That Chapter 41, Title 39, Idaho Code, be, and the same is 9 hereby amended by the addition thereto of a NEW SECTION, to be known and 10 designated as Section 39-4116A, Idaho Code, and to read as follows: 11 39-4116A. FIRE SPRINKLER SYSTEMS. Notwithstanding any other provisions 12 of law, no state agency nor any district health department shall mandate 13 requirements over and above those required in the uniform building code, 14 1979 edition with the 1980 supplement and the national fire protection 15 association pamphlet number 13-1978, or later editions as they shall be 16 adopted by the department, whichever is the most stringent for fire sprin- 17 kler systems. 18 SECTION 2. DATE: May 5, 1981 SUBJECT: Smith's Food King - Fire Sprinkler Backflow Prevention Device I am in receipt of a copy of a letter from Green Acre Properties, Inc., with copies of Health Department letters to Mayor Glaisyer concerning recent Idaho State Legislative action for requirements of installation of backflow prevention devices on fire sprinkler systems. My comments to this letter are as follows: 1. The requirements (laws and ordinances) formulated by the State and Federal government under which we operate as a City Government and as individuals are, in my opinion, minimum requirements, generally speaking. I believe it is now, and has been in the past, the peroga- tive of a City Government to be more restrictive in its operation than required by the State or Federal laws. This may especial~y be true in the health and welfare of its citizenry. 2. Mr. Grossaint's statement in this first paragraph of this letter "..... the cross connection controls that the City of Meridian requested us to install at the Smith's Food King location, because of the letter from Health and Welfare dated November 28, 1980," is ' not totally correct. We were, of course, looking for some assistance from the State in requiring the installation of the backflow preven- tion device. However, Mayor Glaisyer's letter to Mr. Grossaint dated December 30, 1980, states in the second paragraph that "It was the Council's decision at this meeting to reiterate its previous position even though the State Health Department had not yet formally made the backflow prevention device a requirement.11 3. As you know, shortly after Mr. Grossaint's receipt of the December 30, 1980 letter, the fire sprinkler system was flushed by him. and the .flow was conditionally reactivated by the City until the backflow device was installed or January 31, 1981 whichever came first. Prior to flushing of thre system, Bruce Stuart took a sample of water from the lines and according to Bruce it had the same odor character- istics as the water samples taken in the area during July and August of 1980. Mr. Grossaint did not comply with the City's requirement to install the backflow device and shortly after January 31, 1981 the City service to the sprinkler system was turned off by Bruce. Honorable Mayor & Council -2- May 5, 1981 4. Conclusion. (a) It is the responsibility of the City to provide clean fresh drinking water to its citizens. (b) Perhaps flow from hydrants in the area should be checked for odors to reinforce that this is the source. (c) The liability of the City for disconnecting flow to the sprinkler system of the Smith's Food King must be estab- lished. (d) At the very least, if the rea~_rement.of the backflow prevention device is rescinded, a documented program of sprinkler system flushing must be implemented. This is a difficult situation, however, it should be settled as soon as possible so that the events of July and August, 1980 do not reoccur. Please advise me of your decision. This letter was ir~ accordance with the City of Meridian's request by letter to Mr. Stokes dated December 11, 1979. Our City Engineer, Mr. Gary Smith, received your F~bruary 8 proposal and responded on February 29, 1980, with an acceptance of yqur proposed device and installation procedure. It was noted in Mr. Stokes' letter that if this proposal was acceptable to the City the installation-would be~~ completed by May 1, 1980. Since the February correspondence other letters have been written and telephone calls made regarding the appropriateness of th'e double check valve assembly requirement but no installation has been made. Recently you have been in contact with our City Engineer with information co:~cerning requirements of the Backflow prevention device for a fire sprinkler system. Mr. Smith met with this Council prior to the regularly scheduled De~ember 15, 1980 Council Meeting and outlined the chronology of events on this matter as well as the information that you had provided. Also, the State He~lth Department's letter dated December 1, 1980, concerning their "no decision ye " on Backflow requirements for fire sprinkler systems was discussed. It wa the Council's decision at this meeting to reiterate its previous position ev~n though the State Health Department had not yet formally made the Backflow prevention device a requirement. Since that time the City of Meridian has received a letter dated December 18, 1~'~0, from the State of Idaho Department of~Health and Welfare, Bureau of Water Quality, concerning Backflow prevention requirements for fire sprinkler systems. Mr. Murrey states in this letter that "On ATovember 28, 1980 Mr. Milton Klein determined that cross-connection control be required £or fire sprinkler systems." The contents of this letter hav~ie been discussed with the Councilman in charge of the City's Waterworks (Walter Commissioner Orton) and it is felt that an unsafe situation for this community's water system will exist if the double check valve assembly (DCVA) is dot installed as previously requested by this Council. ~, r ~ . Murrey, Chief Bureau of Water Quality SUBJECT: Cross Connection Control for Fire Protection Sprinkling Systems There has been a great deal of misunderstanding over the Department's require- ments for cross connection control for fire sprinkling systems. The purpose of this notice is to inform you of the Department's current position on cross connection control for these systems. The Idaho Regulations For Public Drinking Water Systems (November, 1977) do not require cross connection control for fire sprinkling systems. Section 1-8306.03(1) of these regulations allows the Director or supplier of water to specify other facilities for cross connection control. Apparently some cities believe the Department is requiring "double check valves" for cross connection control for fire systems. However, this is not the case. The Director has not yet determined that cross connection control be required for these systems. The Water Quality Bureau (WQB) has been studying the need for cross connection control for fire protection systems. If the Director determines that cross connection control is required, the WQB will determine the minimum backflow protection required and so inform you. That on c~ctober 22, 1980, Tlayor Glaisyer forwarded a letter to tir. Grossaint, a copy of which is attached hereto as Exhibit "E" and by this reference incorporated herein as if set forth in full; that said letter stated the City would not turn on the water until the backflow prevention device was installed; 15. Smith stated "We have two lagoons at the Meridian Golf Course. The first is the largest lagoon and the irrigation water comes directly into it and then it overflows this dike that was constructed last year to contain irrigation water that was to be supplied by the well that is there, to be used during the times that the irrigation season water is not in the ditch, They experienced .some problems last year because as the large lagoon filled and it ran over the small dike, or the dike that creates the small lagoon,which is set at a lower elevation than the maximum water surface in the larger lagoon, eventually washed about a foot out of that dike.. It was left as it was and functioned all right throughout the irrigation season with the understanding that once the water went out and it dried up they would come back in and repair that (J-U-B Enginners~.
