1 am writing you this letter in response to your inquiry in May 200$ and September 2008 regarding code
violations within the Devon Park subdivision. In both May and September, code violations in the
subdivision were located and have been addressed.
in May, Code Enforcement Officer Tom Baker was assigned to evaluate code violations within the Devon
park suhdivision after you and I spoke on the telephone. Violations found were weeds longer than eight
inches, junk/eanstruction debris, and graffiti. Once the property owners/managers were notified of the
violations, the properties came into compliance with Cade within the allotted timeframe.
After your inquiry in September, Officer Baker returned to the property to evaluate for code violations.
Weed violations were found on several properties. Officer Baker has sent letters via registered mail to the
property owners informing them of the weed violations and seeking that the property be in compliance to
the city code.
Meridian Code Enforcement does not document every violation they encounter. If compliance is
obtained the incident might not rise to the level of being formally documented as a code violation. As a
result, large portions of code violations addressed by Code Enforcement Oi~icers are not documented. In
your inquiry, you asked if the code violations found at Devon Park subdivision are typical, and 1. will not
comment to that question because not all violations are documented and no formula. exists to determine
which an.d/or how many code violations in a subdivision would be considered typical. Additionally, I am
unable to provide accurate data on how many times Meridian Code Enforcement has addressed code
violations within the Devon Park subdivision, since that information is not captured in a database.

Thank you for taking the time to help me refine my request to a more readily deliverable product. My
original Public Records Request was made in early May and this email is an extension o~ the previous
conversations we have had. As we discussed, 1 will be satisfied with the following information:

Please provide a statement regarding any known background or history of previous Code Enforcement
Violations on the parcel. I am only aware of the reports of non-code compliance that I have initiated and
would like more information on this issue. I alerted the Meridian Police Department and the developer
to 4 specific code enforcement violations in early May 2008: Standing Water, Weeds, runk & Graffiti
(at least 3 locations behind the Hastings). I did not ask for citations to be issued; rather, T directed the
notification to the Developer so it could be handled as neighbors. At that time, the Developer (Mr.
Tamura) did admit that a contractor had also installed floodlights illuminating several residences (which
is expressly prohibited in the current entitlement) and said that he intended to fix the~nn, but I am
uncertain if this has been fixed. Within the last 3 years I did contact the Meridian Police Department on
another issue: to remove an abandoned vehicle that it was in a "recently destroyed" condition from
Devon Park. At that time, I _did not know if this sort of thing was a trend and disregarded it as a fluke.
Please consider all of the above during your site inspection.
2) Progress Report:
Please send an officer to inspect the site and make a determination as to weather the developer has
successfully followed instructions and acted to bring the property into compliance with Meridian Code.
I had asked Mr. Tamura to take care of these things without taking it to the next level, and now
I'rn requesting an assessment by the Meridian Police Department, Code Enforcement Division. Again, I
am not asking for Citations to be issued -but I leave that coL~rse of action up to the discretion of the
Officer, as is always the case.
3) Professional Opinion:
In respect to the above stated Background and Progress Report of the progress the developer has made
in bringing this parcel back in compliance with Meridian Code. Secondly, would you comment in a
professional capacity as to weather this is a typical amount of issues for a developer ornon-typical
amount of issues for a developer to have? With respect to impartiality, if you can not provide a
comment as to the typicality of these issues, then provide a sentence explaining why that determination
unable to be made?
Again, thank you for taking the time to meet with me last week on these issues and helping me refine
this request to a more relevant discussion. An email response to this message is sufficient.
