HomeMy WebLinkAboutUnion Pacific Railroad for use of Railroad PropertyFolder. 2388-88 Audit; 246048 SUPPLEMENTAL AGREEMENT THIS SUPPLEMENTAL AGREEMENT is entered into on the day of September, 2008, be#ween UNION PACIFIC RAILROAD COMPANY ("Lessor") and THE CITY OF MERIDIAN, an Idaho municipal corporation ("Lessee"}. RECITALS: By instrument dated July 24, 2007, Lessor and Lessee entered into an agreement (the "Basic Agreement") identified as Audit No. 245049, covering the use of railroad property in connection with the construction of a new city hall in Meridian, Idaho. Article 1 of the Basic Agreement provided that the Premises will be used for "a construction material storage yard, and purposes incidental thereto only, and for no other purpose". AGREEMENT: IT iS AGREED between Lessor and Lessee to modify the Basic Agreement as follows: EFFECTIVE DATE. This Supplemental Agreement is effective as of the first date writing herein. 2. AMENDMENT OF ARTICLE 1.OF THE BASIC AGREEMENT. Article 1 shalt be amended to provide for future use of the Premises for public parking in connection with Lessee's City Hall upon completion of construction, including a driveway approach/pedestrian ramp. This future use is depicted in Lessee's engineering drawing marked F_xhibit "C" and aftached hereto. 3. AGREEMENT SUPPLEMENTAL. a) Nothing in this Supplemental Agreement shall be construed as amending or modifying the Basic Agreement unless specifically provided herein. b) Speciftca[ly, nothing contained in Exhibit "C" shall be construed as permitting Lessee to utilize additional properly beyond what is depicted in Exhibit "A" of the Basic Agreemen#. c} Article 5 of the Basic Agreement provides that a fence or barricade shall be constructed in the location shown in Exhibit "A° of the Basic Agreement. This provision of the Basic Agreement is NOT being amended or modified by this Supplemental Agreement. IN WITNESS WHEREOF, Lessor and Lessee have duly executed this Supplemental Agreement as of the date first herein written.
