Comprehensive Plan Map Amendment to change the land use designation on 11 acres of land
from Mixed Use -Waste Water Treatment Plant to Office (2 +/- acres) and Low Density
Residential (2 +/- acres), by Richard Kartchner.
Dear Commissioners,
Please consider the following points and additional information when deliberating on your
recommendation to the City Council on the referenced amendment to the Comprehensive
Map.
• There is no noise or odor p*oblenn i~•om the plr~.nt ~~.fferting the proposed development.
Attached petition stating as much confirms this with signatures of property owners
directly north and south of the proposed development. You need to be more
concerned about existing complaints of odors from people south of the plant and do
something about that rather than penalize a property north of the plant where there is
no problem.
• Past failures to properly address odor and noise abetment of the treatment plant
should be dealt with in a progressive manner and not used as an excuse to violate
private property rights. This is unconstitutional. The commission should be less
concerned about how they will offend or affect future residences and more concerned
about how they are penalizing and offending present residences with their
unwillingness to grant a very reasonable request for improved use of the land..
• Per Staff findings, application of level 2 abatement "will reduce the frequency of
detectable odors nearly up to the WWTP fence line" (page 10, paragraph 2). Any
expansion of the plant will need to apply state-of--the-art technology to insure this
level of containment is achieved. Anything less would be inattentive and neglectful,
insuring future complaints from occupants of existing designated uses of property
surrounding the plant.
• The WWTP Odor and Noise study is good as a general guide for planning
designations but when empirical evidence (again reference attached petition of
neighbors in area) contradicts the generalized, computer generated, prevailing wind-
absent, obstructed path-absent, clawed, broad-brushed overlay on a property it is the
commissions duty and obligation to stand with the desires of the land owner and
change the comprehensive plan.

the meeting Thursday to hear of your final deliberations.

Petition to City Council and P&Z Commission
We, the undersigned have seldom, if ever, noticed an odor problem
