Dear Mayor DeWeerd and Council members:
Pursuant to Meridian City Code Section 1-7-10, this letter requests reconsideration of
the City Council's decision to deny annexation, zoning and related right-of-way vacation
for the above-referenced project at the northeast corner of Overland & Eagle (fine
"Project"). The following paragraphs address the application requirements in the City
Code:
1, Cameron Investments LLC ("Cameron"} makes the request. Cameron is the
owner of the property acid the assignee of the original applicant.
2. This request is timely as the City Council's decision occurred on September 2,
2008.
3. Basis of request and statement of issues:
a. The City Council's decision was based on concerns regarding the
adequacy of emergency access to the property. The City Council
determined that adequate access could not be provided without connection
through other properties, not owned or controlled by Cameron, to the
traffic signal at SiIverstone Way. Such a requirement was never discussed
or recommended by any party, including the staff, fire department, police

department or ACHD, during the course of numerous hearings regarding
the application at ACHD and at the City.
b. Cameron has relevant information it wishes to present to address the City
Council's concerns and requirements. This information was not available
because Cameron did not know and had no reason to know of the City
Council's belief that a connection to Silverstone Way is necessary.
c. The information will address the following issues:
i. Cameron's rights to obtain development permits from Ada County
without a connection to Silverstone Way;
ii. The City's legal exposure for denying the proposed development;
iii. More detailed information regarding the floodway and floodplain
and its impact on the feasibility of constructing connections to
Silverstone Way;
iv. Alternate means to ensure that the Rackham Way/Overland
intersection is clear for emergency vehicle traffic;
v. Cameron's willingness to contribute a proportionate share toward a
connection to Silverstone Way; and
vi. Additional information regarding building height and parking
concerns at the Park & Ride raised by the Mayorand/or City
Council.
We look forward to the City Council's action on this request at its next meeting.
