I respect- fully request that this subdivision application be heard at your Planning and Zoning Commission meeting scheduled for October 8, 1979. You will notice the Northeast corner of this plat shows a possible school site. Should the Meridian School District choose to acquire this site, a revised plat showing that area as a school will be submitted at the appropriate time. The dashed lots North of the subdivision boundary are to show how this plat will tie into the collector street system as outlined on the Cherry Lane Village Master Plan. We are requesting the following variances to the Meridian City Subdivision and Building Code Ordinance: 1) Section 9-607:1.d. We request variance to this requirement that local or minor streets must have a right-of-way of 60 feet. A 60 feet right-of-way is very satisfactory for a collector street as required by your subdivision ordinance, however, it is the opinion of the planners and engineers for Cherry Lane Village Subdivision that a 60 feet right-of-way for a local street allows traffic to move to rapidly in a residential area. Along the same line, we request that the minimum width of the roadway for local streets be allowed to be 36 feet back to back of curb rather than face to face of curb. The reason for this request is to keep the asphalt present in a neighbor- hood to a safe, but not excessive amount. 2) Section 9-670:3.b. We respectfully request that block lengths exceed- ing 1,000 feet be allowed for blocks 1, 2,.5 and 9 as shown on the tentative plat. A 60 feet right-of-way is very satisfactory for a collector street as required by your subdivision ordinance, however, it is the opinion of the planners and engineers for Cherry Lane Village Subdivision that a 60 feet right-of-way for a local street allows traffic to move to rapidly in a residential area. Along the same line, we request that the minimum width of the roadway for local streets be allowed to be 36 feet back to back of curb rather than face to face of curb. The reason for this request is to keep the asphalt present in a neighbor- hood to a safe, but not excessive amount. 2) Section 9-670:3.b. We respectfully request that block lengths exceed- ing 1,000 feet be allowed for blocks 1, 2, 5 and 9 as shown on the tentative plat. Pine is an infringement t3' to his property. There are 4 units that the contractor was allowed to build six feet from his property line at the rear of the bui.lding;.the renters in Reeves house are made, as this 4-Plex looks into the kitchen, bedrooms, etc.,, no privacy at all, the lawn is damaged, the builder refuses to put up a fence, they are building a.deck and stairway from the top of the two story 4-Plex and no matter what type of fence,this stairway is looking right into their windows, the lot it only 67 X 105, the wooden fence to the south is not on the property line, but 15 feet back towards the 4-Plex. There is only six feet to the foundation on the south and the east side from the property line. Reeves stated that the outcome has caused considerable damage and felt that the property would be best used for his business rather than a residence. It was not feasible at this time, but he is considering the request for a Conditional Use. Reeves stated that the Building Inspector should have a means of checking the builders compliance of approved plans. Agenda 5 Cherry Lane Village West Preliminary Plat - Lampe Annexation. Gene Wright, J -U -g Engineers, was present, representing Leavitt-NuPacific. This property was annexed July 16`, 1979 as Lampe Annexation. Wright stated that Leavitt desires to exercise his option on this property, but requires approval of the Preliminary Plat. This was denied by Planning and Zoning November 13, 1979. Wright stated that the City's.goals are exactly the same as Mr. Leavitt's, quality development and the second nine holes on the golfcourse. The second nine holes cannot be built until there is a cash flow from the lots sold in #3. He stated that they request the City to allow Mr. Leavitt to do what he does best; to make a successful project out of Cherry Lane Village. If the tentative is approved, Leavitt will exercise his option by December 31, 1979. Wright statedthere is currently a lift station that pumps up and down into Cherry Lane Village #2. This would be abandoned and gravity flow of the west, and move the lift station. There would not be anymore lift stations at least. Leavitt has agreed to put.a domestic well with this phase, school site is provided, two laterals piped in cooperation with Nampa -Meridian Irrigation. Gary Smith commented on length of blocks and streets;should comply with Fire Department. Width of street right-of-way should be 60' for future planning. Lift station is shown at the end of Puma Dr. Wright stated that it will go back up to the existing pressure line and on over to Cherry Lane #2. The flag lots were to avoid access onto Incline Way where there will be quite a bit of traffic coming off Cherry Lane. It is the intent that the Protective Covenants be the same. The school's master site plan shows a school site in this plan. A domestic well would be put in with Cherry Lane #3. Wright stated that they go with the 50 foot right-of-way and a 5 foot right-of-way easement on each side, this allows setting homes a little.closer to the street. The setback is from the 50 foot., not the 60 foot right-of-way. �l The Motion was made by Bodine and seconded by Kingsford that Cherry Lane Village I. 4 West Preliminary Plat #3 be denied. Motion Carried: Bodine, yea, Kingsford, yea, Brewer, yea, Williams, ?U! Wright questioned reason for denial. It was the.feeling of Bodine that this was bringing the last.,piece in and putting it forward. Kingsford stated he basically supports Planning and Zoning's recommendation. Bodine agreed. Williams stated that there will be economic hardships resulting from this denial of Preliminary Plat. He felt the merits of the plat were not considered and thisI was unreasonable. Minutes of the previous meeting were approved as read withthe.amendment to Agenda 2, Cherry Lane Village West; "268 lots and does have a possible school site" strike the word "not". Agenda 1 Bob Erland - Building Input. Erland presented sketch and proposed 3-Plex located fronting E. Carlton Ave. next to the Window Box. 90X72 lt, 12 foot City easement. Erland stated there are older people interested in the small tri-plex, close to doctors, Post Office, and stores in the downtown area, inexpensive to heat, unit is 520 sq. ft.; one bedroom; kitchen; dining.; living room, bath; sliding glass door onto 10x20 patio - per unit. The Oncept is low maintenance for older people. Erland stated that the rear setback is shy 5 feet. The Building Inspector had indicated the usual setback is 15'and this would be 100. This 5 foot variance would allow him to meet City Code parking facilities and yard area. Erland stated it would be advantagous to the City as he would have to run a new 4" water line down Carlton, between $1,200.00 to $1,800.00 at his cost.. -The water pressure on Carlton is very poor now and there would be about four other homes that would have access to that new water main. There would be separate meters and sewer lines. The sewer line would cost about $2,000.00. The sidewalks on that street do not exist, but Erland stated he is willing to put in the sidewalk on his property. Density was discussed. The proposed zoning map indicates this area as high density. There was consideration of the Window Box and the proposed tri-plex becoming one parcel, all area owned by Erland. The ratio for density would be more favorable. Guidelines of the Comprehensive Plan were considered. The Motion was made by Mitchell and seconded by Pipkin that the proposed tri-plex of Bob Erland be approved, contingent on the Window Box property, E. 1st and E. Carlton to be included as one (1) parcel; 4 units total, sidewalks, water and sewer line compliance; and a five (5) foot variance. Motion Carried: All yea. Erland stated that net property would be decided as one parcel. The City's portion would be blacktop, then sidewalk and blacktop for parking. Agenda 2 Cherry Lane Village West Preliminary Plat - located inthe Lampe Annexation. Marilyn Olmstead was present, representing J -U -B Engineers for Leavitt-NuPacific. Preliminary Plat was presented for reconsideration. Olmstead displayed map and stated there had been no changes - same number of lots, same density and proposed school site. She reviewed the reason for the Commission tabling the proposal as being the need for a timetable for the second nine holes of the Cherry Lane Golf Course. Olmstead stated that there is no way they can put a number of years on how long it is going to take to sell the required number of lots around the golf course to put a specific year on coming back in with the second nine holes. Olmstead stated as soon as they design the first phase of 600 lots around the second nine holes, they will put in the second nine holes of the golf course. She stated that before this piece of property can be picked up by the Leavitt- NuPacifice Company, there has to be a Tentative Plat approved.��Tentative Plat approval does not mean they will be coming with the Final Plat next. They will be doing the Tentative Plats as.the options are necessary to be picked up. • Meridian Planning and Zoning .2. November 13, 1979 It was the feeling of the Commission that the City should have assurance that the second nine hole golf course would be completed within a time frame. Orton stressed the importance to the City which is now in the golf course business, with only nine holes and no club house. Olmstead stated if the Preliminary Plat is not approved, Leavitt-NuPacific will not pick up the option and the whole concept of Cherry Lane Village will be changed. Orton discouraged the position of approving the Tentative Plat and then disapproving the Final Plat. Mitchell stated he felt it was not the Commission's problem, but that it was Leavitt's condition. Olmstead stated that if the option is not exercised, then they are changing the complete concept of Cherry Lane Village Master Plan. Annette Hinrichs left the chamber at this time. Sharp stated he had concerns with the golf course, there are too many problems there now, and Leavitt-NuPacific needs to keep with their committment. Olmstead stated they intent to. Sharp stated that if Mr. Leavitt were to agree in writing that there would be no Final Plat submitted on this piece of property (Lampe) nor on any additional phasing in Glennfield Manor until such time as the balance of the Golf Course was in, the Commission would approve so he could pick up this option. Orton stated the City's successful planning in that area pivots heavily around the golf course. He prefers the City's plan go first and Mr. Leavitts,second. Olmstead stated Mr. Leavitt's plan for this Village hinges heavily around the Golf Course as well. They cannot predict what is going to be selling in the economy in the next three years. The houses that are possible to sell, will be the ones that they will design for and allow the builders to buy the lots for. Wherever this happens, money is being reserved for the back nine holes. It's going to take a dollar amount of lot sales, whether it be a large number of lower cost frontend lots or lower number of higher cost lots, they have to have the money to build the back nine holes. The back nine holes are going to be expensive. There was discussion concerning the market, phasing and the expansion of the golf course into the Baxter property. The problem was the matter of priority. The Motion was made by Pipkin that the Cherry Lane Village West Preliminary Plat be approved with the condition that Leavit-NuPacific submit a letter in writing that they will not submit for Final Plat approval. Orton stated definitely,until the priorities are straightened out. Mitchell stated he felt the Commission is in the wrong jurisdictional position. This is related to the City finances versus Leavitt's finances. The talk is not about City Codes, community planning, but whether Leavitt can pick up the option or whether the City gets an additional nine hole golf course. The Comprehensive Plan already covers what we are set here to do. He felt this was before them for the wrong reason. Sharp stated except that the development is part of the planning process for the City and the Commission. Olmstead stated that they are not doing anything but asking for Tentative Platting approval, an attractive plan, and no one even cares about the Tentative Plat, all the Commission wants is second nine holes of the golf course, the first nine was a gift, the second nine holes will be a gift, and you just cannot develop the second nine until there is money and it's only been a, year. Sharp stated the Commission wants to be fair, but what they are looking for is some kind of assurance that Mr. Leavitt is going to be fair. e Meridian Planning and Zoning .3. November 13, 1979 0 Olmstead questioned that before Mr. Leavitt could do anything else, he has to put in the second nine golf course? Sharp stated that was the understanding when that concept was approved. There are still a number of lots now to be sold. He wanted some sort of a good faith commitment and he does not feel the City has it. Orton stated the priority should be put on the second nine holes as was intended when the Commission made these additional Annexations. These Annexations were weighed as to what impact they would have on the golf course. He stated that that is not what the City -As getting. Olmstead stated that is not what is happening at all. Pipkin stated he felt, in several cases, people have come to the Commission and have not been entirely candid and then later down the road, it looks like the Commission has been taken in for being put in such a position. And that's where it is. Olmstead stated that the Developer, Mr. Leavitt, has gone overboard in putting a lot of dollars in a project that belongs to the City, that when all these facts come out, he will deserve an apology. If the Commission wants to hold him to his promises because of not believing his word, she thought he has yet to go back on his word. Sharp stated business is not run on promises. Olmstead stated it is. run on dollars.and cents. Pipkin stated nevertheless, the City wants an agreement that they (City) can abide by. Tewksbury stated that a lot of the emphasis tonight might get lost over the months. He felt it would be better not to give approval of Preliminary Plat, it does not make sense to approve Preliminary Plat with no intention of approving Final Plat. The Developers know what they are doing and what they want to do, and it seems they could take that limit offer and buy that property whether it's approved tonight or not. The Motion that was made previously has died for a lack of a second. Olmstead stated if the Commission denys the Preliminary Plat, it will be they that have changed the Master Plan of Cherry Lane Village, not Mr. Leavitt. Orton stated there should be no reason to change the rest of the submittal, aside from moving a couple of interceptor roads away from the Lampe property: Olmstead stated they have an option to exercise and this will have to be taken to City Council. Pipkin stated he resented the position of their (Leavitt) taking it on to the Council, the Council can approved and they are home free anyway. Sharp stated the Commission's job tonight is not to determine whether Leavitt pick up the option, but if this Preliminary Plat proposal is to the best interest to the City of Meridian. Olmstead stated that means whether the Master Plan that has been approved is to the best interest or the Master Plan that would have to come in next time. Mitchell stated he did not like the Master Plan thrown at them this way. It's putting them on the defensive. Minutes of the previous meeting approved as read. Agenda 1 KBBK Radio Station Hearing for Conditional Use - located at 1114 Meridian St. Dave Williams and Burt H. Oliphant, owner, were present, representing Conditional Use request. Williams explained that the office complex is being used by Ed Jones who has a Conditional Use Permit. The parking lot is paved and adequate for 16 spaces; the staff will be approximately 13 employees, but parking at any one time would be needed for 5 to 8 vehicles.; very little traffic in and out; no huge antennas, approximately 12 feet high; no noise; 35 signatures of neighbors with no objections. Hinrichs asked for comments for hearing. Mitchell asked if there would be a sign. Oliphant described the KBBK letter light - approximately 2 feet each. No flashing lights. The Motion was made by Mitchell and seconded by Tewksbury that KBBK Radio Station, located at 1114 Meridian St be granted a Conditional Use Permit. Motion Carried: All yea. Agenda "- 11 2 - Cherry Lane Village West Preliminary Plat - located in Lampe Annexation. Marilyn Olmstead, J -U -B Engineers Inc., was representing Leavitt -Nu Pacific Co. Olmstead stated that this Tentative Plat fits in with Cherry Lane Village Master Plan - 77.4 acres, density of 3.4 lots per acre; 268 lots and does not have a possible school site, Block 8. The lots are roughly designed if there is not a school site picked up by the School District. If the School District picks this site up, they will resubmit a revised tentative at that time. Olmstead stated they will have a wet line sewer. There is a 18" trunk line that will eventually tie in sewer extension on Ustick. A lift station will be pumping back over to Cherry Lane for this first phase. A thorough design of location of lift station has not been done yet, but approximately Block 11. Orton stated that he could see a conflict with what was presented earlier on Cherry Lane Village development. There was a promise to develop lots and the last nine holes for golf course in a timely manner. Orton questioned if there is a schedule developed to come through with the second nine holes. Olmstead stated that the schedule of the existing nine holes has always been that when we begin the 200 lots around the second nine hole, or first phase 200 lots, the second nine will be constructed. Olmstead stated that Leavitt will stand by his oblication to put in the second nine as soon as the first lots are ready to go in around the second nine. The main reason they are coming today with the Lampe Property Tentative Plat is because the schedule on the way this property has to be picked up, the option has to be exercised this December. The Leavitt -Nu Pacific Company does not pick up options, except in rare occasions, if the Tentative Plat has not been approved. Orton stated that he felt Leavitt could push the second nine back with just this kind of monopoly. In his estimation, it could be as much as seven years. Meridian Planning and Zoning .2. October 9, 1979 Olmstead stated that this proposal now was for economic reasons. It is not even necessary that it be final platted next. Orton pointed out how important it is to ask Mr. Leavitt and Company to produce a schedule for developing the rest of that area in an orderly manner before he comes to the outlying areas. They have changed the concept by bringing this list annexation in first. Orton stated if Mr. Leavitt would commit to a schedule of three years, as far as he was concerned, this issue would be solved. Olmstead stated they have not changed the Concept Plan of Cherry Lane Village. Orton stated the Change is in the timing, they have added -so much new land, Leavitt could push the nine hole back. He felt Leavitt was making the City a second rate municipal golf course. We want a first rate golf course and to culture clientele, it can't be done with nine holes. Olmstead stated Leavitt has promised a first class golf course, but the developer should not be rushed into the second nine holes and would be better to let the economic climate develop to get the additional nine holes. Orton maintained the economic climate can be controlled for a long time out there to low frontend cost projects unless the City put some incentive in this. The City should.have a date committment. Mitchell stated Leavitt's options are not the Planning and Zoning's problem. He felt the Tentative Plat was coming in for the wrong reason. Mitchell was not in favor with the pumping station. r The Motion was made by Orton and seconded by Tewksbury to table Cherry Lane Village West Preliminary Plat until the scheduling and phasing for the second nine holes of the golf course and the lots around that are defined and confirmed commitment from Leavitt -Nu Pacific Company. Motion Carried: Orton, yea; Tewksbury, yea; Mitchell, nom. Marilyn Olmstead requested to be put on the October 15, 1979 City Council agenda. Agenda 3 Marty Igo was present to represent both the LDS Church Conditional Use and the Winston Moore Rezone located in Thomas Annexation, East Overland. Igo stated that the Winston Moore Rezone involved 22 acres north of Overland Rd. and east of Kuna-Meridian Rd. The request was to rezone to General Commercial District to allow retail and service commercial such as motel, office, theatre, restaurant and certain limitations. Igo distributed signed petitions for the LDS Church Conditional Use and Winston Moore's Rezone by homeowners in favor. Upon displaying a map, Igo pointed out the original 10 acre site for the LDS Welfare Service Complex. This was approved by Council, December 18, 1978. The purpose of this request is to ask the City to grant a similar use on a different parcel of land located approximately 208 feet east of the land parcel now owned by the church. All of the property is within the City Limits. This move would allow Winston Moore to request about.22 acres, now Agriculture zone, be rezoned to General Commercial to allow retail and service commercial. Igo stated the plan before them is conceptional as Mr. Moore now has a tenant, the buildings are architectural concept. Moving the LDS complex to the east allows Moore to do a Planned Commercial Development. The development would be compatible to the Church's development. He stated Moore proposed different kinds of businesses that would lend well to the shopping centers of Naha's and Mar -Mon. The access or exits onto Kuna-Meridian Rd. are not planned at this time. Igo pointed out that Moore has limited his request for rezone and specific uses would be brought irl for approval. He had tried.to design according to the new Ordinance. •• Attachment "A" .
