Meridian City Council January 17, 1983
Regular meeting of the Meridian City Council called to order by Mayor Joseph Glaisyer
at 7:30 p.m.
Councilmen Present: Grant Kingsford; Ronald Tolsma; Rick Orton, Jr.; Bill Brewer

Minutes of the previous meeting held January 3, 1983, were approved as written.
Mayor Glaisyer welcomed Boy Scout Troops #121 and #89, to the Meridian City Council
Meeting. There were several Scouts present to observe the Council procedures. The
Mayor praised the Scouts and encouraged them to "keep up the good work."

1 Audit Report Prepared by Ripley, Doorn & Co. FY Ending September 30, 1982
Mayor Glaisyer questioned the Council as to their readiness to adopt the audit report
prepared by Ripley, Doorn & Co., for year ending September 30, 1982.
Glaisyer stated that one of the auditors would come and explain any of the facets
of the audit that might be in question.
Councilman Kingsford expressed that he would like more time to study the audit before
action is taken.
It was decided that the adoption of the audit would be brought up at the next regular
Council Meeting scheduled for February 7, 1983.

2 Pre-Termination Hearing Water/Sewer/Trash Delinquencies
Mayor Glaisyer: "This is to inform you, if you choose to, you have the right to a
pre-termination hearing, at 7:30 p.m., January 17, 1983, before the Mayor and Council,
to appear in person to judged on facts and defend the claim made by the City that
your Water/Sewer/Trash bill is delinquent. You may retain Counsel."
Glaisyer: "Is there anyone present tonight to come before the Mayor and Cotuicil in
regard to their Water/Sewer/Trash billing?"
There was no response.
Mayor Glaisyer: "Pre-Termination hearing closed."
Mayor Glaisyer: "Due to their failure to pay their water bill, or to present any valid
reason why the bill has not been paid, their water shall be turned off on ~'anuary 20,
1983. In order to have their water turned back on, there will be an additional fee of
$10.00. They are hereby informed that they may appeal or have the decision of the City
reviewed by the Fourth Judicial District Court, pursuant to Idaho Code. Even though
they appeal, the water will be shut off."
The Motion was made by Kingsford and seconded by Tolsma to approve of the water turn-off
list, and that the water be turned off on January 20 , 1983, unless payment is received
in full.

3 Department Reports - Council Reports
Mayor Glaisyer reported that he had received a letter from Rick Jarvis, of APA, which
are working with the County Commissioners concerning the hearing for the South-West
Plan. Mayor Glaisyer explained that there were some publication problems with the
first hearing, making it invalid. The letter from Jarvis requested a statement of
any concerns that Meridian might have concerning the new plan.
Mayor Glaisyer stated that his comments were that he felt "we still have a:r-egard:_for,
and concern for the water infiltration into the aquifer." Glaisyer said that he would
write a letter back to that effect, if the Council so wished.
Councilman Orton whole heartly endorsed a letter from the Mayor to that effect.
Mayor Glaisyer was instructed to write a letter to Rick Jarvis, of APA, stating the
thoughts of the Council concerning the water infiltration.
Mayor Glaisyer presented a bill from Ada County Civil Defense in the amount of $986.11.
This is for the City's participation in this, which allows the City a discount on
materials bought from the Civil Defense Shop.
Glaisyer questioned the Department Heads on their use of this. Water Supt. Bruce
Stuart stated that he used this quite a bit, and had experienced a great savings on
several items needed by him. This was also voiced by Fire Chief Roger Welker.

The Motion was made by Orton and seconded by Brewer to approve of the payment of
$986.11 to Ada County Civil Defense.

City Engineer Gary Smith presented a bill concerning the HUD Water Grant, for a
Metrotech Line Tracer. Smith explained that the City had approval from HUD to spend
$700.00 of Grant funds on the Tracer. Smith went on to explain that this is a $1,300.00
item, but if they were to rent one, the cost of the rental would be approximately
$700.00. Smith stated that the Tracer is an extremely good piece of equipment.
The Motion was made by Orton and seconded by Tolsma to approve of the bill for the
Water Line Tracer in the amount of $1,300.00, $700.00 of which is grant eligible

Engineer Smith presented a request for reimbursement for inspection time on the HUD
Rehabilitation Water Project for Greg Walker, in the amount of $21.09, and for
Bruce Stuart, in the amount of $105.95. This was for extra time spent on the project.
The Motion was made by Orton and seconded by Kingsford to approve of the payment for
Greg Walker in the amount of $21.09, and for Bruce Stuart in the amount of $105.95,
for extra time spent for inspections on the HUD Rehabilitation Project.

Smith stated that there is only one other thing to "clean up" on the HUD Water Project.
This should be completed by the next Council Meeting and presented at that time. It
concerns the reimbursement to the Water Department for parts used on the project.
Smith explained that they are in the process of getting prices for the items used.

Meridian City Council 3. January 17, 1983
Police Chief Doug Nichols stated that he had been made aware of a large accumulation
of automobiles and automobile parts at 1304 W. 1st. Nichols said that there have
been several complaints on this. On checking with the City Ordinances, Nichols reported
that the Police Department has the right to remove these automobiles with the proper
notice to the property owner,;: Nichols reported that in checking with the City
Attorney, it was recommended that this be handled as a civil action.
The Motion was made by Kingsford and seconded by Brewer to instruct the City Attorney
to draft a letter of violation concerning the accumulation of automobiles and automobile
parts at 1304 W. 1st.

Councilman Bill Brewer stated that he had received another complaint concerning the
cul-de-sac problem at the end of State Street, concerning Catherine Park. Brewer
stated that he would like to find a solution to this problem.
Councilman Tolsma said that he had tried to contact Keith Jacobs, ACRD, with no luck.
Tolsma explained that he had left word for Jacobs, and was expecting to get with him
sometime soon in the near future.

Councilman Orton stated that he would like to get the Area of Impact negotiated.

Councilman Kingsford questioned City Attorney, Wayne Crookston, on the procedure on
drawing up the Findings of Fact and Conclusions of Law regarding the Quong-Watkins
Annexation. Kingsford stated that there has been conflicting testimony concerning the
annexation.
Attorney Crookston explained: "I take a private poll of the Council, and I prepared
proposed findings. If the poll indicates - I basically need each one of your's
feelings - if it appears to me as though there is a split vote, I can prepared two
sets - you adopt either one - the way you want to go." "At Planning and Zoning, I
prepared one set of Findings of Facts and Conclusions of Law, but I prepared two
motions. At Planning and Zoning level, the facts supported going either way." "If
it is unamious, one ~aay. pr~the other, I would probably prepare one set, and if there
is diversed opinion about that, at the time that you go over it, then you could change
it at that time. All I am doing is the proposed Findings of Facts."
The Motion was made by Kingsford and seconded by Orton to instur~t the City Attorney t.o
prepare the Findings of Facts and Conclusions of Law regarding the Quong-Watkins
Annexation.
