M.: Members Present: Bob Giesler, Bob Corrie, Max Yerrington. Absent: Mayor Grant Kingsford. Dthers Present: JoAnn Stuhr, Cheryl Ott, Debbie Brown, Don Hubble, Bruce Freckleton, Frank Thomason, Don Bryan, Dan Torfin, Dave Collins, Gary Lee, Pat Tealy, Russ Hunemiller, Bill Gordon, Wayne Crookston, Gary Smith: MINUTES OF PREVIOUS MEETING HELD JANUARY 19, 1993: The Motion was made by Giesler and seconded by Yerrington to approve the minutes of the previous meeting held January 19, 1993 as written: Motion Carried: All Yea: Tolsma: Read a Proclamation declaring Burn Awareness Week February 7-13, 1993. ITEM #1: PUBLIC HEARING: VARIANCE REQUEST BY GLENCO, INC.: CULDESAC LENGTH & STREET: Tolsma: I will open the public hearing, is there a representative present who wishes to testify first? Don Hubble, Hubble Engineering, was sworn by the attorney. Hubble: I am project engineer for this request. The preliminary plat was brought before you some time ago. It included a lay out with a culdesac on there with a length in access of what is acceptable to the City and at that time we were informed that we needed to come back and request a variance for that culdesac length and at the same time the applicant would request a variance for the street light ordinance as well. Tolsma: Does it show the access road that's supposed to go through to the subdivision south of Country Terrace? Hubble: Gave explanation on preliminary plat. Discussion See tape) Corrie: The Fire Chief and I went out to a subdivision in Boise and looked at this type of parking. Do you have any idea how many parking spaces are going to be in the center of that? • • MERIDIAN CITY COUNCIL FEBRUARY 2, 1993 PAGE 2 Hubble: 4 to 6. You will have area on both ends of that, as a by the Homeowners Association. double parking with a landscaped private lot, owned and maintained Corrie: I think somebody should make sure that that is signed. Because if there's any cars parked there the Fire Department would not be able to get by that area. Tolsma: Did you see the comments of the school district on that also? Hubble: Yes. My response would be that there will be plenty of room for a school bus to turn around but if they decide that they wouldn't drive down there then I guess that's the way it's going to have to be. Tolsma: One other comment, on the Mesa Way extension on Phase II, wasn't that supposed to be completed before Phase III was started? Hubble: That was the City's requirement at that time, right and the developer prepared the construction plans for that and requested ACHD to obtain the right of way through that subdivision to the south and that's where that thing ended up today. I don't know that ACRD has ever secured that right of way and authorized construction to proceed. The plans are completed and have been approved. We drafted up a letter for the developer and he's signed that and said that once the highway district secures that right of way he would construct that portion of the roadway. Giesler: What is ACRD supposed to be doing now? The reports I get is that it's the developer that's holding the project up. This is something that I'd like to see handled right of way before we do anything with this. Hubble: Could you make that a condition of the final plat? The preliminary plat needs to be completed and brought back to you. The developer would like to install street lights in a similar fashion to what he did in unit #2 and that is to place them at intersections and then to use the yard lights intermediate rather than to comply fully with the Ordinance. Tolsma: Have you seen the comments from the Police Chief pertaining to the lights that aren't working in that subdivision? • MERIDIAN CITY COUNCIL FEBRUARY 2, 1993 PAGE 3 Hubble: Yes. • Tolsma: Is that the homeowners association that is supposed to see that all those lights are in working order? Hubble: I don't believe so, I think it's in the covenants that each individual property owner is responsible for his own light to make sure that it is in working order. Crookston: The City is not part of the covenant enforcement. We could send them a letter requesting that it be in working order but we really don't have any enforcing power. Corrie: Questioned request made by Hubble. Hubble: Would like to place street lights just at intersections and then use the yard lights in between intersections as a subst itute. Corrie: How about the culdesacs? Would there be any lights in the culdesacs? Hubble: Yes street lights. Corrie: Personally I like seeing them every 4010'. I would like to see us continue with the ordinance and put the street lights every 4G0'. Discussion tree tape) Tolsma: Thank you. Anyone else to testify? No response. I will close the public hearing. The Motion was made by Corrie and seconded by Yerrington to have the attorney prepare Findings of Fact and Conclusions of Law. Motion Carried: All Yea: Giesler: I would say that I would make a favorable recommendation to culdesac length variance and I also would agree to that issue that street lights at the intersections I feel would be adequate for this subdivision. I would make a favorable recommendation myself that the yard light variance be granted also. ~ ~ MERIDIAN CITY COUNCIL FEBRUARY 2, 1993 PAGE 4 ITEM #2: FINAL PLAT: TRACT SUBDIVISION #3: Tolsma: Is there a representative present? Gary Lee, JUB Engineers, representing the developer for Properties West. Tract Subdivision #3 of course is the third phase of the preliminary plat that was approved about a year ago on this project. There are some differences however from the original preliminary plat. We've combined what was identified as Phase three and four on the approved preliminary plat. The reason for doing that was 1) we wanted to make that street connection at Lark Avenue, Meridian Place #3 has been completed so now we can tie our traffic flow into that street and have our second access; 2) The second reason for the combinations of the subdivision is that the project is going fairly well and phase four was fairly small in numbers of units so the developer felt that it would be better to combine the two of them at this time and make it one plat. So the plat you see before you consists of 64 lots for combined phases three and four. Another point of interest, the marketing team has convinced the developer to go with a few larger lots in this phase and we have reduced the number from the original approved preliminary plat. We are taking out five lots in this general area than what was originally presented to the Council. It's been reduced in number and so of course the density has gone down some. If you have any questions I'd be happy to answer them at this time. Giesler: Have you seen the comments from the City Engineer? Lee: I have reviewed those comments today and we will address the issues that he has brought up. The Motion was made by Giesler and seconded by Corrie that the final plat for Tract Subdivision #3 be approved with stipulations that Engineer's requirements be met. Motion Carried: All Yea: ITEM #3: FINAL PLAT: MAWS ADDITION #2: Tolsma: Is there a representative present? Pat Tealy, 479 Main Street, representing the applicant. This is the second phase of Maws Addition. We have built out the first r~ \J MERIDIAN CITY COUNCIL FEBRUARY 3, 1993 PAGE 5 phase and marketing has gone well on that phase and we proceeded with the second phase. We do have a problem with the right of way in the second phase - explained. 33 feet of right of way was what ACRD originally required. Clerk Niemann: How come we didn't require forty on the first phase? Eng. Smith: Typically what I had been requiring was the 33 foot of dedicated right of way and a seven foot future road right of way easement and the County Engineer recently has not allowed this seven foot easement to be placed on the plat and specifically called out as a future road right of way easement. As I understand it he won't sign the plat with that notation on it. My previous review of Maws #1 Subdivision included that seven foot easement but when the plat came back for signature it wasn't on there so it got signed as a 33 foot right of way. Highway District has swung over to our side on requiring 80 foot right of way on section line roads and I don't know what their comments were on this subdivision. The credit to the developer from ACHD had to do with whether or not the improvements were made on the roadway and whether that section of roadway was in their capital improvement plan. Tealy: Just as a matter of information they will pay for any right of way over 25 feet. We'll get paid back for the 8 feet that we are dedicating here so either they buy it now or they buy it later. As far as the impact fees being used for improvements both on Pine and Locust Grove, we've gotten a letter back since then and we've been quizzing them about this using the impact fee and they've put Locust Grove on their capital improvement program. We will be building all the improvements both on Pine and Locust Grove but at least we'll get paid back for the ones on Locust Grove. Tolsma: This is just the 4G foot right of way on Locust Grove that they are requiring right now? Tealy: They are not requiring a 4~ foot right of way on Locust Grove, they are requiring 33 feet. We haven't gotten comments back from them for final plat but on their preliminary one they went through preliminary approval on this, they requested the 33 feet on our side. The requirement of 40 feet was from the City of Meridian. Probably the best thing to come up with a solution is for myself and/or Gary to meet with ACRD and come up with a solution. • MERIDIAN CITY COUNCIL FEBRUARY 4, 1993 PAGE 6 Giesler: Gary do you still prefer the 40 feet as listed in your comments? Eng. Smith: I think probably I better talk with the Highway District and see what they have in mind. Giesler: Do we have a time on that fence that that will be worked out? Clerk Niemann: I think we can make them bond it before we sign the plat. Tealy: I don't see any problem with the fence on the north boundary at all. The Motion was made by Corrie and seconded by Yerrington to approve the final plat for Maws Addition #2 with conditions being met by the Engineer's comments concerning the right of way of Locust Grove Road also bond for fence be provided if the fence is not completed. Motion Carried: All Yea: ITEM #4: FINAL PLAT: PARKWOOD MEADOWS SUBDIVISION #2: Dan Torfin, representing the developer. This is the second phase of the Parkwood Meadows Subdivision and it contains 24 lots and is in compliance with all conditions of the preliminary plat approval. Currently working with the City Engineer to get our construction plans approved and start construction within the next month. We have read the Engineer's comments and will comply. The Motion was made by Giesler and seconded by Yerrington to approve the final plat with stipulation that requirements be approved from the City Engineer. Motion Carried: All Yea: ITEM #5: FINAL PLAT: SUNBURST SUBDIVISION #4: Russ Hunemiller, developer of Sunburst #4. Crookston: I have a conflict of interest and will be stepping down. Hunemiller: I'd be happy to answer any questions you may have. MERIDIAN CITY COUNCIL FEBRUARY 2, 1993 PAGE 7 • Corrie: Have you seen all the City Engineer's comments? Hunemiller: I have not. Corrie: Item #7 of Engineer's comments concerning house size, you wouldn't have a problem with this would you? Clerk Niemann: That's the way it is designated on the plat. Giesler: Gary has all the irrigation run-off problems out there been taken care of with the neighbors? Eng. Smith: I've been in contact with Mr. Hunemiller and he has posted a bond us to see that that work does get done. He has full intentions of completing the work your speaking of. The Motion was made by Corrie and seconded by Giesler to approve the final plat for Sunburst Subdivision #4 conditioned upon Engineer's comments being met prior to signing the final plat. Motion Carried: All Yea: ITEM #6: REVISED FINAL PLAT ON HAVEN COVE SUBDIVISION #1: Dave Collins, representing the developer of Haven Cove Subdivision. We have changed a couple of lots. Explained reasons for changes. The Motion was made by Yerrington and seconded by Giesler to approve final plat on Haven Cove Subdivision #1: Motion Carried: All Yea: ITEM #7: REQUEST BY REAL ESTATE GROUP FOR TEMPORARY SALES OFFICE AT GOLF VIEW ESTATES SUBDIVISION: Debbie Brown, Real Estate Group in Meridian, representing the developer. We are requesting permission to have a temporary sales office on site in the development until which time we complete our first home. We then would be using the garage area for the temporary sales office, we estimate that to be no later than September 1st. Construction schedule is showing that we will be considerable sooner than that but not knowing what may come up with construction we wanted to give ourselves a little more lead time there. Tolsma: So your looking at about eight months. MERIDIAN CITY COUNCIL FEBRUARY 2, 1993 PAGE 8 • Brown: Actually construction on the home that we will be utilizing will start the tail end of February and the builder is looking at somewhere between 90 and 110 days to complete the home. Tolsma: Did you have any discrepancy about hooking this trailer up to City water and City sewer? Brown: We would like to, in the event that there is a need to be able to hook up to sewer. Tolsma: This is on a buildable lot? Brown: Yes it is. It is going to be located on Lot 9 Block 6. Tolsma: So then it could be hooked to the water and sewer on that lot and then transferred back over to the house. Giesler: You say in your letter you wanted to hook to sewer only, is that correct? Brown: That is my understanding, yes. Giesler: Why not water? Brown: His thoughts were with people in and out we would need to be able to flush those units. He did not address the issue of water with me but you bring up a good point. The Motion was made by Giesler and seconded by Yerrington to approve the request for the temporary office building until their new home is built and that if they are required to hook up to water and sewer that it be made available to them. Giesler withdrew motion and Yerrington withdrew second. The Motion was made by Giesler and seconded by Yerrington to approve the temporary office building to be set up on Lot 9 Block 6 and that water and sewer be available to that and that it be allowed no longer than September 1, 1993. Motion Carried: All Yea: Brown: May I clarify something. The actual temporary structure will be located on Lot 2 Block 5, the permanent structure that we will be moving to is on Lot 9 Block 6. We would be requesting that water and sewer hookup be for the temporary structure. MERIDIAN CITY COUNCIL FEBRUARY 2, 1993 PAGE 9 ITEM #8: PRE-TERMINATION HEARING: WATER/SEWER/TRASH DELINQUENCIES: Tolsma: This is to inform you in writing, if you choose to, you have the right to a pre-termination hearing at 7:30 P. M. 02/02/93 before the Mayor and City Council, to appear in person to be judged on facts and defend the claim made by the City that your water, sewer, and trash bill is delinquent. You may retain Counsel. This service will be discontinued 02/17/93 unless paid in full. Is there anyone present who wishes to contest their water, sewer, trash delinquency? No response. They are hereby informed that they may appeal or have the decision of the City reviewed by the Fourth Judicial Court pursuant to Idaho Code. Even though they appeal their water will be shut off. The Motion was made by Yerrington and seconded by Corrie to approve the turn off list. Motion Carried: All Yea: Tolsma: Amount of list if #13,379.33. ITEM #9: APPROVE THE BILLS: The Motion was made by Giesler and seconded by Yerrington to approve the bills. Motion Carried: All Yea: ITEM #10: BID ON LOCUST GROVE WATER MAIN EXTENSION: Eng. Smith: Passed out bid results to Council. On January 22, 1993 we opened bids for furnishing an installation of 10" water main on Locust Grove Road both north and south of Fairview. We received nine bids. Gulley Excavation was the low bidder at X29,810.00. The City of Meridian will furnish approximately 1480 feet of the 10" diameter pipe, the contractor will furnish the remainder and he will install all of the pipe along with valves and some blow off assemblies. 1 have checked the tabulations of the bid results and the numbers that appear in front of you are the bid amounts and I think with one exception there was one small error. I would request your approval to accept the bid of Gulley Excavation and to award that contract to him and also if it's possible, because I'd like to get him started, I would request you to authorize the Mayor to sign a Notice to Proceed once Gulley Excavation has furnished the required certificate of insurance and the bonds as required by the bid document. MERIDIAN CITY COUNCIL FEBRUARY 2, 1993 PAGE 10 Eng. Smith: The reason I'd like to get him started as soon as possible is the Ada County Highway District has that intersection scheduled for construction beginning April 1st. We're just a little over a month away from the time they will start tearing things up and we need to have that water line in the ground ahead of them. Corrie: Are you familiar with the Gulley Excavation Company and you approve of that? Eng. Smith: Yes, Ron Gulley has done work for the City of Meridian before and he does a good job. The Motion was made by Corrie and seconded by Yerrington to approve the Gulley Excavation Bid for ~29,81G.00 and authorize the Mayor to sign the proper papers to get that started. Motion Carried: All Yea: ITEM #11: DEPARTMENT REPORTS: Eng. Smith: Settler's ditch piping project is out to bid. We will open bid on that the 19th of February. Well #15 is ready to go out to be advertised and we will open bids on that on the 26th of February. Tolsma: Thank you. Mr. Bryan: Would like an update on problem with water. Clerk Niemann: Did they have Nampa Meridian looking at it? Eng. Smith: Yes they have been out, in fact they called again this morning they were going back out to dig up some of their manhole covers so they could get down into that pipe and take a look. I heard a preliminary report that they did find some blockage. Mr. Bryan: Thank you. They are doing something then. Crookston: I would like to have an Executive Session to discuss pending litigation and possible proposed litigation. • • MERIDIAN CITY COUNCIL FEBRUARY 2, 1993 PAGE it Yerrington: We have a letter from the Nampa Meridian Irrigation District requesting on the Vineyards Subdivision that they want to put in pressurized irrigation and they would like to see us waive the well fund on this one subdivision at this time. I think we should do this. Tolsma: Did they give you any idea when they would have that design in? Yerrington: No they didn't. The only thing I have is this 1 ett er. Clerk Niemann: I have a request from Austin Moyle who lives at 2700 N. Meridian Rd. and he wants to hook to City water. Eng. Smith: I might mention, I don't know if your familiar with where his house is located, but it sets back away from Meridian Road a fair distance, there's a long driveway that goes back to it. He owns eight acres and as part of the Meridian Road Project he negotiated with the Highway District to provide two access points into his property so that it could be subdivided at a future time. At that same time the sewer and water lines were stubbed into those access points from Meridian Road, so his intent is to develop that. I don't know how far it is from the house to the street but it's a pretty good distance. I can't remember if we provided a meter the for his house or just the stubs into this future street stub, he may have to excavate down to the water main and tap on and set a t he so that he can get a meter in place, and then dig from there up to the house with his water service line. Of course the requirements for connection to the City system in the Ada County area is the double fee for sewer and water. Giesler: Wouldn't it be premature to have him hook onto the sewer if he's figuring on developing that? Eng. Smith: I guess maybe that's what I was saying. The Motion was made by Giesler and seconded by Yerrington to approve of Austin Moyle hooking to City water with the appropriate costs being met. Idaho REe Golfview Associates Request for Temporary Building Use Golfview Associates, an Idaho Limited Partnership requests permission from the City of Meridian to allow the use of a 32 foot travel trailer, located on lot 2 block 5, of Golfview Estates No. 2 Subdivision, to remain at its present location for a period not to exceed September 1. 1993. Said trailer is to be used as a temporary construction trailer and sales office until such time as construction of a new residence. to be located on lot 9. block 5 of the subdivision is completed. The trailer and all temporary signage/landscaping will be removed at that time. Golfview Associates also request that we be allowed to make a temporary connection to sewer only, should it become necessary. Said connection. if made would be removed at the time the trailer is removed from the site. This trailer will only be used for temporary business use during reasonable and customary business hours for residential construction and sales activity. and will in no way be used in a residential capacity. Section 5-413 A 2 Temporary Buildings of current city code allows the use of a temporary construction trailer "during the construction period". This trailer is available to the project engineer during construction, which will start up again shortly. A sewer lift station is still being installed in the subdivision. This request is. therefore to allow the use of the trailer to be expanded from construction use to sales as well. It is not anticipated that this will create a nuisance. All efforts will be made to minimize any potential impact to property owners in the immediate area. Attractive landscaping has been placed near the trailer to enhance its appearance. The intent of Golfview Associates and its marketing agent, The Real Estate Group, is to have the temporary construction/sales office removed no later that September 1st, or upon completion of the new residence located on lot 9 block 5. At the time of completion of the home, we would desire to locate a temporary sales office in said home, for a period not to exceed 6-9 months. at which time the office would again be relocated to another new home to be built within the subdivision. • • We believe that this new subdivision will be an asset to the city of Meridian. both in increased tax base as well as amenities available to the homeowners. I would like to take this opportunity to thank you for the use of your office space for our meeting which concerned the proposed urban irrigation installation that Nampa & Meridian Irrigation District presented to Boesiger Development. In the course of our conversation with the Boesigers it was determined that there are essentially two primary elements that require answer at this time to aid in the processing of our urban irrigation proposal.. The first question has to do with the requirements of mortgage and/or title companies concerning debts for urban irrigation at the time of sale of the property having such a debt; the District and the Boesigers will pose this question to the mortgage and title companies for their reaction. The second question has to do with the collection of mitigation revenue by the City of Meridian from developers in relation to the lack of the installation of an adequate irrigation system by the developer to defray the impact of the lack of such system on the City of Meridians domestic water system. It was agreed at the conclusion of our meeting of 25 January 1993 with Boesiger Development that both Boesiger Development and the Irri.gairicn District waul~. Bose these t~r~o questions to the appropriate entities and would coordinate on any information obtained at a later date. The Irrigation District Board of Directors has also authorized, and I have submitted, a letter to the District's attorney requesting and opinion concerning the ramifications of the use of a City Local Improvement District law or vehicle to create and subsequently collect a debt for an urban irrigation system, and I will inform you of the results when the attorney has submitted his opinion and/or recommendation to the District. The District is also pursuing certain items of legislation during this legislative session which we believe will aid in bringing urban irrigation to the valley and to any other areas where it may be needed across the State. I take this opportunity to thank you for listening to the Irrigation District's proposal at your City Council Meeting of 19 January 1993.
