Cox qty Clerk fiance Officer HJC:11a cc: File Meridian...City Hall genda Meridian Race Track 6 0�0 December 18, 1978 Storey stated -that the situation at the Race Track at the last meeting with them they anticipated doing some work to bring it as near as they can to the building code. He felt in past years they have done a good job. The racers have quite a little invested and he questioned whether they would be asked if the heights of the stands be torn down because if they do it here they will have to do it all over Idaho. He questioned whether this would happen. It's up to the Council if they want to let the Meridian Racing Association race for another year. He staced that he would like to limit it to one more year. He felt they had plenty of insurance for any accident that could happen out there. Bodine stated the stands were not safe and inquired what they were going to do to strengthen them. Del Gould stated that they keep working on them constantly and outlined what they do to keep them up. He stated that they carry a $1,000,000 accident policy. Williams stated the racing group has contributed a lot to the community over the last 25 years. His concern was the significance of granting a variance and the long term plan. They should support the Race Track for an orderly wind down. .Storey stated that one of the problems is $250,000 wrapped up in cars; recommended that this only go on one more year or year to year and they can phase out. He recommended to the Council that they be allowed to race another year. Kingsford moved to go into Executive Session and confer with the City Attorney, seconded by Glaisyer. The Motion passed: Williams, yea; Bodine, yea; Glaisyer, yea; Kingsford, yea. Executive --Session: City liabilities was discussed. City enforcement of Life and Safety to -des was discussed. The Motion was made by Richard Williams and seconded by Joseph Glaisyer to table the Meridian Race Track question until a study can be done by legal counsel. His input to be no later than the January 2, 1979 meeting and possibly sooner. enda 7 Enclaves were considered. The Mayor inquired if anyone present wanted a legal description read. Noone requested a legal description be read. The Mayor called for comment from the public. Mrs. McFadden stated that she did not feel they should be taken in. They have 10 acres there and have had it for 26 years. It has been farmed and there are no plans to develop it and it should not be taken in until they are ready to develop, which should not be in the to distant future. They have their own sewer and well and do not use any City services. Their neighbor farms the land an -d they have another 20 acres that they farm. They were not notified of the annexation. Paul Pack stated that they heard about it through the grape vine. He contacted his father, Mr..Pack, the owner, in Hawaii. They have considered several possible ways to develop it, no decision has been reached. They have owned it 22 years. They have about 15 acres and is under contract to be farmed. Mr. Pack has indicated a willing- ness to cooperate but would like to know the plans, zoning, ect. he Storey stated that he had talked to the owner and/was in opposition to being annexed. Williams inquired if adequate notice had been published as required by statute. Crookston stated that it was published in the Valley News according to statute of the Land Use. Mrs. McFadden stated that their name was published but Packs was not mentioned. Crookston stated that the description that is the enclave is the entire parcel Pack's and McFadden's. V ridian Citv Hall Agenda Enclaves (Cont'd) W December 18, 1978 Glaisyer explained to those concerned why they are being annexed for police and fire consideration, Kingsford also outlined the fire considerations. Pack felt they could sign a release for protection.' It is not like there are buildings all over it, there is not much protection on bare ground. Kingsford stated a wheat fire would take a lot of fire fighting to protect properties down wind. Williams stated to provide more orderly growth and fairness to all, keep cost down, provide services and continuity in planning, it calls for annexation of enclaves within the City limits. There are 8 or 9 parcels that should be within the City limits. They are not telling them they cannot farm the area. Pack inquired if there was a farming zone within the City. Williaas repeated it does not state they cannot farm it. Crookston stated that they still have the right to use the property as they have always used it, it will have Grandfather Rights. Pack inquired if it would be taxed as farm land. Storey stated that he was concerned that the Packs were not notified. Mrs. McFadden inquired if they had to be notified. Storey stated no. The City should notify them and talk it over if they wanted to wait until next Council meeting it was O.K., the taxes made little difference to the City. Pack -inquired if it was difficult to rezone after it was zoned. His father had entertained -several- ideas - as -far .-as .use.... It_.was discussed. Storey stated that they will be zoned "A" Residential. Cherry Lane was discussed. Kingsford stated that the Comprehensive plan would have to be addressed. Williams stated that the Comprehensive Plan did not have a specific zoning for that area, but says there will not be strip commercial.. Storey inquired if they wanted to go ahead tonight or wait until the next Council meeting. Pack and McFadden stated that they would rather wait. Storey stated it will increase the value of the property. Use of the land as farm ground was discussed. Storey stated tabling the request considerations. Kingsford inquired if it would require republication. Crookston addressed republication considerations. It looks like it would have to be republished. Notification of concerned people was discussed. Crookston outlined the problems with notification. Williams outlined those represented at the Planning And Zoning public hearing. Storey inquired from Crookston what he would do. Crookston stated it was within reason,if the Council wanted to wait and go through the process again,to wait on some and go ahead with the others. Storey stated that the others apparently want in anyway. Kingsford stated - or they did not hear about it. Crookston stated that they can attempt to send a notice to everyone, but it is not required by the statute and that is why they did not do it. Sending notices was discussed. Storey stated that he would entertain a motion to table the whole enclave annexation until they are notified. Meridian City Hall Agenda Enclaves (Cont'd) 7 Bodine moved to table the enclave annexation requests. .7. I December 18. 1978 Williams inquired if it would need republication and the expense involved. Cox inquired if they continued the hearing to some other date4it would need republished. Crookston stated that if the concern was notification then the City should mail to as many people as they can and republish. Storey inquired if there was a way to continue the hearing. Crookston stated that he did not feel it was appropriate where they were not the requesting party. Bodine',s Motion died for lack of a second. Williams felt that the City has gone through a lot of effort and consideration for a lot of reasons and did not feel a delay by tabling would change the outcome. Glaisyer apologized for not notifying those concerned. 3enda 8 Proposed Sewer Ordinance Ellsworth stated that he would like to consolidate all the comments he received from Crookston and Joy. Comments need to be incorporated. Storey had no comments. Ellsworth clarified the last paragraph Page 19. Essentially it says anyone that has sewer available can be charged a monthly user fee. This could cover a vacant home. The issue is the City is reserving capacity for every Subdivision and all platted land If they do not develop we still have,to reserve space at the plant. Williams stated to clarify this issue specify that all platted property to which public sewer is available. By platting they are reserving space for the Plat. Ellsworth stated that it should clarify Platted or developed. The issue was discussed.
