September 6, 1983 Regular meeting of the Meridian City Council called to order by Mayor Joseph Glaisyer at 7:30 p. m. Council Members Present: Grant Kingsford; Ron Tolsma; Rick Orton; Bill Brewer; Others Present: Earl Ward; Larry Hellhake; Doug Nichols; R.C. Spencer; Vern Schoen; Bruce Stuart; John Redding; Gary Smith; K.W. Bowers; Moe Alidjani; Marnell Chenowith; Donna Winn; Wayne Crookston; Betty McGoldrick; Jack H. Niemann; Minutes of the previous meeting held August 15, 1983 were approved as written. Item 1 PUBLIC HEARING: Variance request by Betty McGoldrick Mayor Glaisyer: I will now open the Public Hearing regarding the variance request by Betty McGoldrick allowing construction of a carport with storage area on the North property lot line. Is there anyone present that wishes to comment either pro or con on this variance proposal?" There was no response. Glaisyer: "I will now close the Public Hearing." Glaisyer: "Council Members you have the proposal before you, are there any questions of Betty (McGoldrick)?" Kingsford: "The carport you are talking about is basically going to go the same distance to your property line as the garage is on that property line - is that right?" McGoldrick: "Right." Kingsford: "And that neighbor has no problem?" McGoldrick: "No, they signed.." There were no other comments from the Department Heads or from the Council. The Motion was made by Kingsford and seconded by Tolsma to approve of the granting to Betty McGoldrick, a variance allowing construction of a carport with storage area on the North property line. (Applause) Item 2 PUBLIC HEARING: 1983/84 Budget Glaisyer: "I will open the Public Hearing. Is there anyone present that wishes to make comment to our proposed 1983/84 Budget?" There was no response. Glaisyer: "Being there no Public testimony, I will close the hearing." /_ • • Meridian City Council 2. September 6, 1983 Item 3 Adopt Annual Appropriation Ordinance #425 & #426 Mayor Glaisyer Read: "AN ORDINANCE SETTING FORTH THE TOTAL AMOUNT OF MONEY NECESSARY TO BE RAISED FROM TAXES ASSESSED ON THE TAXABLE PROPERTY WITHIN THE CITY OF MERIDIAN FOR THE YEAR BEGINNING OCTOBER 1, 1983, AND ENDING SEPTEMBER 30, 1984. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO. The total amount will be $343,235.00" Glaisyer: "Is there anyone present that wishes to have Ordinance Number 425 read in its entirety?" There was no response. The Motion was made by Kingsford and seconded by Orton that the rules and provisions of 50-9002 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance Number 425, as read be passed and approved. Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea; Ordinance #426 Mayor Glaisyer Read: "AN ORDINANCE MAKING AN APPROPRIATION OF MONEY FOR ALL THE NECESSARY EXPENSES AND LIABILITIES OF THE CITY OF MERIDIAN, ADA COUNTY, IDAHO, FOR THE FISCAL YEAR COMMENCING THE FIRST DAY OF OCTOBER, 1983, AND ENDING THE THIRTIETH DAY OF SEPTEEBER, 1984, THIS ORDINANCE BEING KNOWN AS THE ANNUAL APPROPRIATION BILL, AND DECLARING AN EMERGENCY.' The total amount will be $1,690,463.00" Glaisyer: "Is there anyone present that wishes to have Ordinance Number 426 read in its entirety?" There was no response. The Motion was made by Kingsford and seconded by Tolsma that the rules and provisions of 50-9002 and all rules and provisions requiring that Ordinances be read on three different days be dispensed with and that Ordinance Number 426, as read be passed and approved. Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea; Item 4 Adopt Resolution #83: Proclaiming General Election. Mayor Glaisyer Read: "A RESOLUTION PROCLAIMING A GENERAL CITY ELECTION, TO BE HELD ON NOVEMBER 8, 1983, DESIGNATING THE POLLING PLACES, DESIGNATING THE REGISTRAR AND DEPUTY REGISTRARS, AND ORDERING THE CITY CLERK TO GIVE NOTICE OF SUCH ELECTION." Glaisyer: "Is there anyone present that wishes to have Resolution #83 read in its entirety?" There was no response. The Motion was made by Kingsford and seconded by Orton to approve of Resolution #83 proclaiming the General Election for the City of Meridian. Motion Carried: Kingsford yea; Tolsma, yea; Orton, yea; Brewer, yea; Glaisyer: "With that Resolution, I will announce that Mr. Grant Kingsford will be running for Mayor.. Congratulations Grant." • Meridian City Council 3. September 6, 1983 Item 5 Audit proposal by Fox & Company for 1982/83 Fiscal Year. Mayor Glaisyer: "The total bill is the same as last year." The Motion was made by Kingsford and seconded by Brewer to approve of the audit proposed by Fox & Company. Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea; Item 6 Request by Senior Citizens for renewal of Variance for Use of Boiler Room at Creamery Building for Hobby Shop. Mayor Glaisyer: "That was a one year variance, it is up this month. I don'.t know of any problems there." All Department Heads agreed that there was no problem in renewing the variance. The Motion was made by Kingsford and seconded by Tolsma to approve of the renewal of the variance request by the Senior Citizens for use of the boiler room at the Creamery for their Hobby Shop for 1 year. Motion Carried: Kingsford, yea; Tolsam, yea; Orton, yea; Brewer, yea; Item 7 Letter to Ada County Commissioners Regarding Rocky Mountain Development Mayor Glaisyer explained that this was on the Agenda of the August 15, 1983 meeting, and that the City Clerk, Jack Niemann, was instructed by the Council at that time to prepare a letter to Ada County. (See Minutes of August 15, 1983 On file - City Clerk's Office.) (Letter on file with these Minutes) Glaisyer: "Do any of the Council Members have any problem with the letter itself?" It was the consensus of the Council that the letter contained the material that had been discussed at the previous meeting. Larry Hellanke representing Rocky Mountain Development requested permission to approach the Council to give findings that he had gathered ince the last meeting. Hellanke explained that in talking to Sheldon Gerber from Ada County Zoning, he had found that the only way Ada County would approve or would recommend approval would be if the area is in or found to be in the Meridian USPA, or if Meridian chooses to annex the area. Hellanke said that he "still believes I am in your USPA." Hellanke said that he had some confusion in his mind over the wording of the Urban Service Planning Area and the Urban Sewer Service Planning Area. Kingsford questioned the distinction between the USPA (Urban Service Planning Area) and the US5PA (Urban Sewer Service Planning Area.) Orton: "I know that I was referring to the Urban Sewer- Service Planning Area as the Urban Service Planning Area." "In 1981, when we made this change: whether::the word Sewer is in tYiere or not, I was here, and I know I clearly meant Urban Service Planning Area. I meant both the areas would shrink to that level or modify to that level. The message got clearly conveyed to APA, because their current maps show it is correct. By way of explaining this confusion with the things from Planning & Zoning - Yes - they have, since we adopted that in 1981, they have come back to the Council with Comp. Plan admendments and they have recommended the different area. It-stands not before us only as a recommendation." "So, Officially, in my opinion, this boundary of the May 4, 1981 hearing is the Urban Service Planning Area that we voted on. I know I can speak for my vote - I meant Urban Service Planning Area - no matter how it got tras,scribed or how our language was during the meeting. .. • • Meridian City Council 4. <f September 6, 1983 Item 7 Rocky Mountain Development Cont'd . Glaisyer: I agree with you on that - it was Urban Service Planning Area - not Sewer area. But even with that you (Hellanke) are not in the Urban Service Planning Area as of May 4, 1981." Hellanke: "The wording made it unclear that this is what took me out." Hellanke said that not being in the Urban Service Planning Area has "dogged potential development" and that he "somehow has to get it in the Urban Service Planning Area." Hellanke questioned a trade-off of possibly part of the Quong property that is in the U5PA being taken out and his property being put in. Kingsford: "We are not negotiating over there to change the USPA." Kingsford told Hellanke that "Gary Smith (City Engineer) is preparing for us a study as to what can gravity out there efficiently, while we meet with the County Commissioners on the Area of Impact negotiations. If it's realistic that it can be sewered - I think we would have a different attitude. But if it can't - if our preliminary study shows that it is 10 Mile Creek - I wouldn't be interested in including it in our USPA." Kingsford suggested that Hellanke check with Gary Smith a week from Friday on his findings concerning the area. The Motion was made by Kingsford and seconded by Tolsma to approve of the letter drafted at the request of Larry Hellanke to Ada County Commissioners in regard to Rocky Mountain Development. Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea; Hellanke thanked the Council and City Clerk, Jack Niemann for their time and efforts. Item 8 Appointment of Members to Planning & Zoning Commission Mayor Glaisyer made the recommendation to appoint Moe Alidjani to a 6 year term on the Planning & Zoning Commission, and Jim Johnson, to complete the term left vacant by Gerry Sweet, who resigned. The Motion was made by Kingsofrd and seconded by Orton to approve. of the Mayor's recommended appointments Mr. Moe Alidjani and Mr. Jinn Johnson to their respective terms of the Meridian Planning & Zoning Commission. Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, yea; Item 9 Discussion Regarding Workshop on Zoning & Development Ordinance Changes There was discussion amoung the Council on the necessity of holding another workshop to go through the changes of the Zoning & Development Ordinance. It was the unanimous concensus of the Council that they would like time to read over all the changes, but felt a workshop was not necessary. NO. 83 A RESOLUTION PROCLAIMING A GENERAL CITY ELECTION, TO BE HELD ON NOVEMBER 8, 1983, DESIGNATING THE POLLING PLACES, DESIGNATING THE REGISTRAR AND DEPUTY REGISTRARS, AND ORDERING THE CITY CLERK TO GIVE NOTICE OF SUCH ELECTION. BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF MERIDIAN, IDAHO, THAT: SECTION 1. The general city election will be held in and for the City of Meridian, on the 8th day of November, 1983, at which time there will be elected a mayor and two (2) councilmen to serve for a term of four (4) years. SECTION 2. The following are designated as the polling places for such election; FOR THE FIRST PRECINCT: Meridian Fire Station 716 Meridian Street FOR THE SECOND PRECINCT: American Legion Hall 22 West Broadway SECTION 3. That J.H. Niemann, City Clerk, is hereby designated as Registrar and the following as Deputy Registrars: Penny Webb; SECTION 4. HINRICHS Chelrman Zonlnp 8 Plannlnp On August 15, 1983 Mr. Tarrv Hellhake representing Rocky Nbuntain Develofanent Corporation was on the Agenda for the Meridian City Council Meeting regarding the above subdivision. This subdivision is outside the Meridian Urban Service Planning Area as the proposed line follows Ten Mile Creek. The proposed use Rocky Mountain Development Corporation has presented for five acre lots with restrictions as to where the housing units must be placed, making it feasible in the future to re-subdivide in smaller lots, is a good concept. Due to the property not being in the proposed Meridian Urban Service planning pry and the problems involved using lift stations for.. sewage the Council will not consider Annexation. It is the consensus of the Meridian City Council that dry lines should be installed when property is developed and plans submitted showing proposed streets, lots and utilities in the event•of future re-subdiv- ision. KINGSFORD BILL BREWER RICHARD F. ORTON, JR. RONALD R. TOLSMA ANNETTE C. NINRICHS Chairman Zoning 6 Planting The following are my thoughts concerning Mr. Hellhake's presentation of August 15, 1983. 1. The closeness of this 121-acre parcel to the City urban boundaries does, in my opinion, make the resubdivision concept a valid proposal. 2. I doubt very seriously, because of the nature of the beast -that is, because people will have bought their five-acre parcel with a specific use in mind - that all of the parcels would be involved in a resubdivision process at the same time. Theoretically, any number may resubdivide over any period of time. 3. I think it is appropriate to have the developer control the location of the building site on each lot to facilitate possible future resubdivision. If this building site control is placed in the covenants, it is then enforceable by the developer and/or homeowners association or Archi- tectural Control Committee. As I remember from the Treasure Valley Baptist Church situation, the City has no jurisdiction in enforcement of the provisions of covenants. I think a site plan, showing the building sites, should be made an attachment to the covenants. ~ - 4. The developer should remain responsible to conform to all legal requirements for subdivision platting in the State and County. GDS:ss a ~ • August 16, 1983 T0: Ada County Commissioners FROM: Meridian City Council Dear Sirs: At the Meridian City Council meeting held on August 15, 1983 a discussion Gzas held with Larry J. Hellhake, a representative of Rocky Mountain Develop- mer_t Corporation in reference to 120 acres they want to subdivide into five acre tracts. It is understood by Larry J. Hellhake and Rocky Mountain Development Corpor- ation that approximately fourteen months ago the Meridian City Council re- structed the boundary of the Meridian Urban Service Planning Area by elimin- ating that portion south of the Ten Mile drain and adding these densities to other areas. The future use of this general area south of Ten Mile drain east of Ten Mile Road north of Overland Road has been left in limbo due to this restriction. As our discussions during the council meeting indicated, we find the proposal by Rocky Mountain Development Corporation to be consistent with our future plans for the area as a rural reserve and is also within the Meridian area of impact. We, as a council would like to recommend to the Ada County Commissioners that they approve this 21 lot subdivision as it is consistent with Meridian's rural area policies for the area. We feel that the low densities created by this development will not adversely affect the quality of services found in Meridian. The approval of this concept and development will be based on the following conditions: 1. The developer install dry line sewers sufficient to handle present and potential future residential growth on the 120 acre site. 2. The developer to receive approval from Central District Health to construct septic tanks on each of the five acre tracts. 3. Developer to install a private water system acceptable to Central District Health or a central water system, including a well and an appro- priate sized mains within the project sufficient to serve the project and also designed to allow extension to the city systems as needed in the fu- ture. These water facilities to be designed to city standards and approved by a city engineer prior to construction. Ada County Commissi era August 16, 1983, P~, 2 4. The existing irrigation system will be maintained and expanded to achieve full irrigation of the parcels while maintaining distribution beyond the site. 5. All power, gas, cable TV, and telephone utilities will be extended underground within the site to local utilities standards. 6. All roads to be designed and constructed to ACID standards. 7. The proposed development will be for a maximum of 21 units of ap-. proximately 5 acres each. If you have any questions or clarification on the above, please let me know.
