Meridian City Hall :2. February 19, 1980
Foley, Attorney for Rainey-Kuhl stated that he was concerned with AIC rules
that any veto must be at the next following meeting after approval, also the
reason for veto in writing. He felt this was not the correct procedure.
Mayor stated that the City's Ordinance will go first and foremost.
Crookston Jr. stated that the Mayor can veto, but if he does not act within a
certain period of time (10 days), the ordinance is vetoed automatically. If the
Council chooses to override the Mayor's Veto, even though the Mayor does not sign
the Ordinance automatically becomes a law.
The Motion was made by Brewer and seconded by Orton Jr. to override the Mayor's
Veto of Ordinance 361.
Plotion Carried: Kingsford, yea, Brewer, yea, Orton, yea, Williams, nor.
Mayor Glaisyer abstained from reading Ordinance #362.
President of Council, Richard Williams read Ordinance #362, Williamsen Truck Equipment,
Plant, Crestwood. Gregory and Crestwood Ten Mile Annexations, entitled:
AN ORDINANCE ANNEXING AND ZONING CERTAIN REAL PROPERTY WHICH IS DESCRIBED AS FOLLOWS:
SW 1/4 of the SW 1/4, PART OF THE NW 1/4 and NE 1/4 of the SW 1/4, NE 1/4 of the SW
1/4, and SE 1/4 of the SW 1/4, ALL IN SECTION 13, T. 3N., R. 1W, B.M., ADA COUNTY,

The Motion was made by Orton and seconded by Brewer that the rules and provisions of
50-9002 and all rules and provisions requiring that Ordinances be read on three
different days, be dispensed with and that Ordinance Number 362, as read be passed
and approved.

3 Kelly Parker Rezone Hearing
David Jensen was present, representing Parker and Valley Dairy Supply rezone of 903
E. 1st from "A" to "C" Commercial. Jensen presented a letter of intention of
improvement to property with a retail dairy equipment store, block or steel., 30X50,
light traffic, only one vehicle. (Letter on file with minutes.)
There was discussion in favor of this improvement by all memebers.
The Motion was made by Williams and seconded by Kingsford that the Kelly Parker
Rezone from "A" Residentfial tQ "C" Commercial, located Lots 16 and 17, Block 2,
Bowers First Addition, be approved with the stipulation that Valley Dairy Supply
present a design revlew,before bui1ding,to the City Council.

4 ; Custom Builders - W. Idaho.
,z• Gene Wright, J-U-6 Engineers, Inc., was present to request release of putting in
curb and gutter on the opposite side of street from Custom Builders Tri-Plexes.
Y The project involves two tri-plexes by developer, Dick Martens. One of the conditions
of curbs and gutters across .the street, which dead ends in a cul-de-sac at this
proposal. Wright stated they did not feel this was a fair requirement.
There was discussion concerning the benefits of building properly and offsite
improvements in the City of Meridian.
Wright felt this improvement was up to ACRD and could see no reason that the
developer should come to this cost.
It was determined that the water service line was put in "in a round-about fashion"
because the owners of the property at that point of time would not grant an easement.
Stuart was not sure at this time if the service would be adequate.

There was more discussion as to whose obligation the curb and gutter on the
north side of the cul-de-sac.
The Motion was made by Orton Jr. and seconded by Kingsford that the Council
approve Custom Builders Final Plat proposal, subject to street, curbs and
gutter and water system improvement by the builder of the development as
discussed here tonight.
Motion Carried: Kingsford, yea, Orton Jr., yea, Brewer, nom, l~lilliams, nom.
The Mayor broke the tie by voting yea.

5 Steve Bowman - Williamsen Truck Equipment Variance request.
Bowman requested that the stipulation that !+lilliams Truck Equipment not be
allowed temporary water and sewer system, be removed. Their intention is to
begin building immediately and will build an adequate temporary system with
dry lines so that they will hook on when the City systems are available.
Bowman stated they have every intention of hooking up to City sewer and water
and they have expressed this in recent meetings and letters.
Santa Clara has the same deadline as far as Bowman knew.
John Cooknell representing Gateway South Association stated that they will meet
with Nampa-Meridian Irrigation's Attorney and they are drafting an agreement to
allow a crossing of the water line on Eight ~1ile'and the final document is then
presented to the BOR. The Plampa-Meridian and BOR makes their final site inspection.•
The hearing. process of BOR on Ten Mile Drain takes approximately two months. They
are aiming to have this completed before the water table rises. The permits for
the Interstate crossing have not been obtained yet.
Cooknell stated all parties involved in the Gateway South Association are now in
the process of signing the agreement (Association) and Willaimsen Truck Equipment
has verbally agreed to do the same.
Bowman stated he is absolutely committed to hook on immediately when services are
available.
Rich Terrill, President of Chamber of Commerce, spoke asking the Council to grant
variance of the stipulation of temporary water and sanitary system for Williamsen
Truck Equipment and Santa Clara Plastic, although Santa Clara is not before the
Council at this time, providing that they hookup to the City system within the
two year period. Terrill stated this development would be a benefit to the City
and the Chamber felt the City would not be setting a precedent as this is a certain
situation at a certain time.
The Motion was made by Brewer and seconded by Williams that the Counccl grant a
variance with a stipulation that Williamsen Truck Equipment be hooked up to City
sewer and water by January 1, 1982, or prior to that if it comes available.

Orton reminded Bowman that hookup fees are dine upon obtaining building permits.

6 Attorney Wayne Crookston, Jr. - Gem Estates.
The matter of Gem Estates, brought to the City Council by Dave Reeves, 777 W. Pine,
is being studied regarding 4-Plexes. Crookston requested that it be tabled until
March 3, 1980.
Dave Reeves stated that he had no objection to the postponement.

7 Jean Gray - Permission fow concert ~at Speedway
It would be a Country-Western Family style local talent benefit for
U.S. Olympics.
Glaisyer stated that he ttz;;uyht it originally was for Torch.
Gray stated that they .decided U.S. Olympics would~hav~ better~.b~cbi~ng.
There would be a Nampa boy used as headliner and that it would be
a "Down home Country-Western Inspirational Concert on August 16, 1979.
Welker stated it would have to have full time coverage for Fire
Department.
Gray stated there ould be Liability Insurance coverage and they
would need three or,~;four Auxiliary Policemen.
Welker stated they would need same regulations as Speedway requirements.
Sherwin opposed because of no manpower during and after Rock Concert.
Gray stated it was not a Rock Concert but a Family Concert.
Sherwin stated that he felt they were the same thing.
Gray stated they would hire their own security.
Bodine against it.
Brewer stated no matter what they call it, it could cause problems.
Williams stated kids are just waiting to go and smoke their pot, etc.
Kingsford had mixed emotions. If you let one have a concert, you have
to let all.
Williams stated same.

8 Action Signs - Tom Jarratt.
Jarratt asked for permission to rent and sell signs.
Vern stated he needed a building permit if set up for more than 120 days.

Jarratt stated most signs are gone 2 or 3 months.
Williams asked Fire Chief if there were any problems with line of visual.
Jarratt stated that he sets up back the required feet.
Brewer stated they were an eye sore; too many and too long.
Jarratt stated that they were not permanent, mostly for Grand Openings.
There was discussion.
Vern state there had to be an electrical permit to plug in.

Martens stated that the two front units would be single level and the rear
unit above the garage or carport. There is a central driveway between the
two lots, three parking spaces on the side and three covered parking in the
back. One covered and one uncovered parking space per unit.
Williams stated~i;hat the 850 sq. ft. is not in line with the Council approval.
Kingsford inquired if there was restrictive covenants.
Martens stated no.
Martens stated that the Tri-Plex is 32 feet long by 28 feet wide and has had
no complaints with the size. .
Density was discussed.
Comments were read as on file. The remaining half of W. Idaho will be finished.
Engineer Smith questioned the street turn-around and curb and gutters.
Martens stated that if the City requested an additional turn-around, there
shout d be no"problem. -.._ _
. Williams commented upon the problem of Subdivision being metes and bounds.
This should come in as a plat, as these .a re not lots in a Subdivision,
and should meet the requirements of the City.
Smith stated that there is concern with the State Laws on subdividing of
land without going through the platting process. If an owner sells more
P than one parcel of his land, this must go through the formal Subdivision
Platting process. This would be splitting a lot into two parcels.
The Potion was made by Kingsford and seconded by Eodine that Custom Builders
Tri-Plex request be tabled until July 16th, 1979. ,

2 Cherry Lane Village Sewer Extension
Gene Wright was present,representing Cherry Lane Village.
Wright requested signature of the City on the Amendment to the Crossing
Agreement between the City and the Bureau of Reclamation at the time of
major trunk line construction for the crossing for the Cherry Lane sewer
extension. It has been signed by the Nampa-Meridian Irrigation Destrict.
The P+totion was made by Bodine and seconded by Brewer that the Cherry Lane
Village sewer extension be granted to accept the maintenance responsibilities •.

Meridian Planning and Zoning 4 June 14, 1979
Water and Sewer was discussed. Sewer comes off of North side of
Cherry Lane, water from W. 4th. Fire hydrants will be located to
satisfy Fire Department and Water Works.
The Motion was made by Hinrichs and seconded by Tewksbury that they
recommend to City Council that Cherry & Sons Office Complex Design Review
be approved, with the stipulation that there be landscaping; with completion
of one half of W. 4th St. sidewalk, and recommend variance set-back of
17 feet.

West View Tract Addition.
Dick Martens was present, representing proposal of two 4-Plexes.
There are 4.3 acres located at the end of W. Idaho, north side. 112 feet
wide by 160 feet. Location, play area, green area, 2 bedroom family
units was discussed. Density would be 18.46.
The Motion was made by Mitchell to recommend denial on the basis of
consistency on density.
There was discussion about denial and density.
Martens stated they had considered putting a Tri-Plex in this location,
but reduce the density.
Motion died for lack of a second.
The Motion was made by Mitchell to recommend to the City Council and
seconded by Tewksbury to deny Custom Builders proposal of taro 4-Plexes.
Motion Carried: Tewksbury, yea; Mitchell, yea; Hinrichs, nom.
The Plotion was made by Hinrichs to recommend to the City Council approval
of two Tri-Plexes to Custom Builders Herby Subdivision, contingent upon
sewer, water, completing W. Idaho St. to this area, and landscaping including
trees.
Motion Carried: All yea.
The Motion was made by Mitchell and seconded by Tewksbury that the meeting

Total acreage is 3.1, Density 6.7 units per acre, 21 units. Sharp
counted 24 units. Square footage would be 860 sq. ft. for the
single units and 600 sq. ft. on the ground floor of the two story units.
The Commission felt these were very small lots. There was only one car
parking minimum and they desired two car off street parking.
Messick stated that these units would be of quality development and one
builder, a complete design all the way through.
The Motion was made by Hinrich that recommendation be made to the City
Council to accept proposal with provisions of water and sewer, that a
garage be provided with two other parking spaces; and an easement for a
possible road continuing East to Pine;.~Recreational easement in their
covenants.
Motion died for lack of a second.
Orton had abstained.
There was discussion. Messick suggested that they drop some lots.

Dave Wilcox was present representing Devco Design Review.
Wilcox state there would be basically 20 units, three (3) 4-Plexes
and one (1) 8-Plex. Two bedroom units would be 840 sp. ft. They
plan to do an extensive amount of landscaping. He stated that there
is a little less than one acre, 38,000 sq. ft.
Sharp stated that density would be 22.7 units per acre.
The Commission referred to Comprehensive Plan and felt density was
too high. Highest is 15 units per acre.
Traffic was discussed. Wilcox states traffic would use Broadway.
The Motion was made by Orton and seconded by Hinrich that they
recommend denial based upon density criteria.

Weast was present representing himself and stated that his request for
rezone is to build a restaurant to be leased to Otis Denny. There will
be 40 to 50 parking spaces. Vacant lot is 240 feet.
Orton stated that the Comprehensive Plan allows this mixed use.
Parking was discussed. Weast stated traffic in and out will be planned;
access would be limited off of Franklin.

Charlene Smith was present representing Char-'lies Catering Service.
Smith stated thtat their purpose is to maintain the character as a residence.

Smith stated thtat Superintendent of Schools Hein had contacted the School
Attorney about using the school property across the street for parking.
The Attorney had reported that if they denied this parking the school
would have to enforce the denial to anybody that used this property for
parking. Smith stated that the agreement would be worked out with the
school for parking.
Sharp called for the opinion of those attending.
Jim Smith, owner, stated that since the Historical Society has taken
and interest in restoring the home, that it would serve the community well
to have the home renovated.
Hinrich inquired if they had approval of all neighbors. Smith stated
they had contacted the neighborhood extensively and they were in favor
of proposal.
Sharp stated that at this point he felt this should not be Commercial.
Orton stated that other proposals have benn turned down and that approval
of the catering service at this location would be opening the floodgate
for other proposals. Mitche]1 inquired if mass renovation would destroy
the historical value. Hinrich felt this home would be best maintained in
this manner and was in favor.
The Potion was made by Hinrich and seconded by Mitchell to recommend to
City Council approval of Char-'lies Catering Conditional Use Permit at
101 W. Pine, with the condition that with Design Review, and preservation
of historical qualities of the building.

School District for appraised value. Eliminated are 15 units.
