Item 1 Resolution #82 - Adoption of Tenative Budget 1983/84 Fiscal Year President of Council, Grant Kingsford presented RESOLUTION NO. 81 "A RESOLUTION AUTHORIZING PUBLICATION OF AN ESTIMATE OF THE EXPENSES FOR ALL PURPOSES FOR THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, FOR THE FISCAL YEAR BEGINNING THE 1ST DAY OF OCTOBER, 1983, AND ENDING THE 30TH DAY OF SEPTEMBER 1984, AND GIVING NOTICE OF PUBLIC HEARING PRIOR TO THE PASSAGE OF THE ANNUAL APPROPRIATION BILL." The Motion was made by Orton and seconded by Tolsma that the Council adopt Resolution #82 Tentative Budget and to give notice of Public Hearing for Final 1983/1984 Fiscal Year City of Meridian Budget to be held September 6, 1983. Motion Carried: Tolsma, yea; Orton, yea; Brewer, yea; Item 2 PUBLIC HEARING - Conditional Use Permit for Janice Love to Operate Day School Mrs. Love was present to request a Conditional Use Permit to operate a day school at 1001 Meridian Street: This is presently a Church. Love explained that only the top floor will be used. Love told the Council that this will be a licensed facility, and that there will be less than 50 children. Kingsford: "I will now open the Public Hearing regarding the Conditional Use Permit request to operate a Day School by Janice Love." There was no response. Kingsford closed the Public Hearing. Councilman Brewer inquired on if the yard would be fenced. Love said that the entire back yard would be fenced. Councilan Tolsma questioned if Love had any problems regarding the Fire Codes. Love said that they are following all codes very strictly and will be adding an additional fire exit and a fire alarm system to the building. Building Inspector, Vern Schoen stated that he had gone over the preliminary drawing and that everything seemed in order. Police Chief Doug Nichols had no comment. There was discussion concerning the sewer and water charges on the building. (Tape on File - City Clerk's Office) Wastewater Supt. Earl Ward said that there would probably be no change in the billing as the Church is going out and the Day School is going in. (Tape on File - City Clerk's Office) • Meridian City Council 2. August 15, 1983 Item #2 Request for Conditional Use Permit by Janice Love for Day School . The Motion was made by Orton and seconded by Brewer to approve the Findings of Fact and Conclusions of Law prepared by the City Attorney as~adopted by~.tihe P&Z_:"... Commission concerning the request for a Conditional Use Permit by Janice Love to operate a Day Care/Day School at 1001 Meridian Street. (On file with these Minutes) Motion Carried: Tolsma, yea; Orton, yea; Brewer, yea; The Motion was made by Orton and seconded by Tolsma to accept the recommendation of the Planning & Zoning Commission to approve of the requested Conditional Use Permit by Janice Love to operate a day school at 1001 Meridian Street, upon the conditions as listed in the Conclusions of the Findings of Fact and Conclusions of Law. (On file with these Minutes) Motion Carried: Tolsma, yea; Orton, yea; Brewer, yea; Item 3 Larry Hellhake - Rocky Mountain Development Corporation Larry Hellhake, a representative of Rocky Mountain Development Corporation was present in reference to 120 acres they want to subdivide into five acre tracts. Several months ago the Meridian City Council restructed the Boundary of the Meridian Urban Service Planning Area by eliminating that portion South of the Ten Mile drain and adding these densities to other areas. The future use of this general area south of Ten Mile drain east of Ten Mile Road North of Overland Road has been left in limbo due to this restriction. There was discussion. (Tape on File - City Clerk's Office) Due to the property not being in the proposed Meridian Urban Service Planning Area, and the problems involved using lift stations for sewage the Council will not consider Annexation. Hellhake requested a statement to Ada County indicating the approval of the concept. Hel'lhake said that he has been tabled by the County Commissioners pending a clarification of the Urban Service Planning Area Boundary. Hellhake said that the covenants that will be placed on the property will stipulate that all houses are to placed at specific locations on the five acre tracts to enable future subdivision of these tracts after appropriate application, study, and approval by the City of Meridian. Hellhake stated that right now they are only asking for a density of 21 units for the 120 acre tract. Hellhake also said that the developer will install dry line sewers sufficient to handle present and potential future residential growth on the 120 acre site. Councilman Brewer said that he feels this is a "nice size project that makes sense and has a practical value." Hellhake told the Council that he felt that there is a "market for a good five acre development." Brewer said that annexation of this property may be a long time in comming, and it would benefit everyone to find away to use the property now, especially if someone wants to develop it. The Motion was made by Brewer and seconded by Orton to direct the City Clerk to draft a letter to be discussed and approved at the next regular meeting of the Council, generally in favor of the concept making certain provisions as discussed. Motion Carried: Tolsma, yea; Orton, yea; Brewer, yea; • • Meridian City Council 3. August 15, 1983 Item 4 Walter B. (Bruce) Honey - Discussion regarding 807.~leridian Street Mr. Honey was present, to discuss the current zoning of the building located at 807 Meridian Street. This building is currently zoned residential. Honey explained that he and his associate Lee Wilson would like to open a restaurant at this location. It was decided that Honey should apply for a Conditional Use Permit. Councilman Bill Brewer suggested that Honey meet~.with City Building Inspector Vernon Schoen for guidance as to what would have to be done to bring the building to Codes. It was the general concensus of the Council Members that they would be in favor of the proposal if the property owners in the 300 foot requirement area would have no objections. Item 5 Pre-Termination Hearing Water/Sewer/Trash Deliquencies Councilman Kingsford Read: "This is to inform you, if you choose to, you have the right to a pre-termination hearing, at 7:30 p.m. August 15, 1983, before the Mayor and Council, to appear in person to be judged on facts and defend the claim made by the City that your water, sewer and trash bill is delinquent. You may retain counsel. This service will be discontinued August 18, 1983, unless payment is received in FULL." Kingsford: "Is there anyone present that wishes a pre-termination hearing on their Water/Sewer/Trash billing?" There was no response. Kingsford: "Due to their failure to pay their water bill or to present any valid reason why the bill has not been paid, their water shall be turned off on August 18, 1983. In order to have their water turned back on, there will be an additional fee of $10.00. They are hereby informed that they may appeal to have the decision of the City reviewed by the Fourth Judicial District Court, pursuant to Idaho Code. Even though they appeal, the water will be shut off." The Motion was made by Brewer and seconded by Orton to approve of the turn off list for delinquencies of Water/Sewer/Trash billings, total being $4,330.40. Motion Carried: Tolsma, yea; Orton, yea; Brewer, yea Item 6 Department Reports Kingsford announced the dedication of Fuller Park to be held Saturday, August 20, 1983 at 11:00 AM. Kingsford urged everyone to attend. Building Inspector, Vernon Schoen told the Council that there has been a new tenant move in at the old Creamery Building about a week or 10 days ago. The new tenant uses .acetylene for welding copper tubing so this business in combination with dust from corn that has been stored in this part of the building is definately a hazard. This new business has not been issued an occupancy permit. At the present time he does not have City Water or Sewer so neither he nor the grain storage people pay any City bills. Schoen told the Council: "I, as well as the other department heads have been to this building many times in the past and still nothing has been resolved. As for myself, I'd like some direction from the Council as to how this can best be handled. I feel the Fire Department, Water Department, and Sewer Department would appreciate your help in this matter also. They may have some comments at this time." • Department Reports Cont'd . Wastewater 5up't Earl Ward: "We still have not resolved the discharge of the artesian well. We haven't had any contact from anybody." Kingsford: "It might be a good idea if we were to contact the owner (Amyx), sit down and discuss these problems as a group." Brewer: "It was my understanding that he (Amyx) would gladly furnish drawings and information of changes and business and the goings on over there " Kingsford: "Also, cap that well - post haste." Brewer: "We will have to have a set down before things get completely out of hand." Kingsford directed the City Clerk to arrange a meeting with Amyx concerning the problems discussed for the later part of the next week. (Tape on File) Meridian City Council 4. I futher certify that the City of Meridian, Idaho did give notice and hold a hear- ing upon the proposed uses of the City's General Revenue Sharing Funds with notice having been published at least seven days prior to the adoption of the tentative budget by the City Council. Citzens are invited to attend the budget hearing September 6, 1983, at 7:30 P.M., and have the right to provide written or oral comments concerning the entire City Budget and its relationship to the Revenue Sharing Funds, and that a copy of the prosposed City Budget in detail is avail- able at City Hall, 728 Meridian Street, Meridian, Idaho for inspection during regular office hours.
