On behalf of Franklin Services, Inc., the developer for Cherry Lane
Village No. 2, we are requesting that a sewer service be located or constructed
for the above -referenced lots in accordance with the construction drawings for
Cherry Lane Village No. 2 Subdivision. We have been informed by the Meridian
Public Works that the contractor for Lot 1, Block 11, has tried to locate his
service and has not been able to after an extensive search. In addition, the
City is concerned that none of the services on that particular line were
constructed, as the 2x4's and locating wires are not visible. As there is a
house under construction at Lot 1, it is imperative that the sewer installation
be installed within the next week so as to not hinder the construction of that
house.

SUBDIVISIONS - FINAL PLATS
S lvia's Little Subdivision - Developer has secured an easement to make twenty-two
feet available for roadway, which will be a private drive. John Joines presented the
plat and recommended approval. After discussion Commissioner Silva moved to approve
the plat for Sylvia's Little Subdivision and to authorize the Chairman of the Commissia
to sign the plat. Commissioner Fairbanks seconded. Motion carried unanimously.
East Meadow Park - Located off Holcomb Road; John Joines presented the plat and
recommende its approval. Commissioner Fairbanks moved to approve the plat for
East Meadow Park and to authorize the Chairman of the Commission to sign the plat.
Commissioner Silva seconded. Motion carried unanimously.
Cherr Lane Village No. 2 Subdivision - John Joines presented the plat and recommended
approva ommissionerFairbanks moved to approve the plat for Cherry Lane Village
No. 2 Subdivision and to authorize the Chairman of the Commission to sign the plat.
Commissioner Silva seconded. Motion carried unanimously.
UBDIVISIONS - PRELIMINARY PLATS
Sherman Oaks No. 3 - John Joines presented the plat for comments. Proposed development
is off Victory and Maple Grove. Discussion followed concerning the drainage in the
area. Commissioner Fairbanks suggested that the drainage in the area be looked at
very closely before the plat is finally accepted.
Arnie Townhouse - Located in Meridian, north of Pine Street. John Joines explained
the area, and that the Highway District has proposed that there be a private roadway
as discussed. One entrance onto Pine Street has been requested.

Sawtooth Townhouses - Located in Boise between Allumbaugh and McKinney Street, south
of Fairview. John Joines explained the area and that it is on a private street
between Allumbaugh and McKinney Streets. Commissioner Silva asked that the people
on McKinney Street be notified of the proposed development, so if they have some
input it can be heard before the final plat is approved.
Five Mile Estates No. 3 - Located off Victory and Five Mile, west of Five Mile. There
were no changes suggested.
LICENSE AGREEMENT - R. J. Tomlinson has requested permission to construct a fence
across an unopened alley. Alley runs north and south between Nez Perce and Spaulding
Streets and is adjacent to 1822 Abbs Street. He wants to construct a fence at the
southerly end of the unopened alley. It is not currently being used for a foot path
or access to any of the properties. The License Agreement has a reversionary clause
so that if the Highway District ever needs the right-of-way, it comes back to the Highway

This office has reviewed and can approve the final plat of this
subdivision under the following conditions:
1. Water is to be provided from a central supply. The water
supply system must be maintained to State of Idaho
Drinking Water Standards.
2. The interim community sewage system meets with this
office's approval at this time. This system is to be
maintained by the City of Meridian until such time as
central sewer facilities become available.
3. This subdivision must disconnect from the community sewage
system and connect to the central sewer facilities within
60 days after they become operational.
4. No lot size may be reduced without prior approval of the
health authority.

installation of offsite and oversized utilities to the Cherry
Lane and Glennfield Developments, I mentioned the possibility
of initiating a late comers charge to those who would eventually.

Often a City will have the developer prepay normal hook-up
charges to fund for the City's installation of trunk lines,
pressure lines and lift stations to service future property
development. In the case of oversizing lines, cities normally

$40,000 for one mile of 15" oversized sewer line
$30,000 for 1,500 lineal feet of 15" sewer
$160,000 for 27" sewer trunk line down Black Cat Road
$20,000 for a lift station

The above numbers represent monies expended by NuPacific to
date as well as anticipated future costs directly related to extra .I
funds which would not be required in normal. development. It seems`
only fair that other developers and landowners should participate
in these costs as they proceed to develop their land inasmuch as;
these services directly benefit property other than Cherry Lane..'
There are several conventional ways of structuring an ordinance C
to provide for a late comers charge or a rebate program for over-
sizing. I have enclosed three sample agreements structured by
various cities which outline several methods used and wotuLd r�ir..!d u
appreciate your discussion and consideration of this matter with
the Council at your next scheduled meeting on August 7th. After"
you have had an opportunity to review this letter and our propoaal,:~-'.'.
we would like to be placed on your agenda for September 5th to
discuss this matter in more depth.
NuPacific is definitely committed to the Meridian area. We ti

and feel that your cooperation in this matter would greatly help'
our program as well as set a fair precedent for future developer3

At your City Council meeting of June 5, 1978, we respectfully request your
approval of the final plat of Cherry Lane Village No. 2 Subdivision with vari-
ances to the following Section of your Subdivision Ordinance:
Section VI -2. Alleys and Easements - b. Where alleys are not provided ease-
ments of not less than ten (10) feet in width shall be dedicated on each
side of all rear lot lines and five (5) feet on each side lot line....
Lot 12, Block 9; Lot 21, Block 9; Lot 4, Block 11 and Lot 53, Block 5 are
golf course lots, and we request that no easement be required on the subdivision
boundary adjacent to these lots except as shown on the plat being submitted for
your approval. The golf playing area would be unnecessarily bisected by any
such easement.
Section VI -3. Blocks - b. Block length shall not exceed 1000 feet_.
Portions of six blocks are included in the Plat for Cherry Lane Village
No. 2 Subdivision. Five of these six, Blocks 5, 9, 10, 11 and 12, will be in
excess of the 1000 feet required by the Ordinance. These long block lengths
are dictated by the golf course which is included within the development.

Gentlemen:
The following are our comments on the subdivisions which you
submitted to us for our review:
Wiener King Subdivision
The Architect should submit an overall drainage plan for his
complete development before any approval is given. This should
meet Ada County Engineer's requirements as well as those of Nampa
& Meridian Irrigation District.
Hollbrook Subdivision
The Subdivision does not show what changes are going to be made
to the North Slough and does not indicate a drainage plan. The
Developer is not using Nampa & Meridian water for irrigation. Plans
show 5 lots to the acre.
\ Sandalwood Subdivision
Drainage from this subdivision will go directly into the existing
30" storm drain on Edna Street which ends up in the Settlers Canal.
Developer is not using Nampa & Meridian water for irrigation. Plans
show 3 lots to the acre.
Linda Vista East #2
Drainage from this subdivision will go directly into existing 10"
storm drain on Linda Vista Street which ends up in the Settlers Canal.
Developer is not using Nampa & Meridian water for irrigation. Plans

Amended Plat of Cherry Lane Village #1 Subdivision
The easement for irrigation along the north side of Cherry Lane is
not adequate for maintaining the Safford Lateral. The only satisfactory
solution is to have the subdivider pipe this lateral until it turns north,
or give Nampa & Meridian Irrigation District their recorded easement.
" A pipe has been installed in the Safford Lateral under Lauderhill Way.
This pipe has been installed to replace a drop structure. This is very
poor and should not be accepted. An hydraulic jump occurs in the pipe
and will cause both operation problems and a hazard to the children.
Cherry Lane Village #2 Subdivision
The proposed new description for Eight Mile Lateral is not shown
on the plat. This should be shown and a new description furnished to
Nampa & Meridian Irrigation District.
Retention ponds throughout the district appear to me to have very
little value as they are now constructed, with the inlet and outlet
pipe set at the same elevation. This should be changed to have the
outlet above the bottom with an elbow or tee attached.

may or may not be within the corporate city limits, at leastinitially.
