Here is a continuance letter for the Volterra Projects. The applicant has submitted one letter with two requests: 1)
continue the Volterra Mixed Use RZ and MDA to the October 2, 2008 Planning and Zoning hearing and 2)
continue the Volterra Commercial CPA to the November 5, 2008 City Council hearing.

To process the applications for the above-referenced project simultaneously, we would like to
request that the hearing dates for this project be changed as shown below:
Planning and Zoning Commission -hearing for rezone application and development
agreement modification -please change from September 18~` 2008 to October 2, 2008.
City Council -hearing for comprehensive plan amendment, rezone and development
agreement application -please postpone hearing for comprehensive plan amendment and
sch~ule hearing date for rezone and development agreement applications for
November 5, 2008.

November 5, 2008 City Council Agenda Items
The Volterra project was insufficiently noticed for the November 5, 2008, City
Council hearing. Staff is requesting the Council continue the public hearing for
the Volterra applications (CPA-08-003, RZ-08-004 and MDA-08-002) to
November 25, 2008, so the project can be properly noticed.

Clint: This is a significant change from what was posted in the agenda. I think it would be cleaner to pull the item

Ted,
Good morning. We are working on the sewer and water easement agreements for the Nola vacation by ZWJ
Properties, and have had to make some changes to the easements. ACHD just informed Zeke Johnson that they
are only going to vacate the north half of the right-of-way of Nola between Lanark and the UPRR. This effected
the easements that we turned in to the city for the vacation, and we need to replace the exhibits with these new

ones depicted the changes. Can you please review these exhibits, and if they are OK, can you swap them out
with the exhibits that are currently attached to the easement? It looks like we are on the agenda for the council
meeting tomorrow evening, so we need to do this right away. If you aren't able to swap the exhibits before the
council meeting, we need to pull this off the agenda so it doesn't get approved the way it is now. Please let me
know what you think. I have attached the new legal descriptions and sketch to use as the new exhibits. Let me
know if you have any questions on anything. Thanks Ted.
