The subdivision as presented in preliminary, shows lots 1 through 19 having access to/dependent upon access to Calderwood Street, which is an extension of a street in the Meridian Greens Subdivision, which has not been final platted/constructed. Because of the lack of access to a public thorough -fare, we recommend approval of the design as presented be deferred. 2. The preliminary plat shows what we assume to be an altermate street design which links Country Terrace Way through a connector street within the subdivision bounds, to Calderwood Street. This latter design is an acceptabled one. It is assumed that with construction completion in Meridian Greens the streets could be re -aligned and lots 19 and 20 would became useable. Leasure stated that Covenants are not normally required on Preliminary Plat, Chief Sherwin stated that the accesses in larger quantities prevent traffic backup. Williams stated that we are trying to encourage some type of industrial development and as this is a 47 acre project, is would take some period of time. Agenda 3 Country Terrace Steve Hosac and Mike Milhollin were present, representing. Mayor Glaisyer requested that Williams report on the meeting that was held Thursday. Williams stated that the meeting was with Steve Hosac; Mike Milhollin; Grant Kingsford; Gary Smith, City Engineer; Sumner Johnson and himself to discuss Country Terrace and Meridian Greens Subdivisions. The Plats were brought out from Country Terrace; the Final Plat of Country Terrace is recorded on the books of the Ada County Recorder's Office shows that there is a street that loops back from what is now a cul-de-sac and continues south for about 300 feet. There was some discussion about the platting of Meridian Greens and what approval had been given for vacating, or not having, a street going from Meridian Greens to Country Terrace. The records of the City Council minutes do not reflect any approval, in our opinion, of going to a pedestrian right-of-way. He stated that it was the position of the Engineer that the City has required Meridian Greens to have an access back through Country Terrace and that the cul-de-sac was platted as a Temporary cul-de-sac for the continuation through to Meridian Greens. This basically was the City's position as they left the meeting. Kingsford stated that the discussion led to there being a public access easement, right-of-way,or quick claim deed of some fashion,basically a triangle in Country Terrace that would connect up that street. Smith commented that basically this was the outcome. The dedication of that strip of land between Country Terrace, , Country Terrace Way, future extended roadway, and Meridian Greens, that that dedication be accomplished prior to the City signing off on Meridian Greens' Final Plat #1. Hosac stated he had discussed with some of the Country Terrace homeowners, namely Dave Hans6n and Bob Chap n and wife, and told them they (Hosac Brothers) had made every effort they could to represent their viewpoint and to bring that viewpoint to the Council. He felt they had every opportunity to express.their views and recognize what the Council's decision is all about. He stated he had recommended to the homeowners that they make the best of decision and live with it and that Meridian City Hall .3. September 17, 1979 although it was not what they wanted (street extension), that there would be some benefits derrived. One benefit was that Country Terrace residents would have direct access to Golf Course. He felt this would be the strong point. Hosac apologized to the Mayor and Council for the emotions displayed at the previous meeting. He again stated they would try and live with the situation and they are going to dedicate, ore provide and easement to the City, of a "triangle shapd'piece of property and they are working on that right now. Williams related to where the intersection would come into the main street of Meridian Greens. Fie stated that is was highly acceptable that the intersection be moved north to make a "T" intersection, but would be Hosac's decision. This may alleviate some of the traffic that would come through. The Mayor called for comments from Country Terrace Homeowners. Mr. Eggleston questioned the depth of a cul-de-sac in the City of Meridian. Smith stated he believed 450 feet. Hosac stated the Country Terrace cul-de-sac is approximately 250 to 300 feet. Eggleston questioned the depth of Meridian Business and Industrial Park cul-de-sac. The Mayor answered the question Eggleston was eluding to by stated when Meridian Business Park comes to the Council for Final Plat they will request a variance and a common variance is a 1000 foot length block which is commonly done. When the Engineers have the basic facts, they will at the time, request a variance. Smith stated that the Meridian Business and Industrial Park cul-de-sac is approximately 360 feet. Williams pointed out that there was not lot approval and the Fire Department's request of access off of Bower in Meridian Business and Industrial Park, the street may not be a cul-de-sac when it is finally approved. Mrs. Eggleston questioned how the Fire Department or emergency calls come through. Welker stated the calls come by radio dispatch from Boise. Eggleston stated she had talked to a Boise Paramedic and found out that with the new section maps it is not often they miss a street in responding for emergency. Welker stated that the section map could cover half of Country Terrace and half of Meridian Greens. The size of the Meridian Fire District cover 64 square miles. Williams stated the largest rural Fire District in the State of Idaho in an urban area. Jeanne Eggleston maintained that Country Terrace is not likely to ever have the problems of being located in emergency. Bodine stated that there are other people that service the area from Boise who are definitely not familiar, pointing out that the volunteer QRU people also come and go. Eggleston expressed concern of safety of children and stated that their home was purchased to avoid such a through street. The Mayor expressed appreciation to the Country Terrace Homeowners for their concern. He stated he felt the Council had acted with great consideration in making their decision, and are doing a service to the emergency people. When there is a life on the line, he as Mayor must stand by his conviction that this street must go through. Kingsford commented that the emergency vehicles were not the only consideration. City Ordinance requires that the property not be landlocked and that was the original -contention. The City Attorney advised that there must be access to adjacent property and it is necessary the City live with it. It was the advise of Attorney Crookston that proceedings should be started for the legal vacation by Hosac. Agenda 4 Country Terrace Annexation #2 Hosac representing Hosac Brothers. This parcel lies below the rim of Country Terrace #1 - approximately 6.3 acres. Hosac stated that Meridian. Greens will be ready to go and if Country Terrace #2 could be annexed it would solve platting problem. They would like to go ahead and get the area platted with sanitary restrictions on the plat so they would not develop until the sewer is there. Hosac stated that the Country Terrace #1 residents desire annexation when the services are available. He again requested Country Terrace #2 Annexation. Mayor Glaisyer commented that Annexation #2 would then create an enclave. Williams stated that the Council has held off on residential annexations and that he could understand Hosac`s point, the vacation process is go8ng to take the same amount of time as the platting process. His concern was of the well lot. As this area grows there will be a need of another well, larger than the one now there. Kingsford agreed on the well lot`and commented that the flat area must not become a weekd patch. Hosac stated that the well was not located to the best advantage, they have no problem with a new well drilled and used by the City. A site in Meridian Greens where the main water line would come out would be better. What they intended to do with the existing well lot is to eliminate, when the services are there, entirely and make that part of two lots. That could only happen when services_ are there. The easement would be eliminated when the well no longer necessary. Annexation request involvement was discussed. Any land that Hosac Brothers do not own cannot be considered unless the people request annexation. The Publication was for Country Terrace Subdivision as a whole (#1 and #2). Agenda 2 Country Terrace Homeowners Mayor Glaisyer stated that there was nothing to discuss as far as the City was concerned, referring to the petition presented by the homeowners opposing Annexation. The City Council has no authority whatsoever if the homeowners do no want to the annexed. David Hansen representing Country Terrace homeowners stated that they were here protesting Country Terrace stay being made a through street. Hansen stated they felt the reasons for this through! street were basically unfounded and not in their best interests. Glaisyer again stated that if in future when they desire Annexation, this problem will be discussed. Hansen stated that perhaps the petition submitted has been misinterrupted. "We are not opposed to Annexation, we are opposed to Annexation if the services are not available, and paying the $1,000.00 and service fee two or three years prior to use of services. once the services are there, we would have no objection to Annexation." Hansen questioned if and when Meridian Greens is approved and goes ahead, would Country Terrace Way be extended. Hansen stated that they feel itis not fair to have the street pushed through and that the lots were sold in Country Terrace with the understanding it was a Closed Subdivision. September 4, 1979 Gary Smith, City Engineer,stated that Meridian Greens was approved, subject to access being made from Country Terrace to Meridian Greens, or that street continuing on through. • Hosac stated,"that is correct. The whole problem has arisen as the result of coming before the City Council and having that modified from a street connection to a pedestrian easement and my understanding that we were given approval of a 20 foot wide pedestrian access in lieu of the street. The City Council has no record of my impression of approval." Mayor Glaisyer stated that the City Council is right in staying with a through street and not a pedestrian path. Willaims stated that he had researched minutes of the last two years and he could not recall any discussion regarding the approval of a pedestrian path. Smith stated that when he and Sumner looked at the two plats, one above the other, the platted street of Country Terrace #1, that is to continue to the South, and shown as Country Terrace Way, could create a through street situation from property to the South of Country Terrace #1; as opposed to connecting Country Terrace with a turning street at the point of the cul -'de -sac into and through the first block of Meridian Greens. Smith stated this item for consideration. The Mayor stated,then actually there would be more traffic flow with Country Terrace going South than going back East. Smith felt that the turn could be moved to the South, far enough and the street could'be turned to the East and not endanger a lot that has been built upon. Hosac stated that,"J-U-B designed. Preliminary Plan of Country Terrace and that design showed street layout as now built." He stated that design did not show any future street layout and that Plat was approved (Preliminary) by Planning and Zoning and City Council at the time (not this Council). They proceded to design this project and brought it in for final approvals. Hosac stated that,"when they went to Sumner Johnson for final approval on that plat, Johnson questioned a future extension of this street. Our answer was that it was not on the Preliminary Map and there has never been anything said about it. Hosac stated Johnson replied, "he didn't care that it hadn't been on the Preliminary Map, and he didn't care if it had been approved by both Planning and Zoning and City Council without an extension, but if they were going to get his signature on this plat they were going to show a street to the South, whether they liked it or not." Hosac stated,"we gave in to Sumner and agreed to show the future street extension to the South, figuring in my own mind that it would never be built. We pint the street on -there because he (Sumner) made them do it. We could have gone to an Attorney and gone back and said this wasn't on the Preliminary that was approved, you have no right to do this, but to get the plat recorded, we added the street to the South,- that was before Meridian Greens designs were being done. Then Meridian Greens came along having a major collector street,10 feet wider than any street.existing in Country Terrace, that goes straight South within 100 feet of this Easterly boundary (Country Terrace boundary) it's a 60' right-of-way, no turns, curves or anything on it. The only reason that Sumner illegally required us to extend this, was his desire to see a connection of this Subdivision to furthur project South and his point was well taken, it's good design to do that. However, it was a requirement he personally placed upon us that he had no right to do, If I had stood my ground at the time, we would all be a lot better off today on this situation as far as I am concerned. Nevertheless, when the Meridian Greens design was done, it provided a major collector street running 100 feet from this boundary, barely 220 feet from nearest street, and it goes all the way,.three times as far in depth, all the way South to Victory. We did show a street connection between the two projects on the original Preliminary Plat. After further going into the design, it became apparent that the street connection was not needed, the people that lived in,project did not desire the connecting street, so we came back to the Council: on July 17, 1978, which I remember very well, as well as Carl Ellsworth, bringing Meridian Greens Preliminary Map which had been approved. We asked the Council I if we could delete the full street connection and replace with a 20!,foot wide. pedestrian easement. I left that meeting with the impression that we were given Council approval for that change. No one seems to feel. we were given this approval. Smith also stated that in Sumner's January 15, 1979 letter there is no mention of vacation, only mention that Country Terrace Way would create a double frontage situation. Agenda 1 Country Terrace Homeowners were present and presented two (2) petitions (on file with these minutes.) Homeowner, David HanseA presented Petition 1; Opposition of paying the hookup fee on water and sewer prior to having services available and Petition 2; Opposition to making Country Terrace Way a through street. Hansen stated that all of the residents had the understanding when they moved there it was going to be a closed subdivision and that there would be very limited traffic. Hansen, in behalf of the Country Terrace, asked that the Commission seriously consider the two petitions presented. Agenda 2 Country Terrace Annexation - Located Overland and Kuna-Meridian Rd. Steve Hosac, Hosac Brothers, was present, representing Country Terrace Annexation. Hosac displayed maps laying out Meridian Greens Annexation and Country Terrace Subdivision proposed Annexation. He opened his presentation by stating that Hosac Brothers are in sympathy with the Country Terrace homeowners and support their viewpoint on this matter. Hosac pointed out the existing clu-de-sac in Country Terrace. He explained that some time ago it was required that Meridian Greens connect to Country Terrace by a street. This was based upon an original concept plan they had done for Meridian Greens. Since that time Country Terrace was developed with the existing cul-de-sac. He stated that they had come back to Planning and Zoning and City Council and proposed an alternate to the street connection. That alternate consisted of a 20 foot pedestrian walkway that came from the head of the cul-de-sac and down through between two lots and connected to the street in Meridian Greens. This was to be access from Country Terrace to the Golf Course. Hosac maintained this proposal was brought into the City Council, but their mistake was that this was not brought forward on the formal agenda and that the approval was not recorded in the City Minutes. He stated that based on the supposed approval, the Engineers went ahead with the Final Plat of Meridian Greens with the 20 foot pedestrian easement and had told the people buying and building homes in Country Terrace that the projects would be connected by this easement. They had resurveyed, recomputed where the boundary would be and built a home on the lot which was part of the previous connecting street proposal. (Lot 1, Block 3 of Country Terrace.) Hosac again maintained that they thought what they were doing had been approved. When Hosac Brothers brought in this proposal for final plat. The City took the position that the pedestrian proposal was not approved and wanted the street connected. There were meetings with the Mayor and Engineers and the outcome was that before final approval, the street must connect. Hosac stated that a meeting with Country Terrace Homeowners Association was held. The best solution they arrived at was to submit a Preliminary Plat of the flat area below Country Terrace now developed that was not intended to be brought in for some time, and in doing so they would essentially be replatting the small segment of Country Terrace including the end of the cul-de-sac. It was the response of the Mayor and the City Engineer that the lower plat,proposed to solve the street problem, would • Meridian Planning and Zoning .2. August 13, 1979 not be annexed unless all of the existing Country Terrace Subdivision was annexed. If this is done,the existing homes would be required to pay the sewer and water hookup fees, which the residents are opposing until the services are available. Sharp questioned and stated the fact that the City has made those services available and that the City is not at fault. Hosac stated, not economically so. Sharp pointed out again that this was not the City's problem that it hadn't been done because there are two different accesses to the sewer and that the City approved the Thomas property so the City would annex Meridian Greens; and yet nothing has happened out there. Sharp stated that the Shopping Center would bring the service up to that point. Hosac stated that when the Shopping Center is done, it is likely the service will go all the way over to Meridian Greens. Hosac stated he presumed the homeowners in Country Terrace would not resist Annexation if they did not have to pay hookup fees until service was available. Hansen stated there are two homeowners who oppose annexation at anytime, but majority realize it will come and accept that fact. Sharp inquired why Hosac wanted Annexation. Hosac explained the lot that the connecting street was to go across now has a home (Lot 1, Block 3 Country Terrace) and the boundaries need to be resolved. As he saw it, the solution to the connecting street problem would be to go ahead and annex, approve the Preliminary Plat; record and legally make the provisions. When the lower portion would be developed might be quite some time in the future. He stated if the City "backs off" on the road connection, he felt the problem is solved. If the pedestrian easement would be approved, there would be no need for replatting. Sharp stated that there is a map discrepancy and asked for clarification, The Commission had acted upon the final plat showing the connecting street. Orton inquired how the road got moved from the original location to a new location. Hosac stated this had been changed within the last six weeks, to two months. Sharp inquired if the last map and location had been approved by the City. Hosac stated "tecnically it had been approved by Sumner Johnson and Joe Glaisyer, and so forth because we worked with them on it" Mitchell stated the Planning & Zoning has been out of this ever since the original was approved. He did not remember any pedestrian easement. Hosac stated it was basically the City Council. Georgia Chapin addressed the Chairman stating that Lot 1, Block 3, the lot in question, was their property and home. Chapin stated that they bought the lot a year ago March and were assured that the street would be a cul-de-sac and gave a 20 foot easement for a golf cart lane. They have put in an underground sprinkler and protested the road going through. Hosac stated that on the contrary,that if the road goes through,it would not take any of their property. Hosac stated they wanted a resolution that would satisfy the City and residents too. He admitted the mistake of presenting the change on an informal basis. Orton questioned why this couldn't be done through the County. Hosac stated this would just be sent back to the City as the boundary is in the City. If the road problem could be resolved, they could wait for Country Terrace Annexation. There was discussion as to access to Kuna-Meridian Highway, connecting streets and fire protection. Meridian Planning and Zoning .3. August 13, 1979 The homeowners protested the need of a through street for fire protection. There was discussion on how Country Terrace was approved with the cul-de-sac and Meridian Greens approved with the connecting street. More discussion concerning how the problem came about. There are only four (4) vacant lots left in Country Terrace. Orton stated that the Commission should consider the Annexation question before them and after this is resolved to make a recommendation to the City Council to either have or not have the connecting street. Originally the Commission moved to have the street in there. If they were to make the same recommendation all over again, it would be in conformance with the City's Engineer recommendation, the Ordinances and the City Council. Again the need for the connecting street for fire protection was debated and opposed by Homeowners attending. James Kling,on behalf of Country Terrace homeowners asked for help from the Commission to solve this street problem. A Compromise Access was discussed to solve police, ambulance and fire department service. Hosac felt the problem would be resolved if the City Council would accept the pedestrian easement. Orton expressed opposition to annex any property south of the Interstate until service lines are extended. The Motion was made by Orton and seconded by Tewksbury that the Commission deny Country Terrace Annexation request. Motion Carried: All yea. Tewksbury stated that taking all in consideration, the homeowners opposition to street connection and access points that are available, he would be in favor of the City Council "back down" on street connection. Mitchell stated that the conflict has already started and that there was very little the Planning and Zoning Commission could do. This matter must be resolved with the City Council. He pointed out the original map had been approved and several errors have been made. It was decided that they cannot study utilization of septic tanks in the Southwest Community Plan, to protect the aquifer from the City of Meridian. Cherry Lane Golf Course discussion. Don Leavitt was present, representing Leavitt-NuPacific, developers of the.golf course. There is a problem with the maintenance and management of the golf course. It was deeded over to the City with only the provision that the City would maintain and manage it. The City leased it to a group and the leasees have not adequately maintained or managed the golf course. The original problem arose when approximately 5,000 feet of pipe broke on the course because it was not properly drained before winter and the freeze made it break. There is also a lack of personnel on the golf course to correct the problems. We have reached an impass and since we have a large investment in the course, we will proceed with the foreclosure to be reconveyed to Leavitt-NuPacific. It is not our desire to be in the golf course business and we have always intended to turn it over to the City for a Municipal course. We cannot allow the further deterioration of the course which will effect the general attitudes of the present and future citizens of Meridian towards the Cherry Lane development. In starting the foreclosure, we intend to regain the control of the course and put into the course the proper professionals, a golf course superintendent, golf pro and an appropriate staff so that the golf course can properly be maintained. At that point, it would be my desire to reconvey the golf course to the City as a Municipal course. Prior to that time, the City should seek out a professional staff for the golf course both from the management and the financial standpoint. Bodine briefly objected to Rudeen's contention that the course was not properly maintained. This parcel lies below the ri!ii of Country Terrace #1 - approximately 6.3 acres. Hosac stated that Meridian. Greens will be ready to go and if Country Terrace #2 could be annexed it would solve platting problem. They would like to go ahead and get the area.platted with sanitary restrictions on the plat so they would not develop until the sewer is there. Hosac stated that the Country Terrace #1 residents desire annexation when the services are available. He again requested Country Terrace #2 Annexation. Mayor Glaisyer commented that Annexation #.2 would then create an enclave. Williams stated that the Council has held off on residential annexations and that he could understand Hosac's point, the vacation process is go8ng to take the same amount of time as the platting process. His concern was of the well lot. As this area grows there will be a need of another well, larger than the one now there. Kingsford agreed on the well lot and commented that the flat area must not become a,weekd_patch. Hosac stated that the well was not located to the best advantage, they have no problem with a rew well drilled and used by the City. A site in Meridian "Greens where the main water line would come out would be better. What they intended to do with the existing well lot is to eliminate, when the services are there, entirely and make that part of two lots. That could only happen when services are there.
