Regular meeting of the Meridian City Council called to order by Mayor Joseph Glaisyer
at 7:30 p. m.
Council Members Present: Grant Kingsford; Rick Orton Jr.; Ronald Tolsma; Bill Brewer

Minutes of the previous meeting held April 18, 1983, were approved a~s written.
Mayor Glaisyer welcomed Bob Haddock from Scod~t Troop #126. Haddock is working on a
merit .badge.

1 Transfer of Beer & Wine License Farmers Club from Norman Green to Don Bennett
Chef Nichols said that everything was in order for the transfer of the License.
The Motion was made by Brewer and seconded by Tolsma to approve of the transfer of the
Beer & Wine License for the Farmers Club from Norman Green to Donald Bennett.

2 Application for Beer & Wine License for Club Wholesale (Elixir Industries)
Mayor Glaisyer questioned Chief Nichols as to if everything was in order on the
application for Beer & Wine License for Club Wholesale (Elixir Industries).`
Nichols: "It is my understanding that they have not gotten approval from the State
as of yet." "Other than that, everything is in order."
The Motion was made by Kingsford and seconded by Tolsma to approve the application for
Beer & Wine License for Club Wholesale - Elixir Industries - subject to approval of the
State of Idaho.

3 Pat Oliver; Petition Regarding Property Located at 26 W. Washington Street
Pat Oliver, 1205 Meridian Street, was present representing his neighbors.': Oliver
presented the Council with a petition signed by 15 of the residents in the area, requesting
a clean up of the property at 26 W. Washington. Oliver stated that some of the requests
that he and the other neighbors had setere; 1.) Removal of two storage buildings sitting
along the side of Washington Street on public property. Also the removal of the lean-to
that is attached to thes.house, 2.) To clean up the property on which the house sits,
and 3.) Something be done about the three dogs, which are constantly tied up on the
place; but have not been taken care of, or cleaned up after, for some time. Oliver said
that the dogs have completely torn the yard up, which makes it a "dust bowl." Oliver
went on to say that it is "unbearable to use the yard in the summer" due to the ".dust and
the fierce ordor":"t~hattthe.~dags create. Oliver stated that he has tried to work with
the neighbor without result, and would like the City to try and do something about the
problem. The property is a "disgrace to town" Oliver said.
Chief Nichols explained to Oliver that the action to be taken would be to sign a complaint
against the people and take them to court.
Lester Jerome, a resident of the area, was.: also present and voiced several complaints
concerning the property. Jerome said that the neighbor had used abussQe language.
Jerome also complained about the dogs and said that the dogs are not licensed.
Jerome also mentioned the property at 1304 W. 1st, belonging to Steve Nesmith. Jerome
said the the City Attorney had written a letter to Nesmith requesting clean up of the
area in 20 days.

Item 3 Petition Regarding Property Located at 26 W. Washington Cont~td. .
Jerome went on to say that nothing had been done on the clean up, and that there were
several items including a motor.and a telephone pole lying in the City sidewalk. Jerome
said that~__~the -back yard is an "extreme disastere', and feels that "something ought to be
done about it."
Jerome also cited 1130 W. 1st, Joe Couch, as a property that needs a clean up. Jerome
said that the garage has been unfinished for about 10 years.
There was discussion concerning the procedure of establishing what the property boundaries
are on the properties in question. (Tape on File - City Clerk's Office)
Mayor Glaisyer suggested that City Engineer Gary Smith make a physical inspection of the
properties and report back to him.
Smith said that he would get an approximation of the property boundaries.
Mayor Glaisyer said that he would get with Mr. Oliver, who could then get in touch with
the concerned neighbors, and work out a strategy on the next steps to take.
Oliver thanked the Mayor and Council for their time.

4 Dave Barkel - Request for Variance for Metal Buildings
Dave Barkel, 1760 West Pine, was present requesting a variance on the Building Code
requiring plywood on a metal out building.
Barkel said that he had contacted his neighbors on his plans, but did not get their
permission in writing.
Vernon Schoen: "I think on these variances, if the Council wishes to use those for
such things, I think that they should follow through on their Variance Ordinance."
City Attorney Crookston: "The Variances fall within the Land Use Planning Act. For
Variances from the Zoning Ordinances or Comprehensive Plan, you are suppose to go through
the hearing procedure."
Barkel was instructed to contact the City Clerk to receive the necessary-- applications
and instructions needed to obtain a variance.
The Motion was made by Brewer and seconded by Kingsford to table the request for a
variance on a 10 x 30 metal building by Mr. Barkel.

5 Crandlemire Annexation Request - From Table
Mayor Glaisyer explained that the Crandlemire Annexation Request was tabled from the
last meeting due to illness of Ah::Marsden who is representing the request.
Glaisyer said that Marsden had contacted Jack Niemann, City Clerk, and requested that
the request be tabled again, as there had been a death in the family, and Mr. Marsden
is..out of town.
The Motion was made by Kingsford and seconded by Brewer to table the Crandlemire Annexation
Request until the next regular meeting of the City Council on May 16, 1983.

7 Set Workshops on Comprehensive Plan & Zoning Ordinance
There was discussion amoung the Council Members regarding a date for a workshop.
It was decided that the Council would hold a workshop on Monday, May 9, 1983, at
7:30 p.m.
City Clerk, Jack Niemann, was instructed to post the notice of the workshop.

_8 Councilman Rick Orton - RE: Claim by Roy Haney for Water Heater
Councilman Orton explained that Mr. Haney had sent a letter to the City requesting their
participation in a repair bill for his hot water heater in the amount of $222.67.
Orton: "I did spend some time today with Mr. Haney and with Bruce (Stuart) checking out
what had occured out there." "We have standard water meter installation at Mr. Haney's
house, and part of that installation is a check valve to stop water from comming back
into the public system from a private residence. Again, that is our standard meter
hook-up installation." "We changed over to the new system November 81. It was
operational and working fine. When Mr. Haney changed water tanks and relocated his
water tank, for some reason it built up pressure in his system more than he had
previously experienced, and it caused the blow-out valve on his new water heater to pop
open and drain off the pressure." "Mr. Haney had the installers come out and check
the hot water heater and replace the blow-out valve. In order to placate the situation,
until I got back, Bruce removed the interior of the check valve so it's no longer a
check valve function, it's open now. Apparently Mr. Haney's problem stopped before
or on that time. My opinion, and I think Bruce's opinion based on my conservation
with hisn this afternoon is, that the check valve is important to us to stop back flow
from comming into our system." "It is a standard feature, and to my knowledge there
was no malfunction that had anything to do with Mr. Haney's problem. Therefore I
would recommend that we deny the claim,-and put the "guts" back in the check valve
right away. We must stop that back flow from coming ins."
Haney: "What about all the other houses along the street that don't have check valves?
All that water is going back down."
Orton: "We have check valves on 60~a of the system."
Stuart: "About 80~ along that street."
Gary Smith, City Engineer: "I might state,..that the check valve is a standard item, putt.
out by Ford Meter, so there is nothing alien to a_watet meter or a yolk." "It is put
out for that use."
Brewer: "I felt that there was very professional counsel here the night that Mr. Haney
was here. I would hate to have this run over tonight when Mr. Haney doesn't have his
people .here. "
Mayor Glaisyer: "Do you want to meet with their (Haney's) plumber, Rick?"
Councilman Orton: "Not particularly. I don't think that there is anything else to
find out. I have verified that our equipment was operation as i:t was suppose to
operate, I think that is probably when our duty ends." Orton explained that he had
spoke with the plumber on the~-telephone already. "I did listen to what he said",
Orton said.

Item 8 Claiun by Roy Haney for Water Heater Cont'd .
Councilman Brewer said that he "didn't feel right about it," and would "like to
be_.able,_tQ wholly understand what took place, if I have to vote on it." Brewer said
that he felt the information presented before was "very professional".
The Motion was made by Brewer and seconded by Kingsford to table the approval or
denial of Mr. Haney's request for reimbursement for his water heater.

9 Request by Lee Stucker Developer of Bethaven Subdivision for Extension on Development
Mayor Glaisyer reported to the Council that Lee Stucker the Developer for Bethaven
Subdivision had submitted a written request for an extension of time to proceed with
the development of Bethaven Subdivision.
Stucker cited "continued depressed economic conditions" as the reason for the
request, and stated it is "not feasible to proceed with the development of
Bethaven Subdivision at this time."
The Motion was made by Kingsford and seconded by Brewer to grant an extension on the
development of Bethaven Subdivison for six months.

Being there no other business to come before the Council this evening .

it feasible to proceed with the development of Bethaven Sub.
Therefore,I am requesting an extension of time be allowed on
the city approvals for Bethaven Subdivision.

PETITION
We, as Meridian residents, wish to petition that the residents, or the owners
of the property at 26 Washington Street clean up that said property. Listed below
are our Poll owing requests z
1. Removal of two storage buildings sitting along the side of Washington St.
on public property. Also the removal of the lean-to that'. is attached to

2. To clean up the property on which the house sits.
3. Something done about the fibres dogs, which are constantly tied up on the
place; but have not been taken care of or cleaned up after for some time.
In summations because of these problems and odors which•engulf the antire premise,
®ther surrounding property will continue to decrease in value. It is for this reason,
as Meridian residents, we would like the City to see to it that the afore mentioned
request be enforced.
