Amity Boise, Idaho 83705 RE: McDonald's Redbox City Council Review (CZC-08-031 and AP-08-004) Dear Mr. Seamon: The Planning Department approved your Certificate of Zoning Compliance (CZC) for a Redbox DVD rental on the same site as the McDonalds on 3415 W. Cherry Lane, Meridian, Idaho. Because of previous commitments made to the neighbors by the developer and McDonald's owner regarding no 24-hour uses, I requested that the City Council review the CZC approval. On September 9, 2008, Meridian City Council reviewed the McDonald's Redbox CZC. At the hearing City Council heard testimony for Baumgart Construction, the owner of the McDonald's franchise, and adjoining neighbors. Staff also provided testimony regarding a recent change to the Unified Development Code that limits hours of operation from 6 a.m. to 10 p.m. in the C-N zoning district. (The zoning of the subject property.) Given the staff, applicant and public comments, the Council directed me to take action that would only allow the Redbox DVD Rental use within the McDonald's restaurant facility. As such, the hours of operation would coincide with the current hours in effect as of the date of this letter for the approved restaurant. Any change or expansion of hours for the restaurant and therefore the Redbox shall require additional approval from the City. If you choose to locate the Redbox within the existing McDonald's, it will be an accessory use, and it will not require additional planning approvals. Please contact the City of Meridian Building Department at 887-2211 to see what other permits may be necessary. Because CZC-08-031 is no longer valid, I will mark the application as denied and close the file.
