TIME TABLE FOR SUBMISSION:

STATEMENTS OF COMPLIANCE:
1. Streets, curbs, gutters and sidewalks are to be constructed to standards as
required by Ada County Highway District and Meridian Ordinance. Dimensions
will be determined by the City Engineer. All sidewalks will be five (5)
feet in width.
2. Proposed use is in conformance with the City of Meridian Comprehensive Plan.

Cherry Lane Village No. 3 - Preliminary Plat
We have reviewed the information for this project., as was submitted
to the Planning and Zoning Commission by the applicant, and respectfully submit
the following comments thereof for your consideration.
The developer has requested three variances regarding block length,
substandard lot, and zero lot lines (reference developer letter dated Feb. 15,
1979 to the City Council).
GDS:ct
1. Block Lengths - All block lengths are acceptable from a circulation
standpoint, due to the golf course layout, except possibly Block 5.
Was it previously recommended not to allow a variance for Block 5
in Subdivision #l?
2. Substandard Lot - Lot 4, Block 17 - Would it be better, for future
legal description purposes, to combine the property easterly of and
adjacent to Lot 4 with Lot 4 thereby forming one large lot fronting
on Oakmont Drive? This could also alleviate future access problems
for the property. A solution to this substandard lot should be re-
quested prior to platting. Note: Should this concept be applied to
the small contiguous parcels of land along Ten Mile Road so as to
include them as part of the subdivision and assign lot numbers there-
to? It could be possible to write them out of the protective cove-
nants if the restrictions would create hardships on the existing
structures.
3. Zero Lot Line Lots - Should the developer be appraised that the zero
lot line applies to one side only of the lot and that a set back is
required on the other side? This is as opposed to townhouse con-
struction of zero lot line on both sides.

Gentlemen:
On behalf of the Ada County Highway District Comnissioners, the District's
Technical Review Committee approves the plat subject to the following conditions.
1. Provide for street improvements by making a deposit to the District's
Public Right-of-way Trust Fund. The amount to be deposited is described in
enclosed Attachments "A" and "B". The amount is payable prior to submitting
final plat for the District Commissioners' approval.
2. Provide and install street improvements in accordance to the latest
edition of the Ada County Highway District Detail Specifications and Standard
Drawings. Street improvements to install include the following:
a) Provide full improvement of all interior streets to include curb,
gutter, sidewalks, and paving to Ada County Highway District Specifications
and Standards.
b) Provide a temporary turn around at the northern extreme of
Westwood Way.
c) Direct access to Ten Mile Road is restricted for those lots fronting
Ten Mile Road. This is to be delineated on the face of the final plat.
3. Provide the District's Review Officer two (2) complete sets of detailed
street, utility, and drain plans. Include a drainage report, as required by
County Engineer, and payment of fee charged for Preliminary Plan and Profile
.Review. Fee is $2.50 per lot.

If plans are acceptable and approved for construction, you and your engineer
should receive notification within ten working days that the plans are approved
and advise you of the Surety Agreement requirements, amount necessary to bond
for Surety Agreement, and amount required to pay fee charged for District's
quality control testing.
4. Provide for the installation of street signs. The District charges a
fee for the installation of these signs and is payable anytime after concrete
improvements are installed, but prior to the District's acceptance of streets for
continuous public maintenance. Street signs to provide are as follows:

accepted by the Ada County Highway District Commissioners and endorsed by the
District Cmmnissioner Chairman. Regular meetings are held every Thursday. SuL-mit
the plat together with a mylar copy of the plat, front only, (for our perminent
files) to me two working days prior to a regular meeting of the Ada County Highway
District Cora issioners.
6. As of August 18, 1978, all Preliminary Subdivision Plat Reviews are
subject to an Ada County Highway District review fee. Subdivisions having over
one hundred lots are subject to a $150.00 review fee. Make check payable to
the Ada County Highway District.

I am submitting with this letter thirty (30) copies each of the required
documents for submittal of the tentative plat for Cherry Lane Village No. 3. We
request that this subdivision application be heard at your Planning and Zoning
Commission meeting scheduled for March 12, 1979.
NuPacific Company, the Developer.of Cherry Lane Village, is obligated to
either purchase the property included within Phase 3 of this development or drop
their option on April 1, 1979. The final decision on this matter rests with the
Board of Directors of NuPacific Company who are scheduled to meet in the latter
part of March to make the final decision as to whether to proceed with the
purchase of this phase of the Cherry Lane Village project.
Because of the slow housing market, Mr. Leavitt feels it is of utmost
importance to obtain tentative plat approval of this phase of the development
before going before his Board of Directors to obtain their approval for this
purchase.
The City's normal scheduling would place the City Council hearing for this
development on April 2, 1979. We respectfully request the City expedite considera-
tion of this matter and hear the tentative plat before the Meridian City Council
on March 19, 1979. This gives the Council a time period of four and one-half
(4-1/2) weeks between the submittal date and the Council hearing within which
the Council Members and Department Heads will be able to review the tentative
plat.
We will be most happy to cooperate with the City in any possible means by
answering questions, meeting with the City, and/or hand carrying whatever docu-
ments necessary to expedite this matter.
We are requesting the following variances to the Meridian City Subdivision
and Building Code Ordinances:

1. We request variance to Paragraph VI 3.b. of the Subdivision Ordinance
requiring that block length shall not exceed 1,000 feet. We request
this variance for Blocks 5, 11, 12, 13 and 14 of this proposed subdivi-
sion.
2. We request variance to Paragraph VI 4.c. of the Subdivision Ordinance
requiring that double frontage lots be prohibited except in unusual
topography or other conditions. We request this variance for Lots 3
through 6, 8 through 9, and 17 through 18 of Block 14 and Lots 3
through 10, Block 15. These lots will have frontage on an interior
street and will be backing to Ten Mile Road. This is a requirement of
the Ada County Highway District.
3. We request variance to Paragraph VI 4.d. of the Subdivision Ordinance
requiring that all remnants of lots below minimum size be included
within other lots. We would request that the City allow substandard
Lot 4, Block 17 to be platted as shown. An easement will be granted
across this property for the Kent and Mary Barney home, which is an
exception to this subdivision. By platting this as a separate lot, it
will make the possible transfer of this property to Mr. Barney at some
future date more easily accomplished. It is possible that some means
may be discovered to effectively eliminate this substandard lot with-
out compromising the street layout during the final plat preparation.
We would wish however, at this time, to leave this option open as
shown on the tentative plat.
4. We request variance to the building code to allow zero lot line dwell-
ings to be constructed on Lots 20 through 32, Block 11 and Lots 18
through 30, Block 13.
We would greatly appreciate your cooperation in this matter, and stand
ready to answer any questions you might have at any time.

When Cherry Lane Village Subdivision #3 was approved by the City of
Meridian there was a verbal agreement between you and Mayor Grant
Kingsford that you would contribute one hundred dollars a lot as
lots were sold and built on to a expansion fund for the Cherry Lane
Golf Course. According to our records. there have been seventeen
building permits issued for this subdivision.
The City of Meridian would appreciate receiving your remittance in
the amount of $1,400.00 ($1,700.00 less the $300.00 previously
remitted) as per your agreement with Mayor Kingsford.
These funds will be deposited in the Golf Course Expansion Fund.

John Matzinger was representing the request. He outlined the proposal: 98 Units;
40 Townhouses; 53 zero lot lines and 6 single family.
Pipkin inquired if 12th Street would cross the canal. It did not, Matzinger stated y;
the farm house would remain until they grow into it, density was 4.07 gross,6.3 net.
Mitchell felt it looked fuller than the figure ind tated.
Orton clarified the development structure. -r

It was clarified that each unit would have a two car garage. The Units along Franklin k,
were discussed.
Orton inquired if they had contingency plans for residential in their proposed;
commercial zone.
Matzinger stated it could if,need be, work in a residential scheme. It was also
clarified that the commercial request could be increased.
Tewksbury inquired about the ponds. It was clarified they are to meet the drainage
requirements.

situation, Smith recommended a variance but suggested the Council watch the
collector street issue. He has some minor points to be transmitted by letter.
Crookston inquired if the street in Glennfield Manor would run from Cherry Lanetp
Ustick. Wright explained the point. The point was discussed.
Welker stated no mail boxes should be within 20 feet of a hydrant.
soasiger stated that they had one conflict but will correct it.

Ted Hepper requesting an Auto Repair Shop on Cherry Lane.
Hepper was present and stated that he has a lot on Cherry Lane with "C" Commercial
zoning and is asking for a special permit for the repair facility,
He requested Council reaction.
Glaisyer stated that he did not like the location, Kingsford concurred.
OTHER BUSINESS:

in getting a delay on rezoning Valley Storage to M-1.

M-1 Zone.

as duplex townhouses with zero ,jot lines, Schoen stated to Wright that he did not
have any problems if there was 12 feet between buildings,
Wright requested acceptance from the Council.
Glaisyer inquired if they had two car garages,
Wright explained that they *Ave a problem on some cu1desac because of narrow frontage, '
Storey stated that cars would be on the street.
Wright explained they may be forced back to single family buildings.
Storey stated that he could not go with 4 one car garage. Kingsford concurred.

roperty. safer than standing empty. The City needs to use common sense, probably
0% of the businesses do not meet Codes but they are Grandfathered.
Crookston stated that the situation is that they are remodeling and there are curtain
requirements that must be met to remodel. If they would not have remodeled they
would have grandfather rights.when they started the process they must bring the
building up to Code.
