Back at the time when the Smith and Bews property was farm land, there was an irrigation -drainage ditch which ran approximately from the Southeasterly corner of the property at a 45° angle, across the property. You also will recall that my property lies directly East of the Smith and Bews property. When Smith and Bews started cutting in their roads and doing their preliminary work, they simply filled this ditch in and cut a ditch across the South side of their property due East and started dumping all the water on my property. I do not believe that the engineers for Smith and Sews made any provision for this water but needless to say, I don't have to point out to you as the council, that by law the developer has to handle that water and under no cir- cumstances does my property have a responsibility to handle it. I am writing the City requesting their assistance in this matter. I am.fully aware that it is the City's position, and correctly so, that they do not get involved in irrigation matters. We have requested a special permit from the city of -Meridian to install gasoline pumps in conjunction with the operation of this store. . It is my understanding from our conversation this date that the City Council considered this matter at their meeting of August 1, 1973, and determined upon review of previous minutes that the approval for the pumps was given several months ago at the time the zoning was approved. As I have stated previously, it is our intent to lay lines { to the location for the pumps but not toinstall the pumps at this time, however, we do desire confirmation that at such time as it is feasible to begin gasoline sales we may proceed. Some months ago this property was zoned C -Commercial. Reference is made to Section 2-407 of the Zoning Ordinance which indicates that filling stations require a special permit. As z am sure you are aware, Circle K customarily provides self-se-L•vice gas facilities on the premises. Because of current conditions related to gasoline supply, it is not likely that gas sales will begin immediately on this property; how- ever, the company does wish to lay electrical lines, etc., out to this area and wishes the assurance that the pumps may be ixustalled at such time as it becomes feasible. We, therefore, respectfully request that the Commission and City Council give their approval to the sale of gasoline in conjunction with this store. The Motion was made by Glaisyer and seconded by Kingsford to accept the Final Plat of Sunnybrook Farms #2 as single family with variances (see evidence) Motion Carried: Williams, yea; Kingsford, yea; Glaisyer, yea. Agenda 7 Ted Hepper requesting an Auto Repair Shop on Cherry Lane. Hepper was present and ,stated that he has a lot on Cherry Lane with "C" Commercial zoning and is asking for a special permit for the repair facility- He requested Council reaction. Glaisyer stated that he did not like the location, Kingsford concurred. Agenda OTHER BUSINESS: 8 John Haraburda was present and requested in writing (see evidence)Council assistance in getting a delay on rezoning Valley Storage to M-1. J. R. Simplot has requested the rezone. Haraburda explained the situation and stated because the area is in the Meridian Irnpact Area, if the Council requested postponement, probably the Commissioners would comply. County Zoning denied the rezgne because it is 0-1 and not in the Comprehensive Plan. Williams felt the Council should take a more positive stand and recommend approval of the M-1 Zone. Haraburda explained the situation and School Superintendent, Gus Hein's position. The Motion was made by Glaisyer and seconded by Williams to recommend that the County Commissioners take the request under advisement. Motion Carried: Williams, yea; Kingsford, yea; Glaisyer, yea Agenda Gene Wright was present and stated that they submitted a Tentative Plat for Cherry Lane Village #3, and a letter requesting they be heard March 12 before Planning and Zoning and March 19th before the Council because of financial considerations, The Mayor could see no problem with the request. On lift stations Wright explained his understanding that the City will take'over.the charges at the end of one year. Hepper stated that the lot is presently zoned for multiple units - the south 40 feet is zoned Commercial. Hepper: "This is not a Nursing Home - it is for th, elderly people to stay,before they go into a nursing home. They need help - the need somebody to do their cooking, their laundry." This is just one home, one level, six bedroom, not to exceed nine people. "We do have State Codes buL when.Lhere is more than nine people it's a different category." MiLchell: "They are putting these in residential areas_" Hepper read from the Restr4.ctive and Protective Covenants pertaining this lot. r Tedi Subdivision: 2.- All -other residential or to �e used -for ultfple units by combining several lots or portion of lots; not to exceed more than 2 stories in height or more than 8 multiple units per building." It was the feeling of the Commission that this would be in a location where this would not cause a disturbance. There was discussion concerning the demand for such units. Each Commission member stated that: they do not have any particular problem with this proposal. Cecil Cherry and Son - Input Regarding Laundromat Kim Cherry spoke to the Planning & Zoning Commission requesting input as to their feeling toward placement of a Laundromat in the Cherry business complex located 309 gest Cherry Lane. Cherry stated that the present zoning is limited office with a Conditional Use, one office spacerin the middle of the building is vacant, that they have exhausted ways to lease this. They have done considerable research and are very serious with putting a laundromat with the intent of keeping attractive_ Eventually they do plan on completing the approved profess oral complex. They had talked with the people around this area and they felt it was ideally located, that there is adequate parking. Cherry stated this laundromat would be 1. first class as they intend to keep their business complex a first class area. Sharp was concerned about the ''retail tyre" traffic and felt he would have a hard time voting in favor of the laundromat of locating anywhere but a shopping center.
