -stated that they are very willing to meet the Fire Chief's requirement of an access paved easement on Lot 12 to Bower St. He stated that the Ada County Highway District requires access every 300 feet on Franklin Rd. It was recom- mended by Planning and Zoning that these access points be limited, but Marsden explained the basis for circulation and the need for the accesses. Larry Leasure, representative of the Business Park stated that the type of marketing is similar to West Park Industrial - total underground utilities, landscaping, clean type industry, warehousing area in back, etc. Pumice Products is to the east, so the Park's larger industry would be in that area. The Mayor questioned if there will be landscaping on the easment to Bower St., Lots 11 and 12, and is there an acceleration on Franklin. Leasure stated that the easment, or access, to Bower is being proposed and agreed to working with the, Fire Department to their satisfaction. The land- scaping was not extensive in this easement area. Lot 13 and Lot 14 needed some type of screen. He stated that they definitely will have covenants at the time they bring in Final Plat. • Meridian City Hall 2 September 17, 1979 Leasure stated that they have been asked by Ada County Highway for a gradual deceleration on Franklin and access to be every 300 feet. The overall frontage of Park is over 2,000 feet, Grant and Williams both stated that the Covenants should be turned in with Preliminary Plat. Bodine statedhe would like to see Covenants. Leasure stated that Covenants are not normally required on Preliminary Plat, Chief Sherwin stated that the accesses in larger quantities prevent traffic backup. Williams stated that we are trying to encourage some type of industrial development and as this is a 47 acre project, is would take some period of time. He was in favor of moving ahead contingent upon receiving the Covenants prior to any development of the property and submission of the Final Plat. .Brewer agreed and stated that after studying access distance on Franklin, had to go along with Preliminary Plat Design. He did not oppose. Ward questioned the access to some of the easements to Lots 6, 7, 14 and 15. Marsden pointed out 18" lone and stated they will maintain these lines. There would be easy access off of a parking lot or something like that. The Motion was made by Williams and seconded by Kingsford that the City Council approve Meridian Business Industrial Park Preliminary Plat contingent upon the submittal of the Covenants prior to Final Plat and emergency vehicle access in the vicinity of Lot 12 to Bower St. Motion Carried: Williams, yea, Bodine, yea; Kingsford, yea; Brewer, yea. Williams requested that copies of the maps be presented to the City Clerk and also for the developer to investigate putting in street lights. Agenda 3 Country Terrace Steve Hosac and Mike Milhollin were present, representing. Mayor Glaisyer requested that Williams report on the meeting that was held Thursday. Williams stated that the meeting was with Steve Hosac; Mike Milhollin; Grant Kingsford; Gary Smith, City Engineer; Sumner Johnson and himself to discuss Country Terrace and Meridian Greens Subdivisions. The Plats were brought out from Country Terrace; the Final Plat of Country Terrace is recorded on the books of the Ada County Recorder's Office shows that there is a street that loops back from what is now a cul-de-sac and continues south for about 300 feet. There was some discussion about the platting of Meridian Greens and what approval had been given for vacating, or not having, a street going from Meridian Greens to Country. Terrace. The records of the City Council minutes do not reflect any approval, in our opinion, of going to a pedestrian right-of-way. He stated that it was the position of the Engineer that the City has required Meridian Greens to have an access back through Country Terrace and that the cul-de-sac was platted as a Temporary cul-de-sac for the continuation through to Meridian Greens. This basically was the City's position as they left the meeting. Kingsford stated that the discussion led to there being a public access easement, right-of-way,or quick claim deed of some fashion,basically a triangle in Country Terrace that would connect up that street. Smith commented that basically this was the outcome. The dedication of that strip of land between Country Terrace, , Country Terrace Way, future extended roadway, and Meridian Greens, that that dedication be accomplished prior to the City signing off on Meridian Greens' Final Plat #1. Hosac stated he had discussed with some of the Country Terrace homeowners, namely Dave Hansen and Bob Chap n and wife, and told them they (Hosac Brothers) had made every effort they could to represent their viewpoint and to bring that viewpoint to the Council. He felt they had every opportunity to express their views and recognize what the Council's decision is all about. Ada County Highway District staff present: Gary Funkhouser, Terry Connell, Dave Zielinski, Chuck Smith, Keith Jacobs, Chuck Wauhob, Rod Cannon, Steve Spickelmier, and Alice Sinsel. Commissioner Winder called the meeting.to order at 7:30 p.m. .CLAIM FOR EXTRA COST - NELSON SAND AND GRAVEL - GEKELER LANE REBUILD - Jim Nelson, Nelson Sand and Gravel Company, stated that his construction crews, while doing the Gekeler Lane Rebuild, encountered a drain pipe which was not listed on the plans for the project. He stated that they damaged approximately 150 feet of that pipe and asked the Commission to consider paying them an additional $2,979.80, because of the cost to repair that pipe. He stated that they were not aware of the pipe and that it should have been listed on the plans. Rod Cannon referred to the contract documents which state that the contractor is responsible for getting the utilities and all existing structures located. He stated that there are manholes in the area and that a.11 the contractor would have to do would be to look in the manholes to see where they go and what they are for and the depth of the drain, etc. The curbs and. all utilities were already in place. Much discussion followed. It was determined that this was a unique problem and that the staff or the contrac- tor had never had a similar problem in the past. Mr. Nelson stated that the pipe i was collapsed before they realized that they had a problem. Mr. Cannon stated that the storm drain system was functioning prior to the construction. Further discussion held concerning the process for drawing the plans for this type of i project. Staff stated that the manholes and drop inlets were visible. After much discussion concerning the problem, Commissioner Winder moved to award Nelson Sand and Gravel $1,500.00 for the increased cost, and that as a matter of policy, directed the staff should go out and field check these types of projects, and make note on the plans if they find anything that is a potential problem. Commissioner Jeppesen seconded. Motion carried. Gary Funkhouser explained that he doesn't want the valley gutter to be used throughout the development because of the safety factor. The interior street is to be private. The final may not be submitted for Highway District certification. Gary Funkhouser said the County is considering not sending the Highway District any plats that have no additional requirements and face on an existing right-of-way. He said we may run into problems if we plan to widen the road and have no opportunity to require right-of-way dedication. Re -Sub of Panama Park - Keith Jacobs said the Highway District may have problems from Lots 7 and 8 on Wright Street and is requiring a single access to serve the two lots. The development will be located on Panama and Brazil Streets. These streets are improved. The Commission agreed with the comments as presented. Meacham Subdivision - The developer has already dedicated the twenty-five feet on Gantz and we will need another twenty-five feet on the other side. Commission felt the requirements as stated are adequate. RESOLUTION NO. 123 - CERTIFYING AD VALOREM TAXES - FISCAL 1978-79 BUDGET - Commissioner Fairbanks moved to approve Resolution No. 123. At one time, you and I discussed the possible need to extend the 10 -inch diameter water line northerly through the cul-de-sac and on to this project's northerly boundary line. Councilman Orton and I discussed this matter and, based on the City of Meridian's policy to construct water lines on an approxi- mate one-half mile grid, it will be necessary to extend this 10 -inch diameter line through the cul-de-sac to this project's northerly boundary. Subsequent development of the property on the north side of the railroad right-of-way will require the water line to be brought across the railroad for continuation to East Pine Avenue. The twenty foot wide easement will be required for placement of the water line. Attached is my revision to a copy of the sketch you previously submitted to me, showing the continuation of the 10 -inch diameter water line and the necessary easement. The remainder of your comments in your most recent letter are in accordance with what we originally discussed. The minutes of the City Council meeting on September 17, 1979, state that the preliminary plat was approved subject to submittal and acceptance, prior to final plat submittal, of an emergency access plan to and through Lot 12 and the protective covenants. In both presentations, Al Marsden stated that the Ada County Highway District requires access every 300 feet on Franklin Road. It is the policy of the Ada County Highway District to minimize the number of access points to a major arterial street such as Franklin Road. In the initial review of the plat by the Ada County Highway District, a design layout was presented which included an excessive number of access points to Franklin and which were too closely spaced. In our critique of the plat we requested some of the access points be deleted and a greater distance be maintained between access points on Franklin Road. The minimum recommended distance between points was quoted at 300 feet. This re- quirement was restated in our written review of the subdivision which was circulated to Meridian Planning and Zoning and Al Marsden on August 31, 1979. The site plan does not show where any of the proposed 23 lots are. If the lots are not shown on the final subdivision plat how can ownership be transferred from one person to another for -building purposes? How can the access and traffic circulation requirements be reviewed properly? 3. It is generally common practice for a site plan to show adjacent land uses within several hundred feet of it. Such a "vicinity map" would give a feeling for the relationship the proposed development has to existing development. No vicinity map was provided so it is difficult to analyze some of the impacts of this development or suggested some modification to the site design that might solve a problem. DONALD L SHARP Chairman Zoning A Planning Your recently submitted final design review set of plans for this project has been reviewed by myself and all City of Meridian Department Heads. One of the sets that you submitted is attached hereto and contains comments in red pencil resulting from this combined review. With the exception of a concern for the location of a section of the 10 inch diameter water main, our comments are of a minor nature. Water Superintendent, Bruce Stuart, became concerned about the probability of a future extension of the 10 inch diameter water line, presently shown extended northerly from Baltic Place, through the property on the north side of the railroad 'right-of-way. After reviewing the City water maps again with Bruce, it was a consensus of opinion that a better chance for a future connection to the north would occur if the 10 inch diameter line was extended as we have shown in red pencil on Bower Street. I have enclosed a sketch to show you what our conditions are on the north side of the railroad right-of-way. Fire Chief Welker is concerned about availability of fire flow to this industrial site via a single line, especially if a pipe failure occurred in that line. For this reason he has requested extension of the 8 inch diameter line from the intersection of Bowef and East 3rd Street to the intersection of Bower and East 5th Avenue. Also, it appears that a sizable amount of land to the south of the Baltic Avenue and Franklin Road intersection could be served by this development's internal 8 inch diameter sewer if the sewer line on Baltic Avenue is extended south to Franklin Road. It has always been the policy of the City of Meridian to request land developers to extend utilities to and through their developments and this is the reason for the request.
