Kingsford; Ronald Tolsma; Rick Orton Jr.; Bill Brewer Others Present: Doug Nichols; Earl Ward; Gary Smith; Bruce Stuart; Vern Schoen; Kenny Bowers; Michael Zuzel; Dean & Dorothy Rule; Robert Giesler; Marnell Chenowith; Mr. & Mrs. Robertson; Wayne Crookston Jr.; Minutes of the special meeting held August 25, 1983 regarding the Creamery Building were approved as written. Counci].m~-m Kingsford c~azted on the minutes of August 25, 1983, saying "In regard to the well, Mr. Atttyx at that time said that he was going to route that water into the stone sewer. It has been called to my attention again that the stone sewer dumps into the sewer system. I've aked Earl (Ward) to meet with Mr. Amyx and his representative and tell them what stornn sewer he will have to go to." Minutes of the previous meeting held September 6, 1983 were approved as written. Item 1 Dean lade: Request for Phase Construction of Westlawn Subdivision #1 Mr. Dean Rule. was present representing his request to be allowed a phase construction plan for Westlawn Estates Sub. #1. Rule explained that in order to meet his present construction loan conunittment he would like to have a phase construction for the first 22 lots. Rule also said that about 2/3'rds of the lots in Phase 1 are sold, and con4nented that "once we start, I doubt if we will ever stop." Fire Chief Kenny Bowers said that that it will be "tight for afire truck, but there are slot of other spots. around that are alot tighter." Kingsford pointed out that phase 1 allows for a cul-de-sac for turn-a-round. Wastewater Supt' Earl Ward said that he would prefer that the length of sewer run in the 1st phase would run to the next ccsnplete manhole. Ward said that this would enable him to facilitate the tests. Works Supt' Bruce Stuart echoed Ward's request to take the water line to the 1st inlay valve. (Broadway Court) Rule said he had no problem with that. The Nation was made by Kingsford and seconded by Tolsma to allow Dean Rule's request for phase development in Westlawn Estates Subdivision No. 1, providing that the sewer and water will go to West Broadway Court cul-de-sac. Motion Carried: Kingsford, yea: Tolsma, yea; Orton, yea; Brewer, yea; Item 2 Mr. Robertson: First Church of Christ, Request to Gravel Parking & Driveway Area Mr. Robertson came before the Council requesting pezmi.ssion to gravel the parking and. driveway area of the First Church of Christ being built at 2511 W. Cherry Ln. Robertson said that due to time limitations and costs they would like to gravel temporarily, and plan to pave within one year. Roberston said that they plan to gravel to meet ccenpactation required by ACIID. The Motion was made by Kingsford and seconded by 'Iblsma to allow the request by 1st Church of Christ, 1 year to pave parking lot and driveway, that it be graveled to the compactation test and rules and regulatons of ACfID. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea; Orton, Obstain; • ~ ___ Meridian City Council 2. Sept. 19, 1983 Item 3 Approval of the Bills The bills were read. The Motion was made by Kingsford and seconded by Tolsma to approve the bills. Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, Yea; Item 4 Pre-Termination Hearing Water/Sewer/Trash Delinquencies Mayor Glaisyer: "This is to inform you, if you choose to, you have the right to a pre-termination hearing, at 7:30 p.m., September 19, 1983, before the Mayor and Council, to appear in person to be judged on facts and defend the claim made by the City that your water, sewer and trash bill is delinquent. You may retain counsel. This service will be discontinued September 22, 1983, unless payment is received in full." Mayor Glaisyer: "Is there anyone present that wishes to come before the Council concerning their Water/Sewer/Trash bill?" There was no response. Mayor Glaisyer: "Being there no response, I will close the pre-termination hearing." "Due to their failure to pay their water bill of to present andy valid reason why the bill has not been paid, their water shall be turned off on September 22,,1983. In order to have their water turned back on, there will be an additional fee of $10.00. They are hereby informed. that they may appeal or have the decision of the City reviewed by the Fourth Judicial District Court, pursuant to Idaho Code. Ewen though they appeal, the water will be shut off." "The amount delinquent is $4,856.23." The Motion was made by Kingsford and seconded by Orton to approve of the Water/Sewer/ Trash turnroffs. Motion Carried: Kingsford, yea; Tolsma, yea; Orton, yea; Brewer, Yea.; Item 5 Department Reports City Engineer Gary Smith asked the Council if they had any questions concerning his letter to Benjamin Franklin Services regarding two situations that arose in Cherry Lane Village. One concerned Sewer and one concerned Water. Smith: "As far as I know, the Engineer from JUB that was involved in the Subdivision wrote two demand letter to Lloyd McKay to take care of the problems, I don't-know what has happened since then. Those have been sent to him too. To put in service for the sewer and clear up the water." Stuart: "One thing more on the water. We have the water hooked-up to the house temporarily, just from another meter file with a pipe going over to his house. If nothing else, if nobody will take care of this, I think that the City should do it, and then bill the owner of the property or of the subdivision. Once it starts freezing we are going to have trouble out there." "He is getting un metered water." Orton: "We will probably want to take action on Bruce's (Stuart) reconmiendation in not less than a month." "Why don't you hook-up some kind of a temporary meter and give McKay a month to do something." Brewer: "I would like to notify you that I did authorize the Chief (Police) today to spend approximately $2,000.00 of our excess funds to obtain a temninal that will put us in direct correm~nication with Ada County Sheriff's Department." ., ~ • • Meridian City Council 3. Sept. 19, 1983 Deparment Reports Cont' d . Councilman Tolsma reported that there have been ccenplaints against blowing trash again. Tolsma said that he had talked to Moe Aldijani and to the Chief (Police) concerning the problem. Chief Nichols told the Council that the Police Department had been to talk to the parties involved. "They told us that they were going to take care of it," Nichols said. Being there no other business to cane before the Council .
