We have reviewed this submittal and offer the following comments, as conditions of the applicant. These conditions shall be considered in full, unless expressly modified or deleted by motion of the Meridian City Council: APPLICATION SUMMARY & LOCATION The Applicant, Inglenook Development, proposes to convert an existing, attached, three car garage to a temporary sales office/model home use in Inglenook Subdivision. The office will have one to two staff members on site seven days a week, 8:00 a.m. to 5:00 p.m. No specific time period was proposed in the application. The lot (Lot 2, Block 1) is zoned R-4 and is located on the east side of S. Locust Grove Rd., approximately ¾ mile south of E. Overland Rd. Title 11, Chapter 8 of the Meridian City Code (Schedule of Use Control) prohibits Professional and Sales Office uses in the R-4 district. Unless a Planned Development specifically proposes a sales office as part of the application, the MCC does not permit these uses outright. The City has allowed sales office uses that are restricted to the sale of residential lots and/or dwelling units within the subdivision for which the sales are intended. For example, Ashford Greens, Heritage Commons, Baldwin Park, Sundance, and Touchmark are recent developments that have been allowed a temporary sales office that is associated with residential lot sales within those developments. A sales office/model home was not applied for as part of the original submission. Therefore, staff required an MI application be submitted for the otherwise prohibited use. OWNER OF RECORD The subject lot is owned by Inglenook Development, 701 S. Allen Street, Ste. 104, Meridian, Idaho. SITE SPECIFIC REQUIREMENTS If City Council approves of the temporary sales office use, Staff recommends the following conditions be placed upon the application: Mayor and Council May 15, 2003 Page 2 MI-03-008 Inglenook Subdivision Temporary Sales Office/Model Home a. The subdivision is permitted to have no more than one temporary use. b. The front yard shall be landscaped and irrigated prior to occupancy. c. The applicant shall be responsible for providing adequate off street parking for the employees. d. One wall sign is allowed for the temporary sales office. The sign shall be limited in size to 18% of the wall area. No other signs shall be permitted. A separate sign permit is required if signage is proposed. e. Sanitary sewer service and domestic water service shall be hooked-up for the proposed use. An assessment for sewer and water service will be determined during the building permit application process. f. The timeframe for the sales and information use is for a period of 24 months. If the Applicant requires an extension of this permitted period, Staff recommends they submit a status of their plans to the P&Z Department after 24 months of operation (starting from date of occupancy). City Council must approve of any time extension beyond 30 months.
