Special Meeting Set - Industrial Revenue Bond MEETING March 3, 1983 SET • Meridian City Council Feb. 22, 1983 Meeting called to order by Mayor Joseph Glaisyer at 7:30 pm. Councilmen Present: Grant P. Kingsford; Ronald Tolsma; Bill Brewer Councilmen Absent: Rick Orton Jr. Others Present: Vern Schoen; Doug Nichols; John Williams; Jim Potter; Todd Godfrey; Moe Alidjani; Roger Welker; Earl Ward; Gary Smith; Bob Nahas; Dorothy Rule; Dean Rule; Russ Durrant; Marnell Chenowith; Mr. & Mrs. Grant Jones; Jay Webb; R.D. Bischoff; R.C. Spencer; Wayne Crookston, Jr.; Jack H. Niemann Judy Linder Minutes of the previous meeting held February 7, 1983, were approved as written. Item 1 John Williams - Construction of Building in City Limits John Williams, 1917 Leisure Lane, was present representing his request for a variance of Building Codes in the construction of a wood frame, metal skin garage type building. Williams explained that this building will not be used in commercial venture, but for his private use in building and working on race cars. Williams show the Council Members several pictures of similar metal buildings that have been contructed in other areas. Williams also stated that the building will be about 1,000 feet from the house, and that he had contacted all neighbors none which had objections to the building. The William's home is located on a 1.23 acre area which is more of a rural setting than residential. Vernon Schoen stated that this type of building was strictly against code, and a variance to UBC Chapter 25 would have to be granted. There was discussion concerning fire protection. (Tape on File - City Clerk's Office) Fire Chief Roger Welker explained that the building would be "marked" and that no firemen would be allowed on the roof. The Motion was made by Kingsford and seconded by Brewer to grant a variance to John Williams to UBC Chapter 25, for the construction of a metal building. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer,yea Item 2 Presentation of Certificates to Wastewater Employees WasteWater Commissioner Grant Kingsford presented two Class 1 Operator Certificates to two employees of the Meridian WasteWater Treatment Plant. The Certificates were presented to Judith Linder, and Richard "Todd" Godfrey. Kingsford commended the two on their hard work. (Applause) Item 3 Final Plat Westlawn Estates #1 (Formerly Brooklawn Estates) Jim Potter, representing Westlawn Estates, stated that the comments by the Council, City Staff, ACRD, and have revised the plans accordingly, and have resubmitted them for the City Engineer's review. "I understand that he (City Engineer) has a couple - three minor comments which can be accommodated, we have discussed it. We are seeking approval of the Final Plat, recognizing that these very minor items, which he (City Engineer) will discuss, will have to be modified prior to recording of the Plat." Gary Smith, City Engineer: "They did a good job in addressing all the comments on the first go -around. There is a couple that I might mention for the minutes. One is that we need a copy of the declaration of protective covents." Potter: "Those were submitted to you with the rest." "They were rolled up with the rest, they must have slipped out between your office and mine. We'll get that." Smith: "I understand - is there a letter comming from Nampa -Meridian Irrigation?" Potter: "Yes." • Meridian City Council 2. Feb. 22, 1983 Item 3 Final Plat Westlawn Estates #1 - Cont'd . . . . . . Smith: "There was a revision to the drainage on Linder Road, that drainage is now comming through the Subdivision." Potter: "Correct. Nampa -Meridian has revised their policy, and even though you have historic drainage patterns, when improvements are made, -they will no longer allow waste water into head water - live water." Smith: "So the system will have to be designed to handle the Linder Road drainage as well as the internal Subdivision." "We did have a bit of a discrepancy on fire hydrants but I think that we will get that worked out between Roger (Welker, Fire Chief) and Bruce (Water Sup't.). That is all the comments that I have. Other than that, the plans look good." Roger Welker, Fire Chief: "We need the fire hydrants replaced. On the entry way off of Linder - is that going to be hard surface?" "Will it be an all weather construction?" Potter: "Yes." Welker: "On the renaming of the streets. Broadway lines up pretty good, and Idaho does, Biddick Circle which lines up with Ra.ilRoad Avenue;'I'm wondering ." Potter: "That change was made at the request of ACHD. They do not wish to extend the name of RailRoad Ave. They feel that it is in conflict because through the valley there are to many Railroad Avenue's or Railroad Streets, they are trying to clean that up." The Motion was made by Brewer and seconded by Kingsford to approve the Final Plat of Westlawn Estates #1, provided that the developer meet the suggestions of ACRD, the City Engineer, and the Meridian Fire Department. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea Item 4 Ordinance #420 (Procedures for Public Hearings) From Table Mayor Glaisyer read: "AN ORDINANCE ESTABLISHING AND FIXING RULES OF PROCEDURE FOR PUBLIC HEARINGS BEFORE THE CITY COiUNCIL OF THE CITY OF MERIDIAN, STATE OF IDAHO; AND PROVIDING AN EFFECTIVE DATE HERF,fl -"' Mayor: "This set the standards for persons that are going to testify or speak before City Council. That the hearing shall be recorded, that no person shall be permitted to speak unless recognized by the Mayor, time limit can be established, the speaker shall not be interrupted by members of the Council until his time limit has been expended, at the con- clusion of a speaker's comment's, each City Counci]man when recognized by the Mayor, shall be allowed to question the speaker, and that each speaker must swear of affirm that his testimony will be true and correct. Any person not conforming to any of the above J.•; may be prohibited from speaking. That's a brief summary of Ordinance #420. Is there anyone present that wishes to have Ordinance #420 read in its entirety?" No response. Kingsford: "As I recall, we tabled this at our last meeting so that Mr. Orton could review it." "This not being a pressing matter, I would suggest that we table Ordinance #420 until a later meeting." The Motion was made by Kingsford and seconded by Brewer to table Ordinance #420 until the March 21st, 1983 meeting of the Meridian City Council. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea CJ Meridian City Council 3. Feb. 22, 1983 Item 5 Pre -termination Water/Sewer/Trash Mayor Glaisyer read: "This is to inform you, if you choose -to you have the right to a pre- termination hearing, at 7:30 p.m., February 22, 1983, before the Mayor and Council, to appear in person to be judged on facts and defend the claim made by the City that your water, sewer and trash bill is delinquent. You may retain counsel. This service will be discontinued February 28, 1983 unless payment is received in full." Mayor:Glaisyer: "Is there anyone present that wishes to come before the Council this even- ing regarding their Water/Sewer/Trash bill?" There was no response. Mayor Glaisyer: "The amount delinquent is $3,547.40." "Due to their failure to pay their water bill or to present any valid reason why the bill has not been paid, their water shall be turned off on February 28, 1983. In order to have their water turned back on, there will be an additional fee of $10.00. They are hereby informed that they may appeal or have the decision of the City reviewed by the Fourth Judicial District Court, pursuant to Idaho Code. Even though they appeal, the water will be shut off." The Motion was made by Kingsford and seconded by Tolsma to approve the turn-off list and discontinue water service if not paid in full by February 28, 1983. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea Item 6 Gary Smith: HUD Block Grant Water/Sewer Rehab Project - Damage Claim Gary Smith, City Engineer, went over a damage claim submitted by Douglas Seamons, 203 W. Idaho, for damage resulting from a leak in the patch in the basement wall of his home. There was much discussion. (Tape on File, City Clerk's Office) It was the consensus of the Council that the damage claim'should be handled through the Contractor and his insurance company. (Claim on file with these minutes) Item 7 Other Business Community Development Block Grant Audit The Motion was made by Kingsford and seconded by Tolsma to approve the Community Development Block Grant Project No. B -81 -DN -16-001 Final Audit prepared by Ripley, Doorn & Co. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea Letter of Demand for Expenses Due City Mayor Glaisyer stated to the Council that he had written 10 day demand letters to over -due accounts for expenses due the City for Engineering costs, Publication costs, and Attorney fees. Glaisyer said that he had received no payment in response to. --,the demand letters. The Motion was made by Brewer and seconded by Kingsford to instruct the City Attorney to file lein against the propertiesi'of_those who had�_t6tiresponded to the demand letter. Motion Carried: Kingsford, yea; Tolsma, yea; Brewer, yea Meridian City Council 4. Feb. 22, 1983 Item 7 Other Business - Cont'd . . . . Findings of Fact and Conclusions - Quong-Watkins Annexation The March 7, 1983 meeting of the City Council was set for the reading of the Findings of Fact and Conclusions concerning the Quong-Watkins Annexation. The Council will vote at that time on the adoption of the Findings of Fact and Conclusions. Special Meeting - Industrial Revenue Bond A special meeting of the City Council was set for March 3, 1983 to adopt the Bylaws, adopt the Articles of the Corporation, adopt the Charter and approve of the inducement resolution with the company. Being there no other business to come before the City Council . . . . The line servicing your home was replaced as a part of that project, and, during replace- ment, it is my understanding you incurred some water damage to some furnishings in your basement, specifically a water heater and wood burning stove. The City is now in the process of administratively closing out the project. We need to know if you intend to file a claimfor the reported damage and, if so, what the dollar value of the claim will be. If you do not intend to file a claim, please execute the attached "Release Agreement". In either case, please submit a response to the Meridian City Hall, City Clerk Jack Niemann, by January 3, 1983. Idaho, Meridian, for water damages sustained as a result of installation of a new sewer service line to and into the residence. We have verbally discussed this situation for some time. Now that Mr. Seamons has formally presented his claim, I ask that you process his claim with your insurance carrier. Please request from them, in written form, and submit to the City their determinations on the claim.
