the mobile home in which they are now living.

2 Ada County Trading Co. Conditional Use Hearing - Car Sales Lot - located at
225 E. Fairview.
Jim Potter was present, representing Harry Hazen, owner and Ed Brooks, Proprieter.
Potter stated that they had resolved all requirements of the Ada County Highway
District except for.the access onto 2 1/2 St. The plans have been approved by
Ada County Highway District.
There were no objections,
The Motion was made by Williams and seconded by Bodine that the Ada County
Trading Co. Conditional Use be approved based upon the recommendations of
Ada County Highway District.
Motion Carried: Williams, yea; Bodine, yea; Kingsfordt yea; Brewer, yea.
Agenda
3 Buds Broiler transfer of Beer, Wine and Liquor License.
Attorney, Tony Clark was present, representing Merinco, Inc's request to transfer
licenses from Bud Reimer. Clark explained by law, they are required to transfer
the license to the name of lessee. He stated that unfortunately the lessee
turned out not to be a good manager. The request now was for a re -transfer. The
State and County had approved the re -transfer. He introduced the new manager,
Ray Harris. He felt the operation would be a good one for the City.
The Mayor asked for comments from the Council.
Brewer commented it was new to him and needed time.
Bodine stated that he does not want any problems and not in favor at this time,
backing Chief Sherwin's report.
Chief Sherwin reported upon the research of applicants of transfer of licenses.
It was his recommendation, based on his research, that the license not be re-
transfered.
There was much discussion concerning this type of establishment.
Parks stated that the establishment was purchased by Merinco, Inc. - Robert
Keller, in 1977 for $225,000.00; there had been no violation of Liquor Laws
while they operated Bud's Broiler; the Council had approved these same people;
that Bud's Broiler should not be compared with the Alpine Bar in Garden City and
the Hide -away Bar; that it would be extremely unfair to reject the license transfer
back to the previous owners.
Mayor Gla isyer stated that the City's concern is the management and does not
want the strain on the Police Department required of this type of establishment.
Brewer again based his opinion on the City's Chief of Police recommendation.
Bodine was not in favor,
Barbara Keller addressed the Mayor and Council explaining reputation and management
of the Alpine and Hide -away Bars. She attempted to explain circumstances leading
to Chief Sherwin's report. She requested that the Mayor and Council consider her
reputation and the seriousness of obtaining the re -transfer of licenses for Bud's
Broiler.
Attorney Parks stated that they had very little time to prepare and had not
een time to respond to the Chief of Police's
predicted any problems. There had not bF
findings.
The Motion was made by Bodine to deny re -transfer of Beer, Wine and Licquor License F'
of Bud's Broiler.

This letter is to advise you that we are working with the Ada County
Highway Dis-trict to resolve the conflicts between our design and their
recommendations. It appears, from conversations with ACHD Staff, that we
will be able to reach a compatible agreement on all points.
I would also like to assure you that had we been priviledged to a copy of the
Highway District's comments, the matter would have been cared for prior
to the hearing of October 1, 1979. We appreciate your tabling this matter to
allow us time to reach an agreement with ACHD. If there are other comments
from the council that should be considered prior to the October 15, 1979
hearing please advise.

This letter is to request a hearing before the commission on the above
referenced project and to respond to the letter of conditions prepared by
your staff member, Mr. Keith Jacobs, Jr. which was directed to the City
of Meridian.
First, I would like to advise the commission that a copy of the project
plans was transmitted to your office on July 27, 1979. It would appear that
they were not associated with the Cities request for comments received by
you in mid September. Unfortunately we were not priviledged to receive a
copy of your comments prior to our final hearing before the City Council.
This situation has caused our client a considerable delay.
Secondly, I would like to address each of the compliance conditions
stated in your letter of September 24, 1979.
1. Our plan provides for curb, gutter and the matching of pavement in
accordance with ACHD Standard Drawing No. 103. We did not provide
sidewalk since there is no sidewalk being installed on the south side
of Fairview in the current construction project, nor a crosswalk at
E 2 1/2 Street. In our opinion, the presence of sidewalk in this location
would encourage pedestrians to cross Fairview at a very dangerous
location.
2. The present access on E 2 1/2 Street was located to provide storage for
one vehicle between the stop sign at Fairview Avenue and the point of
access, The relocation of this access to the south line of the subject
property would provide an additional vehicle storage unit, but would place the
access adjacent to the property fence, thereby, creating an entrance hazard
and slowing the entrance speed which could increase traffic congestion on
E 2 1/2 Street.
3. The Right of Way on Fairview Avenue is presently 50', as required by the
Idaho Department of Transportation. The referenced dimension of 41. 32 feet
is to the section line - the design centerline being to the north thereof.
4. The access and improvements on Fairview Avenue have been designed by and
are being constructed under contract of the Idaho Department of Transportation.
5. Our original plan provided for a periferal gravel swale draining into a seepage
pit at the N. W. Corner. The Idaho Department of Transportaion has disallowed
this concept and suggested that the property drain into E 2 1/2 Street and in
the drop inlet to be installed at that location. Our plan would still call for the
periferal gravel swale, which would contain the 5 year event of excess run off
generated.
6. Street Plans for the E 1/2 of E 2 1/2 Street are transmitted herewith for your
review and approval. Our original concept interpreted this minimal improve-
ment as an extension of the intersection improvement and detailed accordingly
on our plot plan.
7. The developer is aware of this requirement and concurrs with this condition.
8. The developer is aware of this requirement and will comply prior to commencing
any construction with the right of way.
We appreciate your consideration of our opinion relating to Items 1 through
6 and wish to insure you that it is the developers intent to comply with all the
conditions as they may be reasonably modified through your careful review.

suffer a severe hardship. Commissioner Jeppesen asked how the total project was
completed without someone catching the mistake. Mr. Preston said they did not
know that the curb and gutter was misshapen until the total project was done.
Further discussion followed concerning ways that the project could be done. Gary
Funkhouser presented a diagram of the standard curb and gutter section and also
showing the way it was actually installed. Mr. Funkhouser explained that there is
problems even with the workmanship the way it is installed, and further explained
what could happen if it is left. He said there would be water in the gutter
continually and that he isn't sure that the problems can be taken care of by sealing
the asphalt because of the way the water will be running. He further explained that
there is a possibility of water being introduced as far back as the back of the side-
walk, because there are so many wavey lines back there.
Further discussion followed concerning materials that could bond the concrete and the
asphalt together but there is nothing that would be absolutely sure. Gary Funkhouser
explained that if the required results were not obtained, the asphalt and the concrete
would have to come out and therefore would be more costly.
Commissioner Fairbanks said that the proposal presented in letter form from Mike
Preston, in his opinion, is not acceptable. Further discussion followed concerning
possible solutions to the problem.
Dennis Baker said they do realize that the problem is severe to the Highway District
and everyone involved. He explained that some of the work is acceptable but that if
it has to be torn out it would be about 2/3 of the total job that would have to be
replaced and would put a severe hardship on Straight Line Concrete. He further said
that any consideration that the Commission would make would be very much appreciated,
and he is willing to submit to whatever judgment is made. Further discussion followed
concerning what could be done.
David Evans, Evans Brothers Construction, contracted to purchase all the residential
lots in East Meadow Park, explained that the additional costs will have to be passed
on to the property buyers and felt -that this is another consideration. He said that
if there is any way to avoid the removal of the concrete, it would be helpful to all
concerned. Commissioner Jeppesen said that if the curb and gutter fails in the future
the property owner would have to pay for it at that time also, because the Highway
District wouldn't have the money to do it.
Commissioner Fairbanks suggested that the Commission look at the area again to see
if there is anything that they feel can be done or to turn down the proposal at this
time. Commissioner Silva said he would like to see if Ken Pursley can come up with
something that can be done to meet the standards.
Dennis Baker said he doesn't feel that Straight Line Concrete could stand the added
expense and would fold. Scorch and the other owners of Straight Line Concrete said
they know that the work is not up to standard but they didn't know it wasn't until
the whole job was finished. He said they will stand behind their work but that if they
have to take the concrete out, they are out of business. Commissioner Silva suggested
that they check with an insurance company to see if there is anything they can do for
Straight Line.
Further discussion followed concerning the possibility of sawing the concrete and it
was decided that it would not be practical. Mr. Baker explained that he would like
to have this problem resolved as soon as possible. After further discussion the decision
was deferred until next week. Mr. Baker said the loss of Straight Line Concrete would
be a significant loss to everyone since they are one of the three major concrete
companies laying curb and gutter. Commissioner Silva suggested that the engineers and

Phillippi Plaza Condos - Keith Jacobs presented the plat for review. Proposed develop-
ment to be locate on Phillippi and Franklin. They have been required to retain drain-
age on site.
MERIDIAN CONDITIONAL USE
Ada County Trading Company - Keith Jacobs presented the plans and the requirements
placed on the developer. The developers have not had a chance to incorporate the
requirements into their plat. No decision made concerning this plat.
APPEALS
CU -176-78 - 75 Bed Psychiatric Hospital - Keith Jacobs explained that the developer
is appealing the requirements placed on Allumbaugh and Barrister. The developer
explained that they are not going to be developing to the east, and stated the reasons
for the appeal. Discussion of the area followed. After Mr. Smith assured the Commission
that Barrister Street is a public right-of-way, the Commission agreed that the developer
be required to dedicate right-of-way 30 feet from the center line. The realtor repre-
senting the owners to supply a legal description of the property and Mr. Smith can
prepare the instrument for dedication.
Ustick Village Subdivision - Steve Hosac attended to ask that they not be required to
make a deposit to the Trust Fund until such time as it would be required to install the
curb and pavement. He explained that the development will be built over a long period
of time and they need their money for other things. They are planning to go ahead with
construction prior to recording the plat and do not plan to get a development loan
until next spring. After much discussion, the Commission agreed that the Highway District
does have to have some insurance that the developer will deposit money to the Trust
Fund before the Commission will sign the plat. The Commission said they would be
willing to go along with the developer if he can come up with something that will assure
the Highway District that the money will be put in trust.
USE AGREEMENT ON 14TH & SHORELINE - Chuck Smith explained that in November of 1976,
Fred Smithasked ora license agreement (use agreement) to use a piece of public
right-of-way for landscaping and parking on Shoreline. The Commission agreed at that
time to charge $1.00 per year, which was not paid until recently. Right -of -Way
Division checked to see why all of a sudden the money was received. The holder of
the use agreement had not done what he said he was going to do, there has been no
improvement. Mr. Smith asked for direction from the Commission as to whether or not
to continue the use agreement or to terminate it. Discussion followed. Mr. Smith
was instructed to write a letter and give the holder a certain time to make the
improvements or cancel the use agreement.
ADA COUNTY HIGHWAY DISTRICT RIGHT-OF-WAY MANUAL - Chuck Smith presented the Manual
for the Commissioners to review and explained the reasons for the manual. He said
the manual closely corresponds to the State Right -of -Way Manual. Federal Highway
Administration and State Highway personnel have reviewed the manual, and revisions
have been made accordingly. Commission to consider approval next week.
GLENWOOD DEDICATION OF RIGHT-OF-WAY UNDER CERTAIN CONDITIONS - Chuck Smith presented
the dedication of right-of-way under certain conditions, stating that the developers
are giving the Highway District the right-of-way so the power poles can be moved,
but the Highway District cannot use the right-of-way for public access. Commissioner
Fairbanks moved to accept the right-of-way under certain conditions for the power line
relocation. Commissioner Jeppesen seconded. Motion carried unanimously.

The Ada County Highway District is charged with the responsibility for
maintenance of the public road right-of-way in Ada County Idaho by State
law. As such, the District can not accept sub=,standard streets and or
improvements to a public right-of-way which are sub -standard.
The District would appreciate having the conditional use application which
involves public right-of-way, transmitted to the District prior to the
Planning and Zoning Commission meeting.

about deleting the west approach to the Hazen property bordering
Fairview Avenue. This deletion is very commendable since it will
improve the safety of the highway operation.
It will not be possible for the contractor to relocate the
approach onto East 22 Street since the area is not within the
project limits.

1 Mayor Glaisyer called for representation of Cherry Lane Village Homeowners.
Jack Yoho presented a petition drawn up and signed by 29 of the homeowners.
All homeowners present stood upon the presentation of the petition. Petition
1) The Petition listed conditions that the homeowners felt needed attention:
Lack of care; standing water, and a request for the City to take direct action
to remedy problems. Petition is on file with these minutes.
Greek McDonald presented a petition in behalf of home builders, Roger G. Habig,
Gary Hunemiller, and McDonald Brothers. Petition 2) The Petition requested the
City Council not to renew the present lease unless the leasee will agree to put
up a performance bond naming improvements. Petition is on file with these minutes.

Jim Potter, Ed Brooks and Harry Hazen were present requesting a Conditional
Use for a Car Sales Lot.
Potter stated that they had complied with the Planning and Zoning condition
approval of eliminating a curb cut near the west corner. State Highway had
acknowleged confirmed the access would be closed. The drainage pattern
modification will be made to drain the site onto 2 1/2 St.
Brewer stated that the Conditional Use should be granted only if subject to
Ada County Highway District requirements.
Potter had not seen the letter dated September 24, 1979 from Ada County Highway
District listing requirements. He stated that there is no proposed sidewalk
on the South side of Fairview. The re -design of the access to 2 1/2 St. located
to the South boundary of the parcel could cause more of a traffic congestion
than leaving where it is. He felt

Paul Keene was present and stated the Conditional Use was for a Art/Book Shop
at 1123 E. 1st. St. He stated there would be some art lessons and traffic
would be very similar as the Window Box. Petition has been signed by neighboring

Jim Potter, Edward Brooks proprietor and Harry Hazen, owner, were present representing
requested for Conditional Use for a car sales lot.
Design plan was presented.
Potter outlined compatable use, curb cut and access. The Highway Department has not
called for sidewalks. Potter explained the Highway Departments plan for curb cuts.
The Commission requested that they negotiate with the Highway Department to eliminate
the access near the corner of Fairview and 2 1/2 Street, leaving the access onto
Fairview at the East end and on 2 1/2 Street.
The Motion was made by Mitchell and seconded by Tewksbury that Ada County Trading Company
Conditional Use Permit for a Car Sales Lot be allowed with the condition that the
West Fairview access be eliminated and that there be Design Review for City Council.

Brent Barrus and Harold Briscoe were present representing request.
Barrus displayed map and explained the first 150 feet off of Franklin would be Commercial
the rest, extending to the Railroad, Industrial Sewer available off of Boise Cascade
property, water available off of Franklin.
Sharp pointed out that the small piece of Stanley property would create an enclave and
the City's policy is to not create such an enclave.
Barrus stated that the property owner, Keith Stanley, was contacted and his opinion was
that when the City wants them in, they will be taken in. Barrus felt that Stanley had
no objection to "be taken in".
Barrus stated that they need their annexation request approved so that they could better
develop and convenience to the City of fire and police protection.
There was discussion concerning enclaves.
The Motion was made by Orton and seconded by Hinrichs that the B & B Business Park
Annexation be approved based on the condition that the Stanley property (created enclave)
be pruduced also for annexation by written committment.

4 Paul Keene Conditional Use - located at 1123 E. 1st St.
Paul Keene was present, requesting a Conditional Use Permit for an Art shop.
Keene presented signatures of consent of neighbors, and stated there will not be
many patrons at anyone time, some parking off of alley, his living quarters in the
back and compatible location. Sign will be unlighted and approximately three feet
of driftwood design.
The Motion was made by Orton and seconded by Tewksbury that they approve Paul Keene
Conditional Use for an Art shop, located at 1123 E. 1st St.

Marsden displayed Preliminary Plat combination development which includes a
Warehouse development, Industrial development, and a Business Park with a bank and
restaurant corner. The project is 46 acres, small business in front, large buildings
in back, not retail and semi warehouse functions.
Bower access was discussed. Lot 12 shows an easement. Marsden stated that this
-nt parking area could serve as access for fire protection from E. Bower.

At the October 4, 1979 Ada County Highway District Commissioners meeting,
the Commissioners approved the sidewalk requirement relief, but did re-
quire curb, gutter and patchback pavement, relocate driveway 10' south
of present planned location and a drainage review.
