AN ORDINANCE AMENDING AND CHANGING THE ZONING IN CERTAIN REAL PROPERTY WHICH
IS A PART OF THE SE 1/4 of the SW 1/4 of SECTION 7", IN T. # N., R. 1E., B.M.,'
ADA COUNTY, IDAHO.
The Motion was made by Kingsford and -seconded by Brewer that Ordinance #346,
be passed with suspension of the rules.and provisions of 50-9002 requiring that
Ordinances be read on three different days.
Motion Carried: Williams, yea; Bodine, yea; Kingsford, yea; Brewer, yea.
Resolution of the C000perative Agreement for construction of Street light
Intersection of U.S. Highway and Cherry Lane.
It was the feeling that this aggreement should be studied pertaining the
Section 4, that the City agrees maintaining any new or relocating any
existing sanitary or any facilities.
The Motion was made by Kingsford and seconded by Bodine that the Resolution
of the Cooperative Agreement with the Idaho Transportation be tabled, contingent
r upon the sanitary and water lines be moved, repaired and paid for through the
project costs.
Motion Carried: Bodine, yea; Kingsford, yea; Brewer, yea.

Chief Sherwin presented a proposal parking Ordinance to be studied by Police
Commissioner Bodine and the City Attorney's review.
Vern Schoen reported 221 permits so far this yea.
City Engineer Gary Smith submitted a bill from J -U -B Engineers Inc. for
General Engineering from 3-19-79 to 5--25-79, 18 subdivsions and/or consultation
in the amount of $4,700.64.
The Motion was made by Bodine and seconded by Brewer that Engineering bill
from J -U -B in the amount. of $4,700.64 be paid.
Motion Carried: Bodine, yea; Kingsford, yea; Brewer, yea.
Smith -recommended payment of Pay Estimate #18, DVY Construction for the period
of 5.25.79 to 6.20.79, 97% completion.
The Motion was made by Kingsford and seconded by Bodine that Pay Estimate #18, DVY
Construction, Wastewater Treatment Facility, in the amount of $20,936.86 be paid.
Motion Carried: Bodine, yea; Kingsford, yea; Brewer, yea.
Smith recommended payment of Pay Estimate #12, Galey Construction Co., for period of
5.27.79 to 6.29.79, two (2) items involved; sewer trench repair and pavement
patching in the amount of $16,799.40.
The Motion was made by Bodine and seconded by Kingsford that Pay Estimate #12,
Galey Construction Co., be paid in the amount of $16,799.40.

Milt Denny was present, representing James
Weast,

Rezone request.
Denney explained landscaping, ingress and
egress
off
of Franklin which
is designed to prevent backing onto Franklin. Pueblo Indian food would
be served. They will put 10" water line in if Water Works requires.
Building would be 24,000 to 26,000 square feet.
Williams required assurance in written form that they will provide landscaping.
Brewer suggested landscaping that would not block view when entering Franklin.
The Motion was made by Bodine and seconded by Williams to accept James Weast
Jr. Rezone subject to the 10" water main and landscaping.

Agenda
4 Meridian Greens Unit #1 Final Plat - Located E. Overland.
Steve Hosac, CTM Engineer, represented Norman Fuller and Glen Scott of
Meridian Greens Unit #1 Final Plat.
Williams stated that they had originally talked about a street going
back where Meridian Greens now has a pathway back to Country Terrace,
and that the Country Terrace Plat shows a street connecting there.
Hosac stated that they came before City Council quite some time ago
when they were beginning the design phase with the proposal to eliminate
the connecting street between the projects and replace that with a
pedestrian easement. Hosac stated the City Council approved this at that
time. The N/S street that'gais' along boundary -is now a 60' street and
will be a major collector for this area. It is designed to go all the
way southward to the southern edge of the project which will put it
1/4 of a mile within Victory Rd. He stated that when they originally
received approval on Country Terrace Subdivision, the City Engineer
did require them to show a future road right-of-way for a southerly
extension of that. Hosac stated that was before this plan was being
talked about. Now this street is essentially replacing the need for
that. The Country Terrace Street that they are talking about does not
actually show a connection going through on this plot. It shows a street
that starts at the end of the existing cul-de-sac and curves and goes due
south, all on Countr,L Terrace property. -
Hosac referred to correspondence with Engineer Sumner Johnson.
Williams felt the golf course was very narrow.
Hosac stated the area he was referring to was about 120 feet, another
is 140 feet.
Williams questioned lift station.
Hosac stated that Lots 15 & lb, Block 2 and Lot 45, Block 5 cannot receive
Building permits until Sanitary restrictions are removed. They are not
proposing a lift station.
Williams questioned Fuller's committment to put in Golf Course.
Fuller stated that they told Planning and Zoning they would put it in.
Smith, J -U -B stated he "Thought Sumner's only concern was if the street
was not going to be there, that they proceed with the vacating, which
Hosac stated they were." "If the right-of-way continued to be on the
Plat, it could be extended at some future date, then there could be a
problem with the lots in the S/W corner of the Subdivision:" There would
be a double frontage situation.
Smith questioned the access to the east across Lot 4.
Hosac stated that this is the first phase, "If you go just a short distance
south of this street, that currently terminates, there is a street that
goes eastward at that point. It does not go eastward on this project
because there is a canal that comes right down along where this future
golf course fairway will be." This is what the concept plan indicates.
They will tie eastward to Locust Grove.
Smith stated that the date on the Plat should be changed from 1978 to 1979.

Total acreage is 3.1, Density 6.7 units per acre, 21 units. Sharp
counted 24 units. Square footage would be 860 sq. ft. for the
single units and 600 sq. ft. on the ground floor of the two story units.
The Commission felt these were very small lots. There was only one car
parking minimum and they desired two car off street parking.
Messick stated that these units would be of quality development and one
builder, a complete design all the way through.
The Motion was made by Hinrich that recommendation be made to the City
Council to accept proposal with provisions of water and sewer, that a
garage be provided with two other parking spaces; and an easement for a
possible road continuing East to Pine;.'Recreational easement in their
covenants.
Motion died for lack of a second.
Orton had abstained.
There was discussion. Messick suggested that they drop some lots.
The Motion was made by Hinrich and seconded by Mitchell to table
Arnie Subdivision Preliminary Plat.
Motion Carried: All yea; Orton abstained
Devco - 20 Unit Apartments - Located next to 649 W. Broadway
Dave Wilcox was present representing Devco Design Review.
Wilcox state there would be basically 20 units, three (3) 4-Plexes
and one (1) 8-Plex. Two bedroom units would be 840 sp. ft. They
plan to do an extensive amount of landscaping. He stated that there
Sharp stated that density would be 22.7 units per acre.
The Commission referred to Comprehensive Plan and felt density was
too high. Highest is 15 units per acre.
Traffic was discussed. Wilcox states traffic would use Broadway.
The Motion was made by Orton and seconded by Hinrich that they
recommend denial based upon density criteria.
Motion Carried: All yea
Rezone - Commercial for James Weast Jr.
Weast was present representing himself and stated that his request for
rezone is to build a restaurant to be leased to Otis Denny. There will
be 40 to 50 parking spaces. Vacant lot is 240 feet.
Orton stated that the Comprehensive Plan allows this mixed use.
Parking was discussed. Weast stated traffic in and out will be planned;
access would be limited off of Franklin.
