It is ap- parent from the tenor of Mr. Dowdle's letter that the corpora- tion is not prepared to accept any responsibility for any damages sustained by you as a result of the manner in which the subdivision was developed. It is also apparent that Mr. Dowdle is not familiar with the fact that Title 50, Chapter 13 of the Idaho Code, which provides for the filing of plats when a tract of TaF2is divided into five or more parcels, does not require that the developer sell the parcels as "lots". A vio- lation of the Idaho statutes occurs when the tract of land is divided and sold as five or more "parcels". This is precisely what occurred in the instant case. After you have had an opportunity to review the en- closure, please call nye in order that we can discuss the manner in which you wish to proceed. I suggest that we obtain an opinion concerning the damages sustained by you as a result of the wrongful development of the subdivision and then submit a demand letter to Gem Estates, Inc. and Howard Dunbar. December 17, 1979, regarding alleged damages to Mr. David Reeves. Compliance and approval of Plans and Specifications for this subdivision were accepted by the Meridian Planning and Zoning Board, the Meridian City Council and the Ada County Highway District. Building permits were issued by the City of Meridian and the apartments were allowed to hook on to the Municipal water and sewer systems. Also, the streets have been accepted by the :oda Cotinty flighway District for permanent maintenance. All of the property in the subdivision was sold as parcels on a metes .ind bounds descripti.ori :end not on a lot hasis, the ar����!!ent tli.tt we would file a plat when required. The parcel on which Nlr. Reeves resides was included in the original zoning for four-plex apartments. We did not sell tree property to Mr. Reeves and do not know what o reasontoas disclosed at the time of his purchase but have !1 t that information regarding zoning was withheld. We have developed the project according to the specifica- tions of the various agencies involved and believe that we are legal in every respect and have no!, damaged anyone. Storey Q Mayor of r'aridi.an 728 Meridian Street 2.1 Meridian, Idaho 83642 Dear Mayor Storey: G] R.ecently our department has received several questions £ron developers inquiring as to who may c0nnPct to the Neridian sanitary Sewer system. Since there appears to be some question as,to our Position on additional connections to the sewer system, we would like to clarify the matter at this time. Apparently, our department has no jurisdiction on subdivisions or land within the City v,hich was platted prior to Jerry Yode_r's letter of May 2, 1973; consequently these subdivisions maybe,. con- nected to the sanitary sewer it the City of Meridian has no objections. Hov:ever, we ti:iould life to point out that Meridian could violate ; is NPDES discharge permit if it continues to allow additional connections to the sewer system, and that once such violations occur, bringing the selvage treatment plant effluent back into compliance with the permit might be difficult. We would also point out that your letter of January 9, 1975 concerning a certificate of adequacy for the Meridian sewage treatment system stated that additional connections 4 to the sewer system would not be allutved. Based on this letter we f: - concluded that the proposed improvements to the water system would = " have little impact on the Meridian sewage treatment System. If additional connections to the sewer system are allowed, we will have to reevaluate our statement concerning the certificate of adequacy. In summary, although our department appears to have no legal '. jurisdiction over subdivisions.pla.tted prior to May 2, 1973, the City., of Meridian may not want to allow additional connections to the .sewer system because of possible violations to the NPDES discharge permit `Vand-possible effects on the certificate of adequacy. May 19, 1975 - City Council accepted the plans and specifications of Gem Estates, including drawings, development plans, street plan, profile and storm details, standard details sewer plan, profile and plat. August 14, 1975 - Council accepted Dowdle's proposal not to plat at the present time and there were to be four ownerships until platted. Dowdle agreed to plat when required to do .so (Dowdle letter, December 2.8, 1979) . 1. The first item to consider is a difference between construction and the plans of Gem Estates. .It. appears. that the City Council had .before it on May 19, ,1975, the "Ultimate Development Plan" of Gem Estates, when .it approved Gem Estates., It does not appear, however, that a copy of the development plan was maintained in the files 'or forwarded to Vern Schoen. Therefore, the City had no way of knowing construction had not been in conformance with.the development plan. Mayor and City Councilmen March 3, 1980 Page Two The discrepancy between the development plan and the actual construction, as concerns Mr. Reeves, is that the driveway for the fourplex on the cornea: of Pine and 7th Streets was flip-flopped. In other words, the plans show the driveway on the south side of the unit whereas the drive- way is on the north side as actually constructed. This is an unusual situation, in that.normal7_y exact layouts of where buildings and driveways are to be placed on lots are not submitted for approval. Ordinarily such minor details of subdividing are left to the desires of the_developer,.buil.der, or lot purchaser, and are not "set in concrete" by the approval of the City Council. If the developer of Gem Estates had, at the time of construction, approached the Council requesting the flip-flop, it could have been summarily granted. Therefore, as to the difference in construction and the plans,. it is my recommendation that the City Council, on their own motion, approve the plans as they pertain to the fourplex unit of Gem Estates on the corner of Pine and 7th Streets, as actually constructed. 2. The second item to consider is the platting of Gem Estates. At the Council meeting of August 14, 1975, Jack Dowdle, the developer of Gem Estates, requested that he not be required to plat the subdivision at that time. Both the City ordinances and the State statutes required that the subdivision be platted. Mr. Dowdle did agree and apparently presently agrees to plat the subdivision. PZFE AND FITTINGS 1. Scope This section includes the work necessary for the installation of the water distribution lines and fittings, including but not limited to excavation, backfill and beddings; furnishing all materials; fine grading the trench bottom; providing base for the pipe; laying and jointing the pipe, connecting the new pipelines to the existing pipelines; pouring thrust blocks; final cleanup; and all incidental and related work. 2. Materials a. Cast Iron PiPe Cast iron pipe for the distribution lines shall be Class 150, push on joint, thin cement lined cast iron pipe and shall conform to the requirements of ASA 21.6 and ASA 21.11 Specifications. The minimum laying length shall be eighteen (18) feet and of the size as shown on the plans. (1) Joints Joints for the cast iron pipe shall conform to the requirements of ASA A21.11 or ASA A21.6 Specifications. (2) Li_ ni_n_g Thin cement mortar lining for the cast iron pipe shall conform to the requirements of ASA A21.4 Specifications. (3) Fittings Fittings for the water distribution pipes shall be Class 150 cast iron, mechanical joint fittings and shall conform to the requirements of ASA A21.10 Specifications.. Fittings shall be furnished complete with high strength cast iron nuts and bolts, rubber follower gaskets, and cast iron follower glands. b. Polyvinyl Chloride _(PVC) Pipe and Fittings The pipe and fittings shall be made of PVC plastic which conform to the requirements of ASTM D-1784 for a Class I Type I compound and shall meet the requirements for a 12454-B compound. The normal lengths of pipe shall be twenty (20) feet and of the size as shown on the plans. Fittings shall be mechanical joint cast iron and all adaptors shall be furnished for transition from one pipe material to another. (1) Gaskets Gaskets shall conform to the chemical and physical requirements of ASTM C-433. The gasket configuration shall be as recom- mended by the pipe manufacturer for the particular pipe in use. Installation shall conform to the manufacturers recommendation.. (2) Bell Section The bell section shall be designed to be of the same strength or greater than the pipe wall. c. Thrust Block Thrust blocks shall be constructed of concrete having a minimum twenty-eight (28) day compressive strength of 2,500 psi unless otherwise indicated. 3. Workmanship a. Excavation, Backfill,_a_nd Bedding All excavation, backfill, and bedding shall conform to Section 2.01, A, Attachment 2, of these specifications. b. Grade The depth of the trench shall be as required to allow for the pipe bedding and to place the top of the pipe at a minimum depth of two and one-half (2 1/2) feet. c. Handling Material Proper implements, tools, and facilities satisfactory to the Engineer shall be provided and used by the Contractor for the safe and convenient prosecution of the work. In general, slings shall be of heavy canvas or nylon of suitable strength for supporting the load. The use of unprotected chains or cables will not be permitted. All pipe and fittings shall be carefully lowered into the trench, piece by piece, in such a manner as to prevent damage to the pipeline materials and linings. Under no circumstances shall pipeline materials to dropped or dumped into the trench. d. Hammer Test Cast iron pipe and fittings shall be inspected for defects, and, while suspended abovegrade, be rung with a light hammer'to detect cracks. e. Cleaning Pipe and Fittings The ends of mechanical joint fittings and push -on joint pipe shall be wiped clean of all dirt, grease, and foreign matter. .f. Placing of Pipe in the Trench Every precaution shall be taken to prevent foreign material from entering the pipe while it is being placed in the line. If the pipe laying craw cannot put the pipe into the trench and in place without getting earth into it, the Engineer may require that, before lowering the pipe into the trench, a heavy, tightly woven canvas bag of suitable size by placed over each end and left there until the connection is made to the adjacent pipe. During laying operations, no debris, tools, clothing, or other materials shall be placed in the pipe. g. Preventing_ Trench_Water from Entering Pie At times when pipe laying is -not in progress, the open ends of pipe shall be closed by a watertight plug or other means approved by the Engineer, and no trench water shall be permitted to enter the pipe. This provision shall apply during the noon hour as well as overnight. If water is in the trench, the seal shall remain in place until the trench is pumped free of any standing water. h. Cutting__Pip_e The cutting of pipe for inserting valves, fittings, or closure pieces shall be done in a neat and workmanlike manner without damage to the pipe or lining and so as to.leave a smooth end at right angles to the axis of the pipe. When cast iron pipe is cut in the field it shall be cut as recommended -2- by the pipe manufacturer, and the cut end shall be reconditioned so that is may be used for the next joint. The outside of the cut shall be ground back or dressed as recommended by the pipe manufacturer and approved by the Engineer. i. Bell End to Face Direction_ of'Laying Unless otherwise directed, pipe shall be laid with bell end facing in the direction of the laying; and for lines on an appreciable slope, bells shall (at the discretion of the Engineer) face upgrade. J. Permissible Deflection at JAints Where it is _ necessary to def1g6t pipe €reg a sttaigt�t line, either in the Vettieal df Horizontal plane, to avoid obstruction, to plumb valve stems, or where long -radius curves are permitted, the amount of deflection allowed shall not exceed that recommended by the manufacturer and approved by the Engineer. k. Alignment_ Pipelines intended to be straight shall be so laid, and in no case shall a deviation from the straight line at any joint exceed one inch. 1. Unsuitable Conditions for Laying Pipe No pipe shall be laid in water or when, in the opinion of the Engineer, trench conditions are unsuitable. m. Jointing_Mechanical Joint Cast Iron Fittings Mechanical joint cast iron fittings shall be installed in accordance with the manufacturer's recommendations as approved by the Engineer. n. Jointing Pipe Piping shall be laid and jointed in strict accordance with the manufacturer's recommendations as approved by the Engineer. The Contractor shall provide all special tools and devices such as special jacks, chokers, and similar items required for the installation. Lubricant for the pipe gaskets shall be furnished by the pipe manufacturer, and no substitutes will be permitted under any circumstances. o. Mechanical Couplings Before coupling, each pipe end shall be thoroughly cleaned of oil, scale, rust, and dirt for a distance of at least eight (8) inches back from the end to provide a seat for the coupling gaskets. The pipe coating need not be removed if it presents a smooth surface and is securely bonded to the pipe. Couplings shall be installed in accordance with the manufacturer's instructions. Care shall be taken that the gaskets are wiped clean before they are installed. If necessary, they may be lubr.icated.with soapy water for installation on the pipe ends. Coupling bolts shall be tightened progressively, drawing up bolts on opposite sides a little at a time until all bolts have a uniform tightness. P. Fitting; Installation Fittings shall be installed at the locations shown on the Plans or as directed by the Engineer, or both. Fittings shall be handled, cleaned, patched, laid, and coupled in the manner hereinbefore specified for the handling, cleaning, patching. laying, and coupling of pipe. -3- q. Anchorage (1) Limiting Pipe Diameter and Degree of Bend On all pipelines four inches in diameter or larger, all tees, plugs, caps, and bends exceeding 22 1/2 degrees and other locations where unbalanced forces exist shall be securely anchored by suitable thrust blocking as shown on the Plans or hereinafter specified. (2) Thrust Blocks Reaction or thrust blocks shall be placed as shown on the Plans. Blocking shall be placed between the undisturbed ground and the fitting to be anchored. The quantity of concrete and the area of bearing on the pipe shall be as shown on the Plans or directed by the Engineer. The blocking shall be so placed that, unless specifically shown otherwise on the Plans, the pipe and fitting joints will be accessible to repairs. r. Tests and Ins ections (1) Test-Si2ecimens Test specimens in the amounts set forth, in the applicable ASTM Specifications shall be furnished the Owner at no charge. (2) Pipe_ Inspection Specimens for strength tests may be selected by the Engineer in accordance with the applicable ASTM Specifications from pipe in the pipe manufacturer's yard or at the point of delivery to the Contractor. The provisions of applicable ASTM Standards shall apply, except as modified herein, in regard to the number of tests made, the evaluation of such tests, and the rejection or acceptance of pipe. The Owner reserves the right to approve the testing agency, and the Engineer's evaluation of the results of such tests shall be final. (3) Hydrostatic Tests Pressure and leakage tests shall be made on all newly laid pipe or any valved section of it, or both. The Engineer will conduct the tests, but the Contractor shall furnish all necessary assistance, equipment, And material and shall make all taps in the pipe as required. The Contractor shall furnish the following equipment and materials for the tests: 2 5 gallon graduated containers 2 Pressure gnages 1 Hydraulic force pump similar and equal to Pacific H.T. 75 as manufactured by the Pacific -Pumping Company of Portland, Ore. Suitable hose and suction pipe as required. The tests shall be conducted after the trench has been backfilled or partially backfilled with the joints left exposed for inspection. Where any section of pipe is provided with concrete reaction blocking, the pressure test shall not be made until at least five days have elapsed after the concrete reaction blocking is installed. If high -early cement is used for the concrete thrust blocking, the time may be cut to two (2) days instead of the five previously specified. -4- .The pressure test shall be conducted in the following manner. After the pipe has been backfilled or partially backfilled as hereinbefore specified, the pipe shall be filled with water. The test pressure shall be one and one-half ( 1 1/2) times the normal static pressure but not less than seventy-five (75) pounds per square inch. (a) Duration The duration of each pressure test shall be thirty (30) minutes. (b) Expelling Air Before applying the specified test pressure, all air shall be expelled from the pipe. (c) Procedure Each valved section of pipe shall be slowly filled with water to replace any lost; and the specified test pressure, measured at the point of lowest elevation, shall be applied by means of a pump connected to the pipe in a saitsfactory manner. The pump shall then be valved off, and the pressure shall be held in the line for the test period. At the end of the test period, the pump shall be operated until the test pressure is again attained. The pump suction shall be in a bucket, barrel, or similar device, or through a meter so that the amount of water required to restore the test pressure may be measured accurately. s. Leakage Leakage shall be defined as the quantity of water necessary to restore the specified test pressure at the end of the test period. No pipe installation will be accepted until the leakage is less than the number of gallons per hour as determined by the formula following: L = ND (p)1/2 5500 in which L = allowable leakage in gallons per hour N - number of joints in the length of pipe tested D = nominal diameter of pipe in inches P - average,test pressure during the leakage test in pounds per square inch Should any test of pipe laid disclose leakage greater than that allowed above, the Contractor shall, at his own expense, locate and repair the defective joints or pipe until the leakage is within the specified allowance. t. Sterilization Sterilization of new lines shall be completed by the Contractor prior to connection to the existing system in accordance with the Standard for Disinfecting Watermains prepared by the American Water Works Association (AWWA C601; Latest Revision) B. FIRE HYDRANT AND AUXILIARY VALVE 1. Sc_ ope This section covers the work necessary for the fire hydrants and auxiliary valves, including but not limited to furnishing the fire hydrants, auxiliary valves, auxiliary valve boxes, and appurtenances; excavation and backfill; installing the fire hydrants, auxiliary valves, auxiliary valve boxes, and appurtenances; and all incidental and related work. 2. Materials a. Fire H drants All fire hydrants shall be standard AWWA specifi- cation fixe hydrants, for four (4) foot setting, with minimum four and one— half (4 1/2) inch diameter valve opening; 175 psi working pressure; two' (2), two and one-half (2 1/2) inch fire hose outlet nozzles, valve operator to open to the left; a breakable traffic flange just above ground level; a drain which automatically opens when the hydrant is closed; and a six (6) inch diameter flange at the bottom which connects to the auxiliary gate valve. b. Auxiliary Valves Auxiliary gate valves shall conform to the applicable requirements of Section 1.01-C of these Specifications. Auxiliary gate valves shall be six (6) inch, nonrising stem with standard square two (2) inch operating nut and shall open counter -clockwise. The valve shall be flanged on one end to fit the flanged inlet to the fixe hydrant, and the opposite end sall be furnished for mechanical, joint to fit the six (6) inch supply pipe. c. Valve Box The valve boxes for the auxiliary valves shall conform to the requirements of Section 1.01-C of these Specifications. 3. Workmanship_ a. Location Hydrants shall be located as shown on the Plans or as directed by the Engineer in.a manner to provide complete accessibility and to minimize the possibility of damage from vehicles or injury to pedestrians. b.. Position All hydrants shall be installed plumb and shall have their nozzles parallel with or at right angles to the curb with the pumper nozzle facing the curb, except that hydrants having two hose nozzles 90 degrees apart shall be set with each nozzle facing the curb at an angle of 45 degrees. Hydrants shall be set to the established grade with nozzles twelve (12) inches above the ground as shown on the Plans or as directed by the Engineer. c. Connection to Main Each hydrant shall be connected to the main with a six (6) inch cast iron branch controlled by an independent six (6) inch gate valve, unless otherwise specified. d. Hydrant Drainage Hydrant drainage shall be provided at the base of the hydrant by placing gravel or crushed stone from the bottom of the trench to at least six (6) inches above the waste opening in the hydrant and to a distance of one (1) foot around the elbow. No drainage system shall be connected to a sewer. The fire hydrants shall be set upon a stable granular material or a concrete base at least twelve (12) inches square by four (4) inches deep::. e. Anchorage of Hydrants The bowl of each hydrant shall be well braced against unexcavated earth at the end of the trench with stone slabs or concrete blocking as shown on the Plans or directed by the Engineer. 271! Sco a This section covers the work necessary for the cast iron gate valves and valve boxes including but not limited to furnishing the cast iron gate valves, valve boxes, and appurtenances; excavation. -and backfill;. installing the cast iron gate valves, valve boxes, and appurtenances; and all incidental and related work., 2. Materials a. Gate Valves All valves shall be standard AWWA Specification gate valves, 175 psi water working pressure, double bronze mounted, non -rising stem, with 0 -ring rubber gasket, and with a two (2) inch square operating nut, opening to the left. Unless otherwise indicated on the drawings, valves shall have mechanical joint ends. Valves shall be complete with cast iron bolts, nuts, rubber gaskets, and cast iron follower glands. b. Valve Boxes All gate valves shall be fitted with a standard adjustable cast iron valve box and lid. 3. Workmanship a. General Valves shall be set and jointed to the pipe in the manner specified in Section 1.01,A,3 of the Specifications . A valve box shall be provided for every valve that is to be buried in the ground. The valve box shall not transmit shock or stress to the valve and shall be centered and plumb over the wrench nut of the valve with the box cover flush with the surrounding surface, or at such other level as may be directed, by the Engineer. b. Location Valves shall be located as shown on the Plans or as, field located by the Engineer during construction. D. WATER SERVICE CONNECTIONS 1. Scope This item covers the work necessary for the water service connections at existing locations, including but not limited to furnishing all materials, excavation and backfill; installation of corporation stop valves; water service connection pipeline and fittings; and all incidental and related work. 2. Materials a. Corporation Stop Corporation stop valves shall be of the size re- quired to match the water service connection pipe as hereinafter specified. b. Water Service Connection Pie Water service connection pipe shall be copper or Class 160 PVC. Water service pipe shall be one (1) inch I.D. if only one fourplex will be served and one and one half ( 1-1/2) inch I.D. if two fourplexes will be served. c. This item includes the work necessary for the trench excavation and backfill, including but not limited to clearing of right of way; protection of private property during construction; disposal of cleared materials; excavation of the trench for the pipe and appurtenances; trench backfill of the type specified by the Engineer; removal, replacement, and rehabilitation of all drainage and irrigation ditches, waterways, or other features moved or damaged during construction; removal of existing pavement; locating and protecting existing utilities; repair of damage to utilities; the maintenance of adequate barricades, lights, and warning signs for the protection of the public on City streets, public highways, county roads, and private drives; shoring, cribbing, bracing, sheeting, and dewatering as maybe required; the maintenance of access to public thoroughfares and to private property; hauling and disposal of waste excavation, including temporary hauling and disposal of spoil which cannot be accommodated within the designated right of way; repair of public and private property damaged during construction; final clean-up of the construction areas; and all miscellaneous items of work required to complete the construction specified hereunder. b. Sewer Pipe This item includes the work necessary for the installa- tion of the sewer pipe and fittings of the sizes and classes indicated, including but not limited to furnishing all materials; fine --grading the trench bottom; providing base for the pipe; providing bell holes in the trench bottom; laying and jointing pipe; installing closure collars; furnishing pipe necessary for physical tests and air testing of the line: 2. Materials a. Excavation and Backfill (1) Excavation All excavation is unclassified. The Contractor shall complete all excavation of every description regardless of the character, nature, or condition of the material encountered. . (2) Selected Backfill Material Selected backfill material, in the initital backfill zone as hereinafter defined for sewer pipe shall contain no piece of material larger than three (3) inches for all sizes of pipe. (3) Water for Backfill It will be the Contractor's responsibility to make all necessary arrangements for a source of water during all periods of construction and to make all arrangements for delivery of the water to the trench side. b. SewerPip • (1) General The Contractor shall use polyvinyl chloride (P.V.C.) sewer pipe or a pipe having a recommended.Chezy Coefficient of 140 or greater. The pipe shall be of the diameter shown on the drawings and the physical properties specified below. (2) PolZyinyl Chloride (PVC) Pi a and Fittings (a) Compound The pipe and fittings shall be made of polyvinyl chloride (PVC) plastic which shall meet the requirements for a Class 12454-B compound. The minimum physical properties and chemical resistance of the PVC compound shall meet the requirements of ASTM D-1784 for a Type 1, Grade 1 compound. (b) Gravity Sewer Pipe and Fitting_s__ Polyvinyl chloride (PVC) gravity sewer pipe and fittings shall be Type PSP meeting the requirement of ASTM D-3033. All pipe shall be SDR 41. (c) Larking All pipe shall be marked at intervals of no less than five (5) feet with: Normal pipe size SDR number Type Appropriate ASTM number Working pressure (d) Couplings All polyvinyl chloride (PVC) sewer pipe shall have an integral belled gasket pocket coupling at one end.. The gasket shall fit snugly into the space between the under lapping spigot and the gasket retaining pocket to form a flexible watertight seal. (e) Gaskets The surface of the gasket shall be smooth and free of pits, cracks, blisters, air marks and other --imperfections that would impair its use. Gasket strength shall be such that the gasket can be strentch to 150% of it's normal circumference without harm to the gasket. (f) Pipe Length Normal lengths of pipe shall be twenty (20) feet. Other pipe lengths shall be provided if required. (g) Fittings Fittings such as saddle outlets, elbows, tees, wyes, etc. shall be of the same material and compatible in con- struction to the adjacent.pipe. (3) Other than PVC If the Contractor wishes to use other 'than PVC sewer pipe he shall submit to the Engineer the pipe manufacturers information relative to flow characteristics, load carrying capabilities, and other test results which may be deemed necessary for approval by the Engineers. The Engineers shall notify the Contractor, in writing, within 7 days of receipt of said information as to the acceptability of the pipe. 6-M c. Closure Collars Closure collars shall be constructed of concrete having a minimum twenty-eight (28) day compressive strength of two thousand (2,000) psi. Closure collars shall•be used to make connections and pipe joints when conditions prevent the use of the standard rubber-gasketed joint furnished with the pipe. 3. Workmanship a. Excavation and Backfill (1) Clearing the Right of Way Where clearing of the right of way is necessary, it shall be completed prior to the start of the trenching. Brush shall be cut as near to the surface of the ground as practicable and removed to an approved disposal area. The Contractor shall observe all Federal and State laws gelating to hauling permits and local regulations relating to burning and/or otherwise disposing of such materials. Under no conditions shall excavated materials be permitted to cover brush prior to clearing and removing same. (2) Obstructions This item shall refer to obstructions which may be removed and do not require replacement. Obstructions to the con- $txuction of the trench such as but not limited to tree roots, stumps; abandoned concrete structures, and debris of all types shall be removed by the Contractor at his own expense without additional compensation from the Owner. The Engineer will, if requested by the Contractor, make changes in alignment to avoid major obstructions if such alignment changes can be made without adversely affecting the intended functioning of the facility. The Contractor shall pay all additional costs to the Owner resulting from such alignment changes. (3) Trenches Trench excavation shall be to line and grade as established by conventional practice or as ordered by the Engineer. The bottom width of the trench shall not be less than twelve (12) inches or more than twenty-four (24) inches wider than the outside diameter of the pipe to be laid. The trench shall be adequately and properly timbered or shored. The Contractor shall be res?onsible for the adequacy of all shoring, sheeting, and bracing. Where the bottom of the trench encounters cement gravels, stones, or boulders, excavation. shall extend to four (4) inches below the line of pipe bell and then be backfilled and tamped with approved sand or earth to form a cradle for the pipe. Except where rock, boulders, stones, or cemented gravels occur, trench excavation shall first be made to a plane one (1) inch above the finished grade. The final or finished excavation including bell holes shall be made just ahead of pipe laying. All.irregularities in the trench bottom shall be removed by appropriate excavation or backfill. Bell holes shall be excavated for bell and spigot pipe of sufficient dimensions to permit pipe laying to work freely and to positively avoid the bell carrying.any weight or loading stresses and so that the pipe shall have a firm bearing of not less than three-fourths (3/4) of the length of the barrel. Trenches shall be kept free of water until the pipe is laid, joints completed, and thereafter until jointing material is adequately set. ' MZ (4) Location of Excavated Materials During trench excavation, the Contractor shall locate the excavated material so it will not completely obstruct a traveled roadway or street. Unless+ otherwise approved by:the Engineer, all streets and roadways shall be kept open to at least one-way traffic. (5) Removal of Water The Contractor shall provide and maintain ample means and devices with which to promptly remove and dispose of all water entering the trench excavation during the time the trench is being prepared for the pipe laying, during the laying of the pipe, and until the backfill at the pipe zone has been completed. The Contractor shall dispose of the water in a suitable manner without damage to adjacent property. (6) Initial Backfill After the pipe lengths have been jointed and jointing material has properly set to the Engineer's approval for backfilling, the bell holes and sides of the.pipe shall be carefully backfilled and thoroughly compacted with approved tampers, supplemented by "walking in", and with approved backfill material of.sand or earth in layers not to exceed six (6) inches in thickness. The initial backfill shall be continued in layers of not to exceed six (6) inches in thickness until the backfill is twelve (12) inches above the top of the pipe using approved backfill material of sand or earth. Under no conditions will puddling be permitted for this intital backfill. (7) Trench Backfill After initial backfill, trenches may be backfilled with the material excavated provided rocks and other deleterious materials, if present in the excavated material, are removed. Material containing frost shall not be used for backfill. The firstone (1) foot of backfill above the initial backfill shall be given careful attention as to composition. The entire backfill is to be puddled or firmly compacted as hereinafter stipulated or by other methods if approved by the Engineer. (8) Puddling All trench backfill for this project shall be puddled. Puddling shall be accomplished by first backfilling the trench grade of the travel way, then water shall be added to the trench for its entire length until it is evident that the backfill material is saturated with water. Additional backfill material is to be added to the trench to compensate for the settlement incurred by the puddling in such an amount so as to bring the final backfill material to within twelve (12) inches of the finished surface of the travel way. The excess excavated material remaining alongside the trench is to be removed from the public right of way and disposed of by the Contractor. The remaining twelve (12) inches of the unfilled trench is to be backfilled in accordance with street surface repair as hereinafter specified or with topsoil material where street surface repair is not required. (9) Excess Excavated Material All excess excavated materials . from excavation and backfill operations shall be hauled and disposed of by the Contractor at -locations approved by the Engineer and/or Owner. (10) Surface Runoff Water The Contractor shall at all times protect any open trench from the entrance of surface runoff water due to storms, irrigation, or mishandling of puddling or compacting water by any contractor within the work area. In the event that water does enter a -4- 0 0 trench, the Engineer may require the Contractor to furnish, at no additional cost to the Owner, the required foundation stabilization gravel to provide a suitable foundation for laying the pipe. b. Sewer Pipe (1) Preparation of Sewer Pile All pipe and fittings shall be carefully inspected before being laid, and no cracked, broken or defective pipe or fittings shall be used in the work. The ends of the pipe shall be cleaned with a brush, washed, and thoroughly scrubbed where necessary to remove dirt or other foreign material. Extreme care shall be exercised to insure that: the inside surfaces of the bell are smooth and free from any projections which would interfere with the assembly or watertightness of the joint. (2) Handling Proper implements, tools, and facilities shall be provided and used by the contractor for the safe and proper protection of the work. When such damaged pipe cannot be repaired to the satisfaction of the Engineer, it shall not be used in the work. The pipe shall be carefully lowered into the trench to prevent damage to the pipe. Under no circumstances shall pipe be dropped or dumped into trenches. Foreign matter and dirt shall be removed from the inside of pipe before it is lowered into the trench, and it shall be kept clean by approved means during and after laying. (3) Line and Grade Maximum deviation from true line or grade as established by the Engineer, shall be three• -eights (3/8) inch. Measurement for grade shall be taken at the pipe invert - NOT AT THE TOP OF PIPE - because of permissible variation in pipe wall thickness. Grade shall be established from batterboards set in the trench at maximum fifty (50) feet intervals. A minimum of three (3) sets of batterboards with string line shall be maintained ahead of the pipe laying at all times. (k) Tests and Inspections (a) Test Specimens Test specimens in the amount set forth in the applicable ASTM Specifications shall be furnished the Owner at no charge. (b) Pipe Inspection Specimens for absorption and strength tests may be selected by the Engineer in accordance with the applicable ASTM Specifications from pipe in the pipe manufacturer's yard or at the point of delivery to the Contractor. Tests may be performed at the Contractor's expense on the specimens selected. The provisions of applicable ASTM Standards shall apply, except as modified herein, in regard to the number of tests made, the evaluations of such tests, and the rejection or acceptance of pipe. The Owner reserves the right to approve the testing agency, and vhe.Engineer's evaluation of the results of such tests shall be final. -5- 0 0 (5) Air Tests for Sewer Lines (a) Amount of Testing The Contractor shall conduct air tests on all sections of sewer lines after backfilling and settling of the trenches and shall furnish all equipment and personnel required to perform the test. To facilitate the detection of any leaks that may have occurred . during the pipe laying operation, the contractor may, at his option, air test any or all of the sewer lines prior to backfilling. However, this test will be in addition to the required air test following the backfilling and settling of the trench. (b) Leakage Allowance The leakage allowance requirements of the air test shall be considered satisfied if the time required in seconds for the pressure to decrease from 3.5 pounds per square inch (psi) to 2.5 psi is not less than three (3) minutes fifty-seven (57) seconds. (c) Testing Procedure The low pressure air test is a test which determines the rate at which air under pressure leaves an isolated section of pipeline. This rate indicates the presence or absence of pipe damage and/or pipe of poor quality. The test procedure is des- cribed as follows: Step 1. The section of pipe to be tested is plugged at each end. The ends of all branches, laterals, and wyes which are to be included in the test are sealed or plugged. All plugs shall be carefully braced to prevent slippage and blowout due to internal pressure. One of the plugs provided must have an inlet tap or other provision for connecting an air hose. Step 2. Connect one end of the air hose to the inlet tap on. the plug and connect the other end of the hose to portable air control equipment. The air control equipment shall consist of pressure guages and valves used to control the rate at which the air flows to the test section and to minitor the air pressure inside the pipe. The air control equipment can then be connected to a source of air supply such as a portable air compressor. Step 3. After the air hoses are properly connected, inject air into the test section. Monitor the air pressure so- that the pressure inside the pipe does not exceed five (5) pounds per square inch, gage, (psig). Step 4: When the pressure inside the test section reaches 4.O psig throttle the air supply so that the internal pressure is maintained between 4.0 and 3.5 psig for at least two (2) minutes. These two (2) minutes allow time for the temperature of the air to come to equilibrium with the pipe walls. Step 5. After the temperature has been allowed to stabilize for the two (2) minute period, the,air supply should be disconnected, and the pressure allowed to decrease to 3.5 psig. At 3.5 psig a stopwatch is to be started to determine the time required for the pressure to drop to 25. psig. �6- 0 ! The section of pieline being tested shall be considered acceptable if the time required in seconds for the pressure to decrease from 3.5 to 2.5 psi is equal to or greater than three (3) minutes fifty-seven (57) seconds. (6) Thrust Blocking _and Closure Collars The thrust blocks shall be poured against undisturbed earth. No concrete shall be poured until all water has been removed from the excavation. Suitable forms shall be constructed to obtain shapes that will provide full bearing surfaces against undisturbed earth, as indicated on the Plans. The thrust blocks shall be cured three (3) days before air tests are conducted. Care shall be taken during excavation not be over -excavated in the areas where thrust blocks are to be poured. Before the closure collars are poured, the pipe shall be washed to remove all loose material and soil from the surface on which the concrete will be poured. The entire collar shall be made in one pour, and care shall be exercised to prevent concrete from entering the joint. The collars shall be cured seven (7) days by keeping the surface wet. Closure collars shall be used only when approved by the Engineer. B. MANHOLES I. Scope This section includes the work necessary for the construction of the precast manholes, including but not limited to the additional excavation and backfill required; concrete and forms; furnishing and placing concrete precast sections, concrete cones, pipes, and fittings; cast iron frames and covers; dust pans; and all incidental and related work. - The Contractor may, at his option, use poured -in-place type manholes provided all details of the construction are approved by the Engineer. 2. Materials . a. Concrete Concrete used in the construction of the manhole base and other structures specified shall be so proportioned and mixed as to meet a twenty five hundred (2,500) psi compression test after twenty- eight (28) days. There shall be a minimum of five (5) sacks of cement per cubic yards of concrete. Water sahll be provided by the Contractor. (1) Forms Forms for manhole bases and portions of structures below grade shall be matched boards, plywood, or other form material approved by the Engineer. b. Precast Manhole Sections Precast concrete sections for manholes call be minimum forty-eight (48) inch diameter reinforced concrete pipe, Class II conforming to ASTM C 76, with threaded requirement that the reinforcement shall be four and one-quarter (4 1/4) inches. Cones shall be concentric with wall thickness and reinforcement similar to that of manhole pipe sections. The tops and bottoms of cones shall be parallel. -7- 0 0 c. Mortar Grout The joints for the precast concrete manholes shall be made with cement mortar or grout consisting of one part cement to two parts of clean, well -graded sand which will pass a one -eights (1/8) inch screen. Admixtures may be used not exceeding the following percentages by volume of cement: hydrated lime, five (5) per cent; diatomaceous earth or other inert materials, ten (10) per cent. The consistency of the mortar shall be such that it will adhere readily to the pipe. No mortar shall be used when its ingredients have been mixed for a period greater than thirty (30) minutes. d. Manhole Extensions The precast concrete grade rings used between the top of the cone and the base of the manhole ring shall have a minimum thickness of two (2) inches and shall be of standard construction. The rings shall be approved by the Engineer before installation. In general, manhole extensions having a minimum heighth of six (b) inches and a maximum heighth of eight (8) inches will be used on all manholes except in cultivated fields and on very shallow manholes or in other locations where a subsequent change in existing grade may be unlikely. e. Manhole Frames, Covers and Dust Pans All manhole frames and covers shall be of the size and shape as shown on Ada County Highway District's Drawing No. 330 or approved equal. A cast iron dust pan shall be furnished with each ring and cover. 3. Workmanship a. Concrete Base The concrete base for the precast manhole shall be constructed so the first section of the precast manhole has a uniform bearing throughout the full circumference of the manhole wall. Sufficient mortar shall be deposited on the concrete base to provide a watertight seal between the base and the manhole wall. b. Placing Precast Manhole_ Sections The joints for the precast concrete manholes shall be made of cement mortar consisting of one (1) part cement to two (2) parts sand. The walls shall be constructed true to line and grade, as established by the Engineer. Mortar shall be placed on the groove of the lower section of pipe prior to placing the next section of pipe. The entire joint shall be completely filled with mortar and troweled to a smooth finish. c. Manhole Invert The invest of the manhole shall be constructed in conformance with Ada County Highway District's Drawing No. 320. The manhole invert shall provide a smooth flow-through characteristic. No sharp edges or rough sections which will tend to obstruct the flow.of sewage will be permitted. Where a full section of sewer pipe is laid through the manhole, the top shall be broken and the exposed edge of the pipe shall be completely covered with mortar. All cement mortar used in the construction of the invert shall be troweled smooth. -8- d. Manhole Rings and Covers The cast iron manhole rings and covers shall be installed on the top of the manholes so as to positively prevent any infiltration of surface or groundwater into the manholes. SHARP Chairman Zoning 6 Planning As a result of our rent meeting at the site during the evening of October 6, to observe the status of the referenced sewer system, I offer for your consideration the following comments. 1. 8 Inch Diameter Lateral D-1- (The northerly most east -west line) - Physically there appears to be adequate room between the buildings if in the future it was necessary to bring in equipment to make any repairs to the lateral. My previous request for a 16 foot wide easement could effectively be reduced to 15 feet. I say this for convenience purposes, since the plat presently has a 10 foot wide easement on the south side of the Northerly lots adjoining this lateral and the City Subdivision Ordinance requires a 5 foot wide sideyard set back which would be designated as "sanitary sewer easement" on the North side of the Southerly adjoining lots. This combination results in the 15 foot wide easement which would be adequate. 2. 8 Inch Diameter Lateral B. This lateral is located in an asphalt buildings. The plat presently shows a and its location provides sufficient access. (Southerly most east -west lateral-) paved access driveway between apartment IS foot wide easement for this lateral clearance .for possible repair equipment 3. 18 Inch Diameter Trunk Line- The location of a portion of the North --South trunk line is within 2-3 feet of the westerly side of one of the apartment buildings- The location does, however, seem to be in accordance with the development plans that were apparently approved by the City at some point of time in the past. The width of the easement for this trunk is shown as 16 feet on the plat and does conform with my earlier request to Mr. Dawdle. 4. 18 Inch Diameter Trunk Line Construction. It is necessary that the developer complete the construction of the trunk line as shown on his Engineer's "Ultimate Sewer Plan -Profile" drawing. Connect the new 18" diameter trunk line and plug the existing 18" diameter trunk line at the manhole in West Broadway Avenue at the Southeast corner of the development. b. Connect the new 18" diameter trunk line and plug the existing 18" diameter trunk line at the trunk line manhole located 101.6 feet south of the trunk line manhole in West Idaho Avenue_ c. Plug the existing trunk line inlet and outlet at the manhole in West Seventh Street that is located over the 8" diameter lateral identified as "Line B" on the engineering drawings. It will also be necessary to construct a channel through this manhole to promote the transition of flow from the East part of the lateral to the West part. An existing service line from the living units to the South and West of this manhole enters the west side of the manhole on an alignment parallel to the alignment of lateral "B"_ Presently solids and paper are building up on the manhole shelf. The developer must either remodel the transition of this line into the manhole to eliminate the solids and paper buildup or remove the service therefrom and connect the two affected apartment units to Lateral "B" with standard service taps_ If you .have any questions, please don't hesitate to call.
