We request that you require a set back an Cherry Lane that wi11 protect the right-of-way needed for the Cherry Lane Project. Due to the nature of this complex and the age and abilities of the people who will occupy the rental units we are requesting your consideration to lower the number of parking spaces required per unit. We find in nur survey of senior citizens that as many as 40% of these people do not have automobiles due to financial or health limitations. k'or that reason we feel that 23 spaces would be very adequate to accommodate any and all vehicles used in conjunction with:_ii'uing, in this complex. The most important factor of this :type of loan is to keep the rental rates as low as possible. Due to fixed land costs the additional two units gained by this variance would lower the rental rates considerably and provide a very attractive and liveable complex at a reduced cast to the .renters. The majority of the people living in this complex have a fixed income of $5,000 a year or less. _{ . ,~ • • This complex will be designated senior citizens for the life of the mort- gage which will be 50 years. Due to the design and size of the living units it would not be feasible or practical to change the type of occupancy, The information gained by our survey indicated that the majority of these people have lived in this axes many years. Storey Mayor of Meridian 728 Meridian Street Meridian, Idaho 83642 Dear Mayor Stacey: Recently our department has received several questions from developers inquiring as to who may connect to the Meridi.Gn sa~iitaxy sewer system. Since these appears to be some question a~ to our position an additional connections to the sewer system, cre ~~rould like to clarify the matter at this time. Apparently, our department has no jurisdiction on s~udi.visions or land within the City which was platted pciox;to Jerry Yoder's letter of A4ay 2, 1975; consequently these sub divisions may"'b e con- nected to the sanitary sewer i£ the City of Meridian h~.s no objections. However, we would like to point out that Meridian could violate its NPDE5 di.schaxge permit if it continues to allow add.itioraa-1 cannecti.ons to the sewer system, and that once such violations occur, bringing the sewage treatment plant effluent back into compliance Tith the permit might be difficult. ti9e would also paint out t1~.G~~c your letter of January 9, 1975 concerning a certificate of adequacy for the. Meridian sewage treatment system stated that additional connections to the sewer system would not be allowed. Based on this letter ~•re concluded that the proposed improvements to the water s}rstem would have little impact on the I~?eridian sewage treatment s}Ystem. If additional connections to the sewer system axe allowed, v;e ~~~ill have ' to reevaluate our statement concerning the certificate of adequacy. In summary, although our department appears to have no legal jurisdiction over subdivisions platted prior to May 2, 1973, the City of Meridian may not want to allow'additional connections to the sewer system because of possible violations to the NPDES discharge permit anal-possible effects on the certificate of adequacy. If you have any questions concerning this matter, please contact me.
