• Meridian City Council March 7, 1983 Regualar meeting of the Meridian City Council called to order by Mayor Joe Glaisyer at 7:30 p.m. Councilmen Present: Grant Kingsford; Ron Tolsma; Rick Orton Jr.; Bill Brewer Others Present: Roger Welker; Bruce Stuart; Doug Nichols; Jay Webb; Elizabeth Ryan; Martha Berry;Bill Clawson; Richard Willams; Robert Giesler; R.D. Minutes of the previous meeting held February 22, 1983 were approved as written. Mayor Glaisyer welcomed Scout Troop #129, attending the meeting to earn a merit badge. Item 1 Transfer of Beer & Wine License - Farmers Club to John A Goodman Mayor Glaisyer: "Chief Nichols, is everything in order on the transfer of the Beer and Wine License to John A. Goodman ?" Chief Nichols: "Everything seems to be in order." The Motion was made by Kingsford and seconded by Tolsma to approve the transfer of Beer & Wine Licence from the Farmers Club to John A. Goodman. Motion Carried: Kingsford,yea; Tolsma, yea; Orton, yea; Brewer, yea Item 2 Bills The Bills were read. The Motion was made by Kingsford and seconded by Tolsma to approve payment of the bills. Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea Item 3 Findings of Fact and Conclusion of Law on Quong-Watkins Annexation Jay Webb, Attorney for Quong-Watkins Properties, was present and wishes to present a statement before the reading of the Findings of Fact and Conclusions of Law regarding the Quong-Watkins Annexation request. Webb presented the Council Members and Mayor with a memorandum prepared by him regarding the Findings of Fact and Conclusions of Law. (Memorandum on file with these minutes) Webb stated that he would like to go over the highlights of the memorandum with the Council. Webb: "Gentlemen, we feel the Findings as proposed are simply - fatally defective. There is a discrepancy of content, there is a misstatement of fact, and indeed - in all respect to my good friend Wayne (Crookston) here - several of the Conclusions of Law are simply without support of fact in record. This is most significant in Findings of Fact and Conclusions of Law. "We feel in that cruciable'of obj+edtiVity there are in the findings some 36 paragraphs that.are,�at least subj.edt and open.,tb!contest discrepancy as to their conclusions." • • Meridian City Council 2. March 7, 1983 Item #3 Findings of Fact and Conclusions of Law - Quong-Watkins Annexation Cont'd. . . . . . . Webb: "Paragraphs 1 and 2 of the Conclusions seem to me to be in conflict one with the other. Paragraph 8 is simply not supported in the factual record, not on testimony, not by documentation. Paragraphs 11, 13, 14, 15, 18, 19 and 20 are in our judgement not true statements." "Most significantly, paragraph 22, 23, 24 and 30 are based on what we feel is an incomplete analysis of the facts given." "Look if you will - paragraphs 34, 37 , 38, 39, 40 and 42, each and every one of them, taken individually in context are not supportive by the facts before this board." Webb: "As you know, we have requested of you, a timely request, you take at least a two week delay in making a decision in this matter. That request is based upon many things. Simply, I'd like time to reflect upon these proposed Findings. I'd like to see you have time to reflect on them,.oand if you will, extend to us, the applicant, the decency, if you will, to tell you what we think the record shows." "And indeed as a very practial matter, it should be of some passing interest to this body what goes on in Downtown Boise tonight. Which ever way you go on this matter, your final consideration, your final determination,.could well be based on having as clear air and understanding of what is going on in this whole County as you possibly can, before the curtain falls. That seems to be good Idaho horse sense to me." Webb: "Those are some of the reasons why we have asked for the continuation of this meeting, so we can all weigh these matters." "There is no prejudice to the City of Meridian, but indeed, very possibly, great predjudice to Mr. Quong, and just perhaps to your constituency." Webb made reference to the legal memorandum attached. (On File with these minutes) Webb stated that he felt "our position is reasonable, and called for by the circum- ... stances." Webb said that he would like to have the opportunity to "extensively probe the record." Webb: "We can with particularly, develop each and everything I've taked about, this night - or another time." Webb thanked the Council and Mayor for the :opportunity to speak. The Motion was made by Brewer and seconded by Kingsford to pursue the reading of the Quong-Watkins Annexation Findings of Fact and Conclusions of Law. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea; Orton, nay Mayor Glaisyer read the Quong-Watkins Annexation Findings of Fact and Conclusions of Law. (Tape on File - City Clerk's Office - Meridian City Hall) (Findings of Fact and Conclusions of Law Quong-Watkins Annexation on File with these Minutes) Councilman Orton questioned Attorney Crookston on several points of the Findings of Fact and Conclusion of Law, and as to there preparation. (Tape on File - City Clerk's Office - Meridian City Hall) Orton stated several times that he felt there were discrepancies in the Findings of Fact and Conclusions of Law. Councilmen Brewer and Kingsford stated several times that they were very satisfied with the Findings of Fact and Conclusions of Law. Boz 427 MwWlan, Idaho 83812 Telephone 888-4481 amendments were adopted by the City Council, provided no other provisions of the Plan not amended conflicted with the development of a regional shopping center at the proposed location, and provided that it was the decision of the City Council to annex and zone ,the property commercial. The Comprehensive Plan Amendments are now properly before the City Council as is this application fox annexation. The City Council has decided to take action on this annexation prior to taking action on the Comprehensive Plan Amend-, menus. If this annexation is approved, the City Council would, very soon after approval, be required to adopt changes in the Comprehensive Plan, which would be necessitated by the annexation. Of course, if the annexation is denied, there would be no required changes in, the Comprehensive Plan. However, since the City Council has not indicated by vote or other statement its decision on the Comprehensive Plan, this annexation must be considered as if the Comprehensive Plan changes would be adopted. The annexation must be Iconsidered as stated above because the Planning and Zoning Commission has approved the Comprehensive Plan changes, because Section 67-6525, Idaho -Code, requires that before a City Council annexes a parcel'of land, it receive recommendations as to neces- sary changes in the Comprehensive Plan necessitated by the annexa- tion, and because fairness*to the developer requires this pro- cedure since action has not been taken on the Comprehensive Plan. However, like the sewer income, the water income must first be used to operate the system and then to retire the bonded indebtedness with which the present system was constructed. 21. That the developer, Quong-Watkins Properties, has recognized that a replacement sinking fund should be funded to replace the capital improvements when they are worn out; including the well at $85,000.00 and the water lines to the development at $327,100.00 for a total of $412,100.00, the annual cost to fund th water replacement in 1982 dollars and without regard to inflation would be $9,004.39 at 8% for twenty years. 22. A comparison of the two tables reveals that after five (5) years, the shopping center would have added only $90,235.0 to the'City property tax revenues over what the City would have over the same five years without the shopping center; that the increase from the base year of 1982 to the fifth year is $170,130.0 45. That the market value of the City of Meridian, as of December 31, 1981, was $149,009,780.00; that assuming the appli- cant's proposed shopping center was built in phases, so long as the value of each phase added more than loo to the market value of the City each year, the growth factor would be triggered; that the cumulative effect, however, would not be greater than if all the value were added in one year as used in the above examples. 46. That the above contributions would decrease the capital improve- ment costs of the City necessary to service the applicant's proposed shopping center by $400,000.00, unless as is suggested by the applicant, the total amount of $500,000.00 be used for actual and necessary City costs associated with the shopping center which would delete the use of $100,000.00 for the senior citizens' center. 47. That the table below depicts the additional costs and revenues of the City of Meridian as a result of the Quong-Watkins Properties Annexation, assuming a shopping center was developed therein; it is to be noted that the table does not include revenues or costs associated with the water and sewer system since these costs and revenues can only be used and associated with the two systems, and any net gain or loss therein could not be used to aid or detract from another cost or revenue item; it is also to be noted that lower or higher figures may be.found in the record of this annexation, but the figures used below are found to be.representative of the figures contained in the record. That the applicant has offered to construct the inter- change at I-84 and Eagle Road and other associated roadway im- provements if his proposed shopping center is developed.. 49 That almost the entire area included within the annexa- tion is included within the Urban Service Planning Area, herein- after referred to as USPA, as 'the USPA was defined in the 1978 AMBROSE, FITZGERALD &CROOKSTON Attorneys and Counselors P.O. Box 427 Meridian, Idaho 83842 Telephone 8854181 0 Comprehensive Plan; that that portion of the annexation property generally easterly of Eagle Road is not included in the USPA as referred to in the 1978 Meridian Comprehensive Plan, but much of the land included in the annexation easterly of Eagle Road did abutt the USPA boundary; that the USPA boundary was easterly of Eagle Road. 50. That since the City Council has not acted on the Amendments.to'the Comprehensive Plan which would extend the USPA boundary so that all the proposed annexed land would be included therein, it will be assumed that the Amendments would be adopted and all the annexation land included in the USPA. 51. Under the zoning requested as set forth in the requests for annexation, that portion along Overland Road until approxi- mately just east of Locust Grove Road would be in compliance with the Comprehensive Plan and Amendments; that portion along Overland Road just east of the Locust Grove until the proposed Interchange Enterprise area is reached would probably be in violation of the Plan and Amendments as the technical Industrial Review desig- nation was not changed to Commercial under the Amendments; that portion of the annexation included in the Interchange Enterprise Area would be in compliance with the Plan and Amendments; that portion of the annexation north of I-84 and west of Eagle Road not included in the Interchange Enterprise Area would not be in compliance with.the Plan or Amendments as that area would still be residential reserve. 52. That the applicant proposes to construct a regional shopping center on parcels 16 and 17 -of the annexation; that the use of the other property, although zoned commercial, is not known. 54. That the proposed shopping mall would cause a negative impact upon the several residence homes in close proximity to the proposed mall; however, the construction of the I-84/Eagle Road interchange has been determined and growth will occur around the interchange and, thus, the impact on the homes would likely occur in any event. 5$. That while the Petitioner, Quong-Watkins, has agreed to provide a fire station, fire engine., two police cars and a water well, the annexation will increase the costs to the City for additional fire protection manpower and police protection manpower these items have not been addressed by the Petitioner, and those costs would increase immediately with the passage of an annexation ordinance; that the increase in tax base from development in the area which would cover a portion of the added expense for fire and police protection will not occur for some time and, at least, not until a large portion of development is constructed and in use 56. That, if the proposed shopping center proposed by Mr. Nahas is constructed and the applicant's is not, Meridian will have to take immediate measures to rectify the traffic impact. 60. That traffic and exposure are necessary to maintain a volume of business to sustain retail activity. 61. That, in January of 1981, the applicant and the City entered into an Agreement of Developer's Intent; that said agreement indicated applicant would not apply for annexation or zoning of his proposed shopping center until he had signed letters of intent from major retailers; that applicant has not submitted any signed letters of intent into the record. 62. That there was not much public testimony submitted at the public hearings held on the annexation; that what public comment that was submitted was mixed; that is, some supported a shopping center at Eagle Road, some supported one at Meridian Road, and some just wanted a mall and to start construction of it; that in numbers of supporters, the public testimony slightly favored the Eagle Road site. CONCLUSIONS 1. The one bright spot in the revenue picture is the Building Permit fee, but even that must be deducted by 50% for expenses of the building inspector; also, this fee is a one-time fee and, even if put at interest, the amount returned would not dent the deficit associated with the government costs of the annexation. 28. The Sales Tax laws prevent the City from obtaining anything but a minute increase in revenue, even though a great amount of sales tax would be gained from a shopping center; thus, sales taxes do not help the City fund the additional costs due to annexation. 29. The applicant has estimated a liquor tax revenue of between $70,000.00 and $120,000.00; the present amount of revenue from liquor tax is approximately $40,000.00; the basis for applicant's estimates was not given but, even if the present amount were doubled, it would still not fund the deficit created by the additional costs of annexation. 30. The Comprehensive Plan, although having been amended to possibly allow the applicant's proposed shopping center, provides guidelines, standards, criteria, and policies to guide the Council on this annexation. The above-mentioned guidelines, etc. are referenced in paragraph 57 of the Findings of Fact. Those guide- lines, etc. dictate that the applicant's request for annexation be denied. A few of the guidelines, etc., particularly relied on and conclusions thereon are as follows: a. Major concerns of the people of Meridian are orderly growth and development,.and economic growth and balance. It is concluded that the annexation and shopping center, if developed, would create economic growth but that it would not be orderly and would not be in balance with the existing City. b. A goal of the plan is to encourage the kind of economic growth and development which supplies employment and economic self-sufficiency for existing and future residents, reduces the present reliance on the City of Boise and. strengthens the City's ability to finance and implement public improvements, services and its open space character. Both of the proposed shopping center sites are are subject to these guidelines and criteria. ':chile this annexation is not a decision as to location of a shopping mall, per se, these guidelines helped evaluate the annexation due to the proposed inclusion of a shop- ping center in the area. This is pointed out to show the difficulties which the 1% laws have created for the cities. 39. It is further concluded that a shopping center at Eagle Road would lessen the traffic on East First Street, as will the construction of an :interchange on I-84 at that location; that with the loss of traffic due to the Eagle Road Interchange, the present retail community will almost likely not be in a position to need a lessening of traffic, but just the opposite, they will need,traffic and exposure. 40. If the Meridian Road shopping center is developed, which may or may not occur, the traffic will increase and East First and Meridian Road may have to be designated as one-way streets, or some other alternative will have to be devised in order to handle the traffic; the traffic, however, will not cause Old Town to deteriorate. 41. No conclusion is made as to the Agreement of Developers Intent. 42. It is concluded, finally, that the annexation is not in the best interest of the City of Meridian; that the annexation would not be reasonable and would not aid the orderly development of the City; that of primary focus is the irregularity of the annexation route, the lack of sewer and water service to the area south of the freeway, the cost to the City without offsetting revenues, and the adverse affect the development of a shopping center would likely have on the existing retail community of the City of Meridian. It is our purpose herein to bring on for your review and consideration certain discrepancy of content, misstatement of fact and, in particular, asserted conclusions which we feel are totally unsupported by the hearing process fact finding and documentation. We respectfully request of you that the following recitations of error be carefully related to the attached memorandum of law. It is our considered opinion the proposed Findings of Fact and Conclusions of Law are fatally defective, to -wit: The Findings of Fact misstate the facts and documentation submitted as contained in paragraphs 8, 9, 10, 11, 12, 13,14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 25, 26, 28, 31, 32, 35, 38, 39, 42, 43, 44, 47, 51, 52, 55, 56, 57, 58, 60 and 62. In a more telling and positive posture, we now direct your -attention to the conclusions, as proposed: 1. Paragraphs 1 and 2 are conclusive statements, in conflict of one another. 2. Paragraph 8 is not supported in the record. 3. Paragraphs 11, 13, 14, 15, 18, 19 and 20 are simply put, without the purview of factual, true statements. • a (2) The Conclusion of Law proposed as number 3 provides that: "The city has authority to annex land pursuant to §50-222, Idaho Code; that exercise of a city's annexation authority is a legislative function." The clear weight of authority holds that an annexation de- liberation is better characterized as "quasi-judicial" en- titling the annexation applicant to the procedural and sub- stantive protections afforded under any other "quasi-judicial" determination. The city is apparently under the erroneous impression that, as a matter of law, the annexation decision is a purely legislative determination. Of course, the opposite is true. The decision to be made by the City Council in this case is a "quasi-judicial" one, mandating the procedural and substantive safeguards established by the Idaho Supreme Court in Cooper and Edmonds v. Board of Count Commissioners, 101 Idaho 407 (1980). Such procedural and substantive safeguards have not been afforded to the appli- cant in this annexation application. The entire process utilized by the city to reach its decision, and of course the decision itself, are therefore contrary to law and must not be allowed to stand. (3) Also, the Conclusion of Law 11 proposed by the City Attorney relates to the removal of the annexation property from the Meridian Water & Sewer District pursuant to §50-224, Idaho Code. Conclusion 11 states: "that no input on this issue was heard from the affected property owners." The applicant's response to this proposed Conclu- sion is simply that, had any of the persons affected ob- jected to the proposed annexation, they would have voiced such objection at the numerous hearings and workshops held by the City Council. Moreover, the property to be annexed includes many parcels not owned by the applicant Quong- Watkins. These individual property owners, likewise, fall within the boundaries of the Meridian Water & Sewer Dis- trict. Nevertheless, they affirmatively elected to be included within the annexation property.
