Kingsford at 7:30 P.M.: Members Present: Ron Tolsma, Bob Giesler, Max Yerrington, Bob Corrie. Others Present: Don L. Bryan, Wayne S. Forrey, Vicki Welker, Larry Sales, Mike King, Walter Casey, Gary Smith, Jim Johnson, Wayne Crookston, Jim Merkle, John Shawcroft, Bill Gordon, Teri Foley, Mrs. Zimmer: MINUTES OF THE PREVIOUS MEETING HELD DECEMBER 159 1992: The Motion was made by Tolsma and seconded by Giesler to approve the minutes of the previous meeting held December 15, 1992 as written: Motion Carried: All Yea: Eng. Smith: Introduced and welcomed new Wastewater Superintendent, John Shawcroft. ITEM #1: FINAL PLAT ON PHASE #I OF VALERIE PLACE SUBDIVISION: Giesler: There are a number of comments from the City Engineer, have those all been taken care of. Eng. Smith: I haven't heard back yet. The Motion was made by Tolsma and seconded by Yerrington to approve the Final Plat of Phase #1 of Valerie Place Subdivision. Motion Carried: All Yea: ITEM #2: PRE—TERMINATION HEARING: WATER/SEWER/TRASH DELINQUENCIES: Kingsford: This is to inform you in writing, if you choose to, you have the right to a pre—termination hearing at 7:30 P.M. on January 5, 1993 before the Mayor and City Council to appear in person, to be judged on facts and defend the claim made by the City that your water, sewer, trash bill is delinquent. You may retain counsel. This service will be discontinued on January 20, 1993 unless payment is received in full. Is there anyone present who wishes to contest their water, sewer, trash delinquencies? No response. They are hereby informed that they may appeal or have the decision of the City reviewed by Fourth Judicial Court pursuant to Idaho Code. Even though they appeal, their water will be shut off. 0 MERIDIAN CITY COUNCIL JANUARY 59 1993 PAGE 2 • The Motion was made by Yerrington and seconded by Tolsma to approve the turn off list. Motion Carried: All yea. Kingsford: The amount of the turn off list this month is $13.)284.55. ITEM #3: APPROVE THE BILLS: The Motion was made by Tolsma and seconded by Corrie to approve the bills. Motion Carried: All Yea: ITEM #4: LARRY SALES: ADA COUNTY HIGHWAY DISTRICT: Larry Sales: Handed information out to Council about the Capital Improvement Plan which is the legal basis for the Impact Fee Ordinance. Introduced the Impact Fee Coordinator, Mike King. Gave brief presentation on Impact Fees (See Tape for Presentation). ITEM #5: APPROVE FINAL PLAT ON MAJESTIC VIEW SUBDIVISION: The Motion was made by Corrie and seconded by Yerrington to approve the Final Plat on Majestic View Subdivision and allow the City Clerk & Engineer to sign it: Motion Carried: All Yea: ITEM #6: DEPARTMENT REPORTS: Chief Gordon: The State is getting ready to award bids on Patrol Cars again. I would like the approval of the Council to again go with the State Bid, which is the full size Chevrolet Caprice. Randy Hansen out of Twin Falls it looks like will be the low bidder. The bid this year on the patrol cars is less than what it was last year for the same vehicle. The price for ours is going to be about $13,100.00 per car and I was looking at two vehicles. The Motion was made by Giesler and seconded by Corrie to approve request to buy on State Bid. Motion Carried: All Yea: i MERIDIAN CITY COUNCIL JANUARY 5, 1993 PAGE 3 Wayne Forrey: Passed out Memo to City Council. I have two items, the first item is in regards to the downtown Community Development Block Grant Project Phase II Redevelopment. The Improvement Committee met on the 17th to discuss the status of the street work and the land acquisition and to formulate recommendations to the City Council. Four items came out of that meeting. 1) Eliminate several drainage items to reduce some cost; 2) Organize bid documents to include bid alternatives to possibly look at changing the landscaping if we are in an over— bid situation or over our budget in the bid; 3) Several on the committee felt that maybe the private sector could step in and perhaps make up the difference between what would be an acceptable offer to the owners and what the City has already offered; 4) Proceed to immediately acquire land parcel D. Those were the four items that came out of the meeting. The second item regarding the Glennfield/Settlers Ditch situation. I'm very disappointed to report back to you that today at the Settlers Irrigation Board Meeting that board declined the City's offer to have them participate in solving a problem, which was essentially put together. All we needed was their approval and it was declined, so the third entity is not there now. We're right back with the problem with no answer. Mrs. Zimmer: My property is the last lot on the south end of Monaco before the tiling that they did for Crystal Springs Subdivision. They came out, I believe Lasher's came out and put a grate across the pipe because I insisted they do something because if a child fell in they would be under for 100 feet at least. The grate was put across and big boulders placed and dug out a big area in my yard. This summer my neighbors son was playing over there and got his leg caught in that grate. I guess I don't think that they should have had part of it tiled and not all of it tiled because it creates an eye—sore on my property as well as a danger. This was my main concern. If there's anything I can do further to help get this done before Spring I'd be glad to help. Kingsford: We appreciate greatly your helping with the petitions. Tolsma: How far with the LID, Boesiger and the City funds bring it back? Forrey: That's a possibility. Probably would do about 3/4 of it. MERIDIAN CITY COUNCIL JANUARY 5, 1993 PAGE 4 Corrie: There is no way that we can force Settlers to do anything about this. Crookston: Not to my knowledge. Forrey: Wayne do you know if the Irrigation owns any of that property? Crookston: If they own it then they can be assessed in the LID but to my knowledge it's all easement. Kingsford: I'm sure that's true. Let's decide what we are to do with this by the next meeting. Again we appreciate all your help Mrs. Zimmer. Giesler: Disagree with City purchasing that parcel for parking lot. The Motion was made by Giesler and seconded by Tolsma to approve the Findings of the Downtown Committee, recommendations A, B & C. Motion Carried: All Yea: The Motion was made by Yerrington and seconded by Tolsma to table Recommendation D until next meeting. Motion Carried: All Yea: Don Bryan, 2070 N. Locust Grove Road, just came by to see what is going on with resolving my on-going problem with irrigation. Eng. Smith: I believe that Mr. Forrey was going to contact some property owners and Nampa Meridian came back with a response. Bryan: That's what I got. So you got negative review from them as far as becoming involved. It was talked about that they might go half if you could get the right of way or some other thing and they had some negative ideas on doing that after the fact. Kingsford: This would be more productive if we could ask Wayne to pull that file and review it with you. We are all aware of the problem. Forrey: Gave brief summary but will get with Mr. Bryan. MERIDIAN CITY COUNCIL JANUARY 6, 1993 PAGE 5 Crookston: I would request pending litigation. :7 an Executive Session to discuss Kingsford: Before we go into that I visited with Bernice Tisdale today, there is an opportunity, the State Department of Commerce is putting on a trade show in Anaheim, CA. and she thought it would be a good idea now with our new brochures and so on if we might take a look at going down there and participating in that. That would be to leave Feb. 1st and come back Feb. 4th. She has looked into some rates for transportation. Morris Air is $234.00, and she has said that her bank would handle the other expenses if the City would pick up the ticket. This would be plane tickets for myself, Mr. Johnson and Bernice Tisdale. The Motion was made by Yerrington and seconded by Tolsma to approve the expenditure to go to Anaheim. Motion Carried: All yea: The Motion was made by Tolsma and seconded by Yerrington to go into Executive Session to discuss pending litigation at 9:37 P.M.. Motion Carried: All Yea: Kingsford: Called Meeting back to order at 9:22 P.M.. In Executive Session we discussed the litigation and possibility of land acquisition. Anything else Mr. Crookston that you'd like to add. Crookston: We need to take action on the agreement discussed in the Executive Session. Kingsford: At this time I would entertain a motion on the agreement between the City of Meridian and Kenneth M. Jones to enter into a law suit with the City. The Motion was made by Tolsma and seconded by Yerrington to approve of the City signing the agreement between ourselves and Kenneth M. Jones. Motion Carried: All yea: Corrie: The Fire Chief asked if we could get two signs placed on Meridian Street that say "Fire Department 500'" to warn people that there is a Fire Station coming up. After reviewing it, I recommend that I meet with your Council and City staff to explain how the Impact Fee ordinance, and more importantly, how our Capital Improvement Plan works. The enabling statute requires that a capital improvements plan be prepared and adopted as a basis for any impact fee ordinance. The statute further requires that impact fee revenues are to be expended only in accordance with that adopted plan, that the plan identifies existing and projected deficiencies of the infrastructure system which is the subject of the ordinance, and that it sets priorities for improvements which are to be funded from impact fee revenue. This assures the public that the funds are being expended in their best interest - that the infrastructure components (in our case roadways) most in need of expansion are receiving the focus of the impact fee program. Revenue from collected impact fees may only be used for expansion of caRacity of the collector and arterial components of the transportation system. The basis of ACHD's Capital Improvement Plan (CIP) is the Functional Street Classification Map (FSCM) which identifies all the collectors and arterials in Ada County. By law, those are the only roadways upon which impact fee revenue may be expended. ACHD's CIP lists all the collectors and arterials from the FSCM and divides them into segments, usually extending from one major intersection to the next. The CIP lists each segment separately, and the following information about that segment: - the existing Level of Service (LOS), - the future LOS based on traffic projections of APA's traffic model, which in turn is based on each municipality's land use plan, - a calculation of the volume/capacity ratio, - any programmed improvements to that segment, - the estimated costs of that improvement, and - a qualifying statement for the use of impact fee revenue. ada county highway district 348 East 37th • Boise, Idaho 83714 a Phone (208) 345-7680 L 11 Roadway Improvements as they relate to the Impact Fee Ordinance December 28, 1992 Page 2 For various reasons, it is not appropriate that every piece of all collectors and arterials be improved by the developer of an abutting parcel. There are physical, topographical and safety reasons. For example, a short section of widened street with curb and sidewalk in the middle of a long stretch of narrow two-lane street can present drainage, safety and maintenance problems. Similarly, the indiscriminate use of impact fee revenue on a random basis will not result in coordinated improvement of the overall system. The key to success of the impact fee program is to accumulate a significant pool of funds which can then be used to make meaningful, usable improvements to those collectors and arterials which are most in need of expansion. For example, ACHD has budgeted $98,000 in impact fee funds collected in the Meridian area to help improve the Meridian Road/E. 1st. Street/Waltman Lane intersection. Combined with other ACHD funds, this will make a needed long-term improvement to the arterial system in Meridian. Similarly, impact fees will probably help improve Cherry Lane when it is rebuilt. The use of impact fees in these situations is made possible because those streets are "qualified" by the CIP. They have been projected to become deficient in the future because of the amount of growth occurring in their area and/or because of their relative importance to the overall transportation system. A deficiency is indicated when the LOS is projected to fall below LOS C, which has been adopted as the minimum desired LOS in Ada County. Only in situations where a development abuts a "qualified" segment of collector or arterial, is the District allowed to require the developer to dedicate right-of-way and/or install street improvements which will increase capacity of the system. By definition, this includes the widening of pavement and the installation of curbs. Sidewalks are always a site related item. In such a case, the District is required to compensate the developer for his cost for the improved right-of-way from impact fee revenue or to give him "offsets" from the impact fees which his project will pay in the future. We cannot require the developer to both install improvements/ dedicate right-of-way and pay impact fees. To do so would amount to double charging for the same thing. If the installation of qualifying improvements and/or the dedication of additional right-of-way along a collector or arterial are required, the installer/dedicator must be compensated for them. If the segment of collector or arterial which the parcel abuts is not "qualified" by the CIP, ACHD cannot require improvements to the collector or arterial, nor can offsets be granted for the impact fees which the project may pay. To do either would compromise the integrity of the impact fee program. 0 Roadway Improvements as they relate to the Impact Fee Ordinance December 28, 1992 Page 3 A -few weeks ago the Maws Addition subdivision was processed for approval by the City and ACRD. As you know, this project is located at the corner of Pine Street and Locust Grove Road. The FSCM classifies Locust Grove as a minor arterial and Pine as a collector, but neither street segment is "qualified" by the CIP. They are not qualified because the City's land use plan does not project significant growth in that area in the planning period. Therefore, the traf f is model which uses the land use plan as a base makes a determination that the two lane roadways will handle the traffic to be generated within the planning period. This is not the only case where this has happened. In fact, more often than not, such is the case. This is a necessary safeguard. Otherwise, the funding of improvements that have a greater need of improvement would be endangered. This is a significant departure from the practices of exaction to which we are all accustomed, in which we routinely required the installation of such improvements at all locations, but there is not money enough to randomly continue to improve all segments of all collectors and arterials without regard for their standing in the overall transportation system. Therefore, the impact fee program provides for the accumulation of funds so that highest priority improvements to those. components of the overall system which are in the most need of upgrading can be financed. When the City required the installation of curbs and pavement widening of Locust Grove Road and Pine Street in connection with Maws Addition, it placed the future homeowners in the situation of paying twice for those improvements. Under the impact fee program, ACHD would have installed these upgrading improvements at a later time when additional growth had occurred in the area, using revenue from the impact fees paid in that benefit zone. Now, the homeowners will pay once for the improvements in the price of their home or lot and again through the impact fees which their builders will have to pay. Under the law, ACHD cannot grant them offsets from the impact fees because the City's land use plan does not project sufficient growth in that area to need more than a two lane roadway. This is frustrating in some cases, because it may- seem that any widening of a collector or arterial is good, and of course it looks good in that particular location, but it does not provide a significant benefit to the overall system. In order that the City Council, the Planning Commission and the City staff can understand the legal basis and theory behind the impact fee system more thoroughly, I will plan to attend the Council meeting on January 5, 1993 so we can discuss the program to the extent desired by the Council. If that date is not suitable, please notify me of one which is. I suggest that at least 30 minutes be scheduled for the discussion. RHODES, Seu etary LJ December 22, 1992 ACHD`S CAPITAL IMPROVEMENT PLAN - - - -ONE OF FIVE- - - - The ACHD Capital Improvement Plan (CIP) is one of five transporta- tion planning documents currently being used to project the transportation needs of Ada County. These instruments are listed below, together with a description of their use and function. - THE 2000 FUNCTIONAL STREET CLASSIFICATION MAP (FSCM) This document is the longest -range planning tool in use because it is a graphic representation of the "ultimate" surface transporta- tion system. It is a picture of the collector and arterial system in Ada County as it will be at the build -out of the land use plan being used by APA in its traffic model. It is updated and adopted every five to ten years. - THE 2010 REGIONAL TRANSPORTATION PLAN FOR NORTHERN ADA COUNTY While touted as "The Plan", this document is actually shorter in range than the 2000 FSCM because it identifies the prioritized major improvements to components of the collector and arterial system. It relates needs to available revenue and assigns spending capabilities according to the need for the improvement as decided by the elected officials of Ada County. It may not always recognize technical or maintenance responsibilities. It is also updated and adopted every five to ten years. - ACHD'S CAPITAL IMPROVEMENT PLANNING PROGRAM (CIPP) This is a listing of all foreseeable improvement projects, system- wide. It incorporates ACHD Is pavement management program and includes maintenance type projects as well as reconstruction of streets and bridges. The list of projects is prioritized into a next year budget which is adopted by the District as the annual work program and four future years programming in relation to the priority or urgency of the individual projects. This is the first step in the plan- ning/programming process at which costs are estimated and assigned to projects. This document is updated and adopted each year as part of the annual budgeting process of the Ada County Highway District. - THE TRANSPORTATION IMPROVEMENT PLAN (TIP) The TIP includes those improvement projects in the 2010 Plan which are programmed with available revenue in the next five years. It includes projects by ITD, ACHD and any other agency/entity which is projected to spend funds on the transportation system. Prepared in accordance with the enabling statute for impact fees, the CIP lists each segment of the collector and arterial system and assigns a level of need to each roadway segment based on the existing and projected Level of Service (LOS). The projected LOS is determined by assigning the amount of traffic which will be generated by the future growth in Ada County, as planned by each unit of local government in the County. It is the legal basis of ACHDIs Road Impact Fee Ordinance, providing the rational nexus for the spending of impact fee revenues. Besides establishing the relative need for improvement of all segments of the collector and arterial system, the CIP is kept current with changing growth patterns, by annual amendment, to incorporate new traffic projections. Similarly, the CIP prevents the premature or inappropriate use of impact fee revenue for projects which do not match the needs of the various land use plans of the municipalities in Ada County. The CIP meets several important needs: - To identify the existing and projected LOS of all classified collectors and arterials based on adopted land use plans. - To inventory the existing deficiencies of the collector and arterial system and to forecast deficiencies of the future system resulting from planned growth in Ada County. - To serve as a checklist against which the eligibility of impact fee usage is measured. The CIP is maintained as a spreadsheet document, with the data which is most used by the public printed in the Summary, Tables 1 and 2. This data includes the existing number of lanes, the 1990 LOS, the projected 2010 LOS both with and without planned improve- ments, the planned number of future lanes, and all programmed roadway improvements (2010 TP, CIPP, etc.). This data, and other criteria, determine whether or not improve- ments to any particular roadway segment are eligible for the use of impact fee revenues, and thereby whether "offsets" (credits) against impact fees are allowed to repay the cost of improvements constructed by a developer of abutting property. The additional data in the spreadsheet (Tables 3-6) includes existing deficiencies, along with estimated costs to correct them, and other factors which are used to determine the LOS.
