Pursuant to JUB's letter of November 22, 1977 to the Mayor, we have
prepared the following discussion in response to their list of comments:
1. The name of Leisman Street has been changed to "West State
Street".
2. A survey tie has been made to the C 1/4 corner and is shown
on the Plat.
3. The distance of 660 feet shown on the plat is all the property
Mr. Leisman has ownership of. He is presently considering
Acquisition of the remaining property in question however since
it must be decided by a party other than his seller, it will
probably take some time to accomplish. We agree that the
distance shown does not agree with that dhown on the plat of
Phillip Addition, and we further agree with the closing distance
that would fit the Phillip Addition Plat. Our basis of bearing
was the bearings JUB established on the Phillip Addition Plat.
4. We have never been requested to show the features of an adjacent
subdivision before. The legality of such a request is somewhat
in question because the state subdivision law requires the
engineer of record certify that the land shown was indeed
surveyed by him. In this case, we could not certify as to the
property lines within Phillip Addition and it should not be our
responsibility to reestablish the property pins in order to
do so. It is our understanding the city council did in fact
grant a variance for the non -continuation of West 15th Avenue.
If this is not the case, we respectfully request such a variance.

for the attorneys of the Bureau and the District
to concur in the writing of a license agreement
so that, in addition to protection for the United

The Nampa and Meridian Irrigation District has forwarded us a request
and drawing depicting the relocation and tiling of the existing
Ninemile drain in the SW -14 -NW -4 of section 12, T. 3 N., R. 1 W., B.M.,
Idaho. The proposal was submitted to them by your firm in
connection the Leisman Addition Subdivision.
In order for us to proceed with granting permission to relocate and
tile the drain we will need a centerline description of drain as it
is to be relocated. We will also require a reservation of a right-
of-way sufficient in width for future operation, maintenance and
repair of the drain. While the United States presently holds right-
of-way for the waterway under the Act of August 30, 1890, (26 stat.
391) it would be much better for all concerned if the right-of-way
is defined and recorded in the county records. The width of right-
of-way should"determined in consultation with the Nampa and
Meridian Irrigation District who operate and maintain the
Ninemile Drain.

This department has reviewed and approved the final
plat for this subdivision for Central water and individual
sewers under the following conditions.
1. Absorption beds are to be constructed at a
rate of 110 sq. ft. per bedroom into clean
natural sand and gravel. The bottom of the
bed is to be no deeper than 2' from original
grade.
2. Systems should be placed in the front yards
to facilitate hooking of the dwelling to
Central sewers when available.
3. After Central sewer becomes active for the
development all unused individual sewage
disposal system permits will be voided.
Any homes built after that date must be hooked
to Central sewer.

The following recommendations should be considered as conditions for
filing the Final Plat.
1. That the lots that border Linder Road and West Pine not have direct
access to those streets and that access is confined to West 15th and
State Street.
2. Shall obtain a surety agreement with ACHD for 110% of the total
construction cost to complete said subdivision street improvements.
3. Shall acquire a right-of-way permit from AND prior to any construction
in public right-of-way.

2. Provide typical cross section for Linder Road and W. Pine Ave. Match
existing pavement impaovements as necessary,
3. Pipe, 12" Class II C-76 is whown, That is all right, but N®re 4
should have added "except where noted".
4. 20' Radii to be used on radii intersecting Linder Road & W. Pine Ave.
5. 5' Concrete sidewalks oo be constructed on Linder Road & W. Pine Ave.
6. Pedestrian ramps to be constructed on all radii as per ACRD Standard
Drawing #415.
7. Install curb side mailboxes at every other lot line as per ACRD Standard
Drawing #480 (revised 2-28-77). This requirement was issued by the
U.S. Post Office for all subdivisions.

Leisman Addition Final Plat
As requested by the Meridian City Council on November 7, 1977
during the regular City Council meeting, we have reviewed the Leisman
Addition final plat and have the following comments:
1. As the property to the East develops Leisman Street could
intertie to the existing street network. The naming of the street must
comply with Ordinance Number 721 which states "where a street is on the
same alignment but is not linked to an existing street, the Commission,
upon recommendation of the Ada County Highway District, shall designate
a name giving preference to existing names".
2. A survey tie is to be made along Pine Street to the 1/4
corner to the East.
3. The distance shown on the plat of 660.00 feet from the
West 1/4 corner, Section 12, T. 3 N., R. 1 W., B.M., to the Northerly
boundary of the subdivision does not agree with adjacent platted sub-
divisions. Smith and Kangas Engineers, Inc., should contact Mr. Tom
Eddy, L.S., of J -U -B ENGINEERS, Inc., to resolve that discrepancy and
any others, such as changes in bearings of lines.
4. Since West 15th Avenue is platted in Phillips Addition,
the plat should show how Phillips Addition backs into the North row of
lots and then a variance must be granted by the City Council to
approve the non -continuation of West 15th Avenue.
5. A note should be added to read: "All side lot line
utility and drainage easements are five (5) feet wide unless other-
wise noted". Also, you have shown considerably more interior side
lot line easements than are required by the City.
6. As a general rule, front lot line easements are not a
requirement by the City but they are permissible.
7. Double frontage lots as shown between Linder and West
15th Avenue are not recommended in the ordinance; therefore, a specific

variance must be granted by the City Council.

8. The Idaho Code requires each Block to have separate Block
Numbers and to number the lots separately in each block starting with
the number one (1) as the first lot in each block.
9. Monuments need to be set at each intersection and so in-
dicated on the plat. We would interpret that this plat will require
four such additional monuments.
10. The distance along the street centerlines shall be
shown such as on Leisman Street, from North Linder Street to West 15th
Avenue and from West 15th Avenue to the East boundary.
11. The twenty (20) foot easement across Lot 1 does not
appear wide enough. The adequacy of this easement needs to be veri-
fied in writing by Nampa Meridian Irrigation District.
12. The City must require in writing permission from all
agencies having jurisdiction for the change and proposed improvements
to Ninemile Creek. Agencies involved but not limited to are; Nampa
Meridian Irrigation District, Idaho Department of Water Resources,
and the U.S. Bureau of Reclamation.
13. To make sure all utilities fit the dedicated right-
of-ways and easements, the final development plans shall be submitted
to the City and the Ada County Highway District and approved before
the final plat is approved. Also, the development plans shall be
submitted for review in order for the City to see if the development
meets the City's requirements for developing the property and adjacent
area. For instance, a critical item is the design and construction
of the sanitary sewer system serving the lots near Leisman Street on
an alignment and grade to the Easterly side of Leisman Addition so
that it can be extended to serve future developments to the East.
14. West Pine Street requires a bearing to be shown on
the plat and it is our recommendation that forty (40) feet be platted
as the Northerly half of Pine Street right-of-way.
At this time we cannot sign the plat until variances
to the ordinance and/or the City Council authorizes us to do so after
consideration of each item listed in this letter.

If the rezone is approved and development proceeds, the District will pro-
vide the following requirements to Meridian Planning & Zoning as conditions

SITE SPECIFIC REQUIREMENTS:
1. Direct lot access to Pine Avenue is prohibited.
2. Direct lot access to State Street is prohibited.
STANDARD REQUIREMENTS:
1. Site drainage plans showing that storm runoff will not flow into public
right-of-way shall be submitted for review and appropriate action by
ACRD, in compliance with Boise City Code 11-3-54 and ACHD policy.
2. Design data for proposed access to public streets shall be provided for
review and appropriate action by ACHD.
3. A right-of-way permit must be obtained from ACHD for all street and
utility construction within the public right-of-way. Combine utility
cuts where practical to limit the number of pavement cuts. Contact

Dear Mr. Niemann,
This rezoning from LO to R15 may accelerate the need for
Joint School District No. 2 to construct additional classrooms
and/or to adjust school attendance boundaries. Meridian Schools
does not have excess capacity. Nearly every school in the
district is beyond capacity.
The Meridian School District supports economic growth for
Idaho and specifically the district's area, but such growth
produces a need for additional school construction. We ask that
planning and zoning officials assist the district in obtaining
support for a development fee statute on new home construction
to help offset the costs of building additional school
facilities. We also ask that the same support for school bond
issues be required from developers and other interests seeking
planning and zoning approval for residential projects. If this
support is lacking then we ask that additional residential
development be denied.
School bus service may be restricted if adequate
turnarounds and loading areas are not provided.
Residents cannot be assured of attending the neighborhood
school as it may be necessary to bus students to available
classrooms across the district.
Developers are strongly encouraged to provide walkways,
bike paths and safe pedestrian access to schools.

1. Frederic V. Shoemaker requests a rezone from LO (Limited Office) to
R-15 (Duplex Units) of 1.2 acres of property located at the northeast
corner of Pine and NW 15th in Meridian.
2. Pine Avenue has 60 -feet of right-of-way (which is adequate), and is
fully improved.
3. NW 15th Street has 50 -feet of right-of-way (which is adequate), and is
fully improved.
4. W. State Street has 50 -feet of right-of-way (which is adequate), and is
fully improved.
If the rezone is approved and development proceeds, the District will pro-
vide the following requirements to Meridian Planning & Zoning as conditions
for approval.
SITE SPECIFIC REQUIREMENTS:
1. Direct lot access to Pine Avenue is prohibited.
2. Direct lot access to State Street is prohibited.
STANDARD REQUIREMENTS:
1. Site drainage plans showing that storm runoff will not flow into public
right-of-way shall be submitted for review and appropriate action by
ACHD, in compliance with Boise City Code 11-3-54 and ACHD policy.
2. Design data for proposed access to public streets shall be provided for
review and appropriate action by ACHD.
3. A right-of-way permit must be obtained from ACHD for all street and
utility construction within the public right-of-way. Combine utility
cuts where practical to limit the number of pavement cuts. Contact

NOTICE IS HEREBY.GIVEN pursuant to the Ordinances of
the City of Meridian and the laws of the State of Idaho, that
the Planning and Zoning Commission of the City of Meridian will
hold a public hearing at the Meridian City Hall, 33 East Idaho
Street, Meridian, Idaho, at the hour of 7:30 o'clock p.m., on
April 9, 1991, for the purpose of reviewing and considering the
Application of THOMAS R. TRACY.and FREDRIC V. SHOF'R, et al,
for a rezone from limited office (LO) status to duplex zone

Dear Mr. Nieman:
Please find enclosed an Application for Rezoning and the
necessary attachments in accordance with the application. On
behalf of the titled owners, I am formally requesting that the
following property be rezoned from vacant limited office (LO)
status to duplex zone (R15):
Lots 1, 2, 3, 4, 5, 6 and 7 of Block 3 of Leisman Addition
to the City of Meridian, Ada County, Idaho (a subdivision).
(See attached Exhibit A for complete legal description).
The names, addresses and telephone numbers of the titled
owners of the subject property, as well as a notarized request
for the zoning amendment, are attached as Exhibits B through C,
respectively. Pursuant to the Meridian Comprehensive Plan, the
Leisman Addition subdivision was designated for residential
development. It is the owners' belief that the characteristics
of the above -referenced property make the zoning amendment
desirable and would also be in harmony with the adjacent
developments, i.e., Phillips Addition and West Lawn Estates.
As an owner of the subject property, I hereby grant a lien
against said property for payment of all costs incurred by the
City of Meridian, which include engineering, publication and
attorney fees.

Dear Mr. Niemann,
This rezoning from LO to R15 may accelerate the need for
Joint School District No. 2 to construct additional classrooms
and/or to adjust school attendance boundaries. Meridian Schools
does not have excess capacity. Nearly every school in the
district is beyond capacity.
The Meridian School District supports economic growth for
Idaho and specifically the district's area, but such growth
produces a need for additional school construction. We ask that
planning and zoning officials assist the district in obtaining
support for a development fee statute on new home construction
to help offset the costs of building additional school
facilities. We also ask that the same support for school bond
issues be required from developers and other interests seeking
planning and zoning approval for residential projects. If this
support is lacking then we ask that additional residential
development be denied.
School bus service may be restricted if adequate
turnarounds and loading areas are not provided.
Residents cannot be assured of attending the neighborhood
school as it may be necessary to bus students to available
classrooms across the district.
Developers are strongly encouraged to provide walkways,
bike paths and safe pedestrian access to schools.

2-416 G APPEAL* ACTION OF COMMISSION AND COUN•
1. Appeals of Action of Commission: Appeals of the action of the
Commission concerning the Administration of this Ordinance may
be taken by any aggrieved person. All appeals shall be filed
with the Council within fifteen (15) days after the action of
the Commission and shall specify the grounds upon which the
appeal is filed. Upon receipt of an appeal of the action of
the Commission, the Council shall reach a decision to uphold or
overrule the action of the Commission. The Council may uphold
the action of the Commission by vote of a simple majority of
the entire membership of the Council. The Council may overrule
the action of the Commission by a vote of a majority of the
entire membership of the Council. No public hearing shall be
held on an appeal to the Council. If the appeal is denied, the
applicant may appeal the Council's decision pursuant to 2-416
G2. If the appeal is granted, the Council shall send the
matter back to the Commission for further consideration and
findings in light of the Council decision. The matter shall
then be processed through the application process as if there
had been no appeal.
2. Appeals of Action of Council: Appeals to the action of the
Council concerning the administration of this Ordinance may be
taken by any aggrieved person. Within thirty (30) days after
notice of the Council action has been given to the applicant
pursuant to 2-416 I (and after all remedies have been exhausted

2-416 H STAY OF PROCEEDINGS
An appeal stays all proceedings in furtherance of the action taken
unless the Administrator certifies to the Council (after notice of
appeal is filed) that by reason of facts stated in the application,
a stay would, in his opinion, cause imminent peril to life and
property. In such case, proceedings shall not be stayed other than
by a restraining order which may be granted by the Council or by a
court based upon an application, with notice showing due cause.
2-416 I NOTIFICATION OF APPLICANT
Within ten (10) days after a decision has been rendered by the
Council, the Administrator shall communicate to the aggrieved appli-
cant of the Council's decision relative to the appeal.

In response to Mr. Niemann's request that the owner state
in writing the reasons and basis for the appeal to the City
Council, we respectfully advise as follows:
1. The subject five lots, along with all of the 17 lots
in the Leisman Addition Subdivision were .initially developed to
be duplex lots in 1977-78. Then in 1981 the then owner and
developer sought to have them rezoned to LO and as you know, a
portion of them have been developed as offices, although on
balance, both the change in the restrictive covenants and the
rezone from office to residential have proven to be a mistake in
that some 13 years later we still have seven undeveloped lots.
2. This is simply a product of the market in the
vicinity not commanding additional office development. In
contrast, as the City Council is no doubt aware and as was the
unanimous testimony before the Planning and Zoning Commission,
there is considerable demand in Meridian for residential lots and
in particular, duplex lots. Thus, Mr. Lowe, the contract buyer,
is seeking a rezone to allow construction of duplex lots, just as
he successfully sought the written approval of a majority of the
other lot owners in the subdivision, to change the restrictive
covenants to allow duplex construction.
3. The applicant submits that the Planning and Zoning
Commission's Findings of Fact and Conclusions of Law do not in
fact support or present a lawful basis to deny the rezone.

4. As this subdivision was originally developed and
platted and all utility services installed in contemplation of
duplex development, construction of duplexes on these lots
represent a practical and if anything, the most efficient use of
the lots.

6. The only "negative" conclusions or observations made
by the Commission were subparagraphs 4D, E and K. Paragraph 4D
states that: "There has not been any change in the area or
adjacent areas which would dictate that the area should be
rezoned."
This is true in the traditional sense in that there has
been no significant development or trend towards residential
development in the immediate vicinity; however, the events and
experience in the vicinity suggests, as above -stated, that the LO
zone does not foster development of the property. Of course, not
all residential and commercial zones are incompatible. The
Meridian Zoning Ordinance in fact recognizes this in that an R-15
zone allows the development of sales and professional offices on
a conditional use basis.
This in fact supports the rezone request sought by the
applicant in that some or all of the property could, on a
conditional use basis, be developed as offices as has the balance
of the Leisman Addition.
7. If the City of Meridian had a different zoning
ordinance in place in 1977-78, applicant submits, the property
would have originally been zoned and stayed oned R-15 to allow
construction of either duplexes or offic:s. Rezoning the
property to R-15 simply affords the owner of these five lots the
flexibility to develop either as offices or as duplexes that the
prior owners did not have.
8. Each rezone is different. Here lwe are not talking
about a change from industrial to single-family residential, but
a very slight and modest change in zone and one that essentially
restores the zoning to what was in place prior! to 1981.

9. Paragraph 4D states that the proposed use will not
be "designed, constructed, operated and maintained to be
harmonious and appropriate in appearance with the existing or
intended character of the general vicinity and that such use will
change the essential character of the' same area." This is false
in that constructing five duplexes in an area that is in part
office and in part residential development is not going to alter
the essential character of the general vicinity which is in part
residential and in part office - both relatively low intensive
uses, as opposed to commercial or industrial.
10. Paragraph 4K states, in a concl'sory fashion, that
the "proposed zoning amendment is not in the blest interest of the
City of Meridian."
Reasonable men may differ as to what is in the best
interests of the City of Meridian, but there was no evidence
submitted during the Planning and Zoning Commission's hearing
that the proposed rezone would be detrimental to the City as a
whole. As such, this conclusion lacks any ',supporting factual
basis.
Moreover, these five lots lie near thelcenter of the City
and are already "served" by expensive infrastructure, i.e.,
police, fire,, sewer and water. It makes little sense to have
property ready for development but not developed in or near the
city center. The property is producing but a fraction of the tax
revenues that they will produce upon development. Mr. Lowe has
testified that he is prepared to commence construction on at
least two duplexes this building season. The rezone, of course,
will not preempt other types of construction and, as above -
stated, will authorize construction of both office and duplexes
should his market predictions prove in error.

Jerry Vorlicky, Mike Cammann, Wayne Crookston, Dick
Leisman, John Fitzgerald, and myself, who are all the owners
or people who hold an interest in Leisman Addition, hereby
request that the zoning of Leisman Addition be changed from
"A" Residential to "C" Commercial. The request is made with
the understanding that if the change is made it would be
restricted to commercial other than retail.
As you know, Meridian Professional Plaza was granted a
Conditional Use Permit to build some offices on the western
lots of the subdivision. Our intent is to continue the
development of the subdivision in the same fashion. John and
Wayne plan to build their own office building on the northern
lots of the subdivision. Additionally, they plan to continue
the development in like fashion to the lots in the eastern
part of the subdivision.
Included herein is a list of the residence and property
owners within 300 feet of Leisman Addition. We will forward
the necessary certified copies of the Notice of Hearing to
them as required by the ordinances of the City of Meridian.
Also, accompanied herewith are the required maps.

Dear Occupant:
You will find enclosed with this letter a notice of
hearing before the Meridian Planning and Zoning Commission
and City Council of our request to rezone the Leisman Sub-
division from part commercial (under conditional use permits)
and part residential to commercial.
As you have already noticed, we are in the process of
completing the first two buildings now. I am sure you agree
that these are attractive and are positive additions to our
area.
Our plan is to continue on around the subdivision with
similar buildings and create a "Professional Office Center."
we feel that it is in the best interests of everyone concerned
to change the zoning instead of continuing on with conditional
use permits.
We intend to lease to professional people and we have no
desire nor intention of permitting anything such as a drive-in,
retail, etc. and the quality of all the buildings will be
similar to those presently built.
Another positive aspect of doing it this way is the
restrictive covenants will be for our type of operation. I
feel that this will be a positive addition to the community
as well as increasing the tax base, and I invite your support.
