Deft Reports: ~ ~ Meridian City Council May 16, 1983 Regular meeting of the Meridian City Council called to order by Mayor Joseph Glaisyer at 7:30 p.m. Council Members Present: Grant Kingsford; Ron Tolsma; Rick Orton Jr.; Bill Brewer Others Present: Doug Nichols; Earl Ward; Vern Schoen; Bruce Stuart; Mike Zuzel; Gary Smith; Robert Giesler; Bill Robison; Marnell Chenowith; Coenraad Abas; Al Marsden; Wayne Crookston Jr.; Jack Niemann Minutes of the previous meeting held May 2, 1983 were approved as written. Item 1 Bill Robinson -Candidate for School Trustee Zone 2 Bill Robinson a candidate for School Trustee Zone 2, appeared before the Council and -stated his qualifications and involvement in the Community. Robinson urged everyone to get out and vote on May 17. Item 2 Crandlemire Annexation Request - From Table Mayor Glaisyer stated that the Public Hearing had been held, and that there had been no response.: Al Marsden, representing the applicants in the annexation request, was present and commented on the annexation request. Marsden said that the proposed annexation is within the Urban Service Pl~.nning Area (U5PA) and is currently zoned D-1 and residential. The proposed annexation zoning would be Industrial South of the canal, and a~.combination of Residential and Commercial on the property North of the canal. Marsden said they are following the "pattern of the Comprehensive Plan." Marsden said that the planned buffer or barrier between these two types of land uses is the canal area, which Marsden said he felt would make a "very good green belt." Marsden said that the intent is to develop a small shopping center at the two major crossings, Locust Grove and Fairview. Marsden stated that his idea was to develop a sub-collector road with cul-de-sacs off of it providing an opportunity for residential development. Marsden explained that this type of commercial development is known as incubator commercial, and said that he "feels this will elimate strip commercial." The incubator commercial proposed is similar to the commercial development at Fairview and Five Mile on the North side. This type of commercial development is designed for small users. Marsden said that the plan is to extend the Sewer,~:up through Settler Canal area to serve both parcels on both sides of the development. Marsden stated the focal points of the annexation request, "The project is adjacent to the existing City Limits." "The desire is to have a zoning in a similar pattern that is totally compatiable with the Comprehensive Plan." "It's in compliance with the Comprehensive Plan from a land use standpoint." "The Zoning is in compliance with zoning in the Comprehensive Plan." "The Police and Fire facilities are less than 1 mile away from the site and easily accessible." Marsden: "Mr. Crandlemire would like to start development within the current year and develop the facility over a period of time." Marsden said that there are no users as of yet, but a firm has been hired to market the property. There was discussion concerning the widing of Settlers Canal for use as lakes and ponds. Do you see anything different in what was presented tonight?" P&Z Members Chenowith and Gielser both concured that there was no different or additional material presented. Marsden said that he felt the Planning & Zoning has "misunderstood" his presentation, in that they felt it was a mixed use function or design. Marsden said that it is not a mixed use design and stressed that the plan fits the Comprehensive Plan "perfectly." Kingsford questioned Marsden on the future plans of the land owners that have requested annexation without a development plan. Marsden said that no timetable had been reflected to him, and said that one party was interested only in annexation and then selling the property. Councilman Brewer said that he felt it was a "desirable idea", but was concerned as the development plan is not complete. Brewer said that his concerns were "not knowing what type:~of~.business would be users, not knowing what type of residential is planned, not knowing what the covenant would be, and what type of Industrial is planned." Brewer said that he would like a "more complete idea on exactly what is going to be there." Marsden asked the Coucil to defer action on the request, saying that if he would have known their concerns he would have "brought a more detailed plan" to them. Marsden said that he could ta~:k to the developer and submit a more detailed plan. Tolsma stated that he felt there was a great amount of frontage now available for commercial. The Motion was made by Kingsford and seconded by Brewer to approve the Findings of Fact and Conclusions of Law as presented to the Planning & Zoning Commission regarding the Crandlemire Annexation request. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea; Orton, nay The Motion was made by Kingsford and seconded by Tolsma to deny the Crandlmire Annexation request. Motion Carried: Kingsford,=yea; Tolsma, yea; Brewer, yea; Orton, nay Marsden questioned the statue in the Local Land Use Planning Act that required that the Council report in i~rting the reasons that the annexation request was~aurned down. Attorney Crookston said that he was not sure that this particular statue pertained to annexation requests, that he would have to look into it more. Mayor Glaisyer stated that he felt the Findings of Fact and Conclusions of Law did state the reasons that the request was denied. Kingsford also said that he felt all the reasons for denial had been gone over, but if Mr. Marsden wished them in writing they would do so. The Motion was made by Kingsford to direct the City Attoney, Wayne Crookston, to look into the Local Land Use Planning Act as to how it applies to this particular annexation request. The Motion died for lack of a second. • Meridian City Council 3. May 16, 1983 Item 2 Crandlemire Annexation Request Cont'd . Marsden.said that he is trying to get guidance to find out what he needs to do to get the request approved. "I want to make the application better so it would be approved. Marsden also said that he felt that:_he did not receive any guidance from the Planning and Zoning Commission. Kingsford stated that the Planning & Zoning did make a recommendation and that the legal document (Findings of Fact and Conclusions; of Law) also made a recommendation to Marsden. Mayor Glaisyer cited several times that he himself had worked with Marsden on past projects and tried to help him in any way possible. The Mayor said that the Members of the Council and the Members of the Planning & Zoning are glad to help anyone that is seeking guidance, and try to be fair and open with everyone. Mayor Glaisyer said that if Marsden wanted to talk about the problems he:wauld be glad to meet with him, and said he was sure anybody else would too. Item 3 Pre-Termination Hearing Water/Sewer/Trash Delinquencies Glaisyer: "This is to inform you, ~._. °::_.~.`, i:::, ; ; if you choose to, you have the right to a pre-termination hearing, at 7:30 p.m., May 16, 1983, before the Mayor and Council, to appear in person to be judged on facts and defend the claim made by the City that your Water, Sewer, and Trash bill is delinquent. You may retain Council. This service will be discontinued May 19, 1983 unless payment is received in FULL." Glaisyer: "Is there anyone present that wishes a pre-termination hearing before the Council this evening?" There was no response. The Motion was made by Kingsford and seconded by Tolsma to close the pre-termination hearing on Water/Sewer/Trash Delinquencies. Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea Glaisyer: "Due to their failure to pay their water bill or to present any valid reason why the bill has not been paid, their water shall be turned off on May 19, 1983. In order to have their water turned back on, there will be an additional fee of $10.00. They are hereby informed that they may appeal or have the decision of the City reviewed by the Fovrth Judicial District Court, pursuant to Idaho Code. Even though they appeal, the Water will be shut off." The Motion was made by Kingsford and seconded by Ointonvto approve of the turn off.,list minus Mr. Andrews'Watch._8epair. Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea Item 4 Department Reports Wastewater Supt Earl Ward reported on a problem in the lines between West 1st and West 2nd Street. Ward said it would require some TV work. It was decided that Ward would work with Councilman Kingsford on the problem. City Eingineer Gary Smith discussed the problem of infiltration at Wheel Inn Mobile Mannor. (Tape on File - City Clerk's Office) It was decided that Smith would work with City Attorney Crookston on the statement required. City Engineer Smith also reported on a artesian well on the old Meridian Creamery Building property owned by Mr. Raasch. Smith reported that the well is draining into a manhole. on Meridian Street. Smith said that Earl Ward had die tested the well and the die had shown up in the manhold. The rate of drainage into the manhold is about 50,000 gallons per day. There was discussion. (Tape on File City Clerk's Office) City Clerk Jack Niemann announced the AIC Convention to be held in Twin Falls, June 16th through the 18th. Thy Council Members wishing to attend were asked to let the City Clerk know by Friday May 20th so that reservations could be made. Mayor G1~i:~yer presented to the Council Members the Meridian Area Map prepared by the Idaho State Transportation Department. There was much discussion. (Tape on File City Clerk's Office) The Motion was made by Kingsford and seconded by Brewer to authorize the Mayor to sign the Meridian Area Map as presented. Motion Carried: Kingsford yea; Tolsma, yea; Orton, yea; Brewer, yea There was discusstion. (Tape on File City Clerk's Office) It was decided by the Council Members that the Map presented differed than the previous map presented and approved. (Tape on File - City Clerk's Office) The Motion was made by Kingsford and seconded by Orton to turn down the authorization for the Mayor to sign the Meridian Area Map as prepared, and to sent a liaison back to the Idaho State Transportation Department. Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea Councilman Brewer announced the Meridian Days Acution sponsored by the Chamber of Commerce to be held Saturday May 21, 1983 at the Dairy Barn.
