Dempsey 1680 West Pine Street Meridian, ID 83616 September 21, 1982 City of Meridian 728 Meridian Street Meridian, ID 83616 ' Dear City Clerk, Mayor, and Council Members, In the fact that I was not given a chance to respond to the withdrawl of the conditional use permit for my snack bar September 20, 1982 at the city council meeting, I am doing so now. I am a sovereign citzen of the United States and demand all my rights under the Declaration of Independence, Constitution of the United States, The Bill of Rights 1787, and The Civil Rights Act of 1964. I waive none of these rights and demand them at all times. In criminal proceedings I demand my common law right ,to a common law jury of twelve men of my peers to decide all issuers of law and fact, including my right to argue the Constitution as my theory of the vase to the jury. Common law rights stated in the Declaration of Independence "that all men are created eual, that they are indowed by their creator with certain un- alienable Rights, that among these are Life, Liberty and the pursuit of Happiness. That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed.° Being denied by my city government the right to make a living at what I chonse, this 6a,~~,ra mobile snack bar, is a denial of my livelihood and liberty. Article IV of the United States Constitution, Section 1 states, "No state shall make of inforce any law which shall abridge the privileges.,or immuni- ties of citizens; nor shall any state deprive any person of lif®, liberty, or property,witlwut due process of law; nor deny to any person within its jurisdiction the equal protection of the law." The Idaho State Constitution states in A~io~.e I, Section I the inalienable rights of man. "Al1 men are by nature free and equal, and have certain inalien- able nights, among which are injoying and defending life and libertyi acquiring, possessing and protecting property; pursuing hagpiness and securing safety. I contend at this time the City of Meridian government is violating my common and Constitutional rights and those of my employees by trying to regulate out of existan~ with unco~itutional ordinances and codes my snack trailer at 1680 West Pine Steet, Meridian. Also the rights and Sobs of my employees. The Supreme Court states in Miranda verses Arizona (384 U.S. pp.4917'where fights secured by the Constitution are involved, there can be no rule making 2 legislation wlaicH would abrogate them. I cannot in good conscience allow my city government to use its powers to violate its citzens rights. I must inform the mayor and City Council that -~ right to regress of grieve antes and violations of citzens rights can be persecuted under Title 18 and 42 of the United States Code, if these d®privations of rights are pursued to the point of causing a loss of damage to myself or my employees. The snack bar is pra~ding a needed service and fobs for teenagers. I have no other choice but to defend th®se Sobs. Vernon Schoen: If a conditional use for the above was to be approved, it would have to include the following: 1) A variance from City ordinance on mobile homes. 2) A variance from building codes. (A trailer does not meet building codes of a drinking and eating establishment) 3) A variance from code setback requirements. a) On~~hour const.of building if less than 20' from property line. b) No openings in a wall that is less than 5' from property line. 2. Bill Brewer: Could help keep students on or near campus during the lunch hour. It would require good adult supervision. If school officials don't object, it might be worth a try. 3. Earl Ward: No sanitary service available. 4. Joseph Glaisyer: Recommend approval as long as there are trash containers and the area is kept clean. 5: Ada County Highway District: Recommend the following requirement for approval of the conditional use: 1) Parking and dispensing within the public right-of-way is prohibited. 2) Vendor must not obstruct the vision angle at intersections or the right-of-way proper. 6. Richard Williams: Not in compliance with Comprehensive Plan. Do not- encourage commercial development contiguous with high school. ' Recommend denial. 7. Police: What provisions have been made to accomodate the increase in vehicle and pedestrian traffic? What hours will this snack bar be open for business? The police department is assuming that this establishment will attract a gathering which could result in the added need for police service. I question whether this snack bar is going to cure more problems than it's going to create. 8. Central District Health Department: This department would require that this facility be provided with central sewer and either central water or an "approved" individual well source. A formal plan review must also be done with Mr. Dempsey and our office for this establishment. 3.9.81 Planning & Zoning: The Motion was made and seconded to Approve for 15 month Conditional Use at which time to be reviewed by City Clerk and reported to Planning & Zoning Commission 3.16.81 Council: The Motion was made and seconded grant Condition Use Permit and Variance from Bldg. Code for 15 months at which time to be reviewed; hours before school, during lunch and after school (see minutes of 3.16.81) Must have approval of Central Health ~• CENTRAL DISTRICT HEALTH DEPARTMENT . Review Sheet Rezone ~ Conditional use ~ ~, Preliminary/Final/Shor Plat Return to: _ Boise Eagle Meridian Runa ACZ 1.' We have no objections to this proposal. J~ 2. We recommend denial of this proposal. 3. Specific knowledge as to the exact type of use must be provided before we can comment on this proposal. 4. We will require more data concerning soil conditions on this proposal before we can comment. 5. We will require more data concerning the depth of (high seasonal ground water)(solid lava) from original grade before we can comment concerning individual sewage dis- posal. 6. We can approve this proposal for individual sewage dis- posal to be located (2,4) feet above high seasonal ground water, 4 feet above solid lava layers. 7. We can approve this proposal for: _Central sewage _Interim sewage _Individual sewage and _Central water _Individual water _Community water well. 8. Plans for _Community sewage Sewage dry lines, and _Central water _Community water must be submitted to and approved by the Regional Health and Welfare Environmental Services Office. 9. Street runoff is not to create a mosquito breeding problem. 10. Please be advised-that if payment is not received and you become sixty (60) days delinquent, the Citylof Meridian will be forced to not resume service.
