Box 10998 Boise, Idaho 8 3 7 1 9-000 8 May 2, 2003 City of Meridian ~~ ~~~$ T~~ Mayor, City Council and Planning & Zoning Commission J ~/ 33 East Idaho ~aY - 2 2~ Meridian, Idaho 83642 To All Concerned Parties: Oity Of Meridian' City Clerk Office On August 21, 2001, an application was submitted by G & H Enterprises II for a Conditional Use Permit for a second restaurant building with adrive-through on the property located at 677 E. 1st Street in Meridian. The first building on that site has been a KFC building with an approved Conditional Use for adrive-through window. This application received final approval by the Meridian City Council on November 20, 2001, with required recommendations of the Planning and Zoning and Engineering staff, the Nampa and Meridian Irrigation District and the Ada County Highway District. There was no requirement mentioned concerning Building #1 in the approval. This letter is to inform you that we have not abandoned Building #1 on this site. It has been used continuously since D & D Idaho Foods, Inc. stopped using it for a KFC Restaurant on May 6, 2002, In fact, there is electrical power still on in the building and it has been used for restaurant supplies and equipment. We have not made a final decision as to whether or not to remodel the building or to replace it with a new building. That decision is pending with the application by Carl's Jr., to establish a restaurant on that site. Our legal counsel has indicated to us that, as far as they can determine, we can still use Building #1 for a restaurant, including the approved drive-through.
