below the grade culled for. As a result of this you have
caused damage to certain individuals who are presently
threatening to bVUW suit against the City.

this matter.

takeen by the City Council On the Herby Subdivision. The fire chief's request
O for than cul -de -sae or turnaround provision on the extension of Vest Idaho
Avenue Is a valid request and no you will recall that you and I discussed
how to provide this. Wa had hoped that the property to the south of Lots 2
and 3 of Block 1 would also jain with us in dedicating their portion of the
right of way for West Idaho Avenue. then it would halm been proper to provide
the turnaround at the very vest eyed of the street* Slace we have not been
able to a coomp fish this* we will prepare the final: plat to provide an rase -
meat for a turnaround on Vest Idaho Avenue in the area between pat 40 Alock 1
and lot I, Block $.
In regard to the dedication of Wean Fourth Street adjacent to Last 4
of Block I,, I feel that we are meeting the City's wowed by proceeding as
suggested by Mr. Bart of the title company. You will be dedicating all of
your tr4ht titles interest in the *rest 30 feet of West Fourth Street olthough
about only the westerly 4 feet of that 30 foot was included in the deed to
Mer. Berney. Our contract: with you required the 4osign of curb and gutter
and struts on the avast half of West Fourth Street which is your guide in
constructing the improvements, It is our assumption that your playas are to
votwett 040 curb and Sutter and paving to the middle of the said West Fourth
Strewat. If your plans are contrary to thi.e, you should immediately notify
the City.
In regard to the balance of West Fourth Street right of way from
West Pisses Avenue to West Broadway Ar emm, I discussed this with mayor lean
Storey and pointed out that: it to mar opinion that this was not: an obligation
of your* as the subdivider sites you are in no way Involved or had any
control, over the remaining private property that ties adjacent: to and

possibly the simplest method world be to gat right of way deeds for the needed
30 loot strip of sand from the other three ownerships along nest Fourth Street.
Presumable, if we can lot the aright of way dedication from these people for
all rpt title they have in the *trip without Opposition that after a number
of years it will be substantiated that it will belong to the City of Meridian
for right of way purposes. Any help that you can give in explaining this to
the property owners adjacent to your property would be appreciated.
