Minutes of the Regular fleeting held March 2, 1981 were approved as read. Agenda 1 Community Development Block Grant - Public Hearing Flayor Glaisyer announced that the second Public Hearing for the Community Development Block Grant would now be open. Mayor Glaisyer: "Is their anybody in the public that would wish to discuss the Community Block Grant?" There was no response The Motion was made by Bill Brewer and seconded by Rick Orton that the Public bearing for the Community Development Block Grant be closed. Motion Carried: Williams, yea; Brewer, yea; Kingsford, yea; Orton, yea The Motion was made by Richard ~dilliams and seconded by Bill Erewer that the City of Meridian adopt a resolution to proceed with a full application of the HUD Community Development Block Grant as proposed by JUB EfrGII~dEERS, IFJC. Motion Carried: Kingsford, yea; hlilliarns, yea; Orton, yea; Brewer, yea Agenda 2 Conditional Use Hearing and Variance Request - Clyde L. Dempsey Snack Bar on 4Jheels Playor Glaisyer: "The Public Hearing is now open for Clyde L. Dempsey Conditional Use." Clyde L. Dempsey of 1680 W. Pine was present to request a Conditional Use for a Snack Bar on Wheels adjacent to the Meridian Senior Hio.h School. P1aps were displayed. Dempsey: "I want to put a Mobile Snack Bar next to the Meridian Hinh School" Orton: "Has the School Board approved of the idea?" Dempsey: "Yes, I went before the School Board,. all my neighbors, the Student Council- and everybody's far it in that area. The reason I started this is that I have a seventeen year old daughter that needs a job and the more I talked with the students the more I realized there was definitely a service of this type needed. A lot of the students felt that if there was a unit there they wouldn't go to town where they normally do, I imagine you could have the best school lunch in the world and there would still be certain number of students wouldn't be happy a~ith it - some like a variety. And also a lot of the students that don't have transportation would like to have a choice. I would say that 50% of the students I talked to that do have cars told me that they would like to have the service, just to save the gas." Playor: "What do you plan to se11- hamburgers, hot dogs?" Dempsey: "At the present time I don't plan on starting out with hamburgers because by talking with the Health Department it takes $500.00 for a grill, but the hood that goes over the top of it costs X4,300 and until I see whether this would be financially feasible I don't believe I will put the grill in at this time. I have talked to the people who sell the microwave type sandwiches and this is what I will start out with." "I am a parent of teenagers myself and if food is available to get them away from the junk type food - someone suggested yogurt, this type of nutrient food. Basically I am going to try and keep prices down and serve as good as wholesome food as possible." Bi 11 Brewer: "tbly comments are much the same as on the COMPIEt•JT sheet, as I had i nput for this some time back. If it were to keep a number of these children on the school grounds instead of the streets it certainly would be a credit to our Police Department, I think. It would also require good adult supervision and if the School Officials don't object, which apparently they do not, I think this gentlen;en should be given a chance." Dempsey: "You got a copy of this map. (on file) and basically this is where the unit is going to set. I have the old Holladay Place and it actually goes right out into Meridian City Hall .2. March 16, 1981 the School property. 4Jhen they subdivided the folks that owned this saved their homesite - so this unit is going to be surrounded by driveway, tennis court and across the drive a ballfield. Mow basically what my plan is two walk in gates, no drive-in, not a lot of seating so there will be a lot of gathering - I want them to move through, get their food and move on. As far as crowds congregating I want to discourage this - if the kids buy a coke and want to swap a few tales I'm going to encourage this type of thing. As far as policing, I am going to try to be there. There is going to be adult supervision at all times - I'm a old P~arine Corp Blick Sergeant and I'm not going to take a lot off these kids, I like to work with kids but I'm not going to let them walk over me. If this is not compatible with the School, or with the neighborhood, they wouldn't have to worry about shutting it down because I would. I haven't got any negative input." Williams: "I have mixed. emotions about what h1r. Dempsey is trying to do. I guess my concern is the commercial in the immediate vicinity of the {ligh School. The Conditional Use will have a little more latitude and control over it. I have read the minutes of Planning and Zoning and my personal feeling is to go along with the Planning and Zoning recommendations and give Mr. Dempsey 15 months, until June 1982, and have it reviewed again - As long as he complies with Central flealth District requirements and I assume if we do have problems with litter we will be so notified." Dempsey: "I have a letter here from the Flealth Department and P~lr. Bob Jue, Environ- mental Quality Specialist II, and he has stated that he would work with me. I am going to hook on to water and sewer, I have talked to htr. Grton about that. As far as the litter problem - we have an existing problem over there right now. The School pretty well takes care of it, they hire different groups like the Soccer Team and the Tennis Team for a week, to give those groups a certain amount of money to clean this up. I probably will have a student employed full time to clean up the immediate vicinity and will have somebody go over and clean up when I service the events. I'm also going to inform the kids, by signs, etc., that if they are going to litter - they are going to pay for it in the cost of the products. I don't think we will have any problem." Mayor: ~"If you can get that done - we'll hire you and put you out in the park:" Kingsford: "Two Vice Principals were opposed to this -just for the record there is not 100 approval. The Principal said that he had mixed emotions, the Academic Vice Principal told me that she had mixed emotions over the Snack Bar but the food that's there she can't eat, I can understand that, but certainly this should be closed during School hours. That is, we would have no problem with it being open before 8:00 A.M, or no problem from 10:45 A.P. to 11:45, and then after 2:00 P.Pi. there is no problem. I also have mixed emotions just in regard to zoning. You would be running competition with some people that's paying higher price money downtown. I have some friends that is running restaurants downtown, I do have a conflict in that respect. Fdormally I would say I oppose it, however, the school doesn't have a cafeteria and I think that creates a special problem in itself. So, I think I would go along with a Conditional Use until the end of next school year, at which time it will be reviewed." Mayor: "Are there any comments from anybody from the Public?" Ronica Peterson: "The Student Council has sent us to represent them and we have interviewed quite a few students and they stated that they would like a variety of food and their eating habits - and they did like Mr. Dempsey's idea. It is a waste of gas to have to go downtown. Mr. Dempsey did say that he would clean up the litter and I;eep things under control, if it did get out of control he would stop. The Student Council is for the idea and the general Student Body are for it also." P~ayor: "Thank you. Any other comments from the public?" There was no response. "Hearing Closed." The ~1otion was made by Williams and seconded by Kingsford that the Council grant Clyde L Dempsey, 1680 W. Pine Street, a Conditional Use Permit for fifteen (15) months, through June, 1982, at which time there will be a review, with the hours of business to be before 8:00 A.P1., fron 10:45 to 11:45, and then after 2:00 P.M.; subject to approval of Central District Health; and to grant a variance from Buildin, Codes regarding eating establishments. P!o response. _ Meridian City Council Meeting 3. September 20, 1982 Agenda 5 DEBRA COPE - WEED PROBLEf~, Cont'd . Cope questioned on when results could be expected. Crookston::.;:"We usually give them 10 days after receiving the letter." Mayor Glaisyer thanked Mrs. Cope for her time. Agenda 6 P~ERIDIAN PARK - Request for Variance on Square Footage Requirements Allen Anderson was present representing the request fora 100 square foot reduction per house, and the ability to exchange some of the~lot sizes in Meridian Park. There was discussion amoung the Council Members as to whether a variance could be given without a Public Hearing. (Tape on File, City Clerks Office) Anderson explained that time a~s~. a great factor, as several lots are sold and the buyers' are waiting to begin building now. City Attorney Waye Crookston was asked for his advice on this matter. Crookston read from Ordinance Number 383, section 7, which states that one hearing must be held on the request for square footage reductions. (Ordinance on File with these Minute A new plat must also be submitted. There was discussion concerning the interpretation of Ordinance Number 383. (Tape on File City Clerk's Office) Crookston explained his interpretation of the Ordinance. (Tape on File, City Clerk's Office Crookston:. "I think that before you change anything, you have to have a hearing." "That would be regardless if it is to be recorded or not to be recorded." There was much discussion. (Tape on File, City Clerk's Office) The Motion was made by Brea~er that Meridian Park Subdivision have the ability to swap house square footage, on the pink lots, lot descriptions to be designated in the minutes, not to change the density of the entire project, with d 5 lot maximum stipulation. Councilman Tolsma: "Is this a legal variance?" Crookston: "You cannot grant a variance on a Public Hearing requirement unless you change the ordinance." Motion died for lack of a second. Agenda 7 CLYDE DEMPSEY - Renew Conditional Use for Snack Bar (1080 W. Pine) Clyde Dempsey was present representing his request for renewal of his Conditional Use Permit for a snack bar at 1680 W. Pine. The Conditional Use Permit was granted March 16, 1981 for a period of 15 months. There was discussion concerning Bempssy.'~s~~ refusal to pay $130.80 due the City for City Services. (Tape on File, City Clerk's Office) Mr. Dempsey does have City Sewer Service from the Snack•Bar. Earl Ward, Wa~teWater Sup't.: "The.Sewer hookup inspection was for the residence only, not on the snack bar." Dempsey explained that the residence is on a septic tank at this time. "The only reason that I went this route with the City was to try to meet the Health Department's requirements in order to get the Conditional Use Permit.° There was mach discussion concerning the sewer and water services to the~.snack:bar. Councilman Kingsford: "During the discussion that we had some 15 months ago, you said that if there was any problem out there from the school, that you would just close the thing up yourself." (Minutes from March 16, 1982 on file in City Clerk's Office) "Are you aware of the complaints that the school has had about you?" Dempsey: "No, I am not." Kingsford stated~~that:the has been a smoking problem w;th the students there, that there has been vandalism to the cars in the parking lot around the snack bar. There was discussion concerning the problems surrounding the snack bar. Councilman Kingsford also mentioned the litter problem around the snack bar. Dempsey presented 2 of his employees that explained the cleanup procedure that is done every day. (Tape on Fiie. City Clerk's Office) Police Chief Doug Nichols stated that there is a,problem with students loitering during school hours on the snack bar property. This is private property, which prevents the resource officer from interveraa~ng:! Dempsey stated that he will work with the Police Department and with the City on any problems. The Motion was made by Kingsford and seconded by Brewer not to extend the Conditional Use Permit on the Clyde Dempsey snack bar. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea; Agenda 8 TOP1 MARKS - DISCUSSION on Water-Sewer Hookup and Illegal 4Jater Line P1r. Plarks was unable to attend because of a previous commintment. Earl Ward, Wastewater Supt.stated that the hookup fees for the sewer have not. be paid. The second residence is not hookedup to the City Sewer. Bruce Stuart, Water Dept. explained that there are two trailers in the Catherine Park Subdivision. One is on a meter and the other is hooked up by a pipe from the first trailer. The second hookup was never approved. Gary Smith, City Engineer state that he felt there was a another problem to be considered with is that Arniesuti~tivii;aan will hookup to City Sewer through the Catherine Park. There was discussion concerning the illegal water line and the failure of Marks to pay sewer hookup fees. (Tape on File, City Clerk's Office) The P1otion was made by Kingsford and secondec by Tolsma that the City Attorney send notice to Mr. Marks that hookup fees must be paid within 10 days or water services will cease, and that the illegal water hookup to the second residence-must terminate immediately. t~ibtion Carried: Kingsford. vea: Tolsma vea: Brewer, vea: Agenda 9 1982-1983 FY AUDIT The Motion was made by Kingsford and seconded by Brewer to reappoint the accounting firm of Ripley Doorn & Co. to do the 1982-1983 FY Audit of the City of Peridian. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea; Agenda 10 AMENDED ORDINANCE N0. 411 Mayor Glaisyer read Amended Ordinance No. 411 entitled AN ORDINANCE MAKING AN APPROPRIATION OF MONEY FOR ALL THE NECESSARY EXPENSES AND LIABILITIES OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, FOR THE FISCAL YEAR COtdP1ENCING THE FIRST DAY OF OCTOBER, 1982, AND ENDING THE THIRTIETH DAY OF SEPTEMBER, 1983., THIS ORDINANCE BEIt~G KNOWN AS THE ANNUAL APPROPRIATION BILL, AND DECLARING AN EMERGENCY. Mayor Glaisyer explained that there was a typographicl error in the orginal Ordinance in the amount of $3,000.00. w `ieridian Planning and Zoning March 9, 1981 Meeting called to order by Chairman Annette Hinrichs at 8:08 P.M. Plotion Carried: All yea Agenda Chairman Hinrichs welcomed new member Tom Eddy 1 Conditional Use Nearing - Mobile Snack Bar on Wheels - Clyde L. Dempsey Clyde L. Dempsey, 1680 bJ. Pine Street, was present to request Conditional Use. Hinrichs: "The Hearing is now open for the Conditional Use request and a Variance from the Mobile Home Ordinance and Variance from the Building Code regarding Eating and Drinking Establishments." Dempsey: (referring to COP~MEPJTS) "First off I would like to explain to the Commissioners - there are some things on the comment sheet that doesn't apply. This is basically a blueprint of my drawing of the parcel. I have the old "Holladay Place" which was the original farm place that they subdivided for the school Meridian High School) they held that out and had it surveyed away before they allowed the School to build. So actually it sits right out into the school property." Dempsey displayed the blueprint and the proposed location for the Snack Bar on Wheels. "The only traffic I am going to have coming up is foot traffic - it's strictly walk in and walk out, possibly two gates with garbage cans stationed to help prevent the litter. I also intend to hire a teenager to come around and pick up some of this litter. The school hires different organizations, the tennis team, the wrestling team, rugby team and pay them $50.00 to keep in clean, I think in a weeks time and I'm thinking possibly I may be able to get in on that. This would take care of the trash problem." "I've talked to Vernon and as far as the P9obile Nome Ordinance. This is not going to be a Mobile Flome -this is going to be a mobile snack bar. It is a 24 ft. camp trailer & is going to be converted into one of these eating joints and I will be taking it out in the summer and on weekends. In order to rnake it economically feasible it is going to be entirely mobile. I will take it to auctions, horse shows, etc. to mak it pay for itself, there's quite an investment in one of these things." "Rusty Dempsey has discussed primarily with our office the possibility of converting a camp trailer to a mobile food establishment. This establishment at based at his establishment 1680 Pine and operated there during the-shoo] year. Our discussion covered the trailer remodel, the equipment, sewage disposal and water supply. We need to check the water supply. A final plan or review has not been conducted, in other words take and check my well. Plo appoval of plans have-been given. Bob Jue gave me a verbal promise to work with me on a design this right from the ground - look the equipment over and work with it, because actually the Health Department is the only one that has any control over something like this. I'm sure by the time they get done with me from just what they told me it will meet all water codes plus I am a carpenter contractor and have been. for twenty-five years. I've. built three restaurants from the ground up and right now I am in the process of remodeling one so I feel that I am qualified in order to do a job of this kind." "I've talked to the Water Commissioner and he y~said he could see nothing wrong in running the water and sewer back to that unit. We had quite a discussion on that, I don't want to use City water.." City Clerk: "Do you have artesian water there?" Dempsey: "Yes I do and it is wonderful drinking water there." Dempsey: "T would hook up to both water and sewer to this unit." "I do have dry lines there but have just put a great deal of money in my septic system.' Dempsey: In regard to Councilman Williams comrnent - the only thing I can say is I can see his point but since this was not my idea originally but the students, and I have 100% approval of everyone within 300 feet, including the School Board - I haven't any Y. eridian Planning and Zoning 2 March 9, 1981 negatives. There are two representatives from the Student Body here tonight - they represent the Student Council. The Student Council sent these students to give their support. The people in this area all want this kind of service - the kids over here playing ball and tennis tournarnents have many times wished for a cold drink. Dempsey: "Yes - I would even go fora limited use; •~c•r ~t '^as~vt,•~n nears, hecause the time I get the ball rolling this year it will be too late to give this thine a good shot. I would need at least all next year to get it lined out ans see what the bugs were.. Now, I have already promised the School Board, my word is just as good • as my signed signature, if this wasn't compatible with the neighborhood and with the • school that they wouldn't have to worry about shutting me down, because I would. If I do create a monster there I'll shut it down." "In answer to the Police the Snack Bar is only going to be open during lunch hour and probably one to two hours after school lets out, then I'll open for special events. The Tennis Coach has volunteered to give me a schedule, the baseball coaches and all these people have agreed to work with me. At these athletic events and when they contact me I will open up for those few hours involved there. But it isn't going to be open in the evening - I don't need that kind of hassle. I'm also designing this in such a way that there will not be a big meeting place out there. They will be coming through, standing up to get their food and moving on - I'm not applying a lot of chairs because I don't want to encourage this type of thing, I am personally going to keep that down -I'm an old Buck Sergeant and I can get pretty ranky if I have to.." _ "In order to keep the Health Department happy I am going to hook this to City sewer ~~ and water, if approved by the City." Mitchell: "This mobile unit is strictly mobile, except that you are sitting on your own property. I see them all over - totally mobile. What prevents you from going ' to the schools back door: '-; Dempsey: "Because it's school property. This has to be on private property unless permission from businesses etc. - the gas company allov~it." • "Tt is self contained and can be pulled around easily. The only way that I can make it financially feasible is to able to take this to horse shows, the auctions and this type of thing.. The advantage of this to me is that it gives me buying power on ~ '' supplies. I will charge the kids one price economical that they can afford but ' when I go out it's going to be a different price - that's where the bucks will be made." There was discussion concerning the fact that all residents within 300 feet had '•' signed approval.•' Pipkin: "Did you feel that after your discussion with Mr. Schoen that these variances will be satisfied?" t~;',. Dempsey: "Yes" "The setback is not even applicable and this is not a mobile home" Spencer: "4Jhat does the Comprehensive Plan say about Commercial in this area?" Hinriehs: "Our Comprehensive Plan definetly discourages Commercial Zoning around schools -this is not Commercial Zoning this is a Conditional Use." Pipkin: "What's the use that we have across the street from P9r. Dempsey?" kiinrichs: "We have limited office across from the Tennis Courts and we have Industrial over to the South, Residential behind that." ~~inrichs: "Is .there any comment from the public?" Ronica Peterson: "Liza Cookson and I are representing the Student Council (MHS) and we have talked to many of the students around and there was an article in the paper that the students would like a variety for lunch and that they thought Mr. Dempsey's idea was a good one. It was approved by the administration and the Student Body is for it. Mr. Dempsey will cut down on a Tittle of the problem around there and employ some of the students. The•students really want a better lunch so they thought his idea was good. We, the Student Council of the Student Body thought his idea would be a good one." Dempsey: "The main thing behind this is that it will employ three to five teenagers and more if I can swing it. I can train these kids during the lunch hours but in the summertime I will have trained kids to take out with the unit on the road. Inge need people trained in food service just as much as we do auto mechanics. This will give "them the opportunity to have a first job and get a reference. I think that is the mast important of the whole idea as far as I'm concerned." • ,~ ~;_; eridian Planning and Zoning .3. March 9, 1981 Tom Eddy: "Are you going to be supervising whenever it is open?" Dempsey: "As much as possible - All of the time to get this started and then about three times a week in order to keep a handle on it." Eddy: "4Ji11 there be an adult there when you are not there?" Dempsey: "There will be adult supervision at all times." Hinrichs: "Any more comments?" There was no response "Hearing Closed" The Motion was made by Mitchell and seconded by Pipkin to recommend approval of a Conditional Use for a Mobile Snack Bar on LJheels to Clyde Dempsey and be granted for a fifteen (15~ month period at which time will be reviewed by the City Clerk and reported to the Planning and Zoning Commission. Motion Carried: Pipkin, yea; Mitchell; Eddy, yea; Spencer, nay Dempsey thankedthe Commission for their consideration and left the Chamber at this time. There was no further business to come before the Commission. The Motion was made by Spencer and seconded by Eddy that the meeting be adjourned at 8:38 P..M. Mr. Dempsey recited from the '~ City Ordinance concerning construction debri, "items not collectable", presented receipts of dumping fees, explained that in his kind of work he used a~dump truck and flat bed trailer to collect t:f~e c~rstruction debri and haul to the dump. He :stated that he had never used the Sanitary Service. He did not object to hti;s '~~ presidential'use of the service. Dempsey strongly objected to the Commercial service, 3 saying that he did not need it and did not want it and that he would haul the trash from the S(dACK BAR, which he operates along with the masonry and debri. Councilman Kingsford stated that this mandatory service has prevented garbage mounting ~~:~ ~ up and that it is beneficial healthwise and economically. Dempsey felt that the Council should be flexibly on some matters and they were forcing citizens of Meridian to take a service they didn't need in some cases./ There was discussion concerning granting a variance from the Sanitary Service Ordinance. (Tape on File) Councilman Orton stated that the City is not in the business to extort money out of anybody but in the business to provide these services - to protect each citizens health and welfare. Orton stated the City would be losing grasp of that goal if such variances were 'allowed. Councilman Kingsford stated that the Sanitary Service Ordinance was a good Ordinance and thought the .City shout d stay with i t. Mayor Glaisyer thanked t~}r. Dempsey, for attending, Dempsey thanked the Mayor and Council for listening and left the Chamber at this time. Engineer Structures - Kurt Kroll representing Nampa Valley Helicopter Kurt Kroll, Art Lilard and John Nielsen were present to get the Mayor and Council's input on use of property located West of Kuna-e•leridian P,oad, PJorth of T-84N and. South of Waltman Lane. This property is not within the City limits and has been referred to in the Meridian Comprehensive Plan, Page 23. Vincinity Map was displayed by Kroll. Kroll: "There are two (2) acres shaded on this map, actual',y only 1 acre would be used. We will be presenting this proposal to Ada County and Ada County, I believe, will be asking your feelings to4rard this Helicopter maintenance business. This one acre parcel would be for more development. From what I unders~:.and you do want some Commercial built i~ that area." Councilman Orton: "What are you planning to do about water and sewer?" Kroll: "I am not sure where the City of Meridian's system is - we would have to put a septic system if we can't get to the sewer. If there is not water available we would have to put a well." Water Superintendent, Bruce Stuart: "Water lines are just about to Waltman•Lane" Wastewater Superintendent, Earl Ward: "Almost a mile" Orton: "Do you fly a helicoptor in and out of there?" Kroll: "We'd like to yes - we truck a lot of them in and out of there. Kroll stated that the noise of the shop would be comparable to trucks on .the nearby freeway. fJielsen stated it would be far less than the race tracks. Kro11 stated that t6}e building would be situated so that the helicopter would be on the Freeway side. Mayor Glaisyer: "What about gasoline, oil and of that nature that you have to dispose of?" Kroll: "They have to put a special tank in and the tank ~ti~ould be pumped." Motion Carried: All yea Agenda Clyde Dempsey - Input requested regarding Mobile Snack Bar 1 Clyde Dempsey,1680 West Pine, was present to request input from the Commission regarding. placing a mobile snack bar at the back of his property adjacent to the Meridian Sr. High School parking lot and tennis court. Dempsey displayed map. Dempsey: "Living there I have observed the noon hour a mad exodus, you can't believe it. It is my feeling that anything we can do, in my particular case, to save those kids gas they use to run .to town - because they are doing to run somewhere - and to reduce traffic, every little bit helps. The kids do have a school lunch program at school and I have talked to some of them, are going to eat somewhere. This would provide a convenience closer and making it an asset to them - I think all of us basically. But with a mobile unit, let say it doesn't work out and it isn't compatible with the school, I'm not going to be in it to such a great extent that I can't withdraw and let it be a large financial burden to me. That's the idea of going mobile - seeing if it is worthwhile, there's a 30 minute lunch hour there. I also plan on using this .unit to take out to sales, auctions, etc., and of course in the summer time when the school is closed I'll use it for whatever is available. I would like your input to see if I am just wasting my time." Sharp: "Did you talk to your neighbors about this?" Dempsey: "I have 100% (Demnsey presented petition signed by neighbors) I am talking to the School Board tonight. I have everybody within 300 feet - they are all for it. We fight the litter all the time, I had to put up a fence to keep the litter from blowing in on my property - but basically this will give all of us, in order to stay in business, I going to have to keep the place neat so I will be contributing t~o cleanih~g up the mess even all of it would be made from my unit, I have plans for one of the kids from the school to do the clean up." Sharp: "I have a little problem with it. They run a lunch program for the kids at the school, I don't know whether it is the best or not - when I was in high. school I probably didn't think so either - but I don't think we are going to cut down on very much traffic as long a~ Mom and Dad are buying cars, gas and furnishing credit cards - the kids are still going to go somewhere else. In fact, I think this will create another problem and violate good planning, where do we stop in putting in commercial in residential areas." Dempsey: "That's mostly Commercial around me sir." Flinrichs: "We don't have any Commercial right around the High School, just limited office on the corner and light industrial back against the railroad track, but I have been playing strongly to keep Commercial away from the Fligh School. That has always been my philosophy from the very beginning and I would like to keep Commericial completely away from the high school. Dempsey: "This is not a zoning change but a Conditional Use request - the way I understand it would just be permission to do something." Sharp: "That is correct." "But I still would have a problem with it, I can't see that it's going to solve any problem or would warrant violating the Comprehensive Plan, the way I see it." Spencer: "I agree, I think it will create more problems that it will solve." I think they will be congregating and make more of a congestion problem." P~litchell: "I haven't any hangups about. helping private enterprise, but it will be interesting to know what the school board felt about it. I think the kids are going to grab a sandwich and tool around town anyway so it won't help the traffic problem." Pleridian Planning ~ Zoning .2. February 9, 1981 Plitchell: "My primary concern is what the School Board felt about it. You have all your neighbors so obviously there is no problem with them." Dempsey: "Another point I would like to bring up. This would probably employ four or five of those kids over from the school. T have intentions if I can get it together to work with the school and get some of those kids working on a "Work Study". I have taken kind of a poll among the kids just to see and their basic opinion disagrees with yours, gentlemen. That's why I have come this far. One of the main reasons they leave over there at the school is simply because the lunch counter doesn't serve food fast enough and when they get it, it is soggy. Whoever has a concession over at the High School consequently in order to keep it, would have to improve their chow." finrichs: "So what you are thinking of then, is a Conditional Use Permit?" '."~ Dempsey: Yes, in fact if you folks would go along with it possibly just try this for a year.' If it is unsatisfactory I will withdraw it in a year." "Would you consider something like that?" Sharp: "Well, I still have a problem with it. I'm not sure it is going to solve a problem - I guess a liken it to that nice new track that they built out there, but the joggers are still on the street. The next probler~''may ~be that someone may want to put a hotdog stand on the corner - where do you draw the line?" I am for free enterprise as anybody but I think we have to have certain limits." Finrichs: "You have come for input, I think you have just heard it." Dempsey: "That is what I wanted to get. I am going over to the School Board now and I wanted to see what~your.reaction was." . Hinrichs: "We have had some pressure in putting some property across the street from the High School to the South into Commercial and we have balked. In'e have to be consistent, not that we are opposed to your proposal. We are trying to maintain the residential nature around the school." Oempsey: "I understand that and thank you very kindly." (Dempsey left at this time) Agenda Locust Grove industrial Park - Annexation Hearing 2 Chairman Hinrichs called the Hearing open for Locust Grove Industrial Park Annexation of Parcel I and Parcel II.. John Jantz, one of the owners, was present to represent Annexation request. Jantz: (explaining having to re-annex) I think the problem stems from the fact that this area here (indicatigg the long narrow strip of railroad east of Locust Grove Rd) was already annexed into the City and we were under the impression that this annexationc;included the railroad right-of-way as'well. In checking property discriptions out they did not match, we found that this sriall strip had not been annexed. lle have gone back to square one and had us start over." Hinrichs: "You are sure that the new description i~~in order?" Jantz: "Yes, we have been through this twice and we have it square now." Hinrichs: "There still may be some questions on water and sewer lines.?" Jantz: "On the original annexation part of the agreement was that within a year we would have water and sewer~to this property. !de have, in fact, in the last couple of weeks sold a piece of property and I think everything is already in order to pretty much go ahead with the water and sewer with the exception of areas we have to cross. I am not as knowledgeable as Keith (Stokes) is but I think we are within three or four weeks of set.to go on the water and sewer, providing the ordinance goes through, and everything is set to go. Also, in referring to the minutes of the last meeting, you may remember that we have a pump there that we are going to work with the City on. We have already the fire system in and it has been put in, and the sewer lines, to Locust Grove." Hinrichs read the Council motion to annex Locust Grove Industrial Park on July 7, 1980 "The Motion was made by lJi1liams and seconded by Kingsford to approve Annexation of Locust Grove Industrial Park, Parcel I and Parcel II, "D" Industrial, the the Council have design review, that the parcel be platted within a one year time frame, and all portions at that time be connected to water and sewer" Hinrichs: "Is there any comment .from the public regarding Locust Grove Industrial Park Annexation?" There were none. Meridian Planning & Zoning .8. Februa~r 9, 1981 a remarkable job and fulfilled all obligations of the contract.: Quinn displayed a portfolio. Quinn: "We have already submitted a proposal to the City, a maximum of 40 benches. we have strict limitations where they would be located, limitations on advertising matter, maintenance, etc.. What we would like to do here is look at the shopping areas, school areas, possibly park and ride locations. 6~Je pay a certain amount. of dollars per bench, per year. ACHD gave me approval for the benches in Boise and they have O.K'd me for the City of Meridian." There was discussion concerning the necessity for benches. The Motion was made by Sharp and seconded by Mitchell that the Co,~ission recommend to the City Council approval of the agreement with Point of View to place benches within the City of Meridian, subject to limitations on number, quality and location. Motion Carried: Sharp, yea; Mitchell, yea Spencer, Abstain Clyde Dempsey approached the Commission to report that he had attended the Pleridian School Board meeting and the Board had voted 4 in favor and 1 against the proposed Mobile on Wheels Snack Shack. Mr. Dempsey had come before the Commission for input earlier (Agenda 1). Dempsey questioned if this outcome would make any difference with the Commission's feeling. Sharp and Spencer against, Lee P~1itchell in favor. There being no other business to come before the Commission, The P1otion was made by Mitchell and seconded by Spencer that the meeting be adjourned at 9:45 P.PI.
